Development of the parcels adjacent t) Tract 'B' by First City Equities and Holvick, deRegt and Koering (HDK) have been short of parking spaces on existing lots. In order to accommodate proposed parking, lot line adjustments have been approved in which a portion of Tract 'B' is added to the adjacent lots. These lot line adjustments for parking lot areas raised the question of whether Oakesdale needed to be constructed. APPLICANT: HOLVICK, deREGT, KOERING FILE NO. SA-045-85 LOCATION: 1100-1200 block of S.W. 7th Street SUMMARY OF REQUEST: Approval of a Site Plan to allow the construction of one two-story tilt-up concrete building and two one-story tilt-up concrete buildings totalling 60,300 sq. ft. of office and warehouse space. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Site Plan shown as Exhibit #3 is approved. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on July 30, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 6, 1985, at 10:20 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting, and other documents pertaining to this application. Exhibit #2 - Site Plan Exhibit #3 - Revised Site Plan Exhibit #4 - Letter from Jim Matthew, Fire Marshall, to Roger Blaylock, Zoning Administrator, dated August 5, 1985. The hearing opened with a review of the staff report to the Examiner by the Zoning Administrator, Roger Blaylock. He related that this request consists of 4 acres and will contain approximately 60,000 sq. ft. of office space, there is no warehouse space projected for this site. Access is solely off S.W. 7th Street provided through a shared curb cut, with property to the south, north and west being undeveloped. The site includes 302 parking spaces, 301 are required. He continued with a review of the 6 criteria outlined for review of site plans which included compatibility with adjacent structures; compliance with the Comprehensive Plan and Zoning Code; access; functionality of a parking lot; and traffic and pedestrian circulation. Mr. Blaylock stated there is a concern with the traffic patterns and pedestrian circulation as they relate to adjacent structures, noting there should be some functional relationship between them, extending through the manufacturing park area and through the property lines. In a office structure of this size there would be approximately 720 vehicle trips. In this particular structure they would be using one 30 ft. curb cut, which may be excessive. The traffic problem may be resolved with the ultimate extension of S.W. 7th Street. The parking lot appears to be functional, with access completely around the building and parking not more than 100 ft. away from the building. He continued stating there is concern about open space for people; the Fire Department does not believe the plans show adequate emergency access; and approved plans for water and sewer will be reviewed before the building permit is issued. In conclusion, Mr. Blaylock stated it was felt the Site Plan was not specific enough, and rather than recommend a continuance at this time he would wait to see if the presentation to the Examiner this date would provide staff with further information. Iolvick, deRegt, Koering SA-045-85 August 13, 1985 Page 2 Calling for testimony in support of this application, from the applicant or their representative, testifying was: Keith Maehlum The Maehlum Group 14108 24th S.E. Mill Creek, Wa. 98102 Referring to Exhibit #3, Mr. Maehlum commented on pedestrian circulation stating it is now their proposal to extend circulation on the south property line as well as to the west, through the parking stalls, with appropriate landscaping. He believes this would provide the circulation the City desires. Regarding traffic circulation they concur there is an existing curb cut they can utilize at this time and a 2nd curb cut which will provide some secondary access to the site. As to parking, Mr. Maehlum referred to the Exhibit and stated he felt the building permit process is available to show conformance to City standards. With regard to fire department access, Mr. Maehlum advised they have been asked to consider providing emergency vehicle access to the property on the south and west and proposed a 20 ft. minimum fire vehicle access to the adjacent site. He stated they would be losing some parking at different stages to provide the fire access, and requested if they could pick up those lost parking stalls in another way so as to comply with City standards. The applicant feels they are consistant with Phase I, II-A and proposed III development with regard to landscaping and site amenities, and pointed to the garden-type courts between buildings which they feel will provide more open space. In conclusion, Mr. Maehlum stated he feels the applicant has provided a Site Plan and business park that is above the surrounding standards and one that could be followed as an example of quality in future development in the area. The Examiner called for further testimony, responding was: Loren Davis 1000 S.W. 7th Street Renton, Wa. 98055 Representing the applicant, Mr. Davis addressed the concerns of pedestrian circulation and access to the site. It was indicated that future access on S.W. 7th Street was discussed and they will provide the curb cut and driveway to S.W. 7th Street and put in a barricade so it can not be used until the street is extended. The other fire emergency access points were discussed using Exhibit #3 as a reference. Mr. Davis stated if the City is going to require the applicant to provide other access points to adjacent sites they would prefer to see it be an access that could be blocked off in such a fashion that only the Fire Department can use it. He does not feel these access points should be used for vehicle access as well as emergency access as it would entice the public vehicles to use the access to cut through the lots. He requested the Site Plan be approved based on their revised Plan as submitted. The Hearing Examiner called for further testimony in support of, or in opposition to this application. There was no one in the audience withing to testify. Calling for further staff comments, responding was Roger Blaylock. Mr. Blaylock presented Exhibit #4 and briefly reviewed the access concerns of the Fire Department as well as vehicle access; circulation on-site; and off-site improvements with regard to the extension of S.W. 7th Street. The Hearing Examiner joined in the discussion regarding future access points, and suggested that this hearing be continued for one week to clarify the proposed access points. The Examiner inquired if the applicant had any objection to providing the sole access by way of a driveway to S.W. 7th, and Mr. Davis responded that the site plan could be adjusted to reflect the sole access at a point of concurrence with the Building Department. As to the extension of S.W. 7th, Mr. Davis felt this would benefit their development because of the one access point and is in favor of this being accomplished. Wishing to comment on this matter from First City Equities was: Barbara Moss First City Equities 800 5th Avenue #4170 Seattle, Wa. 98104 Ms. Moss advised she has been working with the Public Works Department to put together an LID that would include the extension of S.W. 7th Street. At this time a petition has been mailed out to the property owners involved. She stated the property owners have all verbally agreed to the cost sharing, and when signed, the matter of the 7th S.W. extension will be covered as it is one of the conditions of the LID. Holvick, deRegt, Koering SA-045-85 August 13, 1985 Page 3 The Examiner announced he would not continue this hearing, but will work with the information now presented to him to render his decision. There were no further comments or questions from any one in attendance. The hearing was closed at 10:45 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Holvick, deRegt, Koering, has requested approval of a Site Plan for two one-story tilt-up buildings and a separate two-story tilt-up building. 2. The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.2IC, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject site is located on the south side of S.W. 7th Street, at the 1100 block, just west of Powell Avenue S.W. 6. The subject site was annexed into the City by the adoption of Ordinance 1745 in April, 1959, as amended by Ordinances 1764 and 1928 adopted in May, 1959 and December, 1961 respectively. The site was automatically zoned G-1 (General: Single Family Residential: Minimum lot size - 35,000 sq ft) upon annexation, a classification that was changed to M-P (Manufacturing Park) by the adoption of Ordinance 3344 in August of 1979. The Final Plat was approved in July, 1982. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of Manufacturing Park/Multiple Option/Office uses, but does not mandate such development without consideration of other policies of the plan. 8. The site is currently undeveloped. Other lots near the site have been recently developed as part of Washington Technical Center. Some of the lots remain undeveloped, and applications for three other parcels in the immediate vicinity have been submitted for review. 9. The subject site is 4 acres in size. 10. S.W. 7th Street is a cul-de-sac, or at least the public right-of-way ends, which ends short of the subject site's western property line. Staff was concerned with access from the western end of the subject site to S.W. 7th and the potential extension of that roadway. An LID has been proposed to entend it but no formal action has been taken by the City in this regard. 11. The applicant modified the proposal in reaction to staff analysis regarding circulation, parking, and pedestrian amenities and movement. 11. The applicant proposed providing a driveway near the western edge of S.W. 7th frontage. The applicant also indicated willingness to provide a second emergency passage along either its south, west or both property lines as determined by the F ire Department. 12. The applicant proposes sidewalks and landscaping around the three buildings. Sidewalks with accompanying landscaping would also be provided through the parking areas to provide connections to adjoining lots. This would permit easier pedestrian movements among the various developments more in keeping with the park-like theme required for manufacturing park development. 13. The requirements for additional emergency access, as well as the redesign of the site to provide pedestrian amenities will eliminate some of the originally proposed parking stalls. The applicant proposes complying with the parking requirements by making minor additional on-site modifications to the layout. Holvick, deRegt, Koering SA-045-85 August 13, 1985 Page 4 CONCLUSIONS 1. The proposed site plan, as modified, appears to serve the public use and interest although the applicant does appear to develop the site to its ultimate intensity. 2. While the new design does provide a pathway through the parking areas, the site has no plaza areas around which the three buildings could cluster, and which could provide on-site amenities for employees during lunch. The landscape theme though, will continue that of the already constructed portions of the plat. 3. Rather than minimize the landscaping to provide for the additional parking required, the applicant may have to shrink one of the buildings. The applicant will be provided the option of making minor modifications to the site plan, but the landscaping should not be sacrificed to provide the additional parking. 4. The site is designated under the Office Park option of the Comprehensive Plan and facilities in areas so designated should have more, not less, landscaping. While the plat dedicated property for the P-1 channel which will provide some open space, the individual lots should not be dedicated to simply buildings and asphalt parking stalls, but rather they should achieve a campus-like setting befitting an office park. 5. The Fire Department will have to make a final determination as to the location of an emergency passage through the subject site but it should be located along the south or west property line and through existing parking areas. Again, the proposed landscaping should not be decreased. 6. The total number of vehicles that will use the major access point at the northeast corner of the site may overburden that access. That access point will be used by not only the subject site but also by the developments to the south and east of it. Therefore, the applicant should provide the proposed driveway to S.W. 7th near the northwest corner of the site. DECISION The Site Plan (Exhibit #3) is approved subject to the following conditions: 1. The approval of the Fire Department of an emergency passage through either the southern or western property lines to adjacent property, and the execution of restrictive covenants evidencing that agreement. 2. The provision of a driveway near the northwest corner of the subject site to provide access to S.W. 7th Street when that street is extended. 3. The applicant may modify the plan in minor ways to provide the parking necessary but not at the expense of the landscaping areas of Exhibit #3. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. DEPARTMENT ANALYSIS: 1.The applicant, Holvick, deRegt, Koering (HDK), is requesting site plan approval to allow the construction of one two-story tilt-up concrete and two one-story tilt-up concrete buildings totally 60,300 square feet of office and warehouse on a 4 acre site. In addition, 302 parking spaces are proposed on the design plans. 2.The Environmental Review Committee has issued a declaration of non-significance concerning the proposed construction of the three office buildings. The appeal period expired on Monday, July 22, 1985. 3. In the review of the site plan, the staff and the Hearing Examiner should consider the following criteria: a. Compatibility with adjacent structures. b. Compliance with the Comprehensive Plan and Zoning Code. c. Access. d. Functionality of a parking lot. e. Traffic circulation. f. Pedestrian circulation. This project will be the continuation of the basic style developed in the first three construction phases of Washington Technical Center by HDK. 4.The following is an analysis of design points of concern for the project: a. Pedestrian Circulation: The site plan does not really show how it interties with the adjacent manufacturing park development. Since this is a phase of the development and there is some functional relationship between the previous phases, pedestrian corridors linking these buildings should be identified and constructed. The site plan does not suggest how this can be accomplished. b. Traffic Circulation: Direct access is provided off of S.W. 7th Street: however, the only access point is a shared point on the northeast corner of the site. This would require a tremendous amount of interplay with the adjacent parcel and may not be acceptable in the long run. c. Functionality of the Parking Lot: The parking lot is designed at maximum capacity: 301 parking spaces are required, 302 are provided. The site plan does not specify in enough detail to totally evaluate whether all of the parking spaces comply with the City Code. In addition, it does not allow any interties to the south, west or future access to the north. If these were provided, there would not be enough parking. Circulation appears to be very good in that the common easement along the eastern property line can be used for two phases. This is a supportive concept of creating a manufacturing park atmosphere. Based upon the parking requirements and design requirements, it appears that the buildings have been maximized for the subject site. The Fire Department has commented that they do not believe that the plans are adequate to review emergency access. PRELIMINARY REPORT THE HEARING EXAMINER HOLVIC K, deREGT, KOEFciNG: SA-045-85 AUGUS r 6, 1985 PAGE 3 d. Access: As stated above, access is limited to one point and it is believed that it will create a major problem without the extension of S.W. 7th Street to the western property line of the site with a second access to align with the parking aisle on the west side of the proposed buildings 9 and 10. e. Compliance with the Comprehensive Plan and Zoning Code: The building plans as submitted comply with the requirements of the Zoning Code and the Parking and Loading Ordinance. The intent projected provides a manufacturing park atmosphere but does not really provide very much outside open space for people. These buildings, since they are being utilized by office workers, will have a high demand upon both active and passive recreational areas. Washington Technical Center has not addressed the issues on on-site open space for people. f. Compatibility with Adjacent Structures: This project is a continuation of the existing development to the east and north and suggests a continuation of the basic theme for Washington Technical Center. Therefore, it can be determined to be compatible with the adjacent uses. 5.Various City departments have commented and, with the exception of the Fire Department and Utilities Engineering Division, have recommended approval of the project. The Fire Department's concerns rests primarily with the emergency access and circulation, and Utilities Engineering Division is concerned about water and sewer plans which will be a requirement of the building permit. 6. In conclusion, the site plan is an over design of the site without consideration for interties to potential development areas on Tract B of the Washington Technical final plat. Limiting access to one point creates some potential on-site traffic problems that could be alleviated by simply adding another entrance. The best solution would be to redesign and allow for emergency accesses to the south and west along with a new curb cut to the north when S.W. 7th Street is extended so that the parking requirements meet the specific dimensions of the building. It is probable that in the neighborhood of 8 to 10 parking spaces will be lost so that the building should be reduced in scale apparoximately 2,000 square feet. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the site plan approval request, file SA-045-85, be continued until August 27, 1985, to allow the applicant to prepare specific plans to show the following: 1. Pedestrian circulation to intertie with the adjacent complex and future complexes (Point 2). 2.On-site traffic circulation to address the question of emergency access to the southern and western boundaries (Point 3). 3 A second primary access onto S.W. 7th Street when S.W. 7th Street is extended in the subdivision of the next portion of Washington Technical Center (Point 4). 4.A revised site plan showing specific parking layouts with individual stalls and the reduction of building space to correspond to the parking as it was modified to provide emergency access to adjacent sites. w jiJ ii__ Iv. Holvick deRegt Koering has been aware of the constraints of the daily trip generation from the Washington Technical Center plat as defined in the final Environmental Impact Statement. Holvick deRegt Koering has, at several meetings with Mr. Blaylock, indicated that they do not intend to exceed their allocated prorata share of daily trips as defined in the Final Environ- mental Impact Statement. Mr. Blaylock has indicated his concern about the additional traffic that may be generated from the site if the buildings are 100% office and has been monitoring the potential daily trips from the site based on site plans approved to date. Mr. Blaylock has been concerned that the 6600 trips associated with Phase I will be used up before the land area defined as Phase I on the revised site plan of the Final E.I.S. is actually built out. It has been my contention with Mr. Blaylock that the revised site plan of the Final E.I.S. is a preliminary site plan and that the trip generation of Phase I should be associated with daily trips generated, not the land area. Once the 6600 trips have been used up in Phase I, then the City of Renton could require the developer to update the City with their proposed build-out of the site versus the daily trips defined in the Final Environmental Impact Statement. Holvick deRegt Koering has worked with the City of Renton and with Mr. Blaylock in particular, at great length to answer his concerns about the daily trips generated from the site at the present and in the future. Mr. Blaylock met with Barb Moss of First City Equities and myself recently to discuss the daily trip generation totals to date. Last week I submitted to Mr. Blaylock a calculation of the potential daily trips based on existing buildings built and buildings submitted to the City of Renton for site plan approval at this time (See Exhibit 6) . Based on those calculations, the 6600 trips associated with Phase I of the development would not be exceeded. Due to the dedication of the 17 acres of Tract A for the retention pond for the P-1 Channel, the amount of trips associated with the remaining developable portion of the land has increased. I have discussed this issue with Mr. Blaylock several times, but have not seen Mr. Blaylock take into consideration this transfer of trips from the retention pond site to other areas of the site. The retention pond site was originally defined as the office park portion of the site, but due to the dedication of 17 acres of that tract, office buildings have been developed more fully in the portion of the site along Powell Avenue. This elimination of 17 acres of the site allows for a higher density of office park to be developed in other areas of the site based on the total Daily Trip Generations defined in the Final Environmental Impact Statement. These reduced building coverage areas also allows for a heavier concentration of office development than was originally proposed in the revised site plan of the Final Environmental Impact Statement. Not knowing the exact character of the businesses that will occupy this development, an average or slightly above average trip generation rate was selected by combining these nationally observed rates with observations at local developments of similar character. When these rates are applied to the phased development profile shown on Figure 1 , the daily and peak hour trips shown on Table 2 result. This shows that at full development the proposal will generate about 19,825 one-way trips per day (9,915 round trips) and about 2,650 one-way trips during the evening peak hour (the majority of trips - approximately 70% - will bt: traveling away from the industrial park) . About one-third of the total daily and about 40 percent PM peak hour trips will be generated during Phase I of the development. Difference in trip generation in Pha- ses I :nd II is due to the relatively large portion of office development typically a high traffic generator per unit floor area) . These figures reflect conditions on weekdays and reflect all vehicle trips including those made by employees , service and support services and trick pick-up and delivery. Except for isolated studies which are site or industry specific, there are no universally accepted standards for estimating the amount of weekend vehicle activity at a complex like Earlington Park. These studies suggest, however, that the weekend day traffi : volume is less than 10 percent of the average weekday volume. Most weekend traffic at this development is likely to be associated with the office and business park. An environmental impact statement (EIS) must be prepared for allproposals with probat le significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide information to help you and the agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide whether an EIS is required. Instructions for Applicants: This environmental checklist asks you to describe some basic information about your proposal. Governmental agencies use this checklist to determine whether the environmertal impacts of your proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise information known, or give the best description you can. You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you should be able to answer the questions from your own observatior s or project plans without the need to hire experts. If you really do not know the answer, or if a question does not apply to your proposal, write "do not know" or "does not apply." Complete answers to the questions now may avoid unnecessary delays later. Some questions ask about governmental regulations, such as zoning, shoreline, and landmark designations. Answer these questions if you can. If you have problems, the governmen:al agencies can assist you. The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of time or on different parcels of land. Attach any additional information that will help describe your proposal or its environmental effects.
