Blaylock, Zoning Administrator SUBJECT:- DEVELOPMENT OF TRACT 'B' OF SPRINGBROOK TECHNICAL CENTER The ERC ccnditions at the time of plat approval required the dedication and construction of Oakesdale3 Avenue (2 lanes) along the west side of Tract 'B' from S.W. Seventh Street to S.W. GrE:dy Way prior to the development of Tract 'B'. Development of the parcels adjacent to Tract 'B' by First City Equities and Holvick, deRegt and Koering (HDK) have been short of parking spaces on existing lots. In order to accommodate proposed parking, lot line ad jostments have been approved in which a portion of Tract 'B' is added to the adjacent fors. These lot line adjustments for parking lot areas raised the question of whether Oa<esdale needed to be constructed. On October 30, 1985, the ERC upon review of a new traffic analysis determined that "... parking lot can be constructed on Parcel B without the implementation of the condition to construct Oakesdale Avenue. This interpretation does not include the construction of any buildings." SUMMARY OF REQUEST: Approval of site plan to allow the construction of a parking lot to accommodte new office space within the Washington Technical Center. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval Hearing Examiner Decision: Approved BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on July 13, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 6, 1985, at 9:25 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting, and other documentation pertinent to this proposal. Exhibit #2 - Site Plan This application continued from the meeting of July 13, 1985. Roger Blaylock, Zoning Administrator presented the application and noted additional information has been received and distributed to the various departments. Initially the matter was continued to allow time for the applicants to transfer the boundaries of this property. There is currently a Lot Line Adjustment request pending between the applicant and First City Equities. Mr. Blaylock continued advising this request is to expand the parking around buildings 16, 17, 18, and 19 to allow the conversion of internal space from warehousing to office use. The buildings have been constructed but modifications have not been accomplished due to insufficient parking. The 53 parking spaces requested will permit the conversion to take place in the buildings, with the applicant increasing the parking to 318 spaces. There will be 63,000 sq. ft. of office space and 3000 sq. ft. of warehouse space. Mr. Blaylock reviewed some of the history of the subject site with regard to parking and the lot line adjustment. Mr. Blaylock continued stating the previous concerns by staff brought about the request for this matter to be continued, but now, with the pending Lot Line Adjustment request pending between the two parties, it is felt the Site Plan is appropriate and should be approved by the Examiner. The Hearing Examiner called for testimony in support of this application. Responding for the applicant was: Loren Davis 1000 S.W. 7th Renton, Wa. 98055 Mr. Davis addressed the Site Plan and pointed out the 4 buildings involved in this request. He advised that they have developed a 20 ft. wide driveway through the entire site to be used for access, as required by the City. Of the 47 X 459 ft. requested for Lot Line Adjustment, only 27 ft. is at the present time undeveloped. He stated they have worked Holvick, deRegt, Koering SA-043-85 August 14, 1985 Page 2 with First City Equities to provide a lot that is functional and meets the requirements of the City. Mr. Davis and Mr. Blaylock held a brief discussion on the method used to compute what would be considered useable or non-useable space within the buildings. Mr. Davis stated, according to their computations as to useable space in the buildings, they fall within the requirements for parking space, and stated they will provide the Building and Zoning Department with a list of the buildings and a marked set showing the corridors, etc. inside of the buildings. Mr. Davis requested approval of the Lot Line Adjustment and the Site Plan as presented. The Hearing Examiner called for further testimony in support of, or in opposition to this proposal. There was no one wishing to speak, and no further comments offered from staff. The hearing was closed at 9:50 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Holvick, deRegt, Koering, has requested approval of a Site Plan for a new parking lot containing 53 stalls. 2. The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject site is located on the west side of Powell Avenue S.W., at the southwest corner of the intersection of S.W. 7th Street and Powell Avenue S.W. 6. The subject site was annexed into the City by the adoption of Ordinance 1745 in April, 1959, as amended by Ordinances 1764 and 1928 adopted in May, 1959 and December, 1961 respectively. The site was automatically zoned G-1 (General; Single Family Residential: Minimum lot size - 35,000 sq ft) upon annexation, a classification that was changed to M-P (Manufacturing Park) by the adoption of Ordinance 3344 in August of 1979. The Final Plat was approved in July, 1982. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of Manufacturing Park/Multiple Option/Office uses, but does not mandate such development without consideration of other policies of the plan. 8. The site is currently undeveloped and is located just west of Lot 9 of the original plat. The lot is proposed to provide parking for the buildings located on Lots 9 and 8 of the plat. Those buildings were converted and additional parking is required. A previously submitted Site Plan for the parking area was rejected as inconsistent with the platting ordinance and general land use planning principles. 9. The subject site is approximately .5 acres in size. 10. Access to the site is proposed to be via Powell Ave through Lots 8 and 9. The parking would be close to buildings 16, 18 and 19. 11. A lot line adjustment with the neighboring property to the west was negotiated to permit the parking lot to become part of Lot 9. 11. The applicant proposes adding 53 additional parking spaces to serve the easterly buildings. These buildings house a variety of operations but the predominant use will be office with some subsidiary warehousing. Staff concluded the applicant will be permitted 63,000 sq ft of office uses and approximately 3,000 sq ft of warehousing. Holvick, deRegt, Koering SA-043-85 August 14, 1985 Page 3 CONCLUSIONS 1. The proposed parking lot design appears to provide a reasonable method of increasing the available parking for the subject site without creating unworkable lots. 2. The applicant has expanded and modified the uses on the subject site, and in order to provide the required parking, the expansion of the parking area into an adjoining lot was necessary. The lot line adjustment will enable the desired result while at the same time assuring the City that the necessary parking will be on the same lot as the principle uses. 3. The lot will provide the necessary stall and aisle widths and will comply with other requirements of the code. DECISION The site plan is approved. ORDERED THIS 14th day of August, 1985. FRED J. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. However, these calculations are not correct. The appropriate calculation should be 63,000 square feet of office with 3,036 square feet of warehousing space. Buildings 16, 17, 18, and 19 contain a total of 66,036 square feet. 3. In February, the applicant submitted a proposed parking lot containing 62 parking spaces that was formally rejected by the Hearing Examiner on April 10, 1985. The Hearing Examiner specifically rejected that proposal because of the ridiculous shape necessitated by overdevelopment of the subject site. The applicant has reconsidered their position and have worked with the adjacent property owner to allow a more effective, efficient location for the additional parking. 4.The primary point of concern that the City should be addressing is whether the parking as presented in this site plan approval is both accessible and useful for the buildings that they will service. The new parking area will be 25 feet from Building 19 and 70 feet from Building 16. The farthest parking spaces will be within 75 feet of the buildings they are proposed to serve. In the other case (SA-018-85), the parking would have been in excess of 600 feet from the buildings they were servicing. 5. To functionally allow and legally tie the additional parking area into Lot 9 of Washington Technical Center and the associated Buildings 16 thru 19, a Lot Line Adjustment must be accomplished between HDK and First City Equities. To date, the Building and Zoning Department has not received the application. We have conducted preliminary consultation with the applicants and determine that the proposal would comply with the intent of the Manufacturing Park zone and the Comprehensive Plan. Until an application is submitted and a preliminary approval is granted, the Hearing Examiner should continue the public hearing to allow all documents to be reviewed in the public hearing process. The question that arises is that in the original EIS and the decision by the ERC at that time, any development in Tract B would force the construction of Oakesdale Avenue. Th.s 16,983 square foot area is a portion of Tract B, but the applicant has compensated by reducing the lot sizes in the northern portion of the subdivision. Blaylock, Zoning Administrato 4i) SUBJECT: Environmental Decision/SA-043-85 The Environmental Review Committee issued a declaration of non-significance for the HDK site plan approval to allow the construction of a 53 space parking lot to accommocate the conversion of office space within the existing site plan approval, SA-081-8 The question that arises is that in the original EIS and the decision by the ERC at that time, any development in Tract B would force the construction of Oakesdale Avenue. This 16,983 square foot area is a portion of Tract B, but the applicant has compensated by reducing the lot sizes in the northern portion of the subdivision. Lots 5 and 6 will be reduced by 21,575 square feet. This will be done with simultaneous recordings of several lot line adjustments. The resulting land swap between HDK and First City Equity will be a net reduction of 4,590 square feet from the total developable area. The City has not received the lot line adjustments to date, but would undoubtly condition any site p1 n approval upon those lot line adjustments being finalized. The question comes back to, does the ERC want to invoke the requirement to construct two lanes of Oaksdale Avenue S.W. as part of the approval of the site plan request? The application is being submitted to modify the site plan approved under the City of Renton's Site Plan Approval File No. SA-081-83. The original Site Plan Approval File No. SA-081-83 approved 266 parking spaces that would allow 50,000 square feet of office and 16,000 square feet of warehouse. This applica- tion is to change the use to 318 parking spaces with 63,400 square feet of net occupiable office space and 1000 square feet of warehouse space. In order to obtain this required parking, Holvick deRegt Koering is requesting that a lot line adjustment be made along the west property line of the site. This lot line adjustment would result in incorporating approximately 21,573 square feet of land owned by First City Equities adjacent to the west property line of the site into the present site. Of this 21,573 square feet of land, only 16,983 square feet of the total area is con- tained within Tract B of the final plat. (See Attachment #1) . In ex- change for this 16,983 square feet of First City Equities Final Plat Tract B land and 4,590 square feet of First City Equities Lot 9 and 10 Final Plat land (total 21,573 square feet) , Holvick deRegt Koering will reduce the area of Lots 5 and 6 of the Final Plat by 21,575 square feet. This will be done with simultaneous recording of lot line adjustments. The resulting land swap will produce a net decrease in Tract B Final Plat land area of 4,590 square feet. In addition, a previous lot line adjust- ment along the west property line of Lot 5 was made decreasing the Final Plat Tract B land area by approximately 6,600 square feet. Therefore, the total decrease in Final Plat Tract B land area from the original Final Plat to the requested lot line adjustment would be 4,590 square feet plus 6,600 square feet, or 11,190 square feet.
