APPLICANT: DKB CORPORATION FILE NO. SA-011-85 LOCATION: East side of West Valley Road at approximately the 3900 block. SUMMARY OF REQUEST: Approval of a site plan to allow the construction of an office/warehouse building having approximately 110,000 square feet, on a 6.2 acre site (North Valley Business Park). SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approved. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on March 5, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on March 12, 1985, at 9:25 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and other documents pertinent to this proposal. Exhibit #2 - Site Plan. Exhibit #3 - Elevation Map. Exhibit #4 - Vicinity Map. The above exhibits were entered into the record, and Roger Blaylock, Zoning Administrator was called upon to present the staff report. He advised the subject property is one of the last developing parcels along West Valley Highway. Its frontage is on West Valley Highway, and is approximately 900 ft. deep. There will be a northern and southern access point, with circulation going around the entire building. The proposal is on a curve which will create a sight problem. Utilities are available to the site, and it was noted that this is the fartherest location from the fire station within the City, prompting an agreement with the City of Tukwila for first time response in the area. Mr. Blaylock stated there are parking stalls for 133 vehicles in addition to the loading doors which will be utilized for truck storage. There are large bays of dock-high service areas along the south face of the building where trucks could be stored, as well as sufficient area for the maneuvering of large trucks and automobiles. This proposal complies with the Comprehensive Plan, access will be solely off of West Valley; the site has 375 ft. of frontage, and it is felt the northern most access has insufficient sight distance to be useable which will have to be omitted or modified to function as an emergency access only. The Zoning Administrator advised that if a portion of the building is converted it will be necessary to go through another site plan approval in order to recalculate the parking and be sure the uses are compatible with the zoning and Comprehensive Plan at that time. Continuing, Mr. Blaylock stated landscaping plans comply, but substantial amounts of evergreen materials should be supplemented by wildlife vegetation. The only issue arising is the question of access, and suggested the landscape plans be approved by the City's landscape architect. There were no further comments from staff at this time. DKB CORPORATION SA-011-85 March 18, 1985 Page 2 The Hearing Examiner called for testimony in support of this proposal from the applicant or their represenative. Responding was: Robert Fadden Lance Mueller & Associates 130 Lakeside Seattle, Washington, 98122 Mr. Fadden stated he has reviewed the staff report and advised that the landscape plans have been revised according to the comments of staff. The northern driveway on the site does have marginal sight distance due to the blockage from landscaping and the neighboring business structure. Sight from the south is very good and extends more than 450 ft. Because this is a project that has very little front yard parking, Mr.Fadden requested that the Hearing Examniner waive the front berming requirement so they can improve the sight distance even greater from both the north and south areas, out of the site, which will benefit both the private user on the site as well as the general public. They would wish to maintain the access from the north and would be willing to have only a right out access from that point. Mr. Fadden proposed the street tree plan be modified to allow a larger type of tree. They want to prune the bottom of the trees to create a high canopy which in turn would provide an improved sight line for cars that would not be interrupted. Mr. Fadden had no further comments. There was no further testimony in support of, or in opposition to this application. The Zoning Administrator had a final comment wherein he stated staff would have no objection to utilizing a right turn-in/out at the northern point, upon approval of the Public Works Department. The State of Washington, Department of Ecology, agrees that the shoreline permit issued on the previous project does not change the approval granted in 1982, and feels this is a revision and not a shoreline permit. With this in mind, the City will consider this a revision based upon the continued use and function of the previous approval and the Comprehensive Plan designation of manufacturing/industrial use for this area. There being no further testimony or comments from the audience or staff, the hearing was closed at 9:40 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, DKB Corporation, has requested approval of a site plan to allow construction of an office/warehouse building in the M-P (Manufacturing Park) zone. 2. The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit It 1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5.There was no opposition to the subject proposal from any member of the public. 6.The subject site is located along the 3900 block of the east side of West Valley Road. 7.The subject site was annexed into the City by Ordinance 1745 which was adopted by the City Council in April, 1959, as amended by Ordinances 1764 and 1928 adopted in May, 1959 and December, 1961, respectively. The site was reclassified to M-P, its current classification in July, 1974 by the enactment of Ordinance 2869, as amended by Ordinance 3166 adopted in November, 1977. Grade and fill was authorized by special permit (SP-760-74) in December, 1975. DKB CORPORATION SA-011-85 March 18, 1985 Page 3 8.The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of manufacturing park/multiple option types of uses but does not mandate such development without consideration of other policies of the plan. 9.The applicant proposes constructing an approximately 110,000 square foot building on an approximately 6.2 acre site. The building will be a concrete tilt-up structure. 10. The building will serve both warehousing and office needs. Approximately 103,550 sq ft will be utilized for warehousing while approximately 6,450 sq ft will be used for office space. The entire complex will require 102 parking stalls while the applicant proposes 133 parking stall, 31 more than required. 11. The additional parking would permit conversion of some of the warehousing to office purposes in the future. 12. The applicant has agreed to increase the size of landscape materials to more fully harmonize with the large scale building, but the proposed landscape plans meet the minimum requirements of the 2% wildlife mitigation directive and the landscaping provisions of the Parking and Loading Ordinance. There was no authority cited to eliminate the landscaping berm. 13. The applicant proposes providing access to the subject site via two driveways. Traffic Engineering indicates that the sight clearance for the northerly drive is insufficient and would create safety problems. The applicant indicated a willingness to have the drive limited to right in/right out turning only, if that were acceptable. 14. The proposal will generate additional traffic although projections are not included by staff. Traffic analysis done for the Valley area indicates that saturation on area roads will occur within the next 10 to 15 years. 15. The subject site is within 200 feet of the Green River and is, therefore, governed by the Shoreline Master Plan, and the project is subject to final State approval. CONCLUSIONS 1.The proposed office/warehouse facility appears to serve the public use and interest. The development of the subject site will not only increase the tax base of the City but will provide additional employment opportunites in the Green River Valley Industrial area. 2. The proposed use complies with the Comprehensive Plan designation of Manufacturing Park use, which includes warehousing and the obvious supporting functions provided by an office. 3.The parking proposed, and the size of the lot, would permit modification of the uses on the subject site and permit greater office usage. While staff generates concern over this issue, the applicant should be entirely free to develop the subject site as they see fit, subject to the codes and regulations of the City. Staff should, as they have, place the applicant on notice but should not endeavor to modify a proposal for some remote or speculative modification or future remodeling of the submitted proposal. 4.The northerly driveway will have to be limited to right in/right out to avoid anticipated sight clearance problems on the curve along West Valley Road. Such usage though will be further limited to approval of such right in/right out by the Traffic Engineering Division, and the northern driveway may be further limited as determined necessary by that division, including but not limited to total closure as safety warrants. 5. While traffic problems have been predicted for the Green River Valley Industrial floor, those anticipated problems have not been presented to the City Council as had been requested by the ERC. Until new policy, specifically regarding traffic has been formulated, this Office is compelled to apply the existing Comprehensive Plan which indicates the Valley is to be developed generally along the lines of manufacturing, warehousing, and office usage. Obviously since such development is anticipated, the large volumes of incidental traffic must have been included as part of such planning efforts. DKB CORPORATION SA-0l 1--85 March 18, 1985 Page 4 DECISION The Site Plan is approved subject to approval by Traffic Engineering of the north driveway being limited to right in/right out, and subject to further determinations by that division that the driveway even so limited may still constitute a safety hazard which may be entirely eliminated, save for its necessity as an emergency access for the Fire Department. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. However, in our final review, it came to our attention that the project itself is within 200 feet of the Green River. This will require that a Shoreline Substantial Development Permit be obtained. In 1981, a Shoreline Permit was obtained for -the then Industrial Park Company development (SM-94-81) to construct on the subject site. Since the project is within 200 feet of the shoreline, a Substantial Development Permit must be obtained for this development proposal. We have included the necessary application forms for that process. You should be aware that the process requires State concurrence before the City can issue a building permit. My general observation would be that I see no problem in issuing the permit, however, there would time restraints, approximately 100 days, because of the specific procedures in State law. DEPARTMENT ANALYSIS: 1.The applicant, DKB Corporation, is requesting site plan approval to construct a 110,000 square foot warehouse/office building on 6.2 acres in the 3900 block of West Valley Road. The tilt-up concrete structure will have approximately 103,550 square feet utilized for warehouse along with a 6,450 square foot office area located on the west end of the building. The site plan includes parking for 133 vehicles in addition to space in front of the loading doors which will be utilized for truck storage. 2.The proposal complies with the Comprehensive Plan designation of Manufacturing Park - Multiple Option and the present Manufacturing Park zoning of the subject site. 3.Access will be solely off of West Valley Highway where the lot has approximately 375 feet of frontage. Two accesses are proposed onto West Valley Highway. However, the Public Works Department comments that the northern most access has insufficient sight distance to be permitted. That access will have to be eliminated and modified to an emergency access only or a different access point will have to be approved by the Public Works Department. 4.The site plan, as presented, provides for 133 parking spaces. Based upon a division of 6,450 square feet per office and 103,550 square feet for warehouseing, the required parking would amount to 102 parking spaces. Maximum utilization of the building would be for 13,500 square feet of office and 96,500 square feet of warehouse based upon the present configuration of parking. However, it is anticipated that if the building is converted that under the provisions for new site plan approval, additional parking could be provided in areas presently utilized for loading and unloading of materials. 5.The landscaping plan complies with the Parking and Loading Ordinance and the 2% requirement for wildlife mitigation. Substantial amount of evergreen materials have been utilized, but it appears that the materials may be slightly undersized for the bulk of the building. H. An environmental impact statement (EIS) must be prepared for allproposals with probable significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide information to help you and the agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide whether an EIS is required. Instructions for Applicants: This environmental checklist asks you to describe some basic information about your proposal. Governmental agencies use this checklist to determine whether the environmental impacts of your proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise information known, or give the best description you can. You must answer each question accurately and carefully, to the best of your knowledge.
