APPLICANT: Jack Benaroya Co. FILE NO. SA-216-78 LOCATION: North side of S.W. 41st Street between Longacres Parkway and Lind Avenue extension. SUMMARY OF REQUEST: Applicant requests approval of a warehouse facility consisting of four buildings with storage area of 302,700 square feet. SUMMARY OF ACTION: Planning Department Recommendation: Approval with covenants. Hearing Examiner Decision: Approval with covenants. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on November 1, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The rearing was opened on November 7, 1978 at 10:40 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. David Clemens, Associate Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Site Development Plan Exhibit #3: Site Plan with Schematic Landscaping Exhibit #4: Site Plan with Staff Comments Mr. Clemens advised that since conformance to requirements regarding provision of driveways denoted in Section P.4 of Exhibit #1 had been accomplished by the applicant, the recommendation would be deleted from the report and subsequently replaced by a requirement for bonding or provision of restrictive covenants for the future installation of a street connection of S.W. 39th Street to S.W. 41st Street if construction is deemed necessary. He also reported that installation of off-site improvements had occurred as required by Section P.5 of Exhibit #1 and the recommendation wou:..d be revised to require only added landscaping emphasis. The Examiner reported receipt of a memorandum from the Fire Chief of the Renton Fire Department which he read and entered as follows: Exhibit #5: Memorandum to Hearing Examiner from Richard Geissler, Fire Chief, dated November 3, 1978. The memorandum indicated potential emergency access problems resulting from creation of ,i 1500-foot cul-de-sac on S.W. 39th Street off of Lind Avenue S.W. , and recommended connection of S.W. 41st Street to S.W. 39th. The Examiner noted that the Fire Chief may not be aware of revised circulation plans included in the proposal. The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Joel Benoliel Jack Benaroya Co. 5950 6th Avenue S. Seattle, WA 98108 SA-216-78 Page Two Mr. Benoliel indicated his concurrence in the report. He submitted a reduced architectura rendering which designates an addition of four buildings to the existing three on the site. The rendering was labeled as follows by the Examiner: Exhibit #6: Reduced Architectural Rendering Mr. Benoliel reported that Exhibit #6 conforms basically to Exhibit #7, previously submitted in the public hearing held on File No. SA-150-78, which provided site approval for three existing buildings on the site. He noted a reduction in size of Building No. 6 to accomm••ate possible street connection between Buildings No. 5 and 6; and reported current deve opment for future dedication of S.W. 41st Street between Lind Avenue and Longacres Pa kway which separates Phase I and Phase II of the project. In addition, he advised t -t full development to 90-foot width of Longacres Parkway extending from the railroad right-of-way to S.W. 41st Street will occur. Mr. Benoliel eported that construction of Building No. 4 would begin immediately and subsequent de elopment would proceed to the east although occupancy in structures would not occ r until completion of off-site improvements. He noted that the Fire Chief may not be aware that provision for future connection of S.W. 41st and S.W. 39th Streets had • curred and advised consideration by Burlington-Northern for redesign of the circulati•n plan to provide consistency between both developments. Due to accelerated t'ming on the project, he requested expedition of issuance of the Examiner's decision on t e matter. The Examiner equested testimony in support or opposition to the request. There was no response. He then asked Mr. Clemens if documentation of approval of drainage plans had been received from the Public Works Department. Mr. Clemens reported that although the plans were cu rently review, he was unaware of definite approval to date. The Examiner nquired if the proposal would conform to setback and parking requirements if a connection were developed between S .W. 41st Street and S.W. 39th Street or if hardship woul•; result. Mr. Clemens confirmed provision of adequate right-of-way and required landscaping and building setbacks, and advised that no hardship other than expense of co struction of the roadway would occur. The Examiner •eferenced recent revisions to the Parking and Loading Ordinance requested by the Board of Public Works, yet to be approved by the City Council, and inquired if the applicant's plans would conform to the revised requirements of the ordinance. Mr. Clemens reported that submitted plans conform to existing as well as revised requirements. The Examiner asked the applicant if buildings proposed in the subject application were uniform in de-ign to previously approved buildings in the first phase of the project. Mr. Benoliel esponded affirmatively. The Examiner -sked Mr. Clemens if landscaping plans contained in Exhibit #3 were sufficient for review and approval. Mr. Clemens responded affirmatively. The Examiner inquired if staff comments denoted on Exhibit #4 would correct the deficiency of 2,000 squar- feet of landscaping area noted in Section 0.2 of Exhibit #1. Mr. Clemens responded affirmatively. The Examiner e tered the following exhibits into the record: Exhibit #7: File No. SA-150-78; Jack A. Benaroya Co. Site Approval, dated May 9, 1978. Exhibit #8: File No. PP-086-77; Glacier Park Co. ; Orillia Industrial Park of Renton, dated December 16, 1977. The Examiner r quested a final recommendation from the Planning Department. Mr. Clemens indicated that the recommendation contained in Exhibit #1 would remain as submitted with previously stated corrections regarding deletion of Section P.4 to be replaced with requirement for restrictive covenants for future connection of S.W. 39th Street; and revision to Section P.5 to require only emphasis in landscaping areas. The Examiner requested further comments. Since there were none, the hearing on File No. SA-216-78 was closed by the Examiner at 11:10 a.m. III SA-216-78 Page Three FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a site plan for four additional buildings (302,700 square feet) in the Banaroya Business Park (M-P zone) . 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Pol4.cy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Mans for the proposal have been reviewed by all city departments affected by the mpact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the setbacks, building area and height requirements of ection 4-730 (M-P) and parking and driveway requirements of Chapter 22 (Parking and Loading Ordinance) of Title IV, Ordinance No. 1628, Code of General Ordinances. Per Exhibit #4, staff recommended deletion of three driveways onto S.W. 41st Street which was acceptable to the applicant and in conformance with the Parking and Loading Ordinance. 8. With staff revisions per Exhibit #4, sufficient landscaping will be included on the site to satisfy the requirements of Resolution No. 1923 and the Green River Valley Comprehensive Plan. A meandering path is recommended by staff along the westerly portion of the property. Thelpreliminary plat does not show a path along Springbrook Creek (Exhibit #7 or Exhibit #8) . However, the final plat remains to be approved for the property west Of Lind Avenue S. 9. This property was originally part of the preliminary plat of Orillia Industrial Park (PP-086-77) but was subsequently withdrawn by Burlington Northern Railroad Co. (Conclusion No. 3, Exhibit #7, SA-150-78) . Approval of the site plan for the existing portion of the Benaroya Industrial Park was conditioned upon completion of the final plat improvements within the Benaroya Company property (Exhibit #7) . 10. ['he major deviation of the proposed site plan from the approved preliminary plat Exhibit #8, PP-086-77) is the absence of a roadway connection between S.W. 39th Street and S.W. 41st Street. However, the site plan (Exhibit #2) contains sufficient area for construction of this roadway. The applicant testified that his road connection would be constructed if required in the final plat and that appropriate covenants to this effect would be signed. 11. :onstruction of S.W. 41st Street is underway. Off-site improvements are planned o be completed prior to occupancy of the buildings. 12. Che Public Works Department has not yet approved the railroad spur track locations and, the drainage plans for the proposal. 13. rhree buildings have been constructed on the southerly portion of the property Exhibit #2) . Architectural design, color and graphics will be the same for the proposed additional buildings (Exhibits #4 and 6) . 14. Per Finding No. 11, Examiner's Decision, Exhibit #7, the Benaroya Company is to complete the final plat for that company's property. Testimony regarding the subject application indicated that the company was coordinating the final plat with Burlington Northern Railroad Company. SA-216-78 Page Four CONCLUSIONS: 1. The pro sed buildings and site plan conform to the Comprehensive Plan for the Green River Va ley. The design is an aesthetic contribution to the environment (Introduction, page 1, aVnd Objectives, pages 6 and 8) , which will ". . .enhance the image of the City of Rento . " (Goals, page 4) . Wildlife habitat will be partially enhanced, and a viab e economic climate. . . " will be provided (Goals, page 4) . Suitable landscaping has been provided at the periphery of the site (Objectives, page 6) . Internal circulation accommodates the various means of transportation (Objectives, page 7) . Per Exhibit #3, the loading areas will be visible from adjacent streets but will e obscured by the landscaping along the site perimeter (Objectives, page 8) . 2. The areas of nonconformance of the proposal with the preliminary plat of Orillia Industrial Park are not significant. However, revisions will be required in the final plat which will be the subject of a public hearing thereon, and not this review of a site plan. 3. Detailed landscape plans are required to enable staff to complete final review of their ad uacy. It seems appropriate that the recommended pedestrian pathway not be requi d until the final plat is approved. This feature should be reviewed with the final plat relative to the plat's overall pedestrian system. However, the applican is not prevented from installing the path on a voluntary basis. 4. Due to t e coordinated effort of the applicant with the Burlington Northern Railroad Company in designing the final plat, it seems appropriate to not at this time require construction of the roadway connection of S.W. 41st Street and S.W. 39th Stre t. It is sufficient that the applicant covenant for completion of this roadway s ould it be required in the approved final plat. 5. Due to th potential impact of rooftop mechanical equipment, the Planning Department should re iew these details for compliance with the Objectives, page 8, Comprehensive Plan for he Green River Valley. Impact upon adjacent and distance properties should be minimized. Details of this equipment were not submitted. 6. Screening for the refuse dumpsters was not specified. The final landscape plan should in lude such screening for the review and approval of the Planning Department. DECISION: Based upon th- record, testimony, findings and conclusions, it is the Examiner's decision to approve th- site plan (Exhibit #2) subject to: 1. Completio by the Jack Benaroya Company of improvements required in the approved prelimina y plat of Orillia Industrial Park and improvements required by the approved inal plat thereof, except for improvements which would interfere with and be in onsistent with this approved site plan. 2. Completio of restrictive covenants attesting to construction of the roadway connectio between S.W. 41st Street and S.W. 39th Street should it be required per the a•proved final plat. 3. Submittal of the final storm drainage plans for approval by the Public Works Department. 4. Final approval of the Public Works Department of the proposed railroad spur track locations. 5. Submittal of a final landscape and parking plan per staff comments on Exhibit #4, except fo' the pedestrian pathway along the westerly portion of the property, which sha 1 be resolved in the final plat. However, on a voluntary basis the applicant may include this pathway. The landscape plan shall include screening for the r-fuse dumpsters. 6. Submittal of the rooftop mechanical equipment and screening details for approval by the Pl.nning Department. 7. Submittal of off-site improvement details including landscaping for approval by the Publi Works and Planning Departments. Occupancy of the buildings is not to occur unt' 1 these off-site improvements are completed by the applicant or an LID. 8. The subject development is bounded by Lind Avenue which is being improved by an LID and S . W. 41st Street and Longacres Parkway both of which are currently being improved by the developer as a portion of the Phase I development between S . W. " 41st and 43rd Streets . The minor street connection shown on the preliminary plan for this area between S . W. 39th ( future) and S . W. 41st is not proposed for development with this project . The developer and Burlington Northern are continuing to discuss future circulation needs and the potential to delete this connection. However , the area necessary is provided between buildings 5 and 6 for future improvement of this street. The applicant proposes to covenant for future improvement , if required . 5 . Parking is provided on basis of 5% of total area of the buildings to be used for office purposes . ( 1 space per 200 square feet. ) The remaining area to be based upon warehousing ( 1 space per 1 , 500 square feet. ) A total of 251 spaces is required , with 253 being provided , plus 31 spaces in the area of the future right-of-way of the 39th to 41st Street connection. 6 . I feel this is necessary to accomplish the purpose we discussed, namely to make our obligation contingent on what actually happens in the Burlington Northern property. Thus, should the connector street be required in their final plat, and when their portion of it is constructed, then we are obliged to construct our portion of it. The applicant ' s proposal to landscape Springbrook Creek conforms to the intent of Res . 1923 to maintain adequate open space areas for wildlife habitat. 4. The subject development is bounded by Lind Avenue which is being improved by an LID and S . W. 41st Street and Longacres Parkway both of which are currently being improved by the developer as a portion of the Phase I development between S . W. 41st and 43rd Streets . The minor street connection shown on the preliminary plan for this area between S . W. 39th (future ) and S . W. 41st is not proposed for development with this project . The developer and Burlington Northern are continuing to discuss future circulation needs and the potential to delete this connection . However , the area necessary is provided between buildings 5 and 6 for future improvement of this street. The applicant proposes to covenant for future improvement, if required . 5 . Parking is provided on basis of 5% of total area of the buildings to be used for office purposes . ( 1 space per 200 square feet. ) The remaining area to be based upon warehousing ( 1 space per 1 , 500 square feet. ) A total of 251 spaces is required , with 253 being provided , plus 31 spaces in the area of the future right-of-way of the 39th to 41st Street connection. 6 . The applicant has agreed to provide driveways in accordance with the latest revisions to the Parking and Loading Ordinance recommended by the Board of Public Works . As agreed by Bob Fehnel in his conversation of today with Don Monahan, we will deliver to you today our plans for an illumination system. 2. Conduit for signal at intersection of S.W. 41st and Longacres. This will be provided as agreed. 3. Planning Department request for changes -'n street plans. Our response to these changes requires some background e; pllanation: When we originally discussed plans for Longacres Parkway with the city, we were informed that a center landscaped median would be required. We agreed to this and began our planning accordingly. Later, after our outside street engineering firm Jones Associates) had begun its design work, we were informed by your de- partment of a change in plans, deleting the center landscaped median from Longacres Parkway. We agreed to the change and requested that Jones Associ- ates delete this from their plans. Their plans, as submitted to you, did not show the median. Although several changes to their plan were requested by your department and were agreed to by us, no median was required. Therefore, when you approved our street plans on August 23, 1978, no median was shown or mentioned. Accordingly, we entered into contracts for the street work in late August, 1978, requiring construction per the plans ap- proved by you. On September 12, 1978, Bob Fehnel , Sylvia Otani, and I attended a meeting with the Planning Director and two members of his staff to discuss the site plan for the proposed buildings north of S.W. 41st Street. Your first question concerns the necessity of Benaroya following the City' s subdivision ordinance. As mentioned in your letter, the Benaroya property was withdrawn from the Glacier Park Plat and transferred to Benaroya. Therefore that property is still under one ownership. Your Memo also states that Benaroya intends to retain the property under one ownership but the property will be bisected by S .W. 41st. In reviewing the City' s subdivision ordinance, it is plain that that ordinance is based on Chapter 58 . 17 RCW; while subdivision is not defined in such a manner in that title as to definitely answer your question, it would appear that as long as the property stays under one ownership that the subdivision statute, and therefore the City' s subdivision ordinance would not apply. The roadway would require a dedication to the City of a right of way ,but the underlying fee would still be retained by the Benaroya Company. Therefores .it would appear that this property does not need to be platted. With respect to your question No . 3 about the total completion and dedication of improvements required in phase I , the normal method of development of one piece of property would require that the initial site plan be developed within a reasonable period of time . If development begins on phase 2 prior to the completion of all of phase 1 , the City should have no objection as long as the phase 1 requirements were being completed at a reasonable time . An examination of the preliminary plat reveals the Benaroya proposal is nonconforming as follows: a. Addition of one more railroad spur. b. Alignment of S.W. 42nd Street to be in line with S.W. 41st Street. c. Reduction of the number of lots in Block 4. d. Lengthening the lots adjacent to S.W. 43rd Street and lessening the length of the remaining lots of Block 4. e. Connection of S.W. 39th Street to what was S.W. 42nd Street. 9. Burlington Northern sold property within and part of the preliminary plat to the Jack Benaroya Company prior to submittal of the final plat. This action was in violation of Section 9-1110.2 of the Subdivision Ordinance (see attached legal opinion from Assistant City Attorney) . 10. Exhibits #2 and #3 indicate that the property purchased by the Benaroya Company existed as two individual tax lots prior to the Orillia Industrial Park preliminary plat. Testimony was not given as to the period of existence of these two tax lots. These lots were not shown in the record of the Orillia Industrial Park preliminary plat. 11. With full knowledge of information supporting findings #8, #9, and #10, the applicant testified of the williingness to proceed with the application.
