SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval as submitted Hearing Examiner Decision: Approved. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT:received by the Examiner on June 5, 1984. PUBLIC HEARING: t After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public he ring on the subject as follows: The hearing was opened on JUne 19, 1984 in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. - The following exhibits were entered into the record: Exhibit #1 - Yellow file Exhibit #2 - Site Plan The Hearing Examiner opened the hearing at 9:02 a.m.. Roger Blaylock, Zoning Administrator was called upon to review the proposal. Mr. Blaylock' presented the Examiner with a copy of written comments from the Police Department and asked that they be entered into and made a part of the file. Proceeding with his review of the proposal, Mr. Blaylock, utilizing the Site Plan, outlined the proposed improvements to be made at Earlington Park. Special emphasis was placed on the efforts of the Parks Department and the vigorous planning efforts witFi the neighbors in regard to the design. It was noted that there have been several public hearings on this project. At this time ;there is"no plan to add additional parking as this is a neighbo hood park and not designed to draw people from outside the general area. Mr. Blaylock stated he feels the pro osal meets with the intent of the city's Comprehensive Use Plan for the city and recommended approval. At this point in the hearing the Examiner called for testimony from the applicant or their representative. Responding was: Ronald Heiret Parks Superintendent 200 Mill Avenue South Renton, Washington, 98055 Mr. Heiret stated he is the Project Manager for this project. He said he has received extensive input from the public and requested approval as presented. The Examiner called for further testimony for or against this proposal. There being no on else wishing to speak, the hearing was closed at 9:10 a.m: FINDINGS, CONCLUSIONS'& DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the followi g: FINDINGS: 1. The applicant, City of Renton, Parks and Recreation Department, filed a request for approval of a site plan for improvements for Earlington Park. A. CITY OF RENTON PARKS _ D RECREATION DEPT. FILE NO: SA-052-84 June 27, 1984 Page 2 2. The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent docum nts was entered into the record as Exhibit #1. City of Renton's Environmental Ordinance and SEPA (RCW 43.? 1C3. Pursuant to the 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the subject proposal from any member of the public. 6. The sutlject site is located along the east side of Thomas Avenue S.W. at the 200 block. 1 7. The sullject site is part of the original town site of the City of Renton. The site has been r. zoned P-1 (Public/Quasi- Public) since the adoption of the zoning code. 8. Property, whether public or private, located in the P-1 zone is subject to site plan review at a public hearing. 1 I 9. The Parks Department proposes adding to the existing basketball court, play equipment and picnic area, a catch basin, half street improvements including curbs and gutters, additional landscaping, an asphalt path, picnic shelter and an exercise station. 10. The park is generally surrounded by single family homes. The approximately 1.5 acre park is considered a neighborhood park and most of its facilities are low-key in nature. 11. The pr posed plan wa reviewed after extensive community planning efforts and public meetings. 12. No new parking is proposed in line with the limited neighborhood the park is to serve. CONCLUSIO S 1. The pr posed plan appears to serve the public use and interest.. The plan was thoroughly reviewed in a community planning process and there was no opposition to the plan. 2. The n ture of the improvements, a mix of recreational improvements, aesthetic improvements, and off-site improvements will not adversely affect city operations, nor should there be any impact on the neighboring residents. 3. The neighborhood park also is not intended to draw users from a wide area and ther:foreparkingshouldnotbeaproblem, nor generally traffic in this residential area. DECISION The site plan s approved. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of pew evidence, which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examinerl's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner inay, after review of the record, take further action as he d ems proper. An appeal to the City Council is governed by Title IV, Section 3016, which. requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting ther specified requirements. Copies of this ordinance are available for inspection or purchase i the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex. parte (private one-on-one) communicate ns may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing.Examiner and members of the City Council. All communi ations concerning the the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation o the request by the Court. The total estimated cost will be approximately $50,000 for the refurbishing of this neighborhood park. 2. The proposal complies with the Comprehensive Plan designation of Recreational and the existing P-1 Public Use zoning. 3. The Parks and Recreation Department has held a series of public hearings to discuss the modification of the Earlington Neighborhood Park. The intent of the plan is to upgrade the facility to new urban design standards for park facilities. Heavy new perimeter landscaping-will buffer the park from the adjacent uses and, at the same time, new drainage systems for storm water will be installed to alleviate some of the standing water problems on the subject site. Pasisive recreation is blended in with new benches around the proposed eight-foot wide asphalt jogging trail which will run around the perimeter of the site. This active jogging trail is then blended in with proposed exercise equipment on the west side of the park adjacent to Thomas Avenue S.W. In addition, two new 12 by 12 picnic shelters will be added to provide covered picnic facilities adjacent to the children's play equipment in the south central portion of the site. No new parking is proposed in the remodel because the facility is "a neighborhood park." The demand of this 1.5 acre parcel should be directed only to the immediate neighborhood as proposed to the;Comprehensive Park and Recreation Plan. 4. , All of the departments have recommended approval of the site plan request subject to the standard off-site improvements which would require curbs, glitters, sidewalk, asphalt paving, and street lighting. It is not anticipated, at this time, that additional street lighting will be provided but lighting will be iflcluded on-site itselt. M. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the Hearing Examiner approve the site -plan request, file SA-052-84, by the City of Renton Parks Department to make improvements to Earlington Neighborhood Park as submitted. ly . Earlingt n Neighborhood Park is an existing pocket park located on the 200 block of Thomas Avenue Southwest. The 11 acre park is zoned P-1. The park primaril serves neighborhood residents. The proposed park improvements are being fu ded by King'County Forward Thrust funds. 'ortysix)thousand ,seven hundred inety dollars ($46,790.00) in Forward Thrust funds have been earmarked specific sly for Earlington Neighborhood Park. The impr vements sought under this application reflect the desires and perceive park needsof the Earlington Neighborhood residents. Public input and resp nse was solicited at two public meetings on March 22 and April 4th. Notices f these meeting were posted near the park and surrounding neighbor- hood,pub ished in the Record Chronicle, and leaflets were handed out n the neig boyhood. The first meeting asked residents what improvements they thought ould be most beneficial, and the second meeting presented a park improvem nt plan incorporating input from the previous meeting. The plan was well rec ived by the public. A prelim nary cost estimate of $50,000.00 had been placed on the improvements shown in the plan,which is slightly over budget. Therefore, it was asked that resident prioritizethe improvements. It was indicated that street and curb improvements would probably be required and so must be given first priority.
