J. Litsjo FILE NO. SA-174-78 SP-175-78 LOCATION: Approximately 756 feet north of South 180th Street and east of the West Valley Road. SUMMARY OF REQUEST: Applicant seeks site approval to construct a sales and service facility in an M-P, Manufacturing Park, zone and approval of a special permit for bulk storage on the same site. SUMMARY OF ACTION: Planning Department recommendation: Approval with conditions. Hearing Examiner Decision: Approval with conditions. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on June 1, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on June 6, 1978 at 9:05 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Micrael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: File No. SP-147-78, Orvar N. J. Litsjo; approved 5-8-78; application for fill & grade; by reference) Exhibit #3: Site Plan with staff comments Exhibit #4: Perspective Drawing with staff comments Exhibit #5: Building Elevations with staff comments 2 pages) Exhibit #6: Floor Plans Exhibit #7: Survey Map Exhibit #8: Proposed Fill Plan Exhibit #9: Proposed Landscape Plan with staff comments Mr. Smith noted that staff comments added to exhibits were not significant and related to proposed conceptual landscaping. He advised that submittal of a detailed landscape plan to the Planning Department would be required for final approval. The Examiner inquired if the Planning Department report contained recommendations regarding proposed access provisions. Mr. Smith advised that access proposals as well as proposed left turn lanes on the West Valley Road would be subject to approval of the Traffic Engineering Division during building permit application review. The Examiner stated that inclusion of the access provisions would therefore not be necessary for review at this time. The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Orvar Litsjo Martin & Litsjo Architects 519 S.W. 3rd, Suite 201 Portland, Ore. 97204 SA-174-i8 Page Two SP-175-78 Mr. Litsjo indicated his concurrence in the report with the exception of recommendations contained in Section 0.8 relating to maximum amount of equipment to be contained at one time in the proposed display area. He noted that because of the variety in sizes of equipment only one piece of large equipment or approximately three smaller-sized pieces sold and serviced by the facility could be contained in the area, and he requested that the maximum number be deleted from the recommendation to allow flexibility for the display operation, although he noted that the equipment would be displayed in a neat and orderly fashion. The Examiner asked for testimony in support or opposition to the request. There was no response. The Examiner then asked Mr. Smith for comments. Mr. Smith indicated that during previous discussions with the applicant, new information regarding possible expansion of the facility had been introduced, although it would not affect the initial phase of development. Mr. Litsjo clarified the intent of the company to modify the operation by incorporation of sales and service of additional smaller equipment to the existing proposal. He advised that the revision would require shifting the proposed building 50 feet to the south to allow future expansion of the proposed parts department to the north. He advised that the site plan and proposed building design would remain as submitted, and the revisions would not require provision of additional service or bulk storage areas. He inquired if the proposed modification would affect the Examiner's decision on the application. The Examiner asked Mr. Smith if additional review of the revision would be necessary prior to a final decision on the matter. Mr. Smith stated that since the adjustments would not affect the site plan or bulk storage provisions, review of the proposal could be accomplished during application for building permit. He advised the applicant that additional floor area would create a need for additional parking requirements, but he did not foresee significant problems resulting from the proposed adjustment. Responding to the Examiner's inquiry regarding the applicant's request for deletion of maximum amount of display equipment, Mr. Smith indicated Planning Department concurrence if proposed landscaping were provided in the display area and the equipment displayed in a neat and orderly fashion. The Examiner inquired if final approval had been received for storm drainage plans. Mr. Smith deferred the question to the applicant who indicated that although plans had been submitted, response from the Public Works Department had not yet been received. Mr. Smith referred to Section P.6 of Exhibit #1 which requires final Public Works Department approval of detailed drainage plans. The Examiner entered the following additional exhibits into the record: Exhibit #10: Site Plan as submitted Exhibit #11: Perspective Drawing as submitted Exhibit #12: Building Elevations as submitted Exhibit #13: Landscape Plan as submitted Mr. Smith re rted receipt of a memorandum from the applicant which referred to the proposed 50- oot shift of the structure on the site. The letter, addressed to Mr. Smith from the app icant, dated June 6, 1978, was labeled Exhibit #14 by the Examiner. The Examiner asked Mr. Smith for a final departmental recommendation. Mr. Smith recommended doption of the preliminary report as submitted with previously discussed revision to ection P.2 relating to maximum amount of equipment contained in the proposed display area and recommended it to be revised to require display of equipment in a neat and orderly fashion with provision of landscaping as noted on Exhibit #9. He also indicated co currence in the applicant's request contained in Exhibit #14 and recommended final approv 1 of the proposal during building permit review process. The Examiner requested further comments. Since there were none, the hearing on File No. SA-174-78 an SP-175-78 was closed by the Examiner at 9:50 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a site plan and special permit for bulk storage of a heavy equipment sales and service facility. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. SA-174-78 Page Three SP-175-78 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-730 (M-P) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The site plan (Exhibit #3) generally conforms to the requirements of the Bulk Storage regulations of Section 4-734 of Title IV, Ordinance No. 1628, Code of General Ordinances, with modifications noted on the landscape plan, Exhibit #9. One exception apparently is the screening fence required by Section 4-734. (E) .2. Details of the fence featured in the site plan were lacking, but per this section the Planning Department is to approve the landscape plan which would reasonably include the required fence design. Another exception is the small outdoor display area at the southwest corner of the building. This area does not strictly conform to the landscaping and fencing provisions of Section 4-734. (E) .2. Landscaping screening and a screening fence is not proposed around this display area. The applicant indicated the equipment to be displayed wculd be confined to this area and kept in a neat and orderly manner. 9. Per Exhibit #9 (Landscape Plan) , 2% of the site will be provided for wildlife habitat per Resolution No. 1923. Existing vegetation is to be retained on the easterly and southeasterly portions of the site. 10. According to testimony and Exhibit #14, the proposed main building and southerly portion of the site plan will be shifted about 50 feet to the south. This building will also be slightly revised in configuration. Staff felt that this revision was minor and could be reviewed by staff during the building permit process. 11. Participation in the West Valley Road (SR-181) L.I.D. for construction of a left turn lane is necessary to accomplish the proposed access to the site. 12. Off-site improvements to the West Valley Road (SR-181) have been required by the Public Works Department (Exhibit #1) . 13. As submitted, the proposal requires eight additional parking spaces per Section 4-2208 Parking and Loading Ordinance) . The revised site plan (per Exhibit #14) may require even more parking. Staff indicated that the added parking can be accommodated on the s:,te. 14. The Public Works Department has not given final approval to the storm drainage and oil/water separation plan per Ordinance No. 3174. 15. A Shoreline Management Substantial Development Permit application has been filed with t:he Planning Department. The site lies in a wetland area as defined by Chapter 90.58 R.C.W. , Chapter 173-WAC and the Shoreline Master Program, Section 3.01. 16. A State Flood Zone Control Permit is required for the proposal. CONCLUSIONS: 1. The proposal conforms to the Comprehensive Plan and the Shoreline Management Master Program. 2. Exhibit #13 (Landscape Plan) should be revised per staff comments (Exhibit #9) including the required screening fence per approval of the Planning Department per Section 4-734. (E) .2. 3. The outdoor display area at the southwest corner of the main building should be limited to the total area shown on the Site Plan (Exhibit #3) . Landscaping requirements per Section 4-734. (E) .2 can be accomplished adequately by a combination of landscaping at the westerly and southerly perimeters of the site and adjacent to the display area. Per Section 4-734. (E) .2 the Planning Department should review and approve this landscaping. 4. Shifting the building location 50 feet to the south and revising its configuration r SA-174-78 Page Four SP-175-78 is a minor alteration to the proposal. The Planning Department can review and approve these modifications for conformance with the Examiner's findings, conclusions and decision. 5. The Public Works Department should receive from the applicant sufficient documentation of participation in the West Valley Road (SR-181) L.I.D. for construction of the left turn lane. 6. The P1 ning Department should review with the applicant the location of the required additio al parking spaces per Section 4-2208. These spaces must be incorporated in the rev sed site plan. 7. The bui ding design represents a departure from the architecture existing in the area, however, the structures are compatible with existing development. The integration of berms against the building walls will soften the appearance of the building. 8. The Planning Department has made the applicant sufficiently aware of additional requirements that may result from future changes to the proposal and/or subdivision of the total property. DECISION: Based upon the record, testimony, findings and conclusions, it is the Examiner's decision to approve the Site Plan (Exhibit #3) and Special Permit for bulk storage subject to: 1. Submitt*l of a revised site plan reflecting the relocation and alteration of the main buildin and additional parking spaces for approval by the Planning Department for confor nce with this decision, findings and conclusions. 2. Submitt 1 of a revised Landscape Plan per Exhibit #9 to include sufficient details of the creening fence and landscape screening of the outdoor display area for approva of the Planning Department per Section 4-734. (E) .2. 3. The out oor display area being kept in a neat and orderly appearance and restricted to the otal area shown on Exhibit #3. 4. Submittal of appropriate documentation of participation in the L.I.D. for left turn improvements in the West Valley Road (SR-181) per requirements and approval of the Public Works Department. 5. Approval] of the Shoreline Management Substantial Development and State Flood Zone Control Permits. 6. Retention of and/or addition to existing vegetation on the eastern and southeastern portions of the site for conformance with Section 4-734. (E) .2. per approval of the Planning Department. 7. Installation of off-site improvements in the West Valley Road (SR-181) per requirements of the Public Works Departments. 8. Approval of the Public Works Department of the final storm drainage plan. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting other specified requiremens. Topography: The site is generally level with a very slight decreasing slope toward the eastern boundary. 2. Soils: Puyallup fine sandy loam (Py). Permeability is moderately rapid, runoff is slow, and the erosion hazard is slight. This soil is used for row crops and pasture and for urban development. 3. Vegetation: Short, thick grass is the dominant ground cover with some shrubs and a few deciduous trees. 4. Wildlife: Existing vegetation on the site provides some habitat for birds and small mammals. 5. Water: There is some surface water existing on the site. 6. Land Use: The site itself is basically undeveloped. To the east is located the P-1 Drainage Channel and to the south are a few single family residences. To the west is the West Valley Road and the Green River. North of the subject site a new building is under construction. F. NEIGHBORHOOD CHARACTERISTICS: The area is presently in a slow transition from undeveloped pasture land and filled land to commercial and manufacturing park uses. 3. PUBLIC SERVICES: 1 . Water and Sewer: There is an existing 12 inch water main situated along the Puget Sound Electric right-of-way, along the easterly boundary of the subject site. An existing 8 inch sewer main is located along the same right-of-way. Storm sewer lines are not available; however, there is a drainage ditch east of the subject site. 2. Fire Protection: Provided by the Renton Fire Department as per Ordinance requirements. 3. Transit: Metro Transit Route Number 155 operates along Southwest 43rd Street within 1/4 mile to the south. 4. IMPACT ON NATURAL SYSTEMS: Development of the subject site will disturb soil and vegetation, increase water runoff, and cause a rise in traffic and noise levels in the area. However, through good develop- ment procedures and suitable landscaping and screening, many of these impacts will be minimized. SOCIAL IMPACTS: Not applicable. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended, RCW 43-21C, a declaration of non-significance has been issued for the subject proposal . This negative declaration is further based on proper development procedures per City ordinances and the provision of suitable landscape areas to help reduce the resulting loss in vegetation by site development; and compatibility with the manufacturing park ordinance, Valley Comprehensive Plan, and Resolution Number 1923. M. ADDITIONAL INFORMATION: A vicinity map and a site map are attached. N. AGENCIES/DEPARTMENTS CONTACTED: 1 . City of Renton Building Division. 2. City of Renton Engineering Division. 3. City of Renton Traffic Engineering Division. 4. City of Renton Utilities Division. 5. City of Renton Fire Department. 1. PLANNING DEPARTMENT ANALYSIS: 1 . The proposed use is consistent with the Comprehensive Plan and M-P, Manufacturing Park zone. 2. The proposed site plan conforms to the setback and landscaping requirements of the M-P zone. 3. The proposed site plan is also consistent with the requirements of the bulk storage ordinance (two large areas behind the proposed building are proposed for outdoor storage). This includes setbacks, screening, and landscaping. However, the fence has not been specifically defined on the site plans. The portion of the fence around the storage area must be a screening fence of a height consistent with bulk storage requirements. The landscape strip adjacent to the fence and storage area should have sufficient evergreen shrubs for screening, aesthetic and wildlife habitat purposes (Section 4-734.E, Green River Valley Comprehensive Plan Objectives pages 7 and 8, Resolution 1923). See comments on landscape plans. 4. The proposed development is consistent with the 2% site landscape requirement of the City's agreement with Soil Conservation Service for the Valley Drainage Project Resolution 1923) although additional evergreen shrubs suitable for screening and providing wildlife food and/or habitat should be added to certain landscape areas. See comments on landscape plans. Existing vegetation to remain around storage area must be sufficient to provide screening, buffering, and wildlife habitat. If ever removed, it must be replaced per bulk storage ordinance req.airements. 5. Two points of access along West Valley Road (SR 181 ) are indicated on the site plan. These appear acceptable. The subject site must be included in the LID for left turn lane along West Valley Road, which is being processed. 6. The southerly access road may be required at some future date to be dedicated and improved as a public street if the easterly portion of the site is subdivided from the portion fronting West Valley Road. 7. The Public Works Department has indicated that off-site improvements will be required along West Valley Road as part of site development. Unimproved portions of the right-of-way shall be included in the landscape plan. PLANNING DEPARTMENT PRELIMINARY REPORT TO HEARING EXAMINER PUBLIC HEARING: ORVAR N.J. All other storage must be in designated areas behind the building, screening fence, and landscaping areas, consistent with the M-P zone concept, bulk storage ordinance, and Valley Comprehensive Plan objectives. 9. The proposed plan is consistent with the provision of the parking and loading ordi- nance, except that an additional 8 parking spaces will be necessary to correspond with the proposed use of the accessory building near the north property line. 10. Suitable utilities are available to the subject site. Final design should be approved by the Utilities Division and Fire Department. Standard utilities charges are required (see Utilities Division comments) . 11 . Suitable storm water retention and oil/water separation facilities will be required as part of site development. Detailed plans must be approved by the Public Works Department. 12. A Shoreline Management Substantial Development Permit Application has been submitted to the Planning Department and is presently being processed. 13. A State Flood Zone Control Permit will be required for site development. P. STAFF RECOMMENDATION: Recommend approval of site plan and special permit for bulk storage subject to: 1 . Final Planning Department approval of detailed landscape and screening plans for the entire site development including comments as noted on plans submitted as exhibits at public hearing. 2. Only two pieces of equipment shall be permitted in the display area as stipulated in item 8 above. 3. A left turn lane shall be provided on West Valley Road. This can be accomplished in cooperation with the proposed LID for such purposes in the area. 4. Existing vegetation in the easterly portion of the site shall be preserved as noted on the landscape plan, and shall be of sufficient quantity and size to provide suitable screening to meet bulk storage and Valley Comprehensive Plan standards. Supplemental material may be necessary subject to review by the Planning Department. If any such vegetation is removed, it shall be replaced per bulk storage standards and Planning Department approval . 5. Final Public Works Department and Fire Department approval of utility plans and designs. 6. Final Public Works Department approval of detailed drainage plans with provision of suitable storm water retention and oil/water separation facilities which will not impact adjacent properties. 7. Approval of a Shoreline Management Substantial Development Permit. 8. Approval of a State Flood Zone Control Permit. 9. Any further development and/or sale of the undeveloped portions of the site shall be subject to M-P zone, Subdivision Ordinance, and other applicable City regulations. Vegetation: Short, thick grass is the dominant ground cover with some shrubs and a few deciduous trees. 4. Wildlife: Existing vegetation on the site provides some habitat for birds and small mammals. 5. Water: There is some surface water existing on the site. 6. Land Use: The site itself is basically undeveloped. To the east is located the P-1 Drainage Channel and to the south are a few single family residences. To the west is the West Valley Road and the Green River. North of the subject site a new building is under construction. F. NEIGHBORHOOD CHARACTERISTICS: The area is presently in a slow transition from undeveloped pasture land and filled land to commercial and manufacturing park uses. a. PUBLIC SERVICES: 1 . Water and Sewer: There is an existing 12 inch water main situated along the Puget Sound Electric right-of-way, along the easterly boundary of the subject site. An existing 8 inch sewer main is located along the same right-of-way. Storm sewer lines are not available; however, there is a drainage ditch east of the subject site. 2. Fire Protection: Provided by the Renton Fire Department as per Ordinance requirements. 3. Transit: Metro Transit Route Number 155 operates along Southwest 43rd Street within 1/4 mile to the south. 4. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended, RCW 43-21C, a declaration of non-significance has been issued for the subject proposal . This negative declaration is further based on proper development procedures per City ordinances and the provision of suitable landscape areas to help reduce the resulting loss in vegetation by site development; and compatibility with the manufacturing park ordinance, Valley Comprehensive Plan, and Resolution Number 1923. The proposed use is consistent with the Comprehensive Plan and M-P, Manufacturing Park zone. 2. The proposed site plan conforms to the setback and landscaping requirements of the M-P zone. 3. The proposed site plan is also consistent with the requirements of the bulk storage ordinance (two large areas behind the proposed building are proposed for outdoor storage). This includes setbacks, screening, and landscaping. However, the fence has not been specifically defined on the site plans. The portion of the fence around the storage area must be a screening fence of a height consistent with bulk storage requirements. The landscape strip adjacent to the fence and storage area should have sufficient evergreen shrubs for screening, aesthetic and wildlife habitat purposes (Section 4-734. E, Green River Valley Comprehensive Plan Objectives pages 7 and 8, Resolution 1923). See comments on landscape plans. 4. The proposed development is consistent with the 2% site landscape requirement of the City' s agreement with Soil Conservation Service for the Valley Drainage Project Resolution 1923) although additional evergreen shrubs suitable for screening and providing wildlife food and/or habitat should be added to certain landscape areas. See comments on landscape plans. Existing vegetation to remain around storage area must be sufficient to provide screening, buffering, and wildlife habitat. If ever removed, it must be replaced per bulk storage ordinance requirements. 5. Two points of access along West Valley Road (SR 181 ) are indicated on the site plan. These appear acceptable. The subject site must be included in the LID for left turn lane along West Valley Road, which is being processed. 6. The southerly access road may be required at some future date to be dedicated and improved as a public street if the easterly portion of the site is subdivided from the portion fronting West Valley Road. 7. The Public Works Department has indicated that off-site improvements will be required along West Valley Road as part of site development. Unimproved portions of the right-of-way shall be included in the landscape plan. PLANNING DEPARTMENT PRELIMINARY REPORT TO HEARING EXAMINER PUBLIC HEARING: ORVAR N.J. All other storage must be in designated areas behind the building, screening fence, and landscaping areas, consistent with the M-P zone concept, bulk storage ordinance, and Valley Comprehensive Plan objectives. 9. The proposed plan is consistent with the provision of the parking and loading ordi- nance, except that an additional 8 parking spaces will be necessary to correspond with the proposed use of the accessory building near the north property line. 10. Suitable utilities are available to the subject site. Final design should be approved by the Utilities Division and Fire Department. Standard utilities charges are required (see Utilities Division comments). 11 . Suitable storm water retention and oil/water separation facilities will be required as part of site development. Detailed plans must be approved by the Public Works Department. 12. SUMMARY OF REQUEST: Applicant seeks site approval to construct a sales and service facility in an M-P, Manufacturing Park, zone and approval of a special permit for bulk storage on the same site. PLAr:NING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on June 1, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on June 6, 1978 at 9:05 a.m. in the Council Chambers of the Renton MunLcipal Building. Parities wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following add_tional exhibits into the record: Exhibit #2: File No. SP-147-78, Orvar N. J. He advised that submittal of a detailed landscape plan to the Planning Department would be required for final approval. The Examiner inquired if the Planning Department report contained recommendations regarding proposed access provisions. Mr. Smith advised that access proposals as well as proposed left turn lanes on the West Valley Road would be subject to approval of the Traffic Engineering Division during building permit application review. The Examiner stated that inclusion of the access provisions would therefore not be necessary for review at this time. The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Orvar Litsjo Martin & Litsjo Architects 519 S.W. 3rd, Suite 201 Portland, Ore. 97204 1 SA-174-78 Page Two SP-175-78 Mr. Litsjo indicated his concurrence in the report with the exception of recommendations contained in Section 0.8 relating to maximum amount of equipment to be contained at one time in the proposed display area. He noted that because of the variety in sizes of equipment only one piece of large equipment or approximately three smaller-sized pieces sold and se viced by the facility could be contained in the area, and he requested that the maximum umber be deleted from the recommendation to allow flexibility for the display operation, though he noted that the equipment would be displayed in a neat and orderly fashion. The Examiner asked for testimony in support or opposition to the request. There was no response. The Examiner then asked Mr. Smith for comments. Mr. Smith indicated that during previous discussions with the applicant, new information regarding possible expansion of the facility had been introduced, although it would not affect the initial phase of development. Mr. Litsjo clarified the intent of the company to modify the operation by incorporation of sales and service of additional smaller equipment to the existing proposal. He advised that the revision would require shifting the proposed building 50 feet to the south to allow future expansion of the proposed parts department to the north. He advised that the site plan and proposed building design would remain as submitted, and the revisions would not require provision of additional service or bulk storage areas. He inquired if the proposed modification would affect the Examiner's decision on the application. The Examiner asked Mr. Smith if additional review of the revision would be necessary prior to a final decision on the matter. Mr. Smith stated that since the adjustments would not affect the site plan or bulk storage provisions, review of the proposal could be accomplished during application for building permit. He advised the applicant that additional f oor area would create a need for additional parking requirements, but he did not foresee • ignificant problems resulting from the proposed adjustment. Responding t• the Examiner's inquiry regarding the applicant's request for deletion of maximum amo t of display equipment, Mr. Smith indicated Planning Department concurrence if proposed andscaping were provided in the display area and the equipment displayed in a neat and orderly fashion. The Examiner inquired if final approval had been received for storm dr-inage plans. Mr. Smith deferred the question to the applicant who indicated that althoug plans had been submitted, response from the Public Works Department had not yet been received. Mr. Smith referred to Section P.6 of Exhibit #1 which requires final Public Works Department approval of detailed drainage plans. The Examiner entered the following additional exhibits into the record: Exhibit #10: Site Plan as submitted Exhibit #11: Perspective Drawing as submitted Exhibit #12: Building Elevations as submitted Exhibit #13: Landscape Plan as submitted Mr. Smith reported receipt of a memorandum from the applicant which referred to the proposed 50-foot shift of the structure on the site. The letter, addressed to Mr. Smith from the applicant, dated June 6, 1978, was labeled Exhibit #14 by the Examiner. The Examiner asked Mr. Smith for a final departmental recommendation. Mr. Smith recommended adoption of the preliminary report as submitted with previously discussed revision to S ction P.2 relating to maximum amount of equipment contained in the proposed display area end recommended it to be revised to require display of equipment in a neat and orderly fashion with provision of landscaping as noted on Exhibit #9. He also indicated conurrence in the applicant's request contained in Exhibit #14 and recommended final approval of the proposal during building permit review process. The Examiner requested further comments. Since there were none, the hearing on File No. SA-174-78 and SP-175-78 was closed by the Examiner at 9:50 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now Makes and enters the following: FINDINGS: 1. The request is for approval of a site plan and special permit for bulk storage of a heavy equipment sales and service facility. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby 'attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-730 (M-P) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The site plan (Exhibit #3) generally conforms to the requirements of the Bulk Storage regulations of Section 4-734 of Title IV, Ordinance No. 1628, Code of General Ordinances, with modifications noted on the landscape plan, Exhibit #9. One exception apparently is the screening fence required by Section 4-734. (E) .2. Details of the fence featured in the site plan were lacking, but per this section the Planning Department is to approve the landscape plan which would reasonably include the required fence design. Another exception is the small outdoor display area at the southwest corner of the building. This area does not strictly conform to the landscaping and fencing provisions of Section 4-734. (E) .2. Landscaping screening and a screening fence is not proposed a:-ound this display area. The applicant indicated the equipment to be displayed would be confined to this area and kept in a neat and orderly manner. 9. Per Exhibit #9 (Landscape Plan) , 2% of the site will be provided for wildlife habitat per Resolution No. 1923. Existing vegetation is to be retained on the easterly and southeasterly portions of the site. 10. According to testimony and Exhibit #14, the proposed main building and southerly portion of the site plan will be shifted about 50 feet to the south. This building will also be slightly revised in configuration. Staff felt that this revision was minor and could be reviewed by staff during the building permit process. 11. Participation in the West Valley Road (SR-181) L.I.D. for construction of a left turn lane is necessary to accomplish the proposed access to the site. 12. Off-site improvements to the West Valley Road (SR-181) have been required by the Public Works Department (Exhibit #1) . 13. As submitted, the proposal requires eight additional parking spaces per Section 4-2208 Parking and Loading Ordinance) . The revised site plan (per Exhibit #14) may require even more parking. Staff indicated that the added parking can be accommodated on the site. 14. The Public Works Department has not given final approval to the storm drainage and oil/water separation plan per Ordinance No. 3174. 15. A Shoreline Management Substantial Development Permit application has been filed with the Planning Department. The site lies in a wetland area as defined by Chapter 90.58 R.C.W. , Chapter 173-WAC and the Shoreline Master Program, Section 3.01. 16. A State Flood Zone Control Permit is required for the proposal. CONCLUSIONS: 1. The proposal conforms to the Comprehensive Plan and the Shoreline Management Master Program. 2. Exhibit #13 (Landscape Plan) should be revised per staff comments (Exhibit #9) including the required screening fence per approval of the Planning Department per Section 4-734. (E) .2. 3. The outdoor display area at the southwest corner of the main building should be limited to the total area shown on the Site Plan (Exhibit #3) . Landscaping requirements per Section 4-734. (E) .2 can be accomplished adequately by a combination of landscaping at the westerly and southerly perimeters of the site and adjacent to the display area. Per Section 4-734. (E) .2 the Planning Department should review and approve this landscaping. 4. Shifting the building location 50 feet to the south and revising its configuration SA-174-78 Page Four SP-175-78 is a minor alteration to the proposal. The Planning Department can review and approve these modifications for conformance with the Examiner's findings, conclusions and decision. 5. The Public Works Department should receive from the applicant sufficient documentation of parti ipation in the West Valley Road (SR-181) L.I.D. for construction of the left turn lanS. 6. The Planning Department should review with the applicant the location of the required additional parking spaces per Section 4-2208. These spaces must be incorporated in the revised site plan. 7. The building design represents a departure from the architecture existing in the area, however, the structures are compatible with existing development. The integration of berms against the building walls will soften the appearance of the building. 8. The Planning Department has made the applicant sufficiently aware of additional requirements that may result from future changes to the proposal and/or subdivision of the total property. DECISION: Based upon the record, testimony, findings and conclusions, it is the Examiner's decision to approve the Site Plan (Exhibit #3) and Special Permit for bulk storage subject to: 1. Submittal of a revised site plan reflecting the relocation and alteration of the main buildin and additional parking spaces for approval by the Planning Department for confor ce with this decision, findings and conclusions. 2. Submittal of a revised Landscape Plan per Exhibit #9 to include sufficient details of the screening fence and landscape screening of the outdoor display area for approvals of the Planning Department per Section 4-734. (E) .2. 3. The outdoor display area being kept in a neat and orderly appearance and restricted to the total area shown on Exhibit #3. 4. Submittal of appropriate documentation of participation in the L.I.D. for left turn improvements in the West Valley Road (SR-181) per requirements and approval of the Public Works Department. 5. Approval of the Shoreline Management Substantial Development and State Flood Zone Control Permits. 6. Retention of and/or addition to existing vegetation on the eastern and southeastern portions of the site for conformance with Section 4-734. (E) .2. per approval of the Planning Department. 7. Topography: The site is generally level with a very slight decreasing slope toward the eastern boundary. 2. Soils: Puyallup fine sandy loam (Py). Permeability is moderately rapid, runoff is slow, and the erosion hazard is slight. This soil is used for row crops and pasture and for urban development. 3. Vegetation: Short, thick grass is the dominant ground cover with some shrubs and a few deciduous trees. 4. Wildlife: Existing vegetation on the site provides some habitat for birds and small mammals. 5. Water: There is some surface water existing on the site. 6. Land Use: The site itself is basically undeveloped. To the east is located the P-1 Drainage Channel and to the south are a few single family residences. To the west is the West Valley Road and the Green River. North of the subject site a new building is under construction. F. NEIGHBORHOOD CHARACTERISTICS: The area is presently in a slow transition from undeveloped pasture land and filled land to commercial and manufacturing park uses. 3. PUBLIC SERVICES: 1 . Water and Sewer: There is an existing 12 inch water main situated along the Puget Sound Electric right-of-way, along the easterly boundary of the subject site. An existing 8 inch sewer main is located along the same right-of-way. Storm sewer lines are not available; however, there is a drainage ditch east of the subject site. 2. Fire Protection: Provided by the Renton Fire Department as per Ordinance requirements. 3. Transit: Metro Transit Route Number 155 operates along Southwest 43rd Street within 1/4 mile to the south. 4. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended, RCW 43-21C, a declaration of non-significance has been issued for the subject proposal . This negative declaration is further based on proper development procedures per City ordinances and the provision of suitable landscape areas to help reduce the resulting loss in vegetation by site development; and compatibility with the manufacturing park ordinance, Valley Comprehensive Plan, and Resolution Number 1923. The proposed use is consistent with the Comprehensive Plan and M-P, Manufacturing Park zone. 2. The proposed site plan conforms to the setback and landscaping requirements of the M-P zone. 3. The proposed site plan is also consistent with the requirements of the bulk storage ordinance (two large areas behind the proposed building are proposed for outdoor storage). This includes setbacks, screening, and landscaping. However, the fence has not been specifically defined on the site plans. The portion of the fence around the storage area must be a screening fence of a height consistent with bulk storage requirements. The landscape strip adjacent to the fence and storage area should have sufficient evergreen shrubs for screening, aesthetic and wildlife habitat purposes (Section 4-734.E, Green River Valley Comprehensive Plan Objectives pages 7 and 8, Resolution 1923). See comments on landscape plans. 4. The proposed development is consistent with the 2% site landscape requirement of the City' s agreement with Soil Conservation Service for the Valley Drainage Project Resolution 1923) although additional evergreen shrubs suitable for screening and providing wildlife food and/or habitat should be added to certain landscape areas. See comments on landscape plans. Existing vegetation to remain around storage area must be sufficient to provide screening, buffering, and wildlife habitat. If ever removed, it must be replaced per bulk storage ordinance recpirements. 5. Two points of access along West Valley Road (SR 181 ) are indicated on the site plan. These appear acceptable. The subject site must be included in the LID for left turn lane along West Valley Road, which is being processed. 6. The southerly access road may be required at some future date to be dedicated and improved as a public street if the easterly portion of the site is subdivided from the portion fronting West Valley Road. 7.
