RE : Alaska Fish Fertilizer
Jim Hanson and I met today with Larry Warren ,
Assistant City Attorney , and Mr. St. Germain , Mr.
Kazor, and the Attorney representing Alaska Fish
Fertilizer. Quoting the code Mr. Warren indicated
to them that he did not see a hardship in this part-
icular case. Their Attorney said that they had
additional information that might better explain
the hardship involved. Mr. Warren agreed to review
this information and indicate whether it would
make a difference in his previous determination .

Dear Sir:
In11972 , we were looking for a new location for our plant and de-
cided to build in Renton on Lind Avenue. Mr. Mortenson and myself
formed a partnership to build the present building and the only
reason we selected the site in Renton was because we had received
a permit -from the city of Renton for our present building and the
contemplated addition to our property. Had we known that we could
not build the addition at this site we would not have constructed
our present building at this location.
We 'feel that the present Restrictive Covenant was placed on the
land to assure that the property would have adequate parking. We
have acquired an easement to the south of our building that permits
us to have ample parking along the south side of our building.
We have the permission and complete co-operation from the owners
of the property on both sides of our property. The owner of the
property to our north (Mr. B. ) will give us a deed or any other
legal instrument we may need to proceed.
Had _it not been that I had a severe heart-attack in the Spring of
1973, the addition to our building would have been built. I was
away from the office for a long period of time and was unable to
pursue the project at that time.
Our business is an expanding business with its home-office in Renton.
We are the largest producer of fish fertilizer in the world. We
are presently producing about half our product in the south because
our Renton facility is not large enough. If we are permitted to
expand, we will double our payroll. We are a non-polluting factory.
We make few demands on the public services since we are not a fire
hazard and do not contribute to the sociological problems of the
city.

We ;have sincerely enjoyed our stay in Renton and appreciate the
past co-operation we have received from the city. We feel that
because my health prevented me from going ahead in 1973, that it
is now an unfair hardship to impose on us if we are not permitted
to ego ahead at this time.

RE: LANDSCAPE PLANS FOR ALASKA FISH FERTILIZER,'
865 LIND AVENUE S.W. , RENTON, WASHINGTON
Dear Mr. St.Germain:
This is to confirm the revisions discussed on the landscape
plan in the meeting of Friday, November 21, 1975 . The followingitemswereagreedupon:
1. Delete the planter bed adjacent to the building on
the north side which was to have screened the dumpster.
2. Relocate the dumpster to the south side adjacent to
the building and provide a screening fence and curb
around the transformer vault and dumpster. Eliminate
planter south of transformer vault in lieu of screen-
ing fence.
3. Reduce the size of the planters adjacent to the east
wall to a minimum of 10 feet from the wall. Allow a
2 foot to 2 1/2 foot clearance, adjacent to the middle
loading dock. A raised planter wall surrounding
these beds is acceptable. Asphalt should be removed
from all planter areas in order to provide adequate
drainage and allow for future tree root expansion.
4. Delete the planter island extension around the parking
area and entrance while maintaining the minimum 10 foot
area adjacent to the public right-of-way for screening.
5. Provide a driveway access, minimum 11 foot width,
through the south line planter area (indicated on plansleftwithclient) .

ment hopes that this will ease the parking problems and look forward

As per your request I hereby approve the use of the 20
foot unused side yard north of the Keenan Pipe Supply
Company. This property is to be used solely for ingress
and egress to the Alaska Fertilizer parking lot. It is
further agreed that Alaska Fertilizer Company shall
I improve and maintain the property at their expense.
Alaska Fish Fertilizer shall have the right to use this
property for a period of 10 years or longer by mutual
agreement.

The Planning Director described the proposal, to con-
struct a n•ew addition in an M-P zone within the set-
back area between two warehouses , shifting of the
parking •to the south , and provision for additional
landscaping . He referred the Commission to, the staff .
report , which indicated that the Environmental Develop-
ment Committee had reviewed the item at its July 15th
meeting .• The Planning staff had met extensively with
the applicant in order to clarify the application , cir-
cumstances and alternatives . Legal implications were
reviewed with the City Attorney. It was noted that
the City Attorney has indicated that due to the unique
circumstances , a variance• is required from the Board ,
i of Adjustment.

The revised plan was reviewed by Assistant Planner Smith,
including proposals for additional landscaping , a new park-
ing area , and. agreement with proposed restrictive covenants ,
which include provisions for perpetual easement for access
from Keenan Pipe Company property to the parking area . :
Discussion ensued with particular reference to the need to
obtain a variance from the Board of Adjustment from the
side yard requirements of the Zoning Ordinance, in the M-P
zone in accordance with the City Attorney ' s recommendations
due to -legal technicalities . The roll of the Planning
Commission in determining the appropriateness of the land
use , landscaping , and restrictive covenants was reviewed :
Commissioner Mola , Chairman of the Environmental Develop-
ment Committee , advised that his Committee had visited .
the site and reviewed the situation and recommended ap-
proval of the request. Mr. Ericksen stated that the
applicant is asking for approval subject to staff appro-
val of the site plan and final approval of the landscaping
plan .
Chairman Scholes invited comment from the applicant .
Mr. St. Germain thanked the Commission for allowing con-
sideration of his application this evening . ' He described
his plans for implementation of landscaping and indicated
his willingness to post a bond . He also discussed his
efforts to obtain access to his 20 feet of property on
a perpetuity basis . Mr. St . Germain requested approval
based on his ability to obtain this permission from the
owner of the Keenan Pipe building .
In reply to Commissioner Teegarden regarding any response
from the people who own the building to the north , Mr .
St. Germain reminded the Commission that he owns the 20
feet between them and stated that it is his intention to
construct his own wall due to the original fracture of
that structure. He stated that he would leave the deter-
mination of the distance between his wall and that build-
ing up to the City and indicated that his architect had
recommended a foot or even six inches would be appropri -
ate with some kind of covering of the division" to complete
the general appearance of the buildings .
IT WAS THEN MOVED BY ROSS , SECONDED BY MOLA , THAT THE PUB-
LIC HEARING OF THE ALASKA FISH FERTLIZER SITE APPROVAL

estimate of these costs for our review prior to final establish-

COMMENTS : 1 . The Environmental Development Committee
reviewed the item at its July 15 , 1975 ,
meeting and felt that if certain items
were accomplished the proposal could meet
their approval .
2 . The Planning staff has met extensively
with the applicant in order to clarify
the application , circumstances and
possible alternatives .
3. It is felt by the City Attorney and staff
that the circumstances involved are
unique and represent a valid hardship .
4. The applicant has agreed to various condi -
tions that would upgrade the specific
site and general area .
STAFF
RECOMMENDATIONS.: We recommend conditional approval of the
application subject to the granting of all
variances required because of the unique
circumstances and hardships involved , i . e . ,
the prior City approval of a similar
proposal when the building was under one
ownership , and the resulting disollution
of that ownership while applicant was
seriously ill . Also because the proposal
will substantially upgrade the area and not
be detrimental to adjacent properties .
This approval is conditioned upon :

letter to Mr. St. Germain dated

ACTION A field trip was established for Tuesday July
22 ,. 1975 at 7 : 00 to more specifically review
the site and existing conditions . The applicant
was asked to stake the corner of the proposed
builidng . The item was then continued until the
pre-meeting established for July 23 , 1975 at 7 : 30
p .m. in the third floor conference room.

COMMENTS : 1 . The proposed warehouse addition would
be built on the side property line
although M-P zoning regulations state
that no structure shall be built closer
to a side property line than 20 feet.
2 . The proposed warehouse addition would
be constructed in the same location as
an existing parking lot whose location
is set by restrictive covenants . In
order to allow the addition of the new
warehouse to this site , the restrictive
covenants running with the land would
need to be rescinded .
3 . The Assistant City Attorney recommends
denial of the variance request since
special circumstanes required in the CityCodedonotexisttojustifythevariance .
He also feels that the granting of this
request would modify the intent of the
M-P zone .
STAFF
RECOMMENDATIONS : Recommend denial of the Site Approval for
the warehouse addition for the following
reasons :
1 . The new addition would violate existing
zoning regulations for an M-P zone .
2 . The land in question is presently governed
by restrictive covenants requiring parkinginthisarea .
3 . The waiving of the zoning regulations
for this site approval would set a
precedent that would be harmful to the
enforcement of M-P zoning regulations
on other properties .

The regular meeting of the Board of Adjustment was called to order by
Chairman Lally at 8:00 p.m.
2. PLEDGE OF ALLEGIANCE
The Chairman led those present in the flag salute.
3. ROLL CALL
The secretary called the roll. All members were present with the exception
of GARY SMITH and ROGER PETERSON.
ACTION: Motion made by HOLMAN, seconded by CAMPANELLA, that the absent
members be excused. MOTION CARRIED.
4. APPROVAL OF MINUTES
ACTION: Motion made by HOLMAN, seconded by CAMPANELLA, that the minutes
of the June 24, 1975, meeting be approved as printed. MOTION

The Chairman opened the hearing. Mr. Hanson stated that the application was
before the Planning Commission at this time and that the Commission would be
meeting tomorrow night. He suggested that the Board continue the hearing
until the Commission has made a decision.

b) V-268-75 (Continuation) JAMES W. SPENCER requests variance to
construct patio cover within required rear yard; property
located in the vicinity of 2733 Aberdeen Avenue NE, Renton.
The Chairman opened the hearing. Mr. Hanson presented a plot plan pointing
out that the patio cover would be 10' from the rear of the house and within
15'.6" of the rear proper line.
Mr. Spencer was present to speak in behalf of his application. He explained
that his main reason for constructing a patio cover is that there is no
shade in the back yard. He has two small boys and it gets too hot in the
back yard for them to play. His neighbors have patio covers and their back
yards stay much cooler.
Mr. Spencer stated that his neighbors have patio covers that are 10 feet and
5, feet from their fences; he did not know if they had permits for them. He
does know of one neighbor, however, that was granted a permit for a patio
cover 15 feet from the back fence.
He explained further. that he had talked with Warren Gonnason, Public Works
Director, last fall. Mr. Gonnason thought that the ruling was primarily to
stop people from building additions onto their houses and that it should
possibly be revised. Mr. Gonnason felt that he should not have any problem
at a variance hearing.
The Chairman asked for any opposition to the variance. There was no
opposition.
Mr. Hanson then showed slides of the subject property.
The Chairman asked for questions from the Board. Mr. Campanella asked if the
patio cover would be 15 feet from the property line. Mr. Hanson stated that
the cover would be 10' from the rear of the house and 15'6" from the rear
property line.
The public portion of the hearing was closed.
ACTION: Motion made by QUALLS, seconded by CAMPANELLA, that the variance be
granted.
Discussion followed on the motion.
Mr. Holman asked for the reasons why the variance should be granted. Mr. Qualls
stated that due to the existence of non-conforming residences in the existing
area, the variance should be granted. Mr. Campanella explained that the
neighbors are enjoying greater use of their property under the same conditions.
He felt that this was a hardship to the applicant.
Mr. Holman suggested that the hardship to the applicant be made a part of the
motion.
Roll call vote followed. MOTION CARRIED UNANIMOUSLY.
c) V-270-75 CHARLES E. ENGLISH requests variance to construct
covered deck within required rear yard; property located in
the vicinity of 408 Earlington SW, Renton.
The Chairman opened the hearing. Mr. Hanson presented the plot plan of the

traffic problems in the area .
ACTION A field trip was established for Tuesday July
22,. 1975 at 7 : 00 to more specifically review
the site and existing conditions . The applicant
was asked to stake the corner of the proposed
builidng . The item was then continued until the
pre-meeting established for July 23, 1975 at 7 : 30
p .m. in the third floor conference room.

Mr . Ericksen gave a brief overview of the applica-
tion and the problems related to it.
ACTION The committee continued this item until their

The Chairman advised the audience that the item would
again be considered on September 10th . The Planning
Director requested that a committee meeting be estab-
lished , but it was noted that Chairman Gibson was not
in attendance . Mr . Ericksen said that in the mean-
time , the staff would work with the applicant and
review alternative plans .
Commissioner Mola requested that Mrs . Gest be notified
of any meetings scheduled with regard to this issue .
It was noted that the public hearing is closed but
that input could be made to the staff and committee ,
for study.
Mr. Porter expressed his concern regarding considera-
tion by the public of an alternate design . Mr .
Sherrill stated that six of the neighbors on Olympia
that look down : on the property are in favor of the
present proposal and would so indicate in the form
of a petition . The Planning Director indicated that
the staff would be happy to present any written infor-
mation received to the Commission .

Site Approval for a warehouse addition in an M-P
zone ; property located at 865 Lind Ave . S .W .
Noting that Mr. St . Germain would not be available for
the continued public hearing scheduled for July 30th
to consider the site approval application this evening ,
a staff presentation was invited by Chairman Scholes.
The Planning Director described the proposal to con-
struct a new addition in an M-P zone within the set-
back area between two warehouses , shifting of the
parking to the south , and provision for additional
landscaping . He referred the Commission to the staff
report , which indicated that the Environmental Develop-
ment Committee had reviewed the item at its July 15th
meeting . The Planning staff had met extensively with.
the applicant in order to clarify the application , cir-
cumstances and alternatives . Legal implications were
reviewed with the City Attorney . It was noted that
the City Attorney has indicated that due` to the unique
circumstances , a variance is required from the Board
of Adjustment.

The revised plan was reviewed by Assistant Planner Smith ,
including proposals for additional landscaping , a new park-
ing area , and agreement with proposed restrictive covenants ,
which include provisions for perpetual easement for access
from] Keenan Pipe Company property to the parking area .
Discussion ensued with particular reference to the need to
obtain a variance from the Board of Adjustment from the
side, yard requirements of the Zoning Ordinance in the M-P
zone; in accordance with the City Attorney ' s recommendations
due to legal technicalities . The roll of the Planning
Commission in determining the appropriateness of the land
use ,; landscaptng , and restrictive covenants was reviewed .
Commissioner Mola , Chairman of the Environmental Develop- '
ment Committee , advised that his Committee had visited
the site and reviewed the situation and recommended ap-
proval of the request. Mr. Ericksen stated that the
applicant is asking for approval subject to staff appro-
val of the site plan and final approval of the landscaping
plan .
Chairman Scholes invited comment from the applicant .
Mr. St. Germain thanked the Commission for allowing con-
side'ration of his application this evening . He described
his plans for implementation of landscaping and indicated
his willingness to post a bond . He also discussed his
effo'ts to obtain access to his 20 feet of property on
a perpetuity basis . Mr. St . Germain requested approval
based on his ability to obtain this permission from the
owner of the Keenan Pipe building .
In reply to Commissioner Teegarden regarding any response
from the people who own the building to the north , Mr .
St. Germain reminded the Commission that he owns the 20
feet; between them and stated that it is his intention to
construct his own wall due to the original fracture of
that structure . He stated that he would leave the deter-
mination of the distance between his wall and that build-
ing up to the City and indicated that his architect had
recommended a foot or even six inches would be appropri -
ate with some kind of covering of the division to complete
the general appearance of the buildings .

On Monday, July 21 , 1975 , Mike Smith and I met with
Vivian Thenik and Robert Chisholm of Alaska Fish
Company and Thomas , Berger, Landscape Architect , to
discuss a landscape plan . Included in this discussion
were the staff recommendations which must be satis-
fied prior to the granting of site approval . These
same recommendations were discussed on several occa-
sions with Mr. St. Germain and were also included .
in a letter to him of July 18, 1975 .
It was agreed that Mr. Berger would submit either
verbally or in plan form his thoughts concerning
the landscape plan for the Alaska Fish site at
the Wednesday night Planning Commission Meeting .

This is to confirm our telephone conversations during the
last few days regarding the abovecaptioned matter and your
latest Memo dated July 9 , 1975 regarding the variance
application by Alaska Fish Fertilizer. We now understand
from you that apparently a site plan had been approved by
the City initially, which would have utilized the 20 foot
strip for building purposes and that apparently another
site plan was then approved subsequently which was at
variance with the first one.
As previously expressed in our opinion dated June 12 , 1975 ,
the facts at that time did not support a petition for a
variance because it did not meet the statutory requirements.
The copy of the Restrictive Covenants dated May 25 , 1975 in
our possession provides for 16 parking spaces to be located
immediately south of the building and a "landscaped area 20
feet square" located at the west end of the subject property.
I am not certain that the area is correctly described since
the map furnished to us by Mr. St. Germaine indicates that
the so-called "disputed 20 ff. strip" is north of his existing
building. `
In any event, based on the additional information you have
furnished us , if your Department believes that there was an
honest misunderstanding between the parties as to what site
approval had been granted, and provided further thatnEod ukingcompensatingareacanbefurnishedforlandscaping/gy t1e
owner, then there appear to be no legal objection to do so.
If another area is substituted for parking and/or landscaping,
then this should be reduced to writing, clearly identified
in any such document, and possibly supported by a map to show

The Chairman invited comments and questions from the Commis-
sion . Discussion centered around provisions for a street
on the southern boundary . The Planning Director noted
street right-of-way and waterline easements between the
property line and the paved area , the access road to
Olympic , and that Olympic Pipe Line Company also has two
lines located there . Further discussion ensued with regard
to the location of the proposed P-9 Channel , its proposed
width , and its relation to the private road .

improvements would be required on Union Ave . N . E . and that
the request would be reviewed by the Public Works Depart-
ment. No questions were offered by Commission members .
5- ADMINISTRATIVE :
A. FIELD TRIP
It was decided not to have a field trip in view of the
Commission ' s familiarity with the sites in connection
with recent rezone requests . The Planning Director
noted that should Commissioner Garrison be interested
in visiting the sites , in view of his recent appoint-
ment, the staff would be available at his request .
A recess was declared at 9 : 40 p . m. The meeting was resumed at
9 : 50 p . m . with all members noted above in attendance .
B. PROPOSED BULK REGULATIONS WITH DEFINITIONS
The Planning Director presented for Planning Commission
consideration the revised draft " B" of the proposed
bulk regulations with definitions . It was noted that
the proposed revision incorporated both the input from
the Planning Commission and the City Attorney that
evolved during the previous work meetings on this sub-
ject.
Noting the Court ' s deadline requiring the City to
establish definitive , written standards and guidelines
regulating the issuance of a special permit pursuant
to Subsection 4-713 ( b) of the Zoning Ordinance , the
Planning Director requested Commission concurrence
in the revised draft in order that it might be pre-
sented to the City Council at their meeting of
1 July 14.
Gary Kruger , Associate Planner, noted that "Revision
A" of the proposed document had been reviewed with
the City Attorney and that his suggestions had been
incorporated into " Revision B" also .

Site Approval for a warehouse addition in an M-P
zone; property located at 865 Lind Ave . S .W .
The application was introduced by the Secretary .
The Assistant Planning Director pointed out the subject
property in Earlington Industrial Park on the vicinity
map and noted significant development in the area . He
stated that the applicant is proposing to develop a
warehouse between their existing building and the
building to the north . Dimensions of the proposed addi -
tion will be 45 feet by 160 feet . Mr . Magstadt noted
the original property line and indicated that th.e
applicant proposes to acquire additional property .
so the building would be located adjacent to the prop-
erty to the north . Access to the property would have
to be obtained from the Keenan Pipe Company . It is
proposed to meet the parking requirement by shifting
the stalls to the south of their existing building .
Mr . Magstadt noted that this application had been pre-
sented to the Board of Adjustment originally , and no
action had been taken , as they felt site plan approval
was necessary prior to any action by them . He
referred the Commission to an opinion from the Assis-
tant City Attorney which had been provided .
The Chairman invited comment from the applicant .
G. Perrin Walker , 2100 Washington Plaza , Tacoma , counsel
for Alaska Fish Fertilizer Company , described the his-
tory of the development of the Company originally known
as Seattle Fertlizer Company and located in the Seattle
waterfront area . He stated that in approximately 1971
it had drown to the degree where a centrally located
warehouse and office space , as well as a bottling center ,
were needed . A partnership was arranged between the
principal owners of Alaska Fish , Messrs . Mortensen ,
St . Germain , and Paulson , who acquired title from
Burlington Northern to the property to the north of
Alaska Fish , noted as "existing warehouse" on the dia-
gram by the staff. An arrangement was worked out for
the use of the area between the two structures ( labeled
as " new addition" ) to provide for expansion from Alaska
Fish to Mr. Mortensen ' s building to the north . Mr .
Walker stated that the issue is the requirement of a
twenty foot side yard in accordance with M-P zoning .
Mr . Walker stated that George Kaczor , who had brought
the three partners together , was available to verify
the circumstances that have created the hardship
claimed by the M-P provisions . He noted that Mr .
St. Germain would comment regarding the actual use
of the property and that he would like to point out
some legal considerations that he felt were not avail -
able to the Assistant City Attorney .
George Kaczor , 105 West Highland Drive , Seattle , noting

and noted the history of the construction . Mr . Kaczor also
noted previous plans approved by the Planning Commission .
The Chairman called for questions from the Commission .
In reply to Commissioner Garrison as to whether or not
the previous approval was a matter of record , Mr. Ericksen
indicated that it was but that there are differences between
it and the current proposal . The Planning Director then,
noted those differences . He stated that the basic problem
involves provision for parking on a long-term basis and .
indicated that the Assistant City Attorney noted that this
sort of arrangement could work against the requirements
of' M-P standards in other areas unless the Commission feels
there are conditions that exist that are undesirable , such
as; blacktop parking between the buildings or hardship .
Also responding to Mr . Garrison with regard to the timing
on construction of the two adjacent buildings , the Planning
Director stated that a building to the north was built by
Puget Construction Company about four and a half years
before the structure labeled "existing warehouse" on the
drawing .
Commissioner Gibson inquired if under these circumstances
a new addition could be acceptable under the Parking and
Loading Ordinance as it presently exists . The Planning
Director responded that they could meet the parking
requirement , providing they could get access . Mr. Gibson
inquired further , if it could be acceptable to the City
and meet the standards of the Parking and Loading Ordi -
nance , should an agreement be made between Alaska Fish
and Keenan Pipe on an perpetuity basis . Mr. Ericksen
indicated that it would .
Discussion ensued with regard to the current individual
ownerships of the buildings , the circumstances that caused
the hardship , the effect of waiving the side yard require-
ments of the M-P zone , and the possible need for further
review by the City Attorney .
Mr . St . Germain , applicant, stating that he believes
there is a definite hardship involved , indicated that he
would return to the owner of the Keenan building and seek
an agreement to use the access inperpetuity and that he
would pave it . He also noted that he is the owner of
the property involving the addition and that he had a
written agreement with the former owner , Mr . Mortensen ,
and approval of the City of Renton to go ahead with the
addition . Mr. St . Germain stated that at the time Mr.
Mortensen had a problem with his property , he was in the
hospital as the result of a heart attack and was unable
to do anything about it. He advised that with this
addition , he could double his present staff, as it is
presently necessary to perform forty percent of his pack-
aging work in the San Francisco area . Responding to Com-
missioner Teegarden , Mr . St . Germain stated he is the
owner of the forty feet between the buildings .
The Planning Director noted the property line as indica-
ted on the original property and stated that parking was
to be provided in the side yard to the building to th.e
north . Landscaping was to be placed to the rear portion
of the property , to the westerly portion of the Alaska
Fish building and also in the parking area . He indicated
that this agreement had not been met. He said it was his

position that should the Commission decide to grant
the proposal , he felt conformance and upgrading with
the original agreements is necessary . He suggested
that a definite plan should be provided to be con-
sidered by the Commission , and that an agreement
for access should be made inperpetuity .
In reply to Commissioner Gibson ' s queries with regard
to upgrading the property and improving the parking
and landscaping , Mr. St . Germain indicated that he
would be willing to do so.
There was further discussion with reference to whether
or not a true hardship exists and that a precedent
would not be established by granting a variance from
the M-P requirements . It was noted that a number of
problems had to be worked out before action could be
taken by the Planning Commission . IT WAS THEN

that requirement.
Ken Oyler , project engineer , confirmed that there are
curbs and gutters to the north of the property but no
sidewalks .
A brief discussion followed with regard to considera-
tion of deferral of the requirement to install side-

A PROPOSED BULK REGULATIONS WITH DEFINITIONS
The Planning Director presented the Proposed Bulk
Storage Regulations with Definitions (first draft
dated June 25 , 1975 ) to the Planning Commission
for consideration . He further advised that the
Environmental Development Committee had previously
been working with the staff and were studying
introductory matters relating to the draft .
Their suggestions and additions were incorporated
into the draft presented this evening . Mr.
Ericksen further advised the Commission of the
critical time schedule , noting that the sixty
day time period would terminate July 28 . The
Planning Director requested that in view of this ,
the Commission expedite consideration of' the
proposed regulations . Chairman Ross called for
a Committee-of-the-Whole meeting to consider
the subject at 7 : 30 p . m. , July 2 , 1975 .

Waterway; property located in the Renton Municipal
Airport adjacent to the Cedar River.
The undeveloped approximate two acre site located pri -
marily in the Cedar River Waterway and partially in a P- 1
zone was noted by the Assistant Planner. The opinion of
the City Attorney is being sought with regard to . appro-
priate zoning and controls in that area. The proposal
is for construction of two hangar facilities . The request
also falls under the jurisdiction of the Shoreline Manage-
ment Act.
A brief discussion followed , and Commissioner Scholes
requested that the matter of a vested right to a public
right-of-way be referred to the City Attorney . Commis-
sioner Teegarden suggested review by the Council Airport
Committee , and Commissioner Wik inquired if the private
company had agreements to lease the space .
F. HIGHLANDS CHURCH OF CHRIST; Appl . No . SA-830-75 ; Site
Approval to construct a church in a GS- 1 zone; prop-
erty located on the N. E . corner of N. E. 10th Ave .
and Monroe Ave. N. E.
The proposal to construct a church on an approximate three
acre site in a single family residential district was des-
cribed by Mr . Smith . It was noted that there were other
church facilities to the north and east. Natural character-
istics of the site were discussed , and it was stated by the
Assistant Planner that the church plans to preserve as .many
of the evergreens as possible . The plot plan , including
parking , structures and circulation was described .
Planned access from N. E. 10th was discussed in view of no
improvements on the street . It was agreed that the staff
would explore the possibility of access off Monroe in view
of the above . Further discussion ensued with regard to
this type of development in a single family residential
area , possible height restrictions , and topographical
conditions .

Approval for a warehouse addition in an M-P zone ;
property located at 865 Lind Ave . S. W.
The approximate one acre site located in Earlington Indus-
trial Park north of N. E. 10th on Lind Avenue was described.
by the Assistant Planner . It was noted that there is an
existing warehouse/office facility on the property and that
a new addition for additional warehouse space is proposed
in an area that would eliminate the 20 foot rear yard set-
back requirement of the M-P zone . Mr. Smith advised of
previous Planning Commission approval of the facility with
restrictive covenants for parking . The previous ownership
included another warehouse , but a change of ownership is
involved with the resulting request.
Mr. Smith noted that the applicant had requested a vari -
ance to construct the addition to the Renton Board of Adjust-
ment but that the item had been continued for further study
and also referred to the Planning Commission . Mr. Smith
noted proposed installation of 16 parking stalls along the
south side of the building . He advised that the matter of
whether or not this is a legal use was being studied by
the Assistant City Attorney at this time .

Dear Sir:
In 1972 , we were looking for a new location for our plant and de-
cided to build in Renton on Lind Avenue. Mr. Mortenson and myself
formed a partnership to build the present building and the only
reason we selected the site in Renton was because we had received
a permit from the city of Renton for our present building and the
comtemplated addition to our property. Had we known that we could
not build the addition at this site we would not have constructed
our present building at this location.
We feel that the present Restrictive Covenant was placed on the
land to assure that the property would have adequate parking. We
have acquired an easement to the south of our building that permits
us to have ample parking along the south side of our building.
We have the permission and complete co-operation from the owners
of the property on both sides of our property. The owner of the
property to our north (Mr. B. ) will give us a deed or any other
legal instrument we may need to proceed.
Had it not been that I had a severe heart-attack in the Spring of
1973, the addition to our building would have been built. I was
away from the office for a long period of time and was unable to
pursue the project at that time.
Our business is an expanding business with its home-office in Renton.
We are the largest producer of fish fertilizer in the world. We
are presently producing about half our product in the south because
our Renton facility is not large enough. If we are permitted to
expand, we will double our payroll. We are a non-polluting factory.
We make few demands on the public services since we are not a fire
hazard and do not contribute to the sociological problems of the
city.
