APPLICANT: BURLING-ION NORTHERN RAILROAD PROPERTIES FILE NO. SP-006-85 LOCATION: Between S.W. 27th Street and S.W. 29th Street, approximately 800 feet east of Lind Avenue S.W. SUMMARY OF REQUEST: Approval of a special permit for fill and grade permit to allow 12,082 cubic yards of material to be placed as a fill pad for the future expansion of the Mystic Company SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval. Hearing Examiner Decision: Approved BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT:received by the Examiner on January 22, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on February 5, 1985, at 9:35 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were of firmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, posting information and other documents pertinent to this request. Exhibit #2 - Specific Engineering Drawing. The Zoning Administrator, Roger Blaylock presented the request before the Examiner. After placing the above exhibits into the record, Mr. Blaylock stated this property is just over 4 acres, known as Lot 10, and is zoned Manufacturing-Park. The property is vacant. The proposal is to take the preload material from the Mystic Company site (lot 11), and move it to Lot #10. The intent is for the applicant to expand his operation, at some time in the future, onto Lot 10. The Examiner questioned the requirement that fill be sloped and offset from the lot line, and questioned if this proposal would meet that requirement. Mr. Blaylock stated the property has been sloped and referred to Section 4-2314 stating because this property is under option the key issue would be to protect the safety and benefit of adjacent property. The safety of the adjacent property will not be endangered because the properties function together. The preload is to be used mostly to collect runoff from the site and direct it to the temporary erosion channel. From existing site to top of material there would probably be a 3 to 4-1/2 foot difference in height, with a fire lane at the existing grade. The fill has been held back from the fire lane sufficiently to allow approximately fifteen feet to the sedimentation control ditch before the pad starts. It was pointed out that Burlington Northern, owner of Lot #10, has agreed to the interface of the two properties and the connection of the sedimentation control, as required. The sedimentation control is basically being accomplished on Lot 10. Mr. Blaylock said Burlington Northern Railroad has granted to Mystic Company a right-of-entry as well as a separate option agreement to purchase the site. The Hearing Examiner stated he was a bit concerned over the fact that Lot 11 is being used by Burlington Northern Railroad for part of the sedimentation control and suggested that Mystic Company on Lot 11 should perhaps grant a right-of-entry to Burlington Northern. The material being moved is excess preload from the Mystic Company lot. The Public Works Department has asked that filter fabric instead of straw bales be used. Mr. Blaylock stated there are no other concerns with this proposal and advised that staff would recommend approval to the Examiner. BURLINGTON NORTHERN RAILROAD PROPERTIES, INC. Special Permit 006-85 February 13, 1985 Page 2 The Hearing Examiner called for testimony from the applicant or their representative. Wishing to testify was: Jerry Fleet, Architect Lance Mueller and Associates 130 Lakeside - Suite #F Seattle, Washington, 98122 Mr. Fleet expressed the desire for staff to permit Burlington Northern to place fill on Lot 11 as well as Lot 10. They have had to increase the amount of initial preload on Lot 11 because they need to begin building as soon as possible. The Fire Department has requested a fire lane down the east side of the building, and because of that request, the initial preload needs to extend out further on the east side of the building more than they had intended in order for them to preload the fire lane in the initial preload and then move the material over so they can begin construction. if they are not permitted to place some material on the property line they would have to bring in more initial preload. The Hearing Examiner asked Mr. Fleet to sketch a cross-section of the two lots on the blackboard. This was done, with Mr. Fleet's explanation of the proposed operation and the movement of the subject preload. The Examiner again expressed his concern in the fact that Lots 10 and 11 are under separate ownership, and even though they are being treated similarly by the applicant, there could be liability issues because Burlington Northern is using Lot 11 as a drainage channel and part of the fill material will overlap. He suggested a right-of-entry from Mystic Company back to Burlington Northern Railroad for use of the joint property. Mr. Fleet stated that erosion from the north, south and east will be entirely contained on Lot 10. The only erosion on the west would occur entirely on Lot 11, which is owned by Mystic Company. Again the Hearing Examiner reiterated his desire to have a right-of-entry agreement from Mystic Company to Burlington Northern Railroad for the entry of sedimentation onto their site. The Hearing Examiner called for further testimony in support of, or in opposition to this proposal. There being no one else in the audience to testify, and no further comments from staff, the hearing was closed at 10:00 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1.The applicant, Burlington Northern Railroad Properties, Inc., filed a request for approval of special permit to allow the placement of approximately 12,500 cubic yards of fill material to be placed on an approximately 4.25 acre site. 2.The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered into the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5.There was no opposition to the subject proposal from any member of the public. 6. The subject site is located between S.W. 27th Street and S.W. 29th Street, approximately 800 feet east of Lind Avenue S.W. 7.The site is essentially level, the result of the earlier fill operations in preparation for platting and development. The proposed fill is intended as preload material to compact existing soils and prepare a building pad for eventual construction. 8. The material will be moved from the adjoining westerly lot, and no additional truck traffic will be required. Bulldozers will merely redistribute the material. Special Permit 006-85 February 13, 1985 Page 3 9.The material will actually overlay portions of the adjoining site to the west, and approval of that property's owner has been secured. Drainage will also be jointly developed and controlled. 10. 1 he map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of manufacturing park/multiple option uses, but does not mandate such development without consideration of other policies of the plan. 11. 1 he subject site is zoned M-P, a classification adopted in December of 1969 by the enactment of Ordinance 2533. The site itself was annexed into the City by Ordinances 1745, 1764 and 1928 adopted in April and May of 1959, and December of 1961, respectively. CONCLUSIONS 1.The subject proposal appears to serve the public use and interest. 2.The applicant will be setting the stage for the ultimate development of the subject site, thereby providing additional development opportunities for new industry in the Valley. Utilities are available to the subject site and curbs, gutters and sidewalks are installed. 3. The movement of fill material between the subject site and its westerly neighbor will not adversely affect haul routes or peak hour traffic flows. Special Permit 006-85 February 13, 1985 Page 4 The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. •1 his means that parties to a land use decision may not communicate in private with any decision--maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. DEPARTMENT ANALYSIS: 1.The applicant, Burlington Northern Railroad Properties, Inc./Trans-Rim Enterprises, LTD., is requesting a special permit for fill and grade to allow the placement of approximately 12,000 cubic yards of material to utilized preload for the expansion of the Mystic Company onto an adjacent 4.25 acre lot. 2.The applicant presently has pending site plan approval on an adjacent 4.3 acre site to develop the initial stage of the Mystic Company. Burlington Northern Railroad Properties has granted the right of entry to place the preload on the subject site for the future expansion of the Mystic Company. The Mystic Company has an option on the property but has not exercised it at this point. 3. The actual material, approximately 12,000 cubic yards, will be the surplus preload material that is placed on Phase I of the Mystic Company. Both preload sites will actually utilize the storm water drainage,and temporary erosion control plan into on-site sedimentation ponds. 4. Various City departments have commented and have recommended approval with the Public Works Department pointing out that the plans must be finally approved pursuant to the storm water retention guidelines. 5.In conclusion, the materials that will be placed on site is the second phase of development of the adjacent Mystic Company. If the site is not utilized by the Mystic Company, for some reason, the materials will still be in place for a future developer. At that time, the developer may utilize the site plan approval process to fill the remainder of the lot. In fact, this operation is more of a convenience to the Mystic Company to allow them a place to surcharge than for finalized plans for expansion. Approval of the preload as a special permit for fill would not bind the City on the future site design of the property. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the special permit, file SP-006-85, be approved. An environmental impact statement (EIS) must be prepared for aliproposals with probable significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide information to help you and the agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be done) and to hel) the agency decide whether an EIS is required.
