BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on May 15, 1986. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 20, 1986, at 9:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication, and other documents pertinent to this request. Exhibit #2 - Vicinity Map. Exhibit #3 - Site Plan Map. The applicant's request and staff comments were presented to the Hearing Examiner by Roger Blaylock, Zoning Administrator. He advised the applicant desires to construct three metal aircraft hangar buildings on property approximately 1.12 acres in size. There will be an office located in one of the new buildings as a part of this request; the site is located on the west side of the airport at the northern end of the facility; access is off Perimeter Road; the site is currently used as a airplane hangar tie down area and the new hangars will replace the tie downs, with less airplanes to be located in the area. Mr. Blaylock reviewed the surrounding uses in the area; there will be improved public improvements in the area; storm water drainage will be slightly modified and catchbasins will have to be relocated. Continuing, Mr. Blaylock advised it is felt the applicant's use on this site will be compat'ble with adjacent uses; there is a need for this facility in the area; will have no impact on the surrounding areas; and adequate parking is provided adjacent to the office structure, with parking inside the hangars when the airplanes are not there. There should be no problem for surrounding property owners as to glare, and landscaping will be provided along the western edge of the site to buffer the facility from the roadway. Mr. Blaylock stated the Fire Department raised an issue regarding completion of the necessary water line and fire hydrant locations for operation at the airport. He stated the water line will be completed prior to occupancy by the applicant. This proposal is recommended by staff for approval by the Hearing Examiner. Lane Aviation, Inc. There were no questions asked of him, and no one in the audience wished to comment in support of or in opposit ion to the proposal. With no one else wishing to testify, the hearing was closed at 9:15 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1.The applicant, Lane Aviation, Inc., has requested approval of a Conditional Use Permit to establish aircraft hangars at Renton Municipal Airport. 2.The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C. 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5.There was no opposition to the subject proposal from any member of the public. 6.The subject site is located on the east side of the 450 block of West Perimeter Road at the Renton Municipal Airport. The site is Apron B. 7.The site currently has tie downs for small aircraft. These tie downs would be replaced with three (3) metal hangar buildings. Aircraft could then be located out of the weather. 8. An office area would also be provided on the subject site and parking for six (6) cars provided adjacent to the office area. 9.The site is located at the northern end of the southern third of the airport, south of the Control Tower. Other airport uses are located north and south of the site. The runways are located immediately east of the site. 10. Landscaping will be provided along the western edge of the site, along the roadway. No interior landscaping will be provided since such installation could interfere with aircraft safety. 11. 1 he City is in the process of upgrading the water lines serving the site and area. 1 he Fire Department has indicated that these lines must be operational prior to occupancy. 12. 1 he Airport is zoned P-1 and is owned by the City of Renton. A conditional use permit is required for any development at the airport. 13. 1 he map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of airport related uses, but toes not mandate such development without consideration of other policies of the plan. CU-028-86 June 2, 1986 Page CONCLUSIONS 1.The applicant for a Conditional Use Permit must demonstrate that the use is in the public interest, will not impair the public health, safety and welfare and in addition, is in compliance with the criteria found in Section 4-748(C) which provides in part that: a. The proposal generally conforms with the Comprehensive Plan; b. There is a general community need for the proposed use at the proposed location; c. There will be no undue impacts on adjacent property; d. The proposed use is compatible in scale with the adjacent residential uses, if any; e. Parking will not occur in required side yards, and that traffic movement and circulation will be safe; f. Noise, light and glare will not be adverse; g. Landscaping shall be sufficient to buffer the use; h. Adequate public services are available and will not be burdened by the proposal. The requested conditional use appears justified and is approved. 2.The construction of aircraft hangars is compatible with the designation of the site for aircraft related purposes found in the Comprehensive Plan. 3. Staff reports there is a shortage of hangar space in the greater Renton area which construction of these hangars would meet. The general community need for the proposed use is satisfied. 4.The use will only be providing a formal setting, hangars rather than tie downs, and therefore will create no undue impacts on adjacent property. Adjacent uses are generally all similarly airport related. 5. Residential development is quite remote from the site and the low profile buildings will not intrude into the area or view corridors. 6. Parking will be provided for the office use. Aircraft users will use the freed hangar spaces. 7.The proposed hangars are not anticipated to produce any adverse light or glare. There should be no additional noise, after construction, than now exists. 8. Landscaping along the frontage road appears sufficient to buffer the use. Any additional landscaping could introduce unsafe manuevering conditions for aircraft. 9.1 he City is constructing new water lines which should provide sufficient fire flow, therefore, adequate public services appear available and will not be burdened by the proposal. 10. 1 he metal hangars will generally be compatible with the similar construction at the irport, and provide an increased tax base. The use is approved. DECISION The Conditional Use Permit for the three hangar buildings is approved together with the office addition. Fire flow must be sufficient prior to occupancy. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other .specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. For purposes of these decisions and recommendations the terms "Should" and "Shall" are to be considered mandatory. The term "May" will be considered discretionary. When the report is a recommendation to the City Council the terms "should" and "shall" are intended to inform the City Council that if they approve the recommendation the items should be mandatory to preserve the intent of the decision. G. DEPARTMENT ANALYSIS: 1 The applicant, Lane Aviation, Inc., is requesting a conditional use permit to allow the construction of three metal aircraft hangar buildings totaling 21,450 square feet. Proposed building #3 will have approximately 400 square feet of office space. Six parking spaces have been provided immediately adjacent to the anticipated office area as shown on the site plan. 2.The Environmental Review Committee has issued a declaration of non-significance for the proposed project. The appeal period ended on Monday, May 5, 1986. No appeals were received. 3.The Hearing Examiner in reviewing a conditional use permit must address specific criteria delineated under Section 4-748. The applicant's statement adequately addresses each of the criteria. The staff's analysis reveals the following facts: There is a need for the airplane hangars at the desired location on the west side of the Renton Municipal Airport. Since the adjacent users are also airport related, there is not an effect on the adjacent properties. The airport itself is separated from the commercial properties on the west side of Rainier Avenue North by a substantial distance and an elevation differential. Adequate parking is provided for the tenants according to the Parking and Loading Ordinance, and the proposal appears compatible with the adjacent uses. Glare does not appear to be a problem with the development, but noise may be reduced because fewer planes will be stored on the subject site. The applicant has proposed landscaping along the western edge of the project where it will provide a buffer between the roadway and the buildings themselves. Final landscape plans will have to be approved as part of the building permit application. 4.The only apparent issue concerning design is that the Fire Department has raised concern over completion of necessary water line improvements and fire hydrant locations for the general operation of the airport. This is a technical issue and the water lines must be operational before occupancy. COMPREHENSIVE PLAN The proposed hangars are consistent with the air transportation objectives and the "Transportation Goal" of the Comprehensive Plan and the site is located as suitable for its development in accordance with the Comprehensive Plan. COMMUNITY NEED There is a definite need within the Renton Airport area for storage hangars as there is a shortage throughout the entire Seattle Metropolitan Area. The hangars that we propose will only fill a very small portion of that need. EFFECT ON ADJACENT PROPERTIES There will be no impact on the adjacent properties and the proposed buildings conform with the adjacent uses. Lot coverage, side yards and building heights will all conform with the zoning requirements of all governmental (including F.A.A.) requirements and restrictions. COMPATIBILITY The proposed use is compatible with the general use of adjacent properties. PARKING Parking will be designated for any office area that is constructed at a ratio of one stall for every 200 square feet while the hangar tenants will be pro- vided by the airplane storage units. There should be no problem as it relates to safety for the traffic flow. PUBLIC IMPROVEMENTS There are adequate public facilities to the area and the proposed hangar demand will be very slight and these services will not impose an undue burden. SUMMARY It is our desire to construct three (3) buildings for the housing of aircraft for the general aviation community. The facilities will be well designed and well built and, aside from serving a definite need, should be an asset to the airport. The present location is being used as a tie down area and the construction of hangars would create no additional impact as it relates to drainage, environ- mental impact, impact on utilities or services.
