PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with
11 the application, and field checking the property and
surrounding area, the Examiner conducted a public
hearing on the subject as follows:
The hearing was opened on July 3, 1984, at 9:50 a.m. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.

Hearing was opened and Roger Blaylock, Zoning Administrator presented the staff report
for this 'proposal. He stated the property is surrounded by the Koll Business Park.
Utilities ;in the area are sufficient to. support either a manufacturing or retail business. 1
The proposed; rezone would allow a broader use for the area, which in turn will produce
more traffic Mr. Blaylock pointed out that prior to the development of any of this area,
the City i ha" entered into access agreements with the State of Washington. There are ;
limitations •n controlling the intersection to this property. There are to be no driveways
within the northern 500 feet along East Valley Highway and within the eastern 300 feet of I
S.W. 41 sf St eet. The application shows a new curb cut which is felt to be in violation of l
the City's a•reement with the State. Access to the site is limited due to the location of
SR-167. pDis ussion by Mr. Blaylock and the Examiner ensued regarding the changes in the
subject are. - changes such as commercial activity, improvements to major arterials,!
S.W. 43rd Street improvements and East Valley Highway improvements as they relate to',
this proposa . It was stated that the whole area surrounding subject site has gone ahead;
with the; d=velopment scheme that was originally proposed. Mr. Blaylock stated thej

because the amendment to the Comprehensive Plan has not been adopted by the City;
Council. Be ause the applicant is referring to the potential under the new Comprehensive,
Plan, it is suggested that site plan approval should be a requirement.

e Examiner inquired of Mr. Blaylock why the applicant does not just go ahead and build
mmercial uses on the site as they are permitted under the manufacturing park zone -
s ating the property to the south has already been developed that way. Mr. Blaylock's
sponse was that the B-1 zone is more restrictive, the potential changes in the
lanufacturing park zone did not give the applicant specific guarantees for their project,
d continued use, so they are applying for the B-1 zone.
r. Blaylock also stated the applicant could apply, for a building permit, but they are not
that stage right now. Mr. Blaylock stated he did not feel he could make a formal
rr commendation to the Examiner on this application without specific policy in the

comprehensive Plan. He noted in the past where there were other supporting policies
sed on buffers and other concerns, they have used policies to support a rezone request
here it appears to be in the general intent. In this instance, there is no policy suggested
i the Comprehensive Plan. He stated the Short Plat is a separate issue. If limited access

a'proved. Koll Business Park was previously approved under the agreement concept and

Mr. Gordon is a representative of the real estate department from Taco Time Company.
e stated at one time their company took an option to buy the subject property Ialong with
a package deal of other sites. The main problem with this property is the access. He had
d:veloped traffic information and feels he needs to get with traffic engineers to see if he
c:n put together some sort of access that will work for this site. Mr. Gordon referred to
a I Deed (#8002110471) which restricted access, and read part. of this Deed for the
E) aminer. He said his company could find no other recordings restricting access off of
E ,st Valley Highway. He referred to a letter from the Department of Transportation
r Ngarding the limited access areas and stated his concern is, according to traffic
i formation on hand, how to get people out of that area during peak hours.
At this point in the hearing the Examiner stated it was obvious Mr. Gordon had
i Formation staff had not had an opportunity to review and suggested that this hearing be
ci ntinued to allow time for review and to clear up other areas of concern.
r. Gordon wanted to address the issue of M-P zoning vs. B-1 zoning as his company's
p oposition would'probably include one or two fast food restaurants to be located on the
ri«ht side of East Valley Highway.
A•ain.the Examiner suggested a continuance.to allow staff to review the new information
p Bsented on the access and short plat. He stated the short plat could be approved
in•ependent of the rezone request. The Zoning Administrator concurred and the matter
w:s rescheduled for July 17, 1984. The hearing was closed at 10:20 a.m.
J ly 17, 1984 - 10:05 a.m.:
T Examiner opened the hearing on this continued proposal and, entered into the record a
le ter: from Roger Blaylock, Zoning Administrator, indicating his . department's
r-commendation to deny.this request. This was their original recommendation at the July
3, 1984 hearing. Mr. Blaylock stated that the original plan for Koll Industrial Park was the
o•:imum plat design proposal 'because of limited access and the short plat as proposed
would be an intrusion and be in violation of the agreement between the State and City of
Renton.
M . Tom Gordon, who spoke at the last hearing, again spoke on the proposal. He asked the
E =miner and Zoning Administrator for some kind of direction to assist him in deciding
h• to proceed with this proposal. He said he does not want to invest in .the expense of a
tr:ffic study only to find that there is no way the State or the City is going to consider his
fi dings. Mr. Gordon said he could not . find a deed where the Department of
T .:nsportation ever bought access on S.W. 41st Street. The uses he is proposing will not
go on this property without a curb cut on East Valley Highway.. He said he is hesitant to
d %ign a curb cut because it may not meet the criteria of the D.O.T.

At this point the Hearing Examiner asked Mr. Gordon if he wanted him to consider; the
Rezone request and the Short Plat request together, or if he still wanted the Rezone to be
continued until the previously discussed time in October. Mr. Gordon, after much
discussion with the Examiner and Zoning Administrator, stated he wished the applications
to be considered as submitted, together. Mr. Blaylock shared concerns regarding the
approval!of a short plat that the applicant may not be able to build upon.
Mr. Gordon stated that he felt his only solution to the access problem would be for him to
create another lane with extruded curbing. He said he is very flexible on the boundaries
and could cut the proposal to two lots.
The Examiner asked that the record reflect there was no one else present to testify for Idr
against this proposal and called for final comment from Roger Blaylock. Mr. Blaylock
said he still feels the applicant has not shown it is a safe or appropriate Short Plat request
and does not want the burden of approval to rest with the State because access in;this
area is a';critical problem.
The hearing was closed at 10:20 A.M.
FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the record in this matter, the Examiner now makes and enters the
following:
FINDINGS:
1. The applicant, Edward A. McHugh, filed a request for approval of a rezone of
approximately 1.36 acres of property from M-P (Manufacturing Park) to B 1,
together with a three lot short plat.
2. The application file containing the application, the State Environmental Policy
Act (SEPA) documentation, the Building and Zoning Department Report, and
other pertinent documents was entered into the record as Exhibit #1.
3. 1, Pursuant to the City of Renton's Environmental Ordinance and SEPA (RGW
43.21C, 1971, as amended), a Declaration of Non- Significance has been issued
for the subject proposal by the Environmental Review Committee (ERG),responsible official.
4. Plans for the proposal have been reviewed by all city'departments affected by
the impact of this development.
5. The subject site is located at the southwest corner of S.W. 41st Street and the
East Valley Road.
6. The subject site was annexed into the City by Ordinance 1745 in April of 1959,
as amended by Ordinances 1764 and 1928. The site was automatically zoned G
General; Single Family Residential upon annexation). The site was..reclassified
to M-P, it's current designation, in December of 1969 and March of 1976 by
Ordinances 2533 and 3016. respectively. The property has been previously
platted by the applicant's predecessor in interest.
7. 1, The subject site is relatively flat, covered with grasses and is currently
f undeveloped.
8. I The subject site is located immediately southwest of the S.W. 41st Street
off-ramp of 'the Valley Freeway (SR-167). Restrictions by deed, by agreement
f and by imposition of the ERC have eliminated access rights to the subject[site
along the East Valley Road, its easterly property line, and for 300 feet along
S.W. 41st, its northerly property line.
9. Access to the site is provided by the existing platting and street arrangement atl
the northwest corner of the site at S.W. 41st St. by a series of curb cuts.,The j
11 original Koll plat abided by the limited access rights of the subject site.
10. The map element of the Comprehensive Plan designates the area in which the
subject site is located as suitable for the development of manufacturing park,
type uses but does not mandate such development without consideration of
other policies of the plan:
11. The City is in the process of updating the Comprehensive Plan for the entire
Green River Valley but has not adopted any changes to the existing plan.

1 .. The areas north of the subject site remain undeveloped, while the Koll
Industrial Park, of which the subject site is one lot, is located south and west of
the subject site. A variety of uses are located across the East Valley Road.
1 :. The Comprehensive Plan for the area, limited as it is to manufacturing park
type uses, is intended to discourage retail trade in an area which is supposed to
be reserved for large tractor trailer deliveries and pickups, through traffic, and
generally manufacturing types of operations.
1 M-P zoning surrounds the subject site on three sides, north, west and south.
The East Valley Road serves to separate the M-P district from the L-1 (Light
Industry)'district located on the east side of the East Valley Road. There is no
B-1 (Business/Commercial) zoning in the vicinity of the subject site.
1 . The Koll uses all observe the M-P zone setbacks from the street right-of-way.
The landscaping also meets the code requirements for the M-P zone. Any uses
north of the subject site will also have to observe the generous setbacks and
landscaping requirements of the M-P zone.
1 The applicant proposes a rezone of the site to B-1 along with a three lot
subdivision. The three lots would be approximately 22,907 sq ft, 19,700 sq ft
and 16,800 sq ft respectively. The imposition of the M-P setbacks and
landscaping provisions on lots of this size could potentially reduce the
developable area to half, whereas the existing lot would not be so limited.
1... A traffic analysis for the ultimate uses was not available The traffic generated
by the use of the lot fronting on S.W. 41st and the East Valley was estimated as
considerably in excess of manufacturing uses because the applicant proposes
establishing a "fast food" restaurant in that location which generates large
traffic volumes.
CsNCLUSIONS
REZONE
1 The proponent of a rezone must demonstrate that the request is in the public
interest, will not impair the public health, safety and welfare and in addition, is
in compliance with at least one of the three criteria found in Section 4-3010,
which provides in part that:
a. The subject site has not been considered in a previous area-wide
rezone or land use analysis; or
b. The subject site is potentially designated for the new classification per
the Comprehensive Plan; or
c. There has been a material and substantial change in the circumstances
in the area in which the subject site is located since the last rezoning
of the property or area.
T e applicant has failed to demonstrate that the proposed rezone is appropriate.
2 The approval of B-1 zoning not only would be inconsistent with the present
designation for the area of Manufacturing Park in the Comprehensive Plan, but
would also establish an inconsistent setback margin along the west side of the
East Valley Rd. While the Koll development maintains a 60 foot setback the
B-1 zone would provide a lesser standard and intrude into the spacious setbacks
now existing. It would also be inconsistent with future development on the M-P
property to the north.
3 The B-1 zoning requested would also break the homogeneous manufacturing
park district and provide a relatively small island of B-1 zoning in this area. It
would also allow, and actually limit to, the establishment of retail uses in an
area now designated for manufacturing park type uses. While some retail and
commercial uses have located on some of the properties, the larger setbacks
and landscaping have been an effective deterrent to large scale retail and strip
development in the Green River,Valley. The M-P zone permits fewer curb cuts
and requires that they be larger. Each of these factors work to encourage
appropriate development and discourage retail uses. A reclassification would
thwart the goals of the Comprehensive Plan for this area.

4. The current zoning also does not preclude the establishment of business and
co mercial uses on the subject site. The M-P zoning just assures that they
con orm to the setback and landscaping provisions of the M-P zone so that all
use in the valley present an aesthetic appearance, enhance the City's image
and attract similarly well designed facilities.
5. Whi e the City is considering various changes to the Comprehensive Plan such
stu•ies are not yet law and, therefore, are subject to substantial modifications
and cannot be utilized at this time.
6. The City Council should, therefore, deny the requested reclassification of the
Isub ect site from M-P to B-1.
SHORT PLAT
7. The proposed short plat, while not completely dependent upon a rezoning of the
sub ect site, is affected by setback limitations which would appear to warrant a
den al of the short plat. The various restrictions on curb cuts necessitated by
the close proximity of the SR-167 interchange also mandate a denial of the plat
as -ubmitted.
8. 1'Thz. subject site was part of an earlier division of property which was designed
Ito :ccommodate -the setbacks required by the M-P zone, and the curb cut
lim tations because of the proximity of the SR-167 interchange. The lot was,
I!and is, spacious enough to accommodate the landscaping and setbacks required
hin he M-P district without adversely reducing the reasonable use of the subject
sit=. The smaller lots and their respective width to length ratios do not appear
cap-ble of providing the setbacks mandated by the zoning code for an M-P lot.
9. jiTh= access limitations imposed by the state, the deed, and the City, would
pre lude access to at least one of the lots from a public street and might
lady-rsely affect a second lot in a similar fashion. Therefore, the configuration
sug!ested is an inappropriate short plat and must be denied.
RECOMMENDATION
The City Cou cil should deny the request to reclassify the subject site from M-P to B-1.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be
filed in writing on or before August 13, 1984. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available at the
p.'ior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the Examiner's decision. This request shall set forth the specific
e rors relied upon by such appellant, and the Examiner may, after review of the record,
take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting
o:her specified requirements. Copies of this ordinance are available for inspection or
purchase in the Finance Department, first floor of City Hall.
T le Appearance of Fairness Doctrine provides that no ex parte (private one-on-one)
communications may occur concerning land use. decisions. This means that parties to a
land use decision may not communicate in private with any decision-maker concerning the
p oposal. Decision-makers in the land use process include both the Hearing Examiner and
embers of the City Council.
All communications concerning the the proposal must be made in public. This permits all
i terested parties to know the contents of the communication and would allow them to
o')enly rebut the evidence. Any violation of this doctrine would result in the invalidation
o'' the request by the Court.
The Doctrine applies not only, to the initial public hearing but to all Requests for
aconsideration as well as Appeals to the City Council.

Report, examining available information on file with
the application, and field checking the property and
surrounding area, the Examiner conducted a public
hearing on the subject as follows:
The hearing as opened on July 3, 1984, at 9:50 a.m. in the Council Chambers of the
Renton Muni•ipal Building. Parties wishing to testify were affirmed by the Examiner.

Hearing viias •pened and Roger Blaylock, Zoning Administrator presented the staff report
for this Jiro•osal. He stated the property is surrounded by the Koll Business Park.
Utilities in t e area are sufficient to. support either a manufacturing or retail business.
The proposed rezone would allow a broader use for the area, which in turn will produce
more traffic. Mr. Blaylock pointed out that prior to the development of any of this areal,
the City had entered into access agreements with the State of Washington. There are
limitations o r.controlling the intersection to this property. There are to be no driveways
within the] no them 500 feet along East Valley Highway and within the eastern 300 feet of
S.W. 41st `;Str et. The application shows a new curb cut which is felt to be in violation of
the City's; ag eement with the State. Access to the site is limited due to the location of
SR-167. Disc ssion by Mr. Blaylock and the Examiner ensued regarding the changes in the
subject area - changes such as commercial activity, improvements to major arterials,
S.W. 43rd !Str-et improvements and East Valley Highway improvements as they relate to
this proposal. It was stated that the whole area surrounding subject site has gone ahead
with theiev-lopment scheme 'that was originally proposed. Mr. Blaylock stated the
rezone of th s property from manufacturing to retail commercial may be premature
because the -mendment to the Comprehensive Plan has not been adopted by the City
Council. 13ec•:use the applicant is referring to the potential under the new Comprehensive
Plan, it is,suglested that site plan approval should be a requirement.

The Examin.r inquired of Mr. Blaylock why the applicant does not just go ahead and build
commercial ses on the site as they are permitted under the manufacturing park zone (-
stating the •roperty to the south has already been developed that way. Mr. Blaylock's
response `Iwa- that the B-1 zone is more restrictive, the potential changes in the
manufacturi g park zone did not give the applicant specific guarantees for their project,
and continue• use, so they are applying for the B-1 zone.
Mr. Blayl'pck also stated the applicant could apply for a building permit, but they are not
at that stag: right now. Mr. Blaylock stated he did not feel he could make a formal
recomme p da lion to the Examiner on this application without specific policy in ithe
Comprehensi e Plan. He noted in the past where there were other supporting policies
based on 'buf ers and other concerns, they have used policies to support a rezone request
where it app:ars to be in the general intent. In this instance, there is no policy suggested
in the Cofnp ehensive Plan. He stated the Short Plat is a separate issue. If limited access
agreements •etween the City and the State are correct, the plat as proposed cannot be
approved.; K•11 Business Park was previously approved under the agreement concept and
access was 1 mited. He recommended the rezone request be continued until October 30,
1984 to allo the City. Council time to review the proposed amendment to the Valley
Comprehensi e Plan. The Planning Commission has now recommended the Valley Plan to
the City Cou cil.
The Hearing. xaminer asked if the applicant or his representative was present to testify.

Mr. Gordon i a representative of the real estate department from Taco Time Company.
He stated at •ne time their company took an option to buy the subject property along with
a package,'de of other sites. The main problem with this property is the access. He had
developed,'(tra fic information and feels he needs to get with traffic engineers to see if he
can put toge+her some sort of access that will work for this site. Mr. Gordon referred to
a Deed (#8.02110471) which restricted access, and read part of this Deed for the
Examiner.''I H- said his company could find no other recordings restricting access off of
East Valley ighway. He referred to a letter from the Department of Transportation
regarding;1 the limited access areas and stated his concern is, according to traffic
information o hand, how to get people out of that area during peak hours.
At this poin in the hearing the Examiner stated it was. obvious Mr. Gordon had
information s aff had not had an opportunity to review and suggested that this hearing be
continued Ito allow time for review and to clear up other areas of concern.

Mr. Gordon anted to address the issue of M-P zoning vs. B-1 zoning as his company's
proposition w uld probably include one or two fast food restaurants to be located on the
right side 'of ast Valley Highway.
Again the!Ex miner suggested a continuance to allow staff to review the new information
presented on the access and short plat. He stated the short plat could be approved
independent f the rezone request. The Zoning Administrator concurred and the matter,
was reschedul d for July 17, 1984'. The hearing was closed at 10:20 a.m.
July 17, 1984 - 10:05 a.m.:
The Examiner opened the hearing on this continued proposal and,,entered into the record a
letter from Roger . Blaylock, Zoning Administrator, indicating his department's
recornmen'dat'on to deny this request. This was their original recommendation at the July,
3, 1984 hearin . Mr. Blaylock stated that the original plan for Koll Industrial Park was the
optimum plat design proposal because of limited access and the short plat as proposed
would be an i trusion and be in violation of the agreement between the State and City of
Renton.
Mr. Tom Cord.n, who spoke at the last hearing, again spoke on the proposal. He asked the
Examiner and Zoning Administrator for some kind of direction to assist him in deciding
how to procee..with this proposal. He said he does not want to invest in the expense of a
traffic study •my to find that there is no way the State or the City is going to consider his
findings. 'IMr. Gordon said he could not find a deed where the Department of
Transportatio ever bought access on S.W. 41st Street. The uses he is proposing will not
go on this '(pro.erty without a curb cut on East Valley Highway. He said he is hesitant to'
design a curb +ut because it may not meet the criteria of the D.O.T.

At this p,oin the Hearing Examiner asked Mr. Gordon if he wanted him to consider the
Rezone rqu-st and the Short Plat request together, or if he still wanted the Rezone to be
continued u til the previously discussed time in October. Mr. Gordon, after much
discussion w th the Examiner and Zoning Administrator, stated he wished the applications
to be consi•ered as submitted, together. Mr. Blaylock shared concerns regarding the
approval :of - short plat that the applicant may not be able to build upon.
Mr. Gordon -tated that he felt his only solution to the access problem would be for him to
create anoth-r lane with extruded curbing. He said he is very flexible on the boundaries
and could cu' the proposal to two lots:
The Examine asked that the record reflect there was no one else present to testify for or
against this proposal and called for final comment from Roger Blaylock. Mr. Blaylock
said he still eels the applicant has not shown it is a safe or appropriate Short Plat request
and does not want the burden of approval to rest with the State because access in this
area is a crit cal problem.
The hearing as closed at 10:20 A.M.
FINDINGS •ONCLUSIONS & DECISION:
Having revi-wed the record in this matter, the Examiner now makes and enters the
following:
FINDINGS:
1. I Th- applicant, Edward A. McHugh, filed a request for approval of a rezone of
approximately 1.36 acres of property from M-P (Manufacturing Park) to B-1,
to ether with a three lot short plat.
2. i Th: application file containing the application, the State Environmental Policy
Ac (SEPA) documentation, the Building and Zoning Department Report, and
of er pertinent documents was entered into the record as Exhibit #1.
3. Pu suant to the City of Renton's Environmental Ordinance and SEPA (RCW
143.f 1C, 1971, as amended), a Declaration of Non- Significance has been issued
for the subject proposal by the Environmental Review Committee (ERC),
responsible official.
4. iPla s for the proposal have been reviewed by all city departments affected by
the impact of this development.
5. Th: subject site is located at the southwest corner of S.W. 41st Street and the
Ea t Valley Road.
6. I'Th- subject site was annexed into the City by Ordinance 1745 in April of 1959,
as .mended by Ordinances 1764 and 1928. The site was automatically zoned G
G:neral; Single Family Residential upon annexation). The site was reclassified
to -P, it's current designation, in December of 1969 and March of 1976 by
Ordinances 2533 and 3016. respectively. The property has been previously
pla ted by the applicant's predecessor in interest.
7. Th= subject site is relatively flat, covered with grasses and is currently
undeveloped.
8. Th subject site is located immediately southwest of the S.W. 41st Street
off ramp of the Valley Freeway (SR-167). Restrictions by deed, by agreement
hand by imposition of the ERC have eliminated access rights to the subject site
alo g the East Valley Road, its easterly property line, and for 300 feet along
IS. . 41st, its northerly property line.
9. Ac ess to the site is provided by the existing platting and street arrangement at
the northwest corner :of the site at S.W. 41st St. by a series of curb cuts. The
ori inal Koll plat abided by the limited access rights of the subject site.
10. Thel map element of the Comprehensive Plan designates the area in which thesubectsiteislocatedassuitableforthedevelopmentofmanufacturingpark
typ uses but does not mandate such development without consideration of
oth r policies of the plan.
11. The City is in the process of updating the Comprehensive Plan ,for the entire
Gre n River Valley but has not adopted any changes to the existing plan.

12. T e areas north of the subject site remain undeveloped, while the Koll
In ustrial Park, of which the subject site is one lot, is located south and west of
th subject site. A variety of uses are located across the East Valley Road.
12. T e Comprehensive Plan for the area, limited as it is to manufacturing park
ty e uses, is intended to discourage retail trade in an area which is supposed to
be reserved for large tractor trailer deliveries and pickups, through traffic,,and
ge erally manufacturing types of operations.
13. M P zoning surrounds the subject site on three sides, north, west and south.
Th East Valley Road serves to separate the M-P district from the L-1 (Light
In ustry) district located on the east side of the East Valley Road. There is no
B-1 (Business/Commercial) zoning in the vicinity of the subject site.
14. Th Koll uses all observe the M-P zone setbacks from the street right-of-way.
Th landscaping also meets the code requirements for the M-P zone. Any uses
no th of the subject site will also have to observe the generous setbacks and
I la dscaping requirements of the M-P zone.
15. Th applicant proposes a rezone of the site to B-1 along with a three lot
su division. The three lots would be approximately 22,907 sq ft, 19,700 sq ft
an 16,800 sq ft respectively. The imposition of the M-P setbacks and
la dscaping provisions on lots of this size could potentially reduce the
de elopable area to half, whereas the existing lot would not be so limited.
16. A raffic analysis for the ultimate uses was not available The traffic generated
by the use of the lot fronting on S.W. 41st and the East Valley was estimated as

CONCLUSIO S
REZONE
1. Th proponent of a rezone must demonstrate that the request is in the public
int-rest, will not impair the public health, safety and welfare and in addition, is
in ompliance with at least one of the three criteria found in Section 4-3010,
d wh ch provides in part that:
a. The subject site has not been considered in a previous area-wide
rezone or land use analysis; or
b. The subject site is potentially designated for the new classification per
the Comprehensive Plan; or
sic. There has been a material and substantial change in the circumstances
in the area in which the subject site is located since the last rezoning
of the property or area.
The applicant has failed to demonstrate that the proposed rezone is appropriate.
2. • 1Th- approval of B-1 zoning not only would be inconsistent with the present
des gnation for the area of Manufacturing Park in the Comprehensive Plan, but
two ld also establish an inconsistent setback margin along the west side of the
Eas Valley Rd. While the Koll development maintains a 60 foot setback the
IB-1 zone would provide a lesser standard and intrude into the spacious setbacks
ono existing. It would also be inconsistent with future development on the M-P
pro erty to the north.
3. Th B-1 zoning requested would also break the homogeneous manufacturing
par district and provide a relatively small island of B-1 zoning in this area. It
would also allow, and actually limit to, the establishment of retail uses in an
area now designated for manufacturing park type uses. While some retail and
ommercial uses have located on some of the properties, the larger setbacks
and landscaping have been an effective deterrent to large scale retail and strip
dev lopment in the Green River Valley. The M-P zone permits fewer curb cuts
and requires that they be larger. Each of these factors work to encourage
al pp opriate development and discourage retail uses. A reclassification would
th rt the goals of the Comprehensive Plan for this area.

co mercial uses on the subject site. The M-P zoning just assures that they
co form to the setback and landscaping provisions of the M-P zone so that all
us-s in the valley present an aesthetic appearance, enhance the City's image

st dies are not yet law and, therefore, are subject to substantial modifications '

SHORT PLAT
7. Th- proposed short plat, while not completely dependent upon a rezoning of the
su•ject site, is affected by setback limitations which would appear to warrant la
de ial of the short plat. The various restrictions on curb cuts necessitated by
1 the close proximity of the SR-167 interchange also mandate a denial of the plat
as -ubmitted.

8. Th: subject site was part of an earlier division of property which was designed
to accommodate the setbacks required by the M-P zone, and the curb cut
li itations because of the proximity of the SR-167 interchange. The lot was,
an. is, spacious enough to accommodate the landscaping and setbacks required
in he M-P district without adversely reducing the reasonable use of the subject
sit:. The"smaller lots and their respective width to length ratios do not appear
ca.able of providing the setbacks mandated by the zoning code for an M-P lot.
9. ITh: access limitations imposed by the state, the deed, and the City, would
preclude access to at least one of the lots from a public street and might
adv{ersely affect a second lot in a similar fashion. Therefore, the configuration
sug.ested is an inappropriate short plat and must be denied.
RECOMMEN n ATION
The City Cou cil should deny the request to reclassify the subject site from M-P to B-1.
DECISION

The s bject site was annexed into the City of Renton by Ordinance #1745 of April
14; 1 59, which was later corrected by Ordinance #1764 of May 19, 1959 and
Ordin nce #1928 of December 12, 1961, at which time the property was zoned

overflow is a severe hazard. This soil is used for row crops, pasture, and hay.

adverse impacts on; the environment or adjacent properties for the proposed
r zone request. They have informed the applicant that per State of
ashington and City of Renton agreements (CAG024-81) and (GC-6317),
t ere is controlled ;and limited access to the intersection of S.W. 41st Street
and East Valley Road. In addition, there will be no driveways within the
eastern 300 feet of the subject property along S.W. 41st Street and there
shall be no driveways within the northern 500 feet of the subject property '
long East Valley Road. Access to the subject site is critical and limited
ecause of the location of the access to SR-167.
REZONE:

zone request are' adequate to recommend approval of the reclassification.

That substantial evidence was presented demonstrating the subject
reclassification appears"not to have been specifically considered at the
time of the last area land use analysis and area zoning.
The subject property was annexed into the city in 1959 and rezoned t'o
the Manufacturing Park classification in 1969 and 1976. Both the
city-wide Comprehensive Plan adopted in 1965 and the Green River
Comprehensive Plan adopted in 1975, clearly show the area as
designated for Manufacturing Park activities. The proposed amendment
to the Valley Comprehensive Plan now show the area under
consideration;to be commercial in intent.

requested pursuant to the policies set forth in the Comprehensive Plan ;
and conditions have . been met which would indicate the change is
appropriate.
The proposed rezone to B-1,. Business Use, is not directly in
I conformance'1with the Comprehensive Land Use Element designation of
Manufacturing Park for the subject site. However, the adjacent uses
that have developed to the south of the subject site suggest more of a
business park type of development than those uses originally intended in
the Manufacturing Park as designated in 1976.

c. That since the last previous land use analysis of the area zoning of the
subject property, authorized public improvements, permitted private
development or other circumstances affecting the subject property
have undergone significant and material change.
Since 1975, the general area has undergone a substantial transition from
an undeveloped state to commercial and industrial activities. The
development of the property immediately to the south has been more
towards business park uses with the optimum type of commercial
activities allowed in, the Manufacturing Park zone. These would include
a restaurant, commercial recreational facilities, and more buyer
representative type of commercial activities instead of the typical light
industrial or manufacturing park uses. Development to the east of the
subject site has concentrated more on retail commercial activities such
as restaurants, car dealerships, taverns, and office buildings. These
specific development types suggest that the property may be more
appropriately classified as commercial use instead of the present
Manufacturing Park designation.
d. The final test to determine whether a rezone is appropriate is to
address the question of timeliness.
All utilities are available to the subject site whether it is developed in a
Manufacturing Park state or in a retail commercial development.
Several departments have expressed concern based upon the ultimate
and timed use of the subject property for commercial activities. To
assure compatability and reduction of potential impacts, it has been
suggested that site plan approval be required through the Hearing
Examiner process. The transitional trends clearly point in a direction
away from the theorized Manufacturing Park to more of a business
commercial type activity in this general area which is also suggested in
the potential amendments to the Valley Comprehensive Plan. The
rezoning of the subject property from Manufacturing Park to retail
commercial may be slightly premature primarily because the intent of
the pending Comprehensive Plan has not been adopted by the City
Council.
4. The Building Department clearly states that the proposal does not comply
with the Comprehensive Plan. This is also supported by the Policy
Development Department that states that the' applicant refers to the
potential" under the new proposed Valley Comprehensive Plan. In any case,.
they suggest that site plan approval should be a requirement prior to issuance
of any building permits for the site. They do suggest that the intent of the
proposed retail uses is consistent with adjacent land uses and will not create,
in their minds, a inappropriate interface with the development to the south or
east.
The Public Works' Department points to the fact that many of the original
utilities installed in the plat may have to be revised as needed to serve the
new parcels -proposed. Utilities Division recommends approval only of the
rezone at this time and reserving judgment on actual site development plans.
Both the Police Department and Parks Department recommend approval
without comm ent.
5. The Zoning Administrator takes special exception to the question of
timeliness and using a proposed Comprehensive Plan to support a rezone
request. Until a community decision is reached by the City Council on the
appropriateness of this area being retail, commercial in nature, it seems
totally inappropriate to set a precedence in this case without the support of
general policies in the existing Comprehensive Plan. The Building and Zoning
Department might support the rezone request after a decision is reached by
the City Council concerning the Comprehensive Plan.

6. The short plat, as proposed, shows three retail commercial lots approximately
2,0,000 square feet in size. No new access points are shown on S.W. 41st
Street, however, one new access point is shown on East Valley Highway.
Department comments concentrate on the fact that some revisions to
xisting improvements will have to be accomplished. The entire area was
i proved with the development of Koll Business Center.

est Valley Highway. Access to lots in commercial industrial is not allowed

M. DEPA TMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the rezone request, file
R-056 84, be continued Until Tuesday, October 30, 1984, to allow the City Council
approx mately four months for review of the pending amendments to the Valley ,
Cornpr=hensive Plan. The short plat request, file Sh. Pt.-057-84, should be
rejected for non-compliance with the subdivision 'code allowing access by
easem:nts and creation of a curb cut in violation of approved agreements between
the City of Renton and the State of Washington.

JUSTIFICATION OF
REZONE SWC S .W. 41st AND EAST VALLEY HIGHWAY
FOR MP TO B-1
Thank you for the opportunity to propose the rezone of the South-
west Corner of Southwest 41st and East Valley Highway.
Please note the property is potentially classified as commercial
in the proposed Comprehensive Plan.
We feel the proposed rezone is not materially detrimental to the
public welfare or the properties of other persons located in the
vicinity.
By allowing the rezone, the property could be developed to provide
retail stores and services which otherwise would make local patrons
travel much further to have these needs satisfied.
The types of uses we foresee are : 24-hour convenience store;
a bakery; video store; dry cleaner ; hamburger stand; print
shop ; beauty shop , etc .
Our rezone is necessary to properly short-plat the property. In
