The expansion consists of the construction of additional therapy space,together wit} a residential unit for patients in therapy. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval with conditions Hearing Examiner Decision: The Conditional Use Permit is approved, w :h conditions. BUILDING & ZONING DEPARTMENT The Building & Zoning Department Repo REPORT:was received by the Examiner on Augus 6, 1986 PUBLIC HEARING: After reviewing the Building and Zoni f Department Report, examining availabl information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 12 , 1986 at 9 : 00 A.M in.the Counci Chambers of the Renton Municipal Building. Parties wishing to test =y were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow File containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit #2 -By reference, Site Plan dated June 13 , 1986. Exhibit #3 - Landscape Plan. Exhibit #4 - By reference, Elevation Plans. The hearing opened with a presentation of the staff report by Jeanet :e Samek-McKague, Zoning Research Technician. Mrs. McKague stated that; a Conditional Use Permit had been heard earlier this year for the applicant but was dismissed without prejudice by the Examiner. At that time it was learned that there was an overlap of leased parkin by the Valley Medical Center and the applicant could not supply the required parking due to that circumstance. The applicant now has a new lease line on the property and there is no overlapped parking o the Chin Hills property. She continued stating the proposal is in keeping with the Comprehensive Plan, and has been declared to have non-significant impact by the ERC. Northwest Spinal Rehabilitation CU-036-86 August 15, 1986 Page 2 Continuing, Mrs. McKague reviewed the comments received by various City Departments which included questions regarding the validity of residence as part of the project; the Fire Department requirement tr the building meet the fire code, and stating at some future date if further construction occurs on the site there may be a need for another fire hydrant. She also stated that the Traffic Engineering Department is requiring the applicant to participate in the wideninc of S .W. 43rd Street and an assessment has been made in that regard. All of the conditions and comments by the various departments will k taken care of at the building permit process. Mrs. McKague reviewec the criteria to be considered when reviewing a conditional use request. It was noted that this request conforms with the Comprehensive Plan; provides a supplemental medical use to the Valle Medical Center, and is compatible with its surroundings. As previously pointed out, the parking issue has been taken care of, bt it was pointed out that the applicant will have to be sure that the access driveway going south to the hospital property is left clear c parked cars. Mrs. McKague, addressing the issue of having a residential unit on the property stated staff feels the unit will serve only the patients coming in for therapy, which in turn will he p to lessen the trauma experienced by patients that might have otherw: e had to travel from their home on a daily basis. Based on the above analysis, it was staff' s recommendation that this proposal be approved, subject to the fulfillment of the conditions as set forth n the report to the Examiner dated August 12 , 1986 . The Examiner called for testimony from the applicant or their representative in support of this proposal . Speaking for the applicant was: Jerry Martin 4201 - 51st Avenue So. Seattle, Washington, 98118 Mr. Martin acknowledged his agreement with the recommended condition by staff. He asked for clarification as to the improvement of the parking access drive set out in condition #1 and Mrs. McKague explained it meant there should be a pavement width of 24 ft, and iz there is not a 24 ft. width then it will be necessary for the applicant to work with Valley Medical to place the paving strip aloe the entire access drive for parking and access. He had no further comments. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments froi staff. The hearing closed at 9 : 15 A.M. . FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes a7 enters the following: FINDINGS : 1. The applicant, Northwest Spinal Rehabilitation, has requested approval of a conditional use permit to allow the establishmen- of an expanded medical office and therapy unit together with a residential unit for in-patients. 2 . The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building an, Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3 . Pursuant to the City of Renton' s Environmental Ordinance and SI A RCW 43 . 21C, 1971, as amended) , a Declaration of Non-Significar :e has been issued for the subject proposal by the Environmental Review Committee (ERC) , the responsible official . Northwest Spinal Rehabilitation CU-036-86 August 15, 1986 Page 3 4 . Plans for the proposal have been reviewed by all City departmer s affected by the impact of this proposal . 5. The subject site is located at 3921 Talbot Road South, just nol h of Valley Medical Center and the Chin Hills Building. 6 . The site is zoned P-i ( (Public/Quasi-Public) . The site was annexed into the City in April, 1959 by the adoption of Ordinal e 1743 . 7 . The map element of the Comprehensive Plan designates the area which the subject site is located as suitable for the developmr it of public and quasi-public uses, but does not mandate such development without consideration of other policies of the pla 8 . An existing clinic and accessory building are located on the site. 9 . The site lies just on the edge of a natural ravine and greenbe area which is located to the north. The site itself experiencf some topographical variety as a result of the northerly ravine The applicant proposes no development near the ravine and preservation and enhancement of the landscaping in the north er.' l of the site. 10 . The applicant proposes closing off a carport structure to provile expanded medical office space. The applicant also proposes converting an accessory building to office, storage, treatment and residential space. 11. Staff was not convinced that residential uses could be permitted on the site but hospitals, obviously with in-patient care, are permitted in the zone. The site ' s conversion will have to meet both the fire and construction requirements reflecting the residential nature of the use. 12 . Access to the subject site, as well as some portion of the required parking, will be provided by Valley Medical Center on land leased to the applicant. The applicant' s original plan f( the site included land leased by the Valley Medical Center. Unfortunately the hospital double leased the same property to both the applicant and the Chin Hills Building located next do( . A new agreement with the hospital provided new property for th( applicant' s parking area. The plan shows 23 parking stalls. Restriping of the parking area will be necessary to define the available spaces. The actual width of the proposed access appears limited. Staff recommended a minimum of 24 feet of pavement with no parking permitted along the right-of-way to assure unobstructed regular and particularly emergency access. 13 . The establishment of medical offices in a P-1 zone requires a Conditional Use Permit. 14 . Staff has indicated that a fair assessment to participate in S . . 43rd Street improvements is $22 . 97 per trip, for an anticipate(. trip generation of 20 trips, or a total fee of $459 . 40 . CONCLUSIONS 1. The applicant, for a Conditional Use Permit, must demonstrate that the use is in the public interest, will not impair the health, safety or welfare of the general public and is in compliance with the criteria found in Section 4-748 (C) which provides in part that: a. The proposal generally conforms with the Comprehensive PlE ; b. There is a general community need for the proposed use at the proposed location; c. There will be no undue impacts on adjacent property; Northwest Spinal Rehabilitation CU-036-86 August 15, 1986 Page 4 d. The proposed use is compatible in scale with the adjacent residential uses, if any; e. Parking, unless otherwise permitted, will not occur in the required yards; f. Traffic and pedestrian circulation will be safe and adequE e for the proposed project; g. Noise, light and glare will not cause an adverse affect or neighboring property; h. Landscaping shall be sufficient to buffer the use from right-of-ways and neighboring property where appropriate; and i. Adequate public services are available to serve the proposal. The requested conditional use appears justified and is approve( 2 . The proposed clinic is immediately adjacent to the hospital, al as suggested in the Comprehensive Plan is supportive of the hospital . The proposed facility will provide specialized out- patient care, and with the residential unit, the occasional in- patient care for rehabilitative treatment. 3 . The hospital has become a focal point for medically allied services, and the area has become a hub of medical activity.to centralization of medical care enables both doctors and patien- to travel to one general area to provide or receive medical ca The need for such a regional center is well established. 4 . The primary clinic has already received approval and is protecting the adjacent natural ravine. No other adjacent facility will be affected by the development. Residential use: are not close enough to be adversely affected by the subject proposal . 5. The site will have adequate parking per standard requirements. The new lease agreement will assure the subject site will have its own parking area. 6 . The design should assure safe pedestrian movement on the site Eid as staff suggested, a 24 foot unobstructed access drive with nc parking along the sides will assure a safe circulation pattern. Signs should be posted along the aisle and access driveway whic I indicate that parking is prohibited along the aisle and drivew6T. 7 . The site is set back off the street and is separated from other property by both the ravine and landscaping, and noise, light Eid glare should present no problems. 8 . The landscaping theme and preservation of natural landscaping appear adequate to buffer the site and present a well integrat, facility. 9 . The site is well served by sewer and water. Staff has suggestui participation in traffic improvements for the nearby intersections, and such participation will be required in the amount of $459 . 40. DECISION The Conditional Use Permit is approved subject to the following conditions: 1. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council . All communications concerning the proposal must be made in public. This publc communication permits all interested parties to know the contents of the communication and would allow them to openly rebut ie evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to L1 Requests for Reconsideration as well as Appeals to the City Council . The applicant, Northwest Spinal Rehabilitation, is requesting a conditional use permit to allow the expansion of the medical office currently existing on the subject property. The expansion consists of converting a carport and a barn into medical offices, job similation/training space, storage, and a residential unit for patients requiring therapy and not able to travel from their homes to the facility for the duration of their therapy. A conditional use permit application for the same proposal as this application, file CU-010-86, was dismissed without prejudice by the Hearing Examiner. The applicant was asked to provide a plan showing the lease lines for Northwest Spinal Rehabilitation and the Chin Hills building to ensure that the lease from Valley Medical Center to both users did not overlap, creating a problem with parking on the two sites. In the process of researching the leases, the applicant decided to redesign the parking lot which resulted in a new site plan. Since the Hearing Examiner had already held a public hearing on the subject proposal, the Examiner in a letter dated April 14, 1986. determined that the new site plan required a new public hearing. 2. The subject proposal complies with both the Comprehensive Plan designation of Public/Quasi-Public and the zoning designation of P-1, Public Use. The subject proposal is allowed by a conditional use permit under Section 4-710(C) which allows private medical uses with approval of such a permit. 3. The Environmental Review Committee issued a declaration of non-significance on July 16, 1986. The applicant did not appeal the decision. 4. Various City departments have commented on the proposal. The Building Division, the Zoning Division, and the Police Department approved the subject proposal without conditions or comments. The other remaining departments/divisions commented as follows: Parks and Recreation Department: No comment since the project will not impact the City's park system. Policy Development: The Policy Development Department approved the proposal but questioned the validity of the residential unit. The department did express approval of the residential unit provided the unit is used by one patient at a time. PRELIMINARY REPORT 1 u i HE HEARING EXAMINER NORTHWEST SPINAL REHABILITATION, FILE CU-036-86 AUGUST 12, 1986 PAGE 3 Fire Prevention Bureau: The Fire Prevention Bureau approved the project with the following conditions: 1) the proposal meets all fire codes and ordinances and 2) the applicant be aware that a second hydrant may be required if additional construction occurs on the site in the future. Note: The conditions appear to be informational notes since both conditions will be covered either under the current building permit application or by future building permit/land use applications. Engineering Division: The Engineering Division approved the proposal subject to the installation of a sanitary sewer for the new building. Note: This will be required as part of the building permit approval process. Utility Engineering: The Utility Engineering Division approved the project with the condition that a backflow preventer be installed. Note: This will be required as part of the building permit approval process. Traffic Engineering: The Traffic Engineering Division appears to have approved the subject proposal subject to participating in the S.W. 43rd Street project to increase the roadway capacity. The assessed amount is $459.40 based on the following formula: 20 (vehicle trips generated by project) x $22.97 cost per trip) = $459.40 5. The subject proposal generally complies with the eleven conditional use criteria listed in Section 4-748. The following highlights some of the more pertinent criteria: Comprehensive Plan: The subject proposal appears in keeping with the intent of the Southeast Comprehensive Plan stating "... the expansion of existing residential and commercial areas should be encouraged where land, utilities, access, and community facilities are available with capacity to accommodate projected growth." (Southeast Renton Plan, City of Renton Comprehensive Plan Compendium, p. 31) In addition, the facility provides a supplemental health care facility to the Valley Medical Center. The proposal also complies with the following health care objective of the Comprehensive Plan stating: "Health care and social services should coordinated with other agencies." (Health Care Facilities Objective, Policies Element, Comprehensive Plan, March, 1986, p. 26) Compatibility/Effect on Adjacent Properties: The subject proposal is compatible in terms of bulk and scale with adjacent uses. The one-story structure blends well with the uses in the area and the natural vegetation area along the ravine north of the subject site. The proposed project will only modify existing structures and will not involve increases in bulk or scale. Conversion: The applicant will need to comply with the Building/Fire Code requirements as part of the building permit review process. Parking/Circulation: The Northwest Spinal Rehabilitation has provided sufficient parking for the project. The parking lot will need to be restriped to match the submitted site plan. The applicant leases its site from the Valley Medical Center and access is provided through the hospital's property to the subject property. Currently, cars are parking along the access driveway rather than in adjacent parking lots. 6. One issue raised by the proposed project is the appropriateness of the residential unit. The residential unit is not allowed to stand alone in a P-1, Public Use, zone: it is only allowed as part of a medical facility offering inpatient care such as a hospital. In this case, the residential unit is expected to be used as a temporary use rather than a long term one. A question arises as to the suitability of a cooking unit in the proposed residential unit. It appears appropriate to include a cooking unit as part of the residence since appropriate fire and building codes will ensure a safe situation. The residential unit is appropriate in this zone since it serves a similar function to the inpatient care provided by a hospital. Patients or clients using the facility would do so only on a temporary basis, long enough to finish required therapy. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the conditional use permit, file CU-036-86 for Northwest Spinal Rehabilitation, be approved subject to: I. Improvement and posting of the parking access drive to Spinal Rehbilitation to allow a minimum of 24 feet of paving and the posting of "no parking" signs along the access drive. 2. Constructing and striping the parking lot as shown on the site plan. 3. The proposed uses are compatible with the Comprehensive Plan and the Zoning Ordinance of the City of Renton. The buildings are located in the P-1, Public Use, district. This zoning classification allows medical offices/uses developed by private parties. Although Section 4-710, Public Zone, specifically prohibits residential uses, the proposed residential unit is a temporary rather than a permanent use. That is, there will be a turnover of users of the residential unit. Once a patient completes their therapy, a new patient will come in to use the unit while obtaining therapy. The proposed residential unit is specifically for use by persons obtaining therapy. This type of short-term inpatient care is similar to hospital and related care uses.
