OFFICE OF THE LAND USE HEARING EXAMINER
CITY OF RENTON
REPORT AND RECOMMENDATION.
APPLICANT: Hill-Rowe Investment Company FILE NO. SA-075-77
LOCATION: Directly south of the existing Northwest Hobby and Toy
Company along the easterly side of West Valley Highway.
SUMMARY OF REQUEST: Applicant requests a site plan approval to allow
construction of an office/warehouse facility for a
construction materials distributorship. The proposed
project shall consist of warehouse and manufacturing
facilities building, , 50,000 square feet in size with
an attached office structure with approximately 6,500
square feet. The primary uses of the building will be
distributorship of construction materials and accessories
including a wood door machining plant. Site development
will include parking facilities for eighty spaces, truck
shipping and receiving areas, open storage yard
approximately 15,000 square feet and approximately
20,000 square feet of landscaped areas.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with
conditions.
Hearing Examiner Decision: Approval with conditions.
PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORTS: Examiner on September 14, 1977.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on September 20, 1977 at 1:30 p.m. in the Council Chambers of
the Renton Municipal Building.
Parties wishing to testify were sworn.
It was 'reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Michael! Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:
Exhibit #2: Kroll Map
Exhibit #3: Site Plan
Exhibit #4: Grading Plan
Exhibit #5: Building Elevations
Exhibit #6: Landscape Plan
Exhibit #7: SR-181 Two-way Turn Plan
The Examiner asked Mr. Smith if landscaping designated on Exhibit #6 would meet the
requirements of 2% for wildlife habitat mitigation and 5% required by. the Parking and
Loading 'Ordinance. Mr. Smith advised that requirements could be met with installation
of additional landscaping adjacent to the fenced area.
In response to the Examiner's inquiry regarding Exhibit #7, Mr. Smith reported that
the proposed project was not a result of an L.I.D. but was a deferred requirement, and
plans would be reviewed with all businesses in that location on the West Valley. Highway
and the State Highway Department prior to the project.

The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Hill indicated his concurrence, but reported that he would request revisions to
the landscape plan within the limits of city requirements. The Examiner asked the
applicant if an agreement had been made with the Northwest Hobby & Toy Company regarding
proposed improvements to SR-181. The applicant indicated that a verbal agreement had
been made for joint participation on the project, although he had not contacted other
business owners south of the property. Mr. Smith advised that it would be desirable
for all four property owners to coordinate with the Traffic Engineering Division to
accomplish the revisions to SR-181 simultaneously. Mr. Hill concurred in the suggestion.
In response ,to the Examiner's inquiry regarding landscaping on the southern boundary
of the property, the applicant stated that because of limited driveway width, it would
be more practical to install landscaping next to the building instead of the on the
southern boundary of the site to allow an additional five feet of turning radius for
trucks utilizing the easement. He reported that an industrial building to the south
would be constructed in a westerly direction from the proposed structure, and felt
that a requirement for landscape screening did not exist because of the situation of
the buildings. He suggested that certain screening be deleted at the existing eastern
building line of Northwest Hobby & Toy Company and increased at the northern fence to
allow a larger landscaping area for screening at that location and allow the building
tenant more paved area at the northeast corner. He inquired if these revisions could
be made on a departmental level.
In response to the Examiner's inquiry, Mr. Smith reported that the M-P zone did not
require complete perimeter landscaping. The Examiner stated that perimeter screening
would buffer the property not only from SR-181 but also from adjacent properties, and
inquired about the possibility of installation of a sight-obscuring fence. Mr. Smith
indicated that the Planning Department prefers a landscape screen and fencing. The
applicant reported his anticipation of destruction of landscaping by vehicles and
indicated the desire to install vegetation in a protected location adjacent to the
building.
The applicant reported the desire to maintain the alternative of utilizing a joint
access with the property owner to the south to allow more practical use of the land and
eliminate one access to the West Valley Road. The Examiner advised that the possibility
existed and would require only site plan approval. He also stated that alternatives
may exist to satisfy landscaping requirements. The applicant indicated his willingness
to comply with city ordinances.
The Examiner asked for further comments. Since there were none, the hearing on
Item #SA-075-77 was closed by the Examiner at 2:10 p.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter,
the Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a site plan for a 50,000 square foot office,
warehouse and manufacturing facility.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter, .
is uncontested) , and is hereby attached as Exhibit #1 and incorporated in this
report by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5. There was no opposition to the' proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-730 (M-P) of Title IV, Code of General Ordinances.

8. Improvements in the form of a two-way left turn lane in the West Valley Highway
SR-181) were requested by the Traffic Engineering Division (Exhibit #7) . The
applicant agreed to making these improvements and indicated that he would solicit
joint participation with the property owner to the north.
9. Two access points (at north and south corners of the lot abutting SR-181) are
proposed; however, the applicant stated his intent to attempt a joint access along
the' south property line to serve the site and the southern property. Should this
occur the applicant was made aware of the need for a revision in the site plan
approval.
10. Four additional parking spaces are needed to comply with Chapter 22, Parking and
Loading. Sufficient space is available on the site to provide these four spaces.
11. A rezone is necessary for the northwest 4,500 square feet of the property and this
application is to be heard on September 27, 1977.
12. The outside storage area of 15,000 square feet is enclosed by a fence. A 20-foot
setback strip is located on the north and east portions of the fence, but no
landscaping in this strip is proposed (Exhibit #6) . The applicant expressed the
desire to not landscape this strip but to intensify the 5-foot landscape strip
along the north property line and extending to the storage area. (See attached
reduced excerpt from Exhibit #3, Site Plan)
The applicant intends to place landscaping against the south wall of the proposed
building, not along the south property line to facilitate turning movements of
heavy trucks.
Section 4-730 (M-P) and Chapter 22 (Parking and Loading) do not require perimeter
landscaping, but only landscaping of parking, loading and outside storage areas.
In effect, most of the perimeter may require some landscape screening and the
outside storage area may be screened by a fence. (Section 4-730.030.5)
13. Plant materials must contribute to wildlife habitat per Resolution No. 1923 and
the Soil Conservation Service requirements. The Planning Department has on file
these requirements. Substitution of plant materials can be made accordingly on
the landscape plan. Sufficient landscape area has been provided to conform to
Resolution No. 1923.
14. A Shoreline Management Substantial Development Permit is being processed by the
Planning Department. This permit is necessary for implementation of the proposal.
15. A Flood Zone Control Permit is required from the King County Hydraulics Division.
CONCLUSIONS:
1. The proposed site plan generally conforms to the goals and objectives of the Green
River ,Comprehensive Plan except regarding landscaping for wildlife habitat
mitigation. This discrepancy can be corrected by substitution of plant materials
recommended by the Soil Conservation Service.
2. A two-way left turn lane is necessary in SR-181 to facilitate access to and from the
proposal '(Exhibit #7) . Since other properties adjacent to this site also require
use of such a traffic improvement, it is reasonable to spread the costs on an
equitable basis via an L.I.D. The proposal cannot reasonably be made to bear
the total cost of such a costly improvement. Other properties will equally benefit.
3. The 20foot setback area between the outside storage fence and the north and east
property lines can contain landscaping and/or parking (Section 4-730.030.3) provided
that for parking the requirements of Chapter 22 (Parking and Loading) are met.
The fence must be of a "view-obscuring" design (Section 4-730.030.5) . Since the
fence must be a screening device it seems overly burdensome to require landscaping
of a dense, buffering quantity in the 20-foot setback areas. However, to avoid
these areas becoming unattractive to adjoining development, the setback areas
should be landscaped to be compatible with the remainder of the subject site.
This landscaping is also desirable for wildlife habitat mitigation.
4. Landscaping along the south property line can be designed and located to not
interfere with heavy truck turning movements. In order to buffer the proposal
from the southern property, the landscaping should be located along the south
property. line. Interruptions of this landscaping may be necessary to accommodate
the trucks. This can be resolved by the applicant and the Planning Department.

DECISION:
Based upon the record, testimony, findings and conclusions, it is the decision of the
Examiner to approve the Site Plan (Exhibit #3) subject to:
1. Substitution of plant materials meeting the requirements of wildlife habitat per
approvallof the Planning Department.
2. Agreement to participate in an L.I.D. on an equitable, fair-share basis for
construction of a two-way left turn lane in SR-181 per requirements of the Public
Works Department and other applicable agencies.
3. Addition of four parking spaces per approval of the Planning Department.
4. Approval of the rezone of the northwest 4,500 square feet of the property.
5. Setback around the outside storage area to be used for parking and/or landscaping,
which landscaping is to be suitable for wildlife habitat mitigation per approval
of the Planning Department.
6. Landscaping to be provided along the south property line per approval of the -
Planning Department to facilitate truck turning movements.
7. Approval of a Shoreline Management Substantial Development Permit.
8. Approval of a Flood Zone Control Permit.

Pursuant to'Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before October 12, 1977. Any aggrieved person feeling that
the decision of the Examiner is based on erroneous procedure, errors of law or fact,
error in judgment, or the discovery of new evidence which could not be reasonably
available at the prior hearing may make a written request for review by the Examiner
within fourteen (14) days from the date of the Examiner's decision. This request shall
set forth the specific errors relied upon by such appellant, and the Examiner may,
after review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires
that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements. Copies of this ordinance are available for
inspection in the City Clerk's office, first floor of City Hall, or same may be
purchased at cost in said office. .

D. HISTORY/BACKGROUND
Subject site was annexed into the City by Ordinance 1745 dated
April 14 , 1959. The property was rezoned from G to M-P by
Ordinance No . 2380 on December 21 , 1967 , and filled to its present
elevation prior to the establishment of the City ' s Mining , Grading
and Excavation Ordinance.
E. PHYSICAL BACKGROUND :
1 . Topography : The site is relatively level .
2 . Soils : Urban Land (Ur) .
3 . Vegetation : The site contains some scrub grass and shrubs
regenerated after filling of the subject site .
4. Wildlife : Existing vegetation on the site provides some habitat
for birds and small mammals .
5. Water : No streams or surface water are apparent on the subject
site.
6. Land Use : Subject site is directly south of the. existing North-
west Hobby and Toy Company and the Leber Ink Company is located
directly north of the Toy Company. The site is north of existing
M-P zone and undeveloped land and is directly west of the Puget
Sound Power and Light Company right-of-way and Burlington Northern
and Chicago Milwaukee ' s railroad tracks . The subject site is also
within 200 feet of the Green River and is subject to Shoreline
Management Substantial Development Permit requirements .
F. NEiIGHBORHOOD CHARACTERISTICS:
The area is presently in a slow transition from undeveloped pasture
land and filled land to commercial and manufacturing park uses .
G. PUBLIC SERVICES:
1 . Water and Sewer : There is an existing 12 inch water main situated
along the Puget Sound Electric right-of-way, along the easterly
boundary of the subject site . An existing 8 inch sewer main is
located along Puget Sound Electric right-of-way. • Storm sewer
lines a.re not available ; however , there is a drainage ditch east
of the subject site .
2 . Fire Protection : Provided by the Renton Fire Department as per
ordinance requirements . A development of the site will be subject
to City of Renton Standards .
3 . Transit : Metro Transit Route No. 155 operates along S . W. 43rd
Street approximately one-quarter mile south of the subject site.
4. Schools : Not applicable .
5. Parks : Not applicable.

0. PLANNING DEPARTMENT ANALYSIS:
1 . The proposed use is for a combined office/warehouse storage
facility for a construction materials distributor , and is , a
permitted use within the M-P zone .
2 . The subject site is appropriately zoned M-P , except for a
small portion (approximately 4 , 500 square- feet) of the northwest
corner of the site . This portion was never' included in the
original rezone in 1967 . Therefore , the applicant has applied
for rezoning of this area . The hearing date has been established
for September 27 , 1977 . Because the area consists primarily
of driveway, landscaping and several parking stalls , it is not
critical to the functioning and use of the site . Approval of
the site plans can be conditioned upon the decision on the rezone
of this small portion of the site .

3 . The proposed development meets the minimum height and setback
requirements of the M-P zone.
4. The proposed parking and circulation arrangement is acceptable
and meets ordinance requirements except for the need for four (4 )
additional spaces . These can be placed. to the rear of the build-
ing . A couple more stalls could be added adjacent to the north
side of the building , and would not create a significant conflict
with the loading dock area . However , this area should be kept as
clear as possible to facilitate the track loading and maneuvering
activity.
5 The outside storage area should be landscaped consistent with the
objectives of the Green River Valley Comprehensive Plan , pages
5 through 8 , within the twenty (20) foot setback area and along
the west or front side adjacent to the proposed eight (8) foot
screening fence. This area can also be utilized as part of the
2% soil conservation service landscaping requirement established
by City Council Resolution No . 1923.
6 The landscape materials shown on the landscape plan submitted
with the site plans can be substituted with materials more
conducive to provision of wildlife habitat. Substitutions are
recommended on the landscape plan . Landscape plans shall be
subject to final approval of the Planning Department.
71. The five (5 ) foot landscape strip along the north property line
can be increased by adding the normal two (2 ) foot parking stall
overhang , thereby increasing the planter width to seven (7 ) feet.
81. The planter along the south side of the building should be
relocated to a minimum five (5) foot strip along the south
property line to serve the dual function of breaking up the
visual impact of the building and screening adjacent properties
from traffic and circulation on the subject site .
9. The unimproved portion of right-of-way between the pavement edge
and the property line should be landscaped consistent with the
site landscaping and the Comprehensive Plan objectives . Earth
berming . of all site perimeter landscape areas is suggested .
10. The Traffic Engineering Division has indicated a requirement for
a two-way left turn lane in this area to facilitate safe traffic
turning movements .
11 . The subject landscape plan with the recommended area and
material revisions will meet the landscaping requirements
of the M-P. zones , parking and loading ordinance 5% interior
requirement for large parking areas , the 2% site landscaping
requirement of Resolution No . 1923, and the policies and
objectives of the Green River Valley Comprehensive Plan .
12 . The subject site is with Shoreline Management Act jurisdiction .
A Shoreline Management Substantial Development permit is
presently being processed within the Planning Department.
13. A State Flood Zone Control permit is also required through
King County Division of Hydraulics . The proposed elevation

Applicant requests a site plan approval to allow construction of
an office/warehouse facility for a construction materials distri -
butorship. The proposed project shall consist of warehouse and
manufacturing facilities building , 50,000 square feet in size with
an attached office structure with approximately 6 , 500 square feet.
The primary uses of the building will be distributorship of con-
7 struction materials and accessories including a wood door machining .
plant. Site development will include parking facilities for eighty
spaces , truck shipping and receiving areas , open storage yard
approximately 15 , 000 square feet and approximately 20, 000 square
feet of landscaped areas .

D. HISTORY/BACKGROUND
Subject site was annexed into the City by Ordinance 1745 dated
April 14 , 1959. The property was rezoned from G to M-P by
Ordinance No . 2380 on December 21 , 1967 , and filled to its present
elevation prior to the establishment of the City ' s Mining , Grading
and Excavation Ordinance.
E. PHYSICAL BACKGROUND :
1 . Topography: The site is relatively level .
2 . Soils : Urban Land (Ur ) .
3 . Vegetation : The site contains some scrub grass and shrubs
regenerated after filling of the subject site .
I. Wildlife : Existing vegetation on the site provides some habitat
for birds and small mammals .
5. Water : No streams or surface water are apparent on the subject .
site .
6. Land Use : Subject site is directly south of the. existing North-
west Hobby and Toy Company and the Leber Ink Company is located
directly north of the Toy Company. The site is north of existing
M-P zone and undeveloped land and is directly west of the Puget
Sound Power and Light Company right-of-way and Burlington Northern
and Chicago Milwaukee ' s railroad tracks . The subject site is also
within 200 feet of the Green River and is subject to Shoreline
Management Substantial Development Permit requirements .
F. NEIGHBORHOOD CHARACTERISTICS:
the area is presently in a slow transition from undeveloped pasture
land and filled land to commercial and manufacturing park uses .
G. PUBLIC SERVICES:
1 . Water and Sewer : There is an existing 12 inch• water main situated
along the Puget Sound Electric right-of-way , along the easterly
boundary of the subject site. An existing 8, inch sewer main is
located along Puget Sound Electric right-of-way. Storm sewer
lines are not available ; however , there is a drainage ditch east
of the subject site.
2 . Fire Protection : Provided by the Renton Fire Department as per
ordinance requirements . A development of the site will be subject
to City of Renton Standards .
13 . Transit : Metro Transit Route No. 155 operates along S .W . 43rd
Street approximately one-quarter mile south of the subject site.
14. Schools : Not applicable.

proposal ( see attached ) . This declaration is based on provision
of suitable landscaping to Soil Conservation Services and City
requirements consistent with the Comprehensive Land Use Plan for
the area together with other suitable developmental standards ,
consistent with planning objectives for the area .

0. 'PLANNING DEPARTMENT ANALYSIS:
1 . The proposed use is for a combined office/warehouse storage
facility for a construction materials distributor , and is . a
permitted use within the M-P zone.
2 . The subject site is appropriately zoned. .M-P , except for a
small portion (approximately 4 ,500 square' feet) of the northwest
corner of the site. This portion was never' included in the
original rezone in 1967 . Therefore , the applicant has applied
for rezoning of this area . The hearing date has been established
for September 27 , 1977 . Because the area consists primarily
of driveway, landscaping and several parking stalls , it is not
critical to the functioning and use of the site . Approval of
the site plans can be conditioned upon the decision on the rezone
of this small portion of the site .

3 . I The proposed development meets the minimum height and setback
requirements of the M-P zone.
4. , The proposed parking and circulation arrangement is acceptable
and meets ordinance requirements except for the need for four (4 )
additional spaces . These can be placed. to the rear of the build-
ing . A couple more stalls could be added adjacent to the north
side of the building , and would not create a significant conflict
with the loading dock area . However, this area should be kept as
clear as possible to facilitate the track loading and maneuvering
activity.
5.; The outside storage area should be landscaped consistent with the
objectives of the Green River Valley Comprehensive Plan , pages
5 through 8 , within the twenty (20) foot setback area and along
the west or front side adjacent to the proposed eight (8) foot
screening fence. This area can also be utilized as part of the
2% soil conservation service landscaping requirement established
by City Council Resolution No . 1923.
6. The landscape materials shown on the landscape plan submitted
with the site plans can be substituted with materials more
conducive to provision of wildlife habitat. Substitutions are
recommended on the landscape plan . Landscape plans shall be
subject to final approval of the Planning Department.
7 : The five (5 ) foot landscape strip along the north property line
can be increased by adding the normal two (2 ) foot parking stall
overhang , thereby increasing the planter width to seven (7 ) feet.
8. The planter along the south side of the building should be
relocated to a minimum five ( 5) foot strip along the south
property line to serve the dual function of breaking up the
visual impact of the building and screening adjacent properties
from traffic and circulation on the subject site .
9. The unimproved portion of right-of-way between the pavement ed9e
and the property line should be landscaped consistent with the
site landscaping and the Comprehensive Plan objectives . Earth
berming . of all site perimeter landscape areas is suggested .
10. The Traffic Engineering Division has indicated a requirement for
I a two-way left turn lane in this area to facilitate safe traffic
turning movements .
11 . The subject landscape plan with the recommended area and
material revisions will meet the landscaping requirements
of the M-P. zones , parking and loading ordinance 5% interior
requirement for large parking areas , the 2% site landscaping
requirement of Resolution No . 1923 , and the policies and
objectives of the Green River Valley Comprehensive Plan .
12. The subject site is with Shoreline Management Act jurisdiction .
A Shoreline Management Substantial Development permit is
presently being processed within the Planning Department.

13. A State Flood Zone Control permit is also required through
King County Division of Hydraulics . The .proposed elevation
26 feet) will exceed the minimum flood level elevation (21 . 8
j feet) .

Recommend approval of site plan subject to :
1 . 1 Approval of the proposed site plan to M-P of the 4,500 square
foot portion of the northwest corner of the subject site.
2. Approval of the Shoreline Management Substantial Development
permit and the State Flood Zone Control permit.
3 . Final Planning Department approval of. the landscape plans
including the suggested material and planting area revisions
shown on the landscape plans and mentioned in the above
analysis (Section 0) .
4. Planning Department approval of an additional four (4) parking
stalls on the site plans . These can be placed at the east end
of the building with two (2 ) additional stalls provided along
the south end of the building .
5. Final Public Works Department approval of the storm drainage
plans with the provision of suitable storm water retention and
oil -water separation facilities to meet King County and City of
Renton requirements .
6 All refuse dumpsters and other outside storage must be located
within the screened/landscaped outside storage area located at
the northeast corner of the proposed building .
7 Traffic Engineering approval and construction by ,the applicant
of a two-way left turn lane. As presently planned this will
require an additional ten ( 10) feet of street width with a
six (6 ) foot shoulder along the east side of West Valley Highway.
