RE : EASEMENT VACATION FOR GARFIELD ASSOCIATES
e have reviewed the requested utility easement vacation
proposed by Garfield Associates within the Burlington
orthern Orillia industrial Plat . These easements are
required at all property lines for potential utility
purposes . So long as no utility needs can be demon -
st"ated , it would appear satisfactory to vacate the
easement .

Orillia Industrial Park Subdivision , Section 30 , Township23north , Range 5 east of the Willamette Meridian . Enclosed
are four copies of the plat showing this easement .
Lots 4 and 9 are being developed together . The development
plans , which have been conceived in cooperation with Mr .
Ronald Olsen of the Renton Engineering Department , call for
a building to extend across the above-described easements .

LOCATION: Between S.W. 29th and S.W. 34th Streets, 300 feet west of the
East Valley Highway.
SUMMARY OF REcUEST: The applicant requests site approval for development of a
144,000 square foot warehouse facility in an M-P zone along
with approval of a special permit for fill and grade.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions.
Hearing Examiner Decision: Approval with conditions.
PLANNING DEPAFTMENT The Planning Department staff report was received by the
REPORT: Examiner on November 22, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on November 28, 1978 at 10:05 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Eepartment report, and the report was entered into the record as Exhibit #1.
David Clemens, Associate Planner, reviewed Exhibit #1, and entered the following
additional exhibits into the record:
Exhibit #2: Site Plan as submitted
Exhibit #3: Site Plan designating adjacent development
Exhibit #4: Planting Plan
Exhibit #5: Surcharge Fill Plan and Details
Exhibit #6: Planting Plan with staff comments
Exhibit #7: Building Elevations
Mr. Clemens referenced Section 0.16 of Exhibit #1 which states that the 60-foot open space
on the east side of the building must be substantiated prior to issuance of a building
permit, and explained that the condition is a requirement of the building and fire codes,
not the zoning code. He also noted that a restrictive covenant will be provided by the
Burlington Northern Company to substantiate the open space. Mr. Clemens also advised that
Section P.1 of Exhibit #1 regarding development of S.W. 34th Street and S.W. 29th Street
should be deleted since responsibility for future development of the roadways lies with
Burlington Northern; and the second sentence in Section P.2 pertaining to widening of the
westerly property line planter should also be deleted.
The Examiner asked the representative for the applicant if he concurred in Exhibit #1.

Mr. Orazem indicated his concurrence in the report. He explained that a compromise regarding
the landscaping on the westerly property line was being effected with replacement of a 10-
foot wide cluster of trees at the northern entrance, and was acceptable to the Planning
Department. Mr. Orazem referenced Section P.9 of Exhibit #1 which requires installation of

temporary paving on S.W. 34th Street to East Valley Road if truck traffic utilizes the
roadway prior to installation of improvements, and requested that the wording be revised
to a low access by construction vehicles to the site. Mr. Clemens agreed to change the
word ng to read, "If truck traffic to the completed facility is to use S.W. 34th Street. . . "

of t e unimproved roadway during the construction period.
The xaminer requested testimony in support or opposition to the request. There was no
res nse. Mr. Clemens inquired regarding the applicant's final determination of curbing
heig t at the western portion of the property for the purpose of separating truck traffic
from proposed landscaping. Mr. Orazem reported that only a standard six-inch extruded
concrete curb would be feasible at the subject location.
The Examiner inquired regarding the elevation height of the fill storage area. Mr. Orazem
reported that 4500 cubic yards of fill would be stored until utilized for landscape berms
or by other developments in the surrounding area, although such arrangements for sale of
the surcharge material had not been finalized.
The Examiner inquired regarding exterior building color. Mr. Orazem responded that the
building would be an off-white or cream color with a contrasting stripe consisting of
orange and dark brown, the company colors. The Examiner requested clarification regarding
the restrictive covenant for the required 60-foot distance between buildings on the
eastern portion of the property. Mr. Orazem reported that Burlington Northern Company
had transmitted a letter which had indicated covenants were being drafted, but receipt
had not yet occurred. The Examiner requested a copy of the letter which he entered into
the record as follows:

Mr. Clemens clarified that the restriction would be imposed on the adjoining property to
serve the subject property and the site to the east. Mr. Orazem confirmed that all
requirements had been met by the applicant on the subject site.
The Examiner inquired regarding proposed methods of dust and mud control during landfill
operations. Mr. Orazem indicated that the compaction operation would occur as soon as
possible, and dust would be controlled by natural rainfall and a sprinkling truck if
necessary. He also reported that landfill would not be transported onto the site via the
East Valley Highway.
The Examiner inquired regarding erosion control methods. Mr. Orazem indicated that no
problem with erosion will occur due to the fact that the land is level and very porous.
He agreed that dikes would be provided in the event erosion occurred.
The Examiner inquired if the landscaping plan conforms to requirements of Resolution No.
1923, and if the proposed development conforms to the Parking and Loading Ordinance and
to all conditions of the final plat of Orillia Industrial Park. Mr. Clemens responded
affirmatively.
The Examiner requested submittal of Exhibit #8 from the applicant as soon as possible.
He then requested further comments. Since there were none, the hearing on File No.
SA-252-78 and SP-253-78 was closed by the Examiner at 10:40 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1. The request is for approval of a special permit for a landfill operation and approval
of a site plan for a 143,800 square foot warehouse and 3,000 square foot repair garage
in the M-P zone.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report
py reference as set forth in full therein.
3. Oursuant to the City of Renton's Environmental Ordinance and the State Environmental
policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
1as been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. plans for the proposal have been reviewed by all city departments affected by the
mpact of this development.

5. There was no opposition to the proposal expressed.
6. All utili :ies are available or require extension from existing facilities.
7. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-730 (M-P) of Title IV, Ordinance No. 1628, Code of General
Ordinances.
8. The proposed landfill complies with the setback and fill material requirements of
Chapter 23 (Mining, Excavation and Grading) , Title IV, Ordinance No. 1628, Code of
General Regulations. Storm drainage and erosion control plans have not yet been
approved by the Public Works Department per Sections 4-2313.10, 4-2316.7, 4-2318
and 4-2319. Control of dust and mud on the property or adjacent properties is not
proposed :since the landfill operation will be conducted during the next few winter
months.
9. This property is part of the Orillia Industrial Park final plat (FP-176-78) ,
approved July 17, 1967. Off-site improvements have not been completed but have
been bonded for completion.
10. Approximately 4500 cubic yards of landfill is proposed to be stored at the northern
portion of the site (Exhibit #5) . Stabilization of this landfill is not proposed.
Landscaping will be planted at the westerly, northerly and easterly perimeter of
the landfill (Exhibit #4) . If the fill material can be utilized at other sites
in the area, it will be sold and deported to those sites.
11. The landscaping plan, Exhibit #4, conforms to Resolution No. 1923 and the Green
River Valley Comprehensive Plan.
CONCLUSIONS:
1. The proposal is compatible with the surrounding area and is consistent with the
Green River Valley Comprehensive Plan (Sections 4-2303.2.B and C) . It contributes
to ". . .high operational, development and environmental standards. " (Section 4-730.010) .
2. Storm drainage and erosion control plans must be evaluated and approved by the Public
Works Department prior to commencement of the landfill operation. Erosion control
should be integrated with the landscape plan. Perhaps hydroseeding of the fill
storage area would be appropriate if this fill material is retained on the site.
It is appropriate that the landfill slopes and standing fill material be stabilized
to prevent erosion.
3. Although it is very likely that normal winter rainfall and moisture will substantially
control dust during the landfilling activity, the Public Works Department should
monitor the operation and require dust control measures if deemed necessary.
4. Improvements to S.W. 29th and S.W. 34th Streets will be constructed respectively by
the Glacier Park Company and LID 302. These improvements become necessary relative
to the subject application when the proposed facility is constructed and occupied.
Access for the heavy trucks will be necessary over these two streets. Therefore,
appropriate temporary improvements in these streets should be completed as required
by the Public Works Department pending construction of permanent improvements.
5. Exhibit #6 contains the landscaping plan with staff recommendations for additional
plant material. These recommendations appear appropriate along the westerly property
line separating the proposal from the abutting Superior Fast Freight facility that
was approved on July 31, 1978 (SA-202-78) . It is also appropriate that this landscaping
be compatible with the Superior Fast Freight landscape plan. This will further
implement the Green River Valley Comprehensive Plan.
6. The Uniform Building Code requires a 60-foot separation between buildings proposed.
Per the attached letter of November 22, 1978, (Exhibit #8) Burlington Northern
Railroad Company is aware of the implications of this requirement relative to the
vacant property easterly of the subject site. Approval of the submitted special
permit will precede development of the easterly property; therefore, this letter
should suffice as testimony that Burlington Northern knowingly accepts the
consequences.
DECISION:

1. Submission of erosion control plans to the Public Works Department for review and
approval.

1 . The proposed use is consistent with the Comprehensive Plan

truck/rail warehouse with offices on a 9± acre site located
between S . W. 34th and S . W. 29th ( both proposed ) approximately

A 3 , 000± square foot repair garage is proposed as a part
of this activity to be located in the rear (north ) yard area .
3. The proposed freight distribution facility is consistent
with the manufacturing park zone permitted use , setbacks ,
landscaping , and other requirements . Additional landscaping
has been provided to insure compatibility with future M-P
uses in the area , and other performance standards .
4 . The current filled grade of the site is approximately 15±
feet . The applicant proposes to fill to elevation 21 . 6±
feet the area for the warehouse and repair garage and
store an additional 4500 cubic yards on a one acre site
at the north end of the site .
5 . On July 31 , 1978 , the Hearing Examiner approved a somewhat
similar activity for Superior Fast Freight on the property
immediately to the west .
6 . The proposed site plan and landscaping area is generally
consistent with Comprehensive Plan objectives and the
requirements of Resolution No . 1923 between the City of
Renton and Soil Conservation Service ( Comprehensive Plan ,
Green River Valley , June , 1976 , valley and site objectives ,
pp . 5-8 ) .
Because of the large expanses of structure , asphalt , and
the potential for storage of trucks and trailers , additional
landscape buffering and a screening fence have been provided
around the periphery of the site and within the site interior .
The landscaping buffer along the westerly side , separating
this use from Superior Fast Freight appears to be somewhat
less than adequate and would certainly be inadequate should
Superior not be constructed . The landscape separation
should be increased to 10 feet and tree/shrub plantings
extended accordingly . The areas provided appear suitable
to provide visual buffering and wildlife food and habitat .
7 . Areas have been designated on the site plan for future develop-
ment . Such future development shall be subject to further site
plan approval by the Hearing Examiner .

division , with the provision of suitable on-site retention
and oil /water separation facilities .

10 . Building exterior treatment and color shall be compatible
with M- P Ordinance and Comprehensive Plan objectives subject
to Planning Department approval ( Green River Valley Compre-
hensive Plan objectives , June , 1976 ) .
11 . Suitable bond shall be provided in the amount of 150% of
the estimated cost of landscaping installation and for a
three-year maintenance period .
12 . A preload plan for building construction has been submitted
and is considered suitable for approval with the site plan
as part of on-site construction per Section 4-2305 . 1 . F of
the Mining , Excavation , and Grading Ordinance . The subject
site was filled as part of a special permit application for
Glacier Park Company , approved in 1976 .
13 . The landscaping plan incorporates suitable screening of the
proposed excess fill per Section 4-2307 . 5 . I and must be
installed as a part of site development with suitable
irrigation .
14 . A Flood Zone Control Permit is required for the subject
site development .
15 . Proposed height of the building is approximately 30 feet ,
which is consistent with the height requirements of the
M-P zone .
16 . The 60 foot open space on the east side of the building
must be substantiated prior to issuance of a building permit .
17 . Review and approval of storm water detention plans by the
Public Works Department .
18 . If truck traffic is to use S . W . 34th to East Valley Road
prior to installation of improvements , temporary paving
must be extended to the satisfaction of Traffic and Engi -

To permit the construction of buildings for use as a transfer
warehouse with rail and truck loading facilities . To be included

D . HISTORY/BACKGROUND :
The subject site was annexed into the City by Ordinance 1745
dated April 14 , 1959. The site was filled in 1975 ( file
SP-822-75 ) , rezoned by Ordinance 2992 , dated March 10 , 1976 ,
and approved as a final plat on July 17 , 1978 .
E . PHYSICAL BACKGROUND :
1 . Topography : The site is essentially level .
2 . Soils : The underlying soil materials are Snohomish Silt
Loam ( So ) and Tukwila Muck (Tu ) . The entire site has been
overlain with artificial fill .

scrub brush and grass .
4 . Wildlife : The existing vegetation may provide some habitat
for birds and small mammals .
5 . Water : No surface water was noted on the site .
6 . Land Use : The property adjacent to the west has been approved
for a facility similar to the subject request . The properties
north , south , and east remain undeveloped . To the east across
the East Valley Road are located several businesses .
F . NEIGHBORHOOD CHARACTERISTICS :
The properties in the vicinity are experiencing a transition from
undeveloped land to commercial/ industrial uses of light industrial /
manufacturing park nature .

1 . Water and Sewer : An existing 12 inch main runs north-south
along the East Valley Road within 1/4 mile to the east of
the subject site , and a 12 inch main extends east-west within
1/4 mile to the north and a 24 inch main runs north-south
along the Lind Avenue extension approximately the same dis-
tance . Along the East Valley Road within 1/4 mile to the
east of the subject site exists an 8 inch sanitary sewer
which eventually becomes a 24 inch pipe .

0 . PLANNING DEPARTMENT ANALYSIS :
1 . The proposed use is consistent with the Comprehensive Plan
Land Use Element which designates the site and surrounding
area as manufacturing park .
2 . The applicant proposes to construct a 143 ,800± square foot
truck/rail warehouse with offices on a 9± acre site located
between S . W. 34th and S . W. 29th ( both proposed ) approximately
300 feet west of East Valley Road . The proposed truck
oriented warehouse will also serve as a storage and light
repair yard for trucks and trailers of Garfield Transfer .
A 3 , 000± square foot repair garage is proposed as a part
of this activity to be located in the rear ( north ) yard area .
3 . The proposed freight distribution facility is consistent
with the manufacturing park zone permitted use , setbacks ,
landscaping , and other requirements . Additional landscaping
has been provided to insure compatibility with future M-P
uses in the area , and other performance standards .
4 . The current filled grade of the site is approximately 15±
feet . The applicant proposes to fill to elevation 21 . 6±
feet the area for the warehouse and repair garage and
store an additional 4500 cubic yards on a one acre site
at the north end of the site .
5 . On July 31 , 1978 , the Hearing Examiner approved a somewhat
similar activity for Superior Fast Freight on the property
immediately to the west .
6 . The proposed site plan and landscaping area is generally
consistent with Comprehensive Plan objectives and the
requirements of Resolution No . 1923 between the City of
Renton and Soil Conservation Service ( Comprehensive Plan ,
Green River Valley , June , 1976 , valley and site objectives ,
pp . 5-8 ) .
Because of the large expanses of structure , asphalt , and
the potential for storage of trucks and trailers , additional
landscape buffering and a screening fence have been provided
around the periphery of the site and within the site interior .
The landscaping buffer along the westerly side , separating
this use from Superior Fast Freight appears to be somewhat
less than adequate and would certainly be inadequate should
Superior not be constructed . The landscape separation
should be increased to 10 feet and tree/shrub plantings
extended accordingly . The areas provided appear suitable
to provide visual buffering and wildlife food and habitat .
7 . Areas have been designated on the site plan for future develop-
ment . Such future development shall be subject to further site
plan approval by the Hearing Examiner .

8 . Drainage plans have been coordinated with the Engineering
Division , and shall be subject to final approval by that
division , with the provision of suitable on-site retention
and oil /water separation facilities .
9. Utility plans shall be coordinated with and approved by the
Public Works and Fire Departments .
10 . Building exterior treatment and color shall be compatible
with M- P Ordinance and Comprehensive Plan objectives subject
to Planning Department approval ( Green River Valley Compre-
hensive Plan objectives , June , 1976 ) .
11 . Suitable bond shall be provided in the amount of 150% of
the estimated cost of landscaping installation and for a
three-year maintenance period .
12 . A preload plan for building construction has been submitted
and is considered suitable for approval with the site plan
as part of on-site construction per Section 4-2305 . 1 . F of
the Mining , Excavation , and Grading Ordinance . The subject
site was filled as part of a special permit application for
Glacier Park Company , approved in 1976 .
13 . The landscaping plan incorporates suitable screening of the
proposed excess fill per Section 4-2307 . 5 . I and must be
installed as a part of site development with suitable
irrigation .
14 . A Flood Zone Control Permit is required for the subject
site development .
15 . Proposed height of the building is approximately 30 feet ,
which is consistent with the height requirements of the
M-P zone .
16 . The 60 foot open space on the east side of the building
must be substantiated prior to issuance of a building permit .
17 . Review and approval of storm water detention plans by the
Public Works Department .
18 . If truck traffic is to use S . W. 34th to East Valley Road
prior to installation of improvements , temporary paving
must be extended to the satisfaction of Traffic and Engi -
neering Divisions .
P . PLANNING DEPARTMENT RECOMMENDATION :
Recommend approval of the proposed site plan and special permit
to fill and grade based on the above analysis subject to the
following conditions :
1 . Development of S . W. 34th Street and S . W . 29th Street to
full City standards per approval of the Public Works
Department .
2 . Final Planning Department approval of landscape , berming ,
and screening plans with the provision of an installation
and three-year maintenance bond per 0 , Analysis , No . 11 .
The westerly property line planter shall be widened to
ten feet for its full length and screen tree planting
extended accordingly to provide a pleasant environment ,
minimize the impact of the development , and enhance the
visual experience from adjacent properties in accordance
with Green River Valley Comprehensive Plan , page 7 , Site
Objectives , Landscaping and Open Space .
