An ordinance was read which had been on first reading 6/9/80
rezoning property located west of the existing Renton Elks Club
and east of Benson Rd.S. from GS-l to Business District B-1;
known as the Renton Elks Rezone R-028-80. MOVED BY CLYMER,
SECOND ROCKHILL, ADOPT THE ORDINANCE AS READ.* Councilman
Stredicke objected to waiver granted by the Hearing Examiner
for offsite improvements. Following discussion, it was MOVED
BY SHANE, SECOND TRIMM, COUNCIL RECESS FOR 10 MINUTES FOR
PLANNING DIRECTOR ERICKSEN TO PERUSE THE FILE. CARRIED. 9:23 p.m.
The meeting reconvened at 9:33 p.m. and roll was called. All
Council Members were present. Planning Director Ericksen ex-
plained the waiver is in connection with Short Plat 029-80 and
that the Rezone 028-80 required restrictive covenants. *ROLL CALL:

A PORTION OF ALLEY BETt-JEEN BURNETT AVE. N. & PARK AVE. N.

WlIEREAS a proper petition for vacating a portion of alley
between Burnett Ave. N. & Park Ave. N. between N. 30th St. and N. 29th
St., Renton, King County, Hashington, 'l;Y'as duly filed 'l;Y'ith the City
Clerk on or about March 24, 1980, and said petition having beerl signed
by owners representing more than t'l;10-thirds of the property abutting
upon such alley sought to be vacated; and
WHEREAS the City Council by Resolution No. 2327 passed and
approved on April 14, 1980, and after due investigation, did fix and
determine the 19th day of May, 1980, at the hour of 8:00 P.M. in
the City Council Chambers of the City of Renton to be the time and
place for a public hearing thereon, said hearing being continued to
June 2, 1980, and the City Clerk having given due notice of such
hearing in the manner provided by law, and all persons having been

HEREAS the Department of Public Works and the Planning

Helen Ivanich, 2907 Park Ave. N., submitted a petition asking
Council to add the names of those parties that did not sign
petition for vacation of alley between Burnett Ave. Nand
Park Ave. N between N 30th St. and N 29th St., so that the
entire alley could be vacated. Ways and Means Committee Chair-
man Clymer explained the ordinance would be presented for first
reading for vacation of the alley as presented in the petition
from Eugene Casper (without six easterly lots included). MOVED
BY CLYMER, SECOND ROCKHILL, COUNCIL ALLOW FILING OF PETITION
FOR VACAT ION OF REMA INING PORT ION OF ALLEY BY O~/NERS OF THE

advised proper form should be obtained from the Public Works
Department.
The following items are adopted by one motion which follows the
business matters included therein:
Letter from ,the Public Works Department presented a petition
for street vacation of a portion of NE 12th St. which was a
deadend, rounded cul-de-sac street. The street has been opened "
arid cont i nued as thorough-fare and the rounded port i on of cu l-cie-sac
is no longer necessary for roadway purposes; needs f6 be vacated
to the abutting City property for surplus and sale with portion
of the public use area in Block 46 corrected plat of the Renton
Highlands No.2. Refer to Ways and Means Conmittee for resolution
setting hearing date of'8/11/80 and to Board of Public Works.
Letter from Parks Department requested a resolution declaring
Tract 46, Lot 2, Highlands Public Use Area, as surplus. Money
received from the sale will be credited to Park Acquisition Fund.
Refer to the Ways and Means Committee for resolution declaring
subject area surplus. (A,bove vacation of portion of NE 12th
Street abuts subject property to, be declared surplus.)
Letter from Planning Department reported completion andaccep-
tance of the Senior Center Project CAG 052-78, Calhoun Construc-

published and mailed as required by law, Mayor Shinpoch opened
the public hearing to consider vacation of,~outh port jon of ~~lly

Manager of. Lake' Terrace Associates. Letter from Board of Public
Works Chairman Gonnason reported the Board finds no objection
to the vacation as street is not necessary for the City's
traffic circulation, however, it is necessary to retain a
utility easement as sanitary sewer line and telephone cable are
located in the right-of-way. The letter recommended the City
charge a fee equal to one-half of the appraised value which
the Board recommended be set at $2.S0 per sq. ft. Letter from
the Publ ic Works Department reported petition valid and repre-
sented 100% of the total property to be vacated. Public Works
Engineer Houghton used map to point out street vacation and
noted information received that Lake Terrace Associates are
not owners of one abutting parcel, but are in the process of
purchasing; however, represent 75%·of abutting property (only
2/3 approval required by law).
Persons present making inquiries: Dick Beltz, 1221 N 27th, asked
re property division, zoning and access. City Attorney Warren
advised that the street right-of-way Is divided with one-half
to each abutting owner, that the zoning does not change but

Dear Council Member:
Our firm represents Mr. and Mrs. Eric Grindeland, owners
of property (1217 N. 30th, Renton) which abuts the ahove-.
designated alley which was vacated by the Council on June 2,
1980, following a publ:i,.c hearing. I am requesting on :.their
behalf that you reconsider your action for the reasons stated
below, and either amend your decision so as to vacate the alley
except for the east six lots or completely rescind the vaca-
tion altogether. .
1. The City Council unlawfully vacated property outside the
specific request in the petition .. The petition circulated and
presented by Mr. Eugene L. Casper requested specifically the
vacationa portion of the a:lley between Burnett Avenue North
and Park Avenue North and North 30th Street and North 29th
Street. INCLUDING: All that portion of an alleyway, having
a width of 12 feet, lying between Lots 1 and 22 inclusive of
the north and Lots 29 through 50 inclusive on the south,within
Block 13 of' C. D. Hillman's Lake Washington Garden of Eden Divi-
sion No.1."
The petition by its own terms limited the· subject property
upon which the council could legally act. RCW 35.79.010 pro-
vides two methods of vacating municipal streets or alleys:
by petition and by legislative resolution. Since the former
route was pursued in this case, both the petitioner and the
City of Renton are bound by the procedural requirements for
vacation by petition as set forth in RCW 35.79.010-.030 and
the Renton municipal ordinance pertaining to vacation.

In the case of vacation by petition,' the petitioner creates
jurisdiction over the particular property to be vacated for the
legislative body by (1) presenting a petition (2) which speci-
fically describes the alley to be vacated, "or any part thereof"
and (3) which is signed by more than two-thirds of the abutting
property owners. (RCW 35.79.010) The statute specifically
provides that the petition may specify a portion of the parti-
cular alley, to be vacated as 'opposed to the whole alleyway: ,',
With respect to the Council's action on June 2, 1980, the'
Council went beyond the scope of the petition and, in effect,
vacated a portion of the alley which no one had requested to
have vacated. The language of the petition clearly indicated
an intention to exclude the eastern six lots abutting the east
end of the alley.
There is no difference between this situation and the hy-
pothetical case in which the Council while deciding to grant a
petition for the vacation of the alley, decided on their own
motion to vacate another alley across the street or even two
streets away. Obviously "this would be illegal for the City
Council to, do', primarily because the petition did not request
such action and the Council was without legal power to act on
their own. The same is true in the case at hand. While the
Council certainly has the power to vacate a portion of the spe-
cific portion, of the alleyway requested in the petition to be
vacated~ in other words to accede to part of the petitioners'
request, it has, no authority to go beyond the specific request
and add property to the petition.
2. 'Inadeqtlate Notice. RCW 35.79.020 provides that written
notice of the pendancy of the petition shall be posted in three
public places twenty days prior to the public hearing. The
statute further requires that the notice provide a description
of the alley or street to be vacated. The notice posted and
sent out prior to the May 19, 1980, hearing stated (1) that
the hearing was for the purpose of considering a proposed vaca-
tion 6f the alleyway,; as petitioned by Eugene L. Casper (VAC-
1-80) and (2) the general location of the subject property
was a portion between Burnett Avenue North and Park Avenue
North and North 30th Street and North 29th Street. The notice
incorporated by reference the language in Mr. Casper's petition
which specifically stated that the request was limited to 'the
western lots. The notice posted for the June 2, 1980, con-i
tinuation hearing said essentially the same thing, only this
time the exact description of the property to be vacated was
used~ In either case, this was not adequate notice to apprise
any persons other than the affected property owners (in other

words, those with property abutting on the specific portion of the
alleyway sought to be vacated) of the kind of action which the
Council took. Legally the notice was inadequate.
3) Compensation. If and when the Council reconsiders the
vacation of the entire alleyway, it should provide for just
compensation to Mr. and Mrs. Grindeland. The Grindelands appa-
rently are .. ' the only abutting lot owners who would have the1r
access severely impacted by the vacation of the entire alley.way.
They own a garage at the rear of their property which opens to
the east and to which access is available only via the alleyway .
While the access route is not available all year round because
of rain, it certainly benefits their property during those months
and days when the weather is dry.
The vacation of the entire alleyway would render the
Grindelands' garage absolutely useless for offstreet parking
and considerably reduce the value of their property, notwith-
standing the addition of three hundred square feet. Due to the
situation of their house and the existing property lines, they
would be unable to put a driveway on their own property to the
garage.
Unless the Council reconsiders its action, the Grindelands
will suffer an injury both different ,in degree than other per-
sons and different in kind. Legally they will be entitled to
compensat~on for their loss.
In conclusion, the City Council is specifically requested
to reconsider its action taken on June 2,,1980, by which it
vacated the entire alleyway described earlier. The ordinance
passed on June 2 should be either rescinded or modified accord-
ingly. The Grindelands believe that this is the most reasonable
c'ourse: however, should they be unable to have this matter
reconsidered by the Council, they will seek relief by means of
a writ of certiorari. Thank you.

the request for reconsideration and had elected not to remain

Blvd. NE near Union .Ave. NE. Mayor Shinpoch advised matter will
be explored.
The Ways and Means Committee recommended concurrence in the
Mayor's appointment of Kathy Keolker to the Library Board; five

1980, following a public hearing. I am requesting:bn i,their
behalf that you reconsider your action for the reasons stated
below, and either amend your decision so as to vacate the alley
except for the east six lots or completely rescind the vaca-
tion altogether.
1. The City Council unlawfully vacated property outside the
specific request in the petition. 'The petition circulated and
presented by Mr. Eugene .~. Casper requested specifically the
vacation a portion of the 'alley between Burnett Avenue North
and Park Avenue North and North 30th Street and North 29th·
Street. INCLUDING: All that portion of an alleyway, having
a width of 12 feet, lying between Lots 1 and 22 'inclusive of
the north and Lots 29 through 50 inclusive on the south, within
Block 13 of' C. D. Hillman's Lake Washington Garden of Eden Divi-
sion No.1:
The petition by its own terms limited the subject property
upon which the council could legally act. RCW 35.79.010 pro-
vides two methods of vacating municipal streets or alleys:
by petition 'and by legislative resolution. Since the former
route was pursued in this case, both the petitioner and the
City of Renton are bound by the procedural requirements for
vacation by petition as set forth in RCW 35.79.010-.030 and
the Renton municipal ordinance pertaining to vacation.

In the case of vacation by petition, the petitioner creates
jurisdiction over the particular property to be vacated for the
legislative body by (1) presenting a petition (2) which speci-
fically describes the alley to be vacated, "or any part thereof"
and (3) which is signed by more than two-thirds of the abutting
property owners. ,(RCW 35.79.010) The statute specifically
provides that the petition may specify a portion of the parti-
cular alley, to be vacated as opposed to the whole alleywayi,~':
With respect to the Council's: action on June 2, 1980, the
Council went beyond the scope of the petition and, in effect,
vacated a portion of the alley which no one had requested to
have vacated. The language of the petition clearly indicated
an intention to exclude the eastern six lots abutting the east
end of the alley. .
There is no difference betw'een this situatiori and the hy-
pothetical case in which the Council while deciding to grant a
petition for the vacation of the alley, decided on their own
motion to vacate another alley across the street or even two
streets away. Obviously:,.this would be illegal for the City ,
Council to do, primarily because the petition did not request
such action and the Council was without legal power to act on
their own. The same is true in the case at harid. While the
Council certainly has the power to vacate a portion of the spe-
cific portion of the alleyway requested in the petition to be
vacated, in other words to accede to part of the petitioners'
request, ft has no. authority to go beyond the specific request
and add property to the petition.

2. In:~aeJiu.ate.Notice. RCW 35.79.020 provides that written
notice of the pendancy of the petition shall be posted in three
public places twenty days prior to the'public hearing. The
statute further requires that the notice provide a description
of the a,lley or street to be vacated. The notice posted and
sent out prior to the May 19. 1980, hearing stated (1) that
the hearing was for the purpose of considering a proposed vaca-
tion of the alleyway;; as petitioned by Eugene L. Casper (VAC-
1-80) and (2) the general location of the subject property
was a portion between Burnett Avenue North and Park Avenue
North and North 30th Street and North 29th Street. The notice
incorporated by reference the language in Mr. Casper's petition
which specifically stated that the request was limited to'the
western lots. The notice posted for the June 2, 1980, con .. ;
tinuation hearing said essentially the same thing, only this
time the exact description of the property to be vacated was
1 used. In either case, this was not adequate notice to apprise
an!, ,persons other than the affected property owners (in'other

words,. those with property ahut'ting on the specific portion of the
alleyway.sought to be vacated} of the kind of action which the
Council took. Legally the notice was inadequate.
3) Compensation. If and when the Council reconsiders the
vacation of the entire alleyway, it should provide for just
compensation t() Mr. and Mrs. Grindeland. The Grindelands app'a-:-
rently are the only abutting lot owners who would have thefur
access severely impacted by the vacation of the entire alleyway.
They own a garage at the rear of their property which opens to
the east and to which access is available only via the alleyway.
While the access· route is not available all year round because
of rain, it certainly benefits their property during those months
and days when the weather is dry.
The vacation of the entire alleyway would render the
Grindelands"garage absolutely useless for offstreet parking
and considerably reduce the value of their property; notwith-
standing the addition of three hundred square feet. Due to the
situation of their house and the existing property lines, they
would be unable to put a driveway on their own property to the
garage.
Unless the Council recons.iders its action, the Grindelands
will suffer an injury both different.in degree than other per-
sons and different in kind .. Legally they will be entitled to
compensation for their loss. .
In conclusion, the City Council is specifically requested
to reconsider its action taken on June 2, 1980, by which it
vacated the entire alleyway described earlier. The ordinance
passed on June 2 should be either rescinded or modified accord,:-._.·
ingly': .. -,The Grindelands believe that this is the most reasonable"
course: however, should they be unable to have this matter
reconsidered by the Council, they will seek relief by means of
a writ of certiorari. Thank you.

the request for reconsideration and had elected not to remain
for the Council meeting. Ways and Means Committee Chairman
Clymer presented committee report that recommended the ordinance
vacating the alley between Burnett N. and Park N. (VAC-I-80)
be amended to vacate only that property considered in the

Blvd. NE near Union Ave. NE. Mayor Shinpoch advised matter will
be explored.

CONTINUED Persons present making inquiries: Ruth Dunham, 1119 N 30th St.,
inquired regarding taxes and retaining walls for elevation difference
and was advised by City Attorney Warren that H Council determines
to vacate the alley,the title to property reverts to abutting
property owners for payment of taxes and responsibility of any
improvements such as retaining walls. Upon inquiry by Councilman
Stredicke regarding protest, Public Works Director Gonnason
advised no protest was received from the abutting property owners
of the portion of alley aspetitioned,however protest was made
for inclusion by abutting owners of portion of alley not included
in. the petition (the 6 lots 'located at the Park Ave. N. easterly
end of alley). Discussion ensued regardi~g possible vacation of
entire alley. City Attorney Warren noted expanded posting; City
Clerk Mead noted continued hearing was posted as petitioned. Upon
inquiry,Petitioner Eugene Casper, 1208 N 29th, advised those prop-
erty owners at the easterly end were not asked to sign petition.
City Attorney Warren noted in order to vacate entire 'alley, all
of the abutting property owners would have bad to be notified
of the hearing in writing; City Clerk Mead advised written notifica-
tion was made to all petitioners, parties of record and everyone
who addressed the City Counci 1 durinq the Publ ic Hearing. Eric
Grindeland noted receiving notice for vacation as petitioned. Upon
inquiry by Councilman Rockhill regarding property owners of the
six lots on easterly end of alley, Stewart Carpenter, 2913 Park N,
and Helen Ivanich, 2913 Park N, asked to be included in the vac~tiori.
Councilman Hughes recalled his prior request that all property
owners be notified, objecting to "piece meal" vacation. Hughes
used blackboard to explain division of alley property as now fenced
and proposed vacation. Councilman Stredicke inquired of Eric
Grindeland, 1217 30th N,' (owner of garage located on alley) whether
his primary parking place was the garage and Grindeland advised
negatively. It was then MOVED BY HUGHES, SECOND STREDICKE, COUN-
CIL VACATE ALLEY FROM BURNETT AVE. N. TO PARK AVE. N. MOVED BY
STREDICKE, SECOND SHANE, AMEND THE MOTION TO INCLUDE RECOMMENDATION
OF THE BOARD OF PUBLIC WORKS THAT VACATION BE MADE ON NO-FEE BASIS.

This being the date set and proper notices having been posted
and published as required by law, Mayor Shinpoch opened the Public
Meeting to consider the 10% Letter of Intent to Annex 'property to
the City, k.no\'m as the Ra in i er Annexat ion. Property bQunc!.eQQn'_ eas.t,_
by ~ainier Ave •• 87th Ave. S on west. from north of S. 121 St. to City
limits. Letter from City Clerk Mead reported that signetures on
the petition represent not less than 10% of the assessed value of
the lands to be annexed, that Planning Department has certified
signatures represent 48% of the assessed value. The letter recalled
the Legislative Body needs to determine whether to accept the letter
of intent; require adoption of the Comprehensive Plan, zoning and
pre-existing bonded indebtedness;and authorize circulation of the
75% petition. Ronald R. Healey, representing John Anderson and
Associates, 10620 NE 8th, Bellevue, acted as spokesperson for the
annexation petitioners and advised willingness to accept bonded
indebtedness, zoning ordinance and Comprehensive Plan. Data infor-
mation from the Planning Department was distributed which showed
area as 7.1 acres with assessed valuation of $130,400 with existing
use of generally undeveloped land and scattered single family
res i dent i'a 1 ne i ghborhoods to the north. west and south, Ai rport to
east; area includes five dwell ing units and population o'f 12.
The data sheet 'listedComprehenslve Plan: COfTITIercial use il1lDedi-
ately adJacent to Rainier Ave. separated from single family on
the upper plateau by a strip of medium density multiple family.
Persons present favoring annexation: Ronald Healey. 10620 NE 8th.
Bellevue, noted earnest money on Heilpern/Holm properties Rainier
Ave. and noted proposed development by Stirskey Holdings for multi-
family and officeonRainier Ave.; steep grade rising 100 ft.;
need for utilities from Rainier Ave.; access only from Rainier Ave.;
no desire to address zoning at this time, however, noted,Kinq
County zoning of commercial and R-7200 arrow'iog greater flexibil ity;
and expanded annexation ,was mandated by the Planninq_[)~.partment.
Persons present opposing annexation: Albert Abbott, 8925 S 121st
St., Seattle, presented petitions bearing over 700 signatures of
area residents opposing annexation. Robert Kuvara, Attorney,
Kent, represented Mr. and Mrs. John S. Tomam, 12006 87th S.,
Seattle, and explained opposition by three property owners on
87th, John Toman, J. Gulla and C. P. Ambrose. Ray Kravagna, 8044
S 132nd, Seattle, Tomanl's son, asked that geographic boundaries
be considered. Karen Lunder, 506 Stevens Crt. NW, asked area on
87th be omitted. 'Ethel Klepach. 8916 S 121st St., explained the
fragile hillside slope, 65% grade and not suitable for building site.
Robert A. Stoutenberg, 8904 S 121st, favored squaring off of area
or total rejection. Dr. C. P. Ambrose, 11914 87th S., Seattle, is
included in annex area and opposeS'annexation. Sandra Snyder, 117th
Pl., lives across street, is. opposed. Gloria Bird, 8]22 S 121st,
Seattle, asked buffer zone to protect single family area. Robert
Bird, 8722 S 121st, Seattle, explained llke concern,

SUBSTITUTE MOTION BY HUGHES, SECOND ROCKHILL, ACCEPT THE 10%
PETITION AND AUTHORIZE CIRCULATION OF THE 75% PETITION. ROLL
CALL: 4-AYE: TRIMM, HUGHES, ROCKHILL, STREDICKE. 3-NO: CLYMER,
REED AND SHANE. MOTION CARRIED AUTHORIZING CIRCULATION OF THE
75% PETITION FOR ANNEXATION. Following discussion regarding
reduction of the annexation area, City Attorney Warren noted
at the time of adoption of the ordinance, amendment can be made.
Upon inquiry Planning Director Ericksen advised no minimum size
annexation required equal staff time and City expense are .required
regardless of size of annexation. Councilman Stredicke inquired
of the postings of the area for notification and was advised of
location of the postings by the City Clerk who also explained the
publication and mailings. Councilman Stredicke requested the same
posting locations be used.
MOVED BY STREDICKE, SECOND TRIMM, COUNCIL RECESS. CARRIED. 9:40 p.m.

REPORT RE APPROVAL OF LATECOMER'S AGREEMENTS. CARRIED.
This being the date set and proper notices having been posted and
published according to law, Mayor Shinpoch opened the public hear-
ing to consider vacation of a portion of 12 ft. alley. located
east of Buroett Ave. N., Lots 1 through 22 on the north and Lots
29 through 50 inclusive on the south within Block 13 Hillmans
Lake Washington Garden of Eden, as petitioned by Eugene L. Casper.
Letter from Board of Public Works Director reported no objection
to the vacatton of alley as it is not necessary to the City's
trafflccirculatlon and no utilities are on the site. The letter
recommended that, in keeping wtth previous pol icy for simi lar
situattons .in the same area, alley be vacated on a no-fee basis.
Gonnason used wall map to point out alley.
Persons present:' Helen ~vanich, N 29th and Park N., objected to
being excluded from the vacation and noted vacation included 44
lots and excluded six lots of the alley located at Park Ave. N.
Eri:c::Grindeland, 1217 30th N. explained his garage situated with
only access from the alley which is the reason six lots excluded;
alley to 'be graded and gravelled. Mrs. Ivanich noted alley not
accessible in winter, that if vacated she would not give easement
but would not fence at present time. Councilman Hughes noted the
port ions of the' a 11 ey had been d i vi ded and fenced by res i dents .
Asst. City Attorney Kellogg noted one-half of alley property goes
to each abutt i ng property owner and noted some Ii ab 111 ty I f access

requested Agenda Item 7.a. be read. MOVED BY ROCKHILL, SECOND
HUGHES, COUNCIL CONCUR. CARRIED. Letter from Public Works Director
Gonnason presented proposed agreement with the City of Kent for
purchase of water for an interim period pending development of
permanent water supply programs. Gonnason noted Renton has the
capacity of providing water for an interim period of time and
recommended 27¢ per hundred cubic feet, requesting Council concur
and authorize Mayor and City Clerk to execute contract. Upon
inquiry Gonnason noted two.year contract, Lind Ave. S. area
intertie, Kent to pump to their system. Hughes explained his
intent that Renton have sufficient well water to discontinue
City of Seattle water. Gonnason also noted Agenda Item 7.b. did
not affect Kent water matter. Rockhill inquired re fixed rate
and inflation and if need for capital. Reed inquired re rate for
water, being advised 27¢ at low end for large users (34¢ charged
to residents). Councilman Stredicke requested matter be referred
to committee. MOVED BY ROCKHILL, SECOND REED, REFER MATTER TO
THE PUBLIC UTILITIES COMMITTEE. CARRIED.
Del Bennett, 18004 SE 147th, Renton, requested reading of letters:
Letter from Del Bennett, President, Belterra Development Corp.,
1900 So.Puget Dr., urged reconsideration and repeal of the
recently adopted ordinance increasing sewer facility charge from
l¢ to 4¢ per square foot as it would increase cost of an average
new home in the City by approximately $800 per house. The
letter also questioned facilities charge to property owners
in the southeast quadrant to benefit property owners in the
Honeycreek"Kennydale trunkline service area.
Letter from Seattle Master Builders Association, 170 Mercer St.,
Seattle, representing concerns of residential construction
industry, requested the City to review 1.00% increase in sewer
facilities development charge and proposed increase in water
facilities development charge and requested opportunity to
discuss the matter wi th the Counc i 1. The 1etter noted breakdown
of increased cost to homeowners: Added 3¢ per sq.ft. amounts to
493.11 increased sales price and with 30 year mortgage is $1,911.60.
Del Bennett objected to ordinance increasing sewer facility charge
and objected that funds would be used to benefit a particular
area and not of benefit to entire City and noted sewers should
be provided through LID. Bennett called attention to increase
costs to home buyers and effect on inflation; also noted costs
to development of Burlington Northern property in Lind Ave. area
would amount to $2,090,880. Bennett noted that as the fee is
determined by square foot, It will cause higher density building.
Bennett favored original ordinance for financing Honeycreek-
Kennydale sewer with drainage basin Included In added facilities

Committee Member Hughes reported the matter had been discussed
at the 5/19/80 meeting and requested referral to Committee of

Sewer Construction estabijsh Fund No. 415 ~or 1975 Water/Sewer Construction Fund
Fund as requested by the State Auditor during 1979 examination because

application for Phase II of Renton's bikeway trail (Rainier
Avenue corridor) connecting the Rainier Avenue bikeway to the
Interurban bikeway in Tukwi la providing for funds under the
Surface Transportation Assistance Act of 1978. MOVED BY

Community Services Committee report noted Metro opposition
to change in P-l Channel and since council approved an
alternate channel for that area, no action is required at

Community Services.Committee report recommended that the
request, as submitted from Secoma Communications, Inc.,
for a 99-year lease of City property in the wetland area

Councilman Stredicke noted updating of Talbot House Special
Permit is an adminstrative function. Mayor Shinpoch will check
into which diyision has authority and report back to council.
Councilman Stredicke inquired re Lakeview Towers Condominium
building permit status. Warren Gonnason, Public Works Director,
noted meeting sheduled with Lakeview Towers for progress report
set for Tuesday, 4/8/80.
Public Safety Committee Chairman Hughes submitted committee
report recommending no changes be made in the Smoke Detector
Ordinance. MOVED BY STREDICKE, SECOND SHANE, CONCUR IN THE
COMMITTEE RECOMMENDATION. CARRIED.
Public Safety Committee report recommended approval of the
OK Cab Company to Mr. Richard T. Pierce. COMmittee also
recommended Taxi Cab Ordinance be revised to establish only two
taxicab zones in the City. (southwest corner on Wells Ave. South
at South 3rd St. and first parking space south of Houser Way on
the east side of Wells Ave. So.) referring matter of code revision
to the Ways and Means Committee. MOVED BY REED, SECOND SHANE,
TO CONCUR IN THE COMMITTEE RECOMMENDATION. CARRIED.
Public Safety Committee report recommended an ordinance be
adopted prohibiting the overnight parking of all type trailers
designed to be drawn by a motor vehicle except recreation trailers,
and buses and trucks used for bus i ness purposes in whole or in part
excludirig pickup or panel trucks of less than one ton rated
capacity in residential areas of the city only. Refer to Ways

Ways and Means Committee Chairman Clymer submitted committee
report recommending the matter of the Cabaret Ordinance

An ordinance was read changing the zoning classification from
H-I to R-I single family residential for property located at
east of existing Renton Hill R-I and north of South 7th St. in
a northeasterly direction to the center of the Cedar River.

The Ways and Means COfl1llittee recommended first reading for an
ordinance providing for LaRue property rent monies (ordinance
on first reading 4/7 was revised). Following reading, MOVED
BY CLYMER, SECOND ROCKHILL, REFER ORDINANCE BACK TO WAYS AND
MEANS COMMITTEE, CARRIED.
The committee recommended reading and adoption of a resolution
establ ishing a public hearing 5/19 regarding pro~osed vacation
of an alley located between Burnett N. and Park N. and N. 30th
and N. 29th St. (Petitioned by Casper) MOVED BY CLYMER, SECOND
HUGHES, ADOPT THE RESOLUTION AS READ. CARRIED.
The Ways and Means Committee recommended approval for payment
of Vouchers Np. 27699 through 28008 in the amount of $936,722.98.
Vouchers No. 27694 through #27698 machine voided. Vouchers
received departmental certification as to receipt of merchandise
and/or services. Also included: LID #312 Revenue Warrant R-2.
43,943.97. MOVED BY ROCKHILL, SECOND CLYMER, APPROVE VOUCHERS
AS PRESENTED. CARRIED.
Councilman Hughes suggested the Park Department consider adding
lawn bowl ing court at the Senior Center. Counci lman Hughes noted
used car lots using public right-of-way in vicinity of Sunset NE
and N 3rd St. Mayor Shinpoch noted several departments were
checking the matter.
Mayor Shinpoch requested resolution transferring $5,616 for
Senior Center improvements to Park category; noted previous
request for discussion of uniformed longevity and rate 'increase
for solid waste noting that without policy decision, the City
is spending $38,000 ($9,700 month). MOVED STREDICKE, SECOND
CLYMER, MATTER OF -$5,616 BE REFERRED,TO WAYS AND MEANS COMMITTEE
FOR PROPER LEGISLATION REFERRING FUNDS TO PARK DEPARTMENT FOR
SENIOR CENTER IMPROVEMENTS. CARRIED. MOVED BY STREDICKE, SECOND
CLYMER, THE WAYS AND MEANS COMMITTEE PRESENT AN ORDINANCE ESTAB-
LISHING POLICY WITH REGARD TO SOLID WASTE DISPOSAL RATES.

Public Works Director Gonnason reported King County has authorized
County Executive to enter into agreement with City to negotiate
property for City Shop site and called attention to Gonnason's
letter of 8/6/79 requesting Council grant authority to commence
process to proceed for consolidated shop site. MOVED BY CLYMER,
SECOND HUGHES, REFER THIS INFORMATION TO THE COMMUNITY SERVICES
COMMITTEE. CARRIED.

Letter from Public Works Director Gonnason recommended referral
to the Committee of the Whole to consider request from Commercial
Pacific Brokerage Services, Inc. to purchase City-owned property
on Lind Ave. SW consi~ting of 5.68 acres. The letter noted the
2.00 per sq. ft. purchase offer: that property is located in
the Industrial Park, consists of approximately 247,421 sq. ft.
and $494,842 would be selling price. MOVED BY STREDICKE, SECOND
TRIMM, THIS SPECIFIC OFFER BE DENIED AND THAT THE SUBJECT BE
REFERRED TO THE COMMITTEE OF THE WHOLE. CARRIED.
Council President Trimm submitted Committee of the Whole report
recommending concurrence in Mayor Shinpoch's letter of 3/13/80
regarding the uncommitted funds in the amount of $35,188.60
included in the 1980 budget.· The Mayor's letter recommended
11,982 for Building Division permit clerk; $1,000 travel account;
15,000 for Salary Survey ($13,631 appropriated in 1980 budget).
The Committee of the Whole report also recommended concurrence in
Mayor Shinpoch's letter of 3/13/80 regarding the City's excess
revenue in amount of $1,122,382.72, recommended proposed expendi-
tures of $860,212.34 for City Shop relocation; $68,787.48
finishing Burnett project and balance for Contingency and Special
Funds. MOVED BY TRIMM, SECOND STREDICKE, COUNCIL CONCUR IN THE
RECOMMENDATION. CARRIED.
MOVED BY STREDICKE, SECOND CLYMER, MATTER OF CITY SHOP DEVELOPMENT
AND RELEASE OF ANY PROPERTY ALONG CEDAR RIVER BE REFERR~D TO THE
COMMUNITY SERVICES COMMITTEE. CARRIED.
Utilities Committee Member Reed submitted committee report
recommending the systems development charge for water and sewer
connections be increased from the present I¢ per sq. ft. to 4¢
per sq.ft. on a City-wide basis. The report stated charges
would re adjusted annually in accordance with Consumer Price
Index for Seattle area; refer to Ways and Means Committee.

Public Works Director Gonnason used wall map and explained 4/17
deadline for meeting with Urban Arterial Board, matter referred
to Transportation Committee; fund for undercrossing would require
7,000,000; Forward Thrust Funds not sufficient. Gonnason
recommended project be modified; Gonnason explained five lane
proposal wedging down to 44 ft. in area of railroad tracks and then
returning to five-lane width to el iminate immediate need for
right-of-way acquisition; that Kent Transportation Committee
has approved plan and requested Council concurrence in an alternate

WHEREAS a Petition has been filed with the City Clerk of the City of
Renton on or about March 24, 1980, pursuant to the requirements of RCW 35.79,
petitioning for the vacation of a portion of a certain alley, as hereinafter more
particularly described, and said petition having been signed by the owners of more
than two-thirds of the property abutting upon a portion of said alley sought to be
vacated, and same being described as follows:
As incorporated herein as per Exhibit "A" which is made a part hereof as
if fully set forth.
Portion between Burnett Avenue N. and Park Avenue N. and N. 30th Street
and N. 29th Street
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO RESOLVE AS FOLLOWS:
SECTION I: That the 19th of May, 1980, at the hour of 8:00 P.M. at the
City Council Chambers in the Municipal Building, Renton, King County, Washington,
be and is hereby fixed as the time and place when the aforesaid Petition for vacating
the aforesaid portion of alley shall be heard and determined, which said hearing date
is not more than sixty nor less than twenty days from the date of passage of this
Resolution.
SECTION II: The City Clerk is hereby authorized and directed to give
notice of said time and hearing as provided by RCW 35.79.020 and any and/<?r all
persons interested therein or objecting to said vacation may then appear and be heard
thereon, or they may file their written objections thereto with the City Clerk at or
prior to the time of hearing on said vacation.
SECTION III: The City Council shall determine, as provided in RCW 35.79.030
as to whether an appraisal shall be secured to determine the fair market value of the
property sought to be vacated as provided for in Ordinance No. 2349 and the amount
of compensation to be paid by the Petitioner-Owners to the City for such vacation
but which said amount shall not exceed one-half of th(il appraised value of the area
to be vacated.
The City likewise reserves the right to retain an easement for public utility
and related purposes.
