E. 7 . Existing Zoning : GS-1 , General Classification District, Minimum lot size 35 ,000 square feet. 8. Existing Zoning in the Area : R-1 , Residence Single Family , GS-1 , General Classification District, G-7200, Residence Single Family. 9 . Comprehensive Land Use Plan : Single Family Residential 10. Notification :The applicant was notified in writing of the hearing date. Notice was property published in the Record Chronicle and posted in three places on or near the site as required by city ordinance . C . PURPOSE OF REQUEST : The purpose of the request is to provide zoning consistent with the proposed development of single family residence lots . D. HISTORY/BACKGROUND : The subject site was annexed into the City by Ordinance #1965 dated May 27 , 1959 . Contiguous parcels of property adjacent to the north boundary of the property were rezoned from GS-1 to R-1 by Ordinance #2650 dated August 11 , 1971 and a . second ordinance currently pending . E . 10th Court was also rezoned to R-1 from GS-1 by Ordinance #2626 on April 16 , 1971 . E . PHYSICAL BACKGROUND: 1 . Topography: The site is relatively level . 2 . Soils : Arents , Alderwood material , (AmC ) . Runoff is medium, erosion hazard is moderate to severe . This soil is used for urban development. 3 . Vegetation : The site consists of a mixture of deciduous trees , backberries and grass undergrowth . 4 . Wildlife : Existing vegetation may provide suitable habitat for birds and small mammals . 5 . Water: No surface water was observed on the subject site. 6. Land Use: The site itself is presently undeveloped . The property adjacent to the east consists of developed single family residences as are the lots to the west. To the north are some undeveloped single-family zoned property and to the south is the St. Andrews United Presbyterian Church . F. NEIGHBORHOOD CHARACTERISTICS : The surrounding properties are principally single family residential in nature. G. PUBLIC SERVICES : 1 . Water and Sewer : Existing 6" water mains are located on N . E . llth Street, N . E . 10th Place , N. E. 10th Court and Pierce Avenue N . E . 8" sewer mains are located along Pierce Avenue N. E . and N . E. 12th Street and a 6" sewer main is located on N . E. llth Street. In addition , an 8" storm drain is located on Pierce Avenue at N . E . llth Street . Development of the property will require extension of water and sewer utilities . 2. Fire Protection: Provided by the Renton Fire Department per ordinance requirements . 3. Transit: Metro Transit Route #42 operates along Redmond Avenue N . E . adjacent to the easterly border of the subject site. 4 . Schools : The site is within one-half mile of Honeydew Elementary School , within three-quarters of a mile of McKnight Middle School , and within two miles of Hazen High School . 5 . IMPACT ON THE NATURAL SYSTEMS : Rezoning of the subject site will not have a direct effect on the natural systems ; however , subsequent development of the property will disturb soils and vegetation , increase storm water runoff and cause an increase in traffic and noise levels in the area. Through proper developmental controls and procedures these impacts can be mitigated . K. SOCIAL IMPACTS : Development of the subject site may result in increased social interaction among the area residents . L . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton' s Environmental Ordinance and the State Enviromental Policy Act of 1971 , as amended, RCW 43-21C , a Declaration of Non-Significance has been issued for the subject proposal for rezoning only and any development is subject to proper development controls to mitigate any potential adverse impacts . M. ADDITIONAL INFORMATION: A vicinity map and a site map are attached. N . AGENCIES/DEPARTMENTS CONTACTED : 1 . City of Renton Building Division. 2 . City of Renton Engineering Division. 3. City of Renton Traffic Engineering Division. 4. City of Renton .Utilities Division. 5 . City of .Renton Fire Department. O. PLANNING DEPARTMENT ANALYSIS : 1 . The proposal is consistent with the Land Use Element of the Comprehensive Plan which designates the site and surrounding area as single family residential . 2 . Suitable utilities are available to the subject site , although existing water and sewer lines will need to be extended. Standard hook-up charges would also apply . 3 . The proposed rezone is required to establish future lots that are consistent with the zoning and subdivision ordinances . This will permit platting of the subject site and subsequent development of the property for single family residences . 4. Additional right-of-way may be required along the westerly 20 feet of the subject site to establish Pierce Avenue N. E. as a full 50-foot right-of-way depending upon the applicant ' s specific future development plans . Subsequent development should be consistent with properties adjacent to the east and west. 5. Any proposed future development would have to meet access and fire flow requirements- as per Fire Department standards . 6 . The subject site is adjacent to existing R-1 zoning . Although City policy has been to establish new residential lots at the SR-1 category of minimum 7500 square feet, these lots are located somewhat centrally and would be consistent with existing lots in the vicinity which are either at or below the R-1 standard of 7200 square feet . The Presbyterian Church has sold a portion of their property to facilitate this rezoning . No short plat has been accomplished , however. Also the legal description provided in the application does not match that of the property applied for rezone. Prior to any legislative action on this rezoning , the plat approval must be accomplished to divide the lots and provide correct legal descriptions . Discussion with the applicant indicates that the proposed plat of the site and portions of adjoining properties will be in process shortly. 8. Additional comments from other departments are attached for consideration. P . DEPARTMENTAL RECOMMENDATIONS : Based upon the foregoing analysis , the proposed rezone is recommended for approval subject to: 1 . Approval of the preliminary plat separating the subject rezone area from the remainder of the Church property as required by State law and local ordinance shall be completed prior or concurrently with adoption of this rezone application . 2. A correct legal description shall be submitted prior to final adoption designating the correct limits of this rezoning . SR-1 or SR-2 zoning classifications' requiring larger lot sizes in fringe areas to provide compatibility for that specific type of development. He .noted that' because the proposal ' is established on a centrally located site, the SR-1 zoning category would not necessarily be appropriate and a recommendation for R-1 zoning had been issued by the department. The Examiner requested a copy of the city's adopted policy regarding the matter. The Examiner inquired if correspondence from the United Presbyterian Church had been received regarding proposed rezoning of the church site. Mr. Clemens responded that input from church representatives had not been received. The Examiner referenced Section 0.7 of Exhibit '#1 requiring receipt of corrected legal description as well as plat approval of lot division prior to legislative action on the proposed rezone, and inquired regarding the applicant's intent for resolution of the matter. Ms. Henry advised that submittal of a preliminary plat through a standard plat procedure was proposed, and agreement to sign the plat application and certificate had been obtained from owners of record of all affected properties to segregate the property in the proposal. The Examiner requested confirmation of the procedure from Mr. Clemens: Mr. Clemens concurred with the applicant's proposal and indicated that the long rather than short plat procedure would provide the most expeditious method of resolving the matter. He advised that timing of the final plat process could be ensured by requirement of restrictive covenants to provide compliance with requirements of the Subdivision Ordinance. The Examiner requested general comments. Responding was: Norman Abrahamson 3408 N.E. 17th Street Renton, WA 98055 Mr. Abrahamson, owner of property located at 1110 Queen Avenue N.E. , corrected Section E.5 (Physical Background) , of Exhibit #1 which states that surface water is not evident on .the site. He advised that standing water exists on the northerly side of the subject property during most of the year. The Examiner reported that City of Renton Ordinance No. 3174 requires submittal of storm drainage plans per review and approval of the Public Works Department for all development, and all plans would be reviewed at the subsequent preliminary plat hearing. Mr. Abrahamson discussed proposed circulation plans for the proposal and supported improvement of Queen Avenue N.E. rather than Pierce Avenue N.E. for proposed access to preclude a situation wherein backyards of residences in the proposed development abut front yards of existing residences on Queen Avenue N.E. Mr. Clemens reported that precise circulation would be dependent upon the development plans of the applicant and further analysis of the plat by city departments. The Examiner advised that subsequent preliminary and final plat public hearings would be held to review specific design proposals contained in the plat. Responding was: Ray H. Ball 3607 N.E. 12th Street Renton, WA 98055 Mr. Ball was affirmed by the Examiner. He reported that a 29-foot strip of property located on the southeast corner of N.E. 12th Street and Queen Avenue N.E. had been previously dedicated to the City of Renton and should be designated on submitted plans. Responding was: Florence Shoaf 1108 Queen Avenue N.E. Renton, WA 98055 Mrs. Shoaf supported the proposed development but objected ,to improvement of Pierce instead of Queen Avenue N.E. as primary access to the site. She indicated that a current problem with trash exists on the roadway and objected to further deterioration by creation of an alley at the rear' of the proposed development. R-270-78 LOCATION: East side of Pierce Avenue N.E. between N.E. 10th Place and N.E. llth Street. SUMMARY OF REQUEST: Applicant requests the rezone of property from, GS-1 to R-1. SUMMARY OF Planning Department: Approval with conditions. RECOMMENDATION: Hearing Examiner: Approval with restrictive covenants. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on January 4, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted' a public hearing on the subject as' follows: • The hearing was opened on January 9\ 1979 at 9:05 a.m. in the Council Chambers of the Renton Municipal ,Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning,Department report, and the report was entered into the. record, as Exhibit #1. David Clemens and Steve Munson, Planning Department staff representatives, reviewed . Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: King County Assessor's Map Exhibit #3: Plot Plan Exhibit #4: Rezone Application Mr. Clemens advised that an incorrect legal description of the property contained in Exhibit #4 includes the site of the United Presbyterian Church, and submittal of a revised description will be required unless rezone of the church property occurs. The Examiner asked the applicant if she concurred in Exhibit #1. • Responding was: Cheryl Henry Belterra Development Corp. P.O. Box 1282 Bellevue, WA 98009 Ms. Henry indicated concurrence in Exhibit #1. She stated that proposed zoning and subsequent development would be compatible with surrounding uses in the area and the proposal would provide amenities such as off-site improvements which would benefit residents in the community. She advised that a corrected legal description would be submitted to the Examiner. Ms: Henry noted that access to the development is proposed via Pierce Avenue N.E. and N.E. llth Street, and single family residential lots containing a minimum of 7200 square feet or more will be located in a cul-de-sac configuration on the site'. She advised that a parcel of previously zoned property located 220 feet northerly of the church site , will be included in plat development. ,The Examiner reported that finalization of the rezone of the northerly property owned by Ray H. and Margaret Ball, File No. R-083-77, had not occurred to date, and approval was contingent upon execution of restrictive covenants by Mr. and Mrs. Ball. The Examiner requested testimony in support or opposition to the request. There was no response. He referenced Section 0.6 of Exhibit #1 which states that city policy recommends establishment of new residential lots in an SR-1 zoning category, and requested clarification of the policy. Mr. Clemens indicated his understanding that R-270-78 Page Four indicated a willingness to participate in the rezone. 12°. The applicant stated that access to the subject property will occur at the . intersection of N.E. llth Street and Pierce Avenue N.E. While the former is a fully improved street; Pierce Avenue N.E. consists of only 30 feet of right-of-way. Additional right-of-way of 20 feet was not required in the near future by the City Council in its action on rezone application, File No. R-083-77, which involved the abutting northerly property. Rezoning of this abutting property (R-083-77) was approved on December 19, 1977 by the City Council subject to conditions which were to be implemented in restrictive covenants. To date these covenants have not been completed, and the City Council has not adopted an ordinance finalizing approval of the rezone to R-1. CONCLUSIONS: 1. The proposal conforms to the Comprehensive Plan goals and objectives and Land Use Map (Section 4-3014. (B) ) . Rezoning activity since 1971 (see paragraph D of Exhibit #1) has clearly established the trend in the area of gradual conversion of existing GS-1 zoning to R-l. The GS-1 zoning is a carry-over from annexation of the area in 1959. The subject property lies between existing R-1 and G-7200 zones. The, neighborhood apparently has been experiencing transition from the King County zoning to more dense City of Renton zoning. It seems appropriate, therefore, that the property be reclassified to R-1, a density and zoning category compatible and similar to the predominant development pattern in the neighborhood and immediate area. 2. Compliance with the Subdivision Ordinance can be accomplished by conditioning approval of the rezone to completion of either a short plat or formal plat of the total church property. The applicant and staff have found that the formal plat preliminary and final plat applications) to be the most expeditious while accomplishing legalization of the sale of the subject site from the total church property. The Examiner concurs. Normally a property is rezoned prior to submitting a plat application. While this process is reversed in this application, the same result can be accomplished. But an unusual condition must be imposed upon the rezone of approval contingent upon completion of appropriate subdivision of the total church property. 3. Despite the fact that the subdivision of the property is not, the subject of this hearing, it is appropriate to mention the nonconformity of setback requirements for the church buildings that will apparently be created in the proposed subdivision (See Finding No. 8) . A subdivision of the property can only be accomplished in conformance with the zoning requirements unless a variance is granted by the Board of Adjustment. The Examiner lacks authority to grant variances from these zoning requirements. More specifically, this subject will be considered during review of the subdivision, but it is raised at this point for the applicant's information. 4. Since access to the property will occur via an extension of N.E. llth Street, development of Pierce Avenue N.E. does not appear necessary at this time. Although this street is only half improved, the City Council's action, though still pending, on rezone R-083-77 indicates that at some time a full street may be required (at such time as the existing house in the eastern half of the right-of-way is removed or destroyed) . Therefore, it appears appropriate to require dedication of the easterly 20 feet of Pierce Avenue N.E. from the subject property and submittal of restrictive covenants agreeing to participate in a Local Improvement District for construction of the required normal off-site improvements at such time as development of the eastern half of Pierce Avenue N.E. to N.E. 12th Street is possible. RECOMMENDATION: Approval subject to: 1. Submittal of the correct legal description for the subject property prior to submission of the application to the City Council for final action,. 2. Completion of the appropriate subdivision of the total property owned by the United Presbyterian Church whereby the subject property is created. 3. Dedication of the easterly 20 feet of Pierce Avenue N.E. for public right-of-way and agreement to participate in an L.I.D. for construction of the required off- Site improvements at such time as development of the eastern 20 feet of Pierce Avenue N.E. between N.E. llth and N.E. 12th Streets, is possible and required by the City of Renton. n-170-78 Page Three Mr. Pfitzner requested clarification of potential church property zoning. The Examiner advised that the' zoning code does not specify a definite zoning category for church uses, and if the use were to change, the land could be developed per the existing underlying: zoning.. He indicated that if the church site abutting the subject proposal were rezoned to 'R-1, the density would be incr.eased 'from less than one single family' unit per acre to five to six units per acre. Mr. Pfitzner inquired if plans to open 10th Place N.E. for access exist' in the proposal. Mr. Clemens advised that the schematic. plans do not indicate extension of 10th Place N.E. Responding was: Charles Shoaf 1108 Queen Avenue N.E. Renton, WA 98055 Mr. Shoaf. expressed concern regarding drainage problems created by inconsistent grades in the area. The Examiner reported that during preliminary plat' review, utility and grading plans would be examined and approved. He reiterated previous comments encouraging residents to review submitted plans with the Public Works Department following receipt of notice of the preliminary plat public hearing and prior to the hearing. The Examiner requested final recommendations from Mr. Clemens. Mr. Clemens reported that the, Planning Department report, Exhibit #1, would remain as submitted. The Examiner requested further comments. Since there were none, the.hearing on File No. R-270-78 was closed by the Examiner at 9:55 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and. enters the following: FINDINGS: 1. The request is for approval of reclassifying 1.54 acres from GS-1 to R-1 in preparation for a single family subdivision. 2. .The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for 'the subject proposal by Gordon Y. ' Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected 'by the impact of this- development and no adverse comment was expressed. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and/or in close proximity. 7. The proposal is compatible with the lot area and dimension requirements of Section 4-706 (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. Exhibit #3 is a plot plan of the church property including the requested reclassification. On what is to remain church property is indicated an apparent structure approximately 28 feet from the proposed northerly property line separating the two portions of the total church parcel. Sections 4-729 (G) , 4-707 (S-1) and 4-706 _(R-1) requi're that the church buildings not be located closer than 100 feet from any developed single family lot. This poses a problem .to the proposed development of single family lots 28 feet from the northernmost church. buildings. 9. Testimony was not submitted regarding previous area land use and zoning analysis . Section 4-3014. (A) ) 'and previous significant public and private improvements Section 4-3014. (C) ) affecting the property. 10. The subject property has not been subdivided from the total church property in compliance with the Subdivision Ordinance although purchase has occurred. The applicant proposed that this be accomplished in the formal plat process for creating a single family subdivision on the. subject property. ' This was acceptable to staff. 11. In the rezone application (Exhibit #4) the legal description for the total church property was shown. The applicant stated that the legal description for Only the subject property would be provided.
