APPLICANT: FREDERICK J. STIENER FILE NO. SA-043-84 I. LOCATION: 800 block Grady Way S.W. I SUMMARY OF REQUEST: The applicant seeks site approval to allow the construction of an office building having 16,156 square feet.1 SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval subject to conditions. 1 Hearing Examiner Decision: Approved with conditions. BUILDING & ONING The Building & Zoning Department Report was DEPARTMEN1T REPORT:received by the Examiner on May 15, 1984. PUBLIC HEA ING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing as opened on' May 22, 1984, at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties;wishing to testify were affirmed by the Examiner. Roger Blaylo k, Zoning Administrator, presented the staff report advising that this hearing had been continu-Id from May 1, 1984; and, while there had been no publication of the continuance, the property had been posted to that effect. The following exhibits were entered into the record: Exhibit #1 Yellow file containing the original application, staff report and other pertinent documents. I Exhibit #2 Site plan. I Exhibit #3 Landscaping plan. Mr. Blaylock reported that the property had been recently rezoned to B-1, Business Use, to become effective on May 16th. The greatest potential problem with development of the site regards acces, to the site in view of planned improvement of Grady Way. It was noted that the Environments_ Review Committee issued a Memorandum of Concurrence on April 11, 1984, which refers back to the underlying rezone. Mr. Blaylock advised the underlying environmental declaration of non-significance was issued without any conditions but contained ' two informational notes. In this connection, it was explained that the site plan originally reviewed was not acce ted in total, and the plan under review today is a a revision. Secondly, off-street improvements will be required along S.W. Grady Way, or it will be necessary to sign a petition to participate in an L.I.D. Because of im rovements planned for Grady Way, no specific design plans adjacent to the public right-of-way have been provided in the site plan. The Examiner inquired if it would be reasonable to eliminate the driveway along Grady Way,'if access is not necessarily required to the arterial. e suggested possible direction to a side street - in this case, Raymond Avenue. In response, t e Zoning Administrator noted that the Traffic Engineering Division and Police Department suggest only right turns be allowed in and out of the access onto Grady Way. I The anticipated roadway construction will include a left-turn lane, however, which may be appropriate for access. As staff is not sure what the final design will allow, limitation of left-turn movements onto S.W. Grady Way from the subject site is recommended until the arterial is improved to include five lanes, with left-turns. Further, Traffic Engineering approval to allow for the possibility of changed conditions in the future is suggested. Mr. Blaylock continued his presentation, noting that landscape plans for the area adjacent to S.W. Grady Wy are not specific due to anticipated arterial improvements. Plans for on!-site parking and ci culation, which will utilize part of a public alley, were reviewed. The Examiner inquired if paring maneuvering is allowed in the alleyway. In reply, Mr. Blaylock stated that it is, according to advice from 'the City Attorney. Several instances were cited where this has been permitted as a part of site plan approvals. He noted that parking is not allowed in alleyways, however. 1 it EXAMINER'S REPORT & b-,.-2ISION II FREDERICK J. This was acknowledged by Mr. Blaylock, who noted that they were using it for primary circ lation of their facility. In this case, the intent is to utilize the alleyway for circulation f r the parking and to retain common availability because it is a public alleyJ The Examiner qu ted from sections of the Parking Loading Ordinance, which indicates alleys shall not be used f r off-street parking and loading purposes. Mr. Blaylock responded concerning the City Attorne 's interpretation, which states that it cannot be used for parking and loading; however, he elieves that maneuvering for the parking space is appropriate but not on-site for the function f that use. In response t the Examiner's further inquiry, Mr. Blaylock advised that at present the alley is two-way, an he believes the Board of Public Works would have jurisdiction to revise it to one-way. Continuing the discussion regarding the problems with alleys, Mr. Blaylock indicated that most allays are 12 to 16 feet wide, and the normal circulation for a two-way alley should be at least 20 feet wide. This has created difficulties dealing with alleys in the older portions of the City. Mr. Blaylock continued with his presentation, noting that, while the other City departments_had indicated ap royal, both the Utilities and Traffic Engineering Divisions of the Public Works Department had not approved. Their reasons were not stated but rather a series of requirements were listed, which the Building and Zoning Department interprets to mean that, if I they can be et, approval should be granted. 1 I He then concluded his report with a discussion of the basis for their recommendation of approval. With respect to condition #4, which reads, "Limitation of left turn movements; onto S.W. Grady vyay from the subject site until S.W. Grady. Way is improved to a five-lane arterial with left turn lanes," he stated that they are not recommending approval for left turns or'to or out of the si e at this time but rather approval subject to approval by the Traffic Engineering Division base upon final design plans for the L.I.D. Condition #5 was revised to read, "Filing of restrictive covenants to participate in the L.I.D. if formed to improve S.W. Grady Way." He noted the a plicant would then have the option of agreeing to restrictive covenants or accomplishin the improvements at the time of issuance of the building permit. The Examiner called for testimony from the applicant or his representative. Responding was: Craig Johnson 523 S. Washington Kent, WA 98032 Mr. Johnson 'ndicated that he is representing the applicant and is in general concurrence' with the staff rep rt. The Examine invited testimony in support or opposition to the application. There was none. He invited fu ther comment from the Zoning Administrator, who indicated he had none. The public he ring was then closed by the Examiner at 9:29 a.m. 1. The a plicant, Frederick J. Stiener, filed a request for approval of a site plan for an office uilding. I' 2. The a plication file containing the application, the State Environmental Policy Act documentation, the Building and Zoning Department report, and other pertinent docum nts was entered into the record as Exhibit #1. 1 3. Pursua t to the City of Renton's Environmental Ordinance and SEPA a Declaration of Non-si nificance has been issued for the subject proposal by the Environmental Review Comm ttee (ERC), responsible official. 4. Plans or the proposal have been reviewed by all city departments affected by the impac• of this development. 5. The su•ject site is located on the south side of the 800 block of S.W. Grady Way between Raymund Ave S.W. and Seneca Ave S.W. I 6. The re atively level parcel is approximately 0.8 acres in size and is undeveloped. 1' I' 7. The s bject site was, annexed into the City by Ordinance 1745 in April of 195119, as amend-d by Ordinances 1764 and 1928. The site at annexation was zoned G-60100, a design.tion modified by residential zone consolidation to R-1 (Single Family Residential; Minim m lot size - 7,200 sq ft). The site was rezoned to B-1 (Business/Commercial) by Ordina ce 3811 in May of this year. EXAMINER'S REPORT & L-JISION FREDERICK J. STIENER, SA-043-84 June 5, 1984 Page 3 8. The a plicant proposes the construction of an approximately 16,156 square foot office buildi g on the subject site. The building will contain two stories above grade. A parkin garage will be provided in the basement of the proposed office building. 9. Lands aping and setbacks have been provided on the subject site. Ten feet of landsc ping has been proposed along Raymond Ave S.W. and along S.W. Grady Way. 10. Requi d landscaping along Grady on the public right-of-way has not been indicated. Recon truction of Grady could eliminate any' plantings initiated by the applicant and a deferr 1 may be in order. 11. Parkin areas over 10,000 square feet require internal landscaping of not less than 5% of the parking area. The site's approximately 11,000 square feet of parking requires landscaping. 12. The site fronts upon Grady Way, a major arterial. Other site plans for development along this roadway have been limited to collector street access if that is available. This limitation preserves and protects the arterial function of Grady. The future improvements of Grady have not been finalized, and the left turn lane could be limited to inte sections rather than two-way left turns. 13. The ap licant proposes direct parking access via the alley running along the rear o,f the subjec site and, therefore, improvement of the alley has been recommended by staff;. 14. The proposed complex is estimated to increase the daily vehicle traffic count by approximately 215 trips per day. As an office complex, these trips would most likely occur during the peak hours. CONCLUSIONS 1. The pr posed site plan generally appears to serve the public use and interest. The develoi ment of the site will provide additional employment opportunities in the City of Renton. 2. The development will also increase the tax base of the City. The additional utility demand generated by the proposal should not unduely burden the City's infrastructure. 3.The traffic generated by the development will increase traffic and will certainly utilize the ally adjacent to the subject site for parking. The alley will therefore, have to be improved to safely and efficiently handle the demands created by the subject site.1 The site's larking will be accessed from the alley and the alley is required for maneuvering into th parking stalls. The applicant will have to pave the alley to its full width and provid storm drainage improvements subject to approval of the Department of Public Works. 4. The sit has access via both Raymond Ave and the rear alley and the elimination of the access to Grady will not unreasonably restrict access to the site. Since Grady is a major arteria access to it should generally be limited when possible. Access via a collector such as Raymond would provide both safe and efficient access to the site and protect the arterial function of Grady. The access to Grady from the subject site should, therefore, be eliminated. 5. The pr posed improvement of Grady Way will benefit the applicant since traffic genera ed by the subject site will more than likely utilize Grady Way for ultimate access. Therefore, the applicant will be required to participate in any improvements propos d and approved by the City Council for that roadway. Covenants to that effect will be equired. 6. As indi ated above, the applicant will have to provide additional landscaping along the periphe y of the subject site and within the large parking lot. The landscaping will be subject to approval of the City's landscape architect. The plans for all required landscaping must be submitted for review. A deferral, if granted for the Grady frontage, will require the submission of such plans. DECISION The site plan is approved subject to the following conditions: 1. The driveway along Grady Way S.W. will be eliminated. 2. Landscape plans for the entire site shall be approved by the landscape architect of the City and shall include the required landscaping along Grady Way and within the parking lot. The proposed structure is two stories over a basement which is utilized as a parking garage. The building is setback 20 feet from the property along S.W. Grady Way and is actually approximately an additional 20 feet back of the piesent curb. The parking lot, located on the western half of the property, has 10 feet-of landscaping showing adjacent to both S.W. Grady Way and Rleymond Avenue S.W. 4. The landscape plans, as submitted, do not show landscaping on the public right-of-way adjacent to S.W. Grady Way. These areas will have to be landscaped and plans should be approved by the Landscape Architect along with the building plans. However, because this segment of Grady Way will undergo construction within the near future, it is suggested that a deferral from the Board of Public Works be requested by the applicant. 5. The on-site parking, outside of the parking underneath the building, comprises an area of approximately 11,000 square feet including all access and paved areas. However, the landscape plan does not show the required 5°' interior landscaping for any parking lot exceeding 10,000 square feet in area. Thp site plan shows angle parking which would allow access off of Raymond Avenue S.W. and then exiting to the east of the subject site through the alley to Seneca Avenue S.W. Since the applicant is proposing using a public alley as part of their circulation, the entire length of the alley should be paved and storm drainage installed per City requirements. 7. The Building Division, Policy Development Department, and Park Department hale all recommended approval of the project. The Fire Prevention Bureau, E Igineering Division, and Police Department recommend approval with conditions. The Fire Prevention Bureau believes that the alleyway should be improved and that the applicant should participate in street improvements to R ymond Avenue S.W.' and S.W. Grady Way. The details of the water system can be worked out at the time of building permit application. The E gineering Division points to the fact that an on-site storm water retention/detention system is required and that all plans and profiles of ofir-site improvements are to be done by a licensed civil engineer. The Police Department recommends that no left turns be permitted out of the subject sit onto S.W. Grady Way. Both the Utilities Division and Traffic Division ha a not approved the proposal. They have not stated why the proposal should be denied, but they have, instead, listed a series of requirements. 8. The Environmental Review Committee has issued a Memorandum of Concurrence corresponding to the underlying Declaration of Non-significance fok the rezone on the subject site. M. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the site approval request, file SA-1043-84, be approved subject to the following conditions: 1.
