Preliminary Plat, Exception) The hearing was opened on June 5, 1979 at 9:10 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the supplementary Planning Department report, dated June 5, 1979, which incorporates both the rezone and preliminary plat staff reports, dated May 15, 1979, as well as the supplementary report regarding the preliminary plat and exception, dated May 22, 1979. The report was ' entered into the record as Exhibit #3. The Examiner indicated that because .the rezone had been reviewed through a prior public hearing which was subsequently closed, dependent upon the applicant's concurrence in the matter, the previous discussion could be incorporated into the record without further review. Mr. Gustafson indicated his concurrence in the procedure. Mr. Clemens reviewed the preliminary plat and exception request, and entered the following additional exhibit into the record: Exhibit #4: Preliminary Plat as submitted Mr. Clemens noted that the proposed plat contains a total of 18 lots, 17 of which will contain 7500 square feet and one of larger size which contains the existing residence of the applicant. He also advised that extension of N.E. 10th Street from Union Avenue N.E. to Redmond Avenue N.E. was recommended in the proposal. The Examiner asked the applicant if he concurred in Exhibit #3. Mr. Gustafson indicated his concurrence in the report. The Examiner inquired if the applicant was amenable to provision of improvements along Union Avenue N.E. and retention of existing trees along the western ,boundary of the site. Mr. Gustafson responded affirmatively. The Examiner requested a representative of the Public Works Department to testify regarding the question of sanitary sewer connection from the site. Paul Lumbert, Traffic Engineering Division, advised that'although the department has not received utility profiles, the applicant's engineer has reviewed the matter and is confident that sanitary sewer connection can be accomplished. The Examiner inquired if the Public Works Department concurs in the requiremer for provision of off-site improvements as part of development. Mr. Lumbert indicated the department's concurrence. PUBLIC HEARING: After reviewing the Planning Department. reports, examining available information on file with the application, and field checking the property and surrounding area, the Examiner Rezone) conducted a .public hearing on the subject .as follows: The hearing was opened on May 15, 1979 at 9:00 a.m. in the Council Chambers of the Renton . Municipal Building to review rezone application, R-292-79. Parties wishing to testify were affirmed. by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report. was entered into the record as Exhibit #1. David Clemens, Associate Planner, reviewed Exhibit #1, and entered- the following additional exhibit into the record: Exhibit #2: King County Assessor's Map The Examiner referenced Section J. (Environmental Assessment/Threshold Determination) . which indicates that due to the modest size of the proposal, and subject to retention of existing evergreen trees on the site, a Declaration of Non-Significance has been issued for the subject proposal, and he inquired if a separate threshold determination had been required for the rezone proposal. as well as the preliminary. plat application scheduled at a subsequent public hearing. 'Mr. Clemens advised that a single declaration was determined sufficient to encompass proposed action regarding approval of the subdivision for single family residential use. The. Examiner noted a typographical error in Section I.2 of Exhibit #1 which erroneously denotes the proposed number of lots as 17 instead of the requested 18 lots. The Examiner requested testimony by the applicant. . Responding was: Arthur Gustafson 909 Union Avenue N.E. Renton, WA 98055 Mr. Gustafson indicated concurrence in the Planning Department recommendations contained in Exhibit #1. The Examiner inquired if the applicant was amenable to continuance__of the preliminary plat hearing. for one week to allow concurrent review-of the requested exception. Mr. Gustafson indicated his. concurrence in the request. The Examiner requested testimony in support or- opposition to the application. There was no response. The current classification, GS-1, was applied to the subject property upon annexation by the city in 1957. Since that time this property has remained relatively undeveloped while the area surrounding the subject site has undergone considerable growth and development. The subject site is the last remaining parcel of this size to be proposed for subdivision and development in this area. Both to the north and west, single family homes have been developed. Lots to the north are about 7500 square feet. To the west, lot size varies. The Comprehensive Plan designates the area in which the subject site is located for potential development of single .family residences. Single family use is proposed by the applicant. 3. The proposed single family development will ,be served by the commercial areas developing to the south, along N.E. 4th Street, and to the north, along Sunset Boulevard N.E. The proposed use will permit use of the subject property for needed single family residential development. The use of this area will permit the in-filling of the area rather than extending growth into other sparsely developed areas. 4. Any use of this area whether generated by. the proposed subdivision or some other development will have some impact on Kiwanis Park. Therefore, the applicant should. provide a buffer along all property lines which the subject property shares with the park. A covenant to provide a buffer of. 10 feet of natural landscaping will protect the park from development but_not deny the applicant reasonable use of the subject property. CONCLUSIONS: (Preliminary Plat) 5. The proposed preliminary plat is compatible with the Comprehensive Plan and surrounding land uses in the area. As previously mentioned, the area is potentially designated as single family residential and is surrounded by similar uses on generally similar sized lots. 6. All of the proposed lots either equal or meet the minimum requirements of the Subdivision Ordinance. One of the lots, containing the applicant's current residence, will be much larger than•the 'remaining lots. Another of the lots has a pipestem access and the applicant has requested an exception for that lot. 7. The Planning Department has indicated that N.E. ' 10th Street will be opened through the proposed subdivision.. There would still be a small section of this street right- of-way which will not be opened if the proposal is completed. The eventual development of N.E. 10th Street can be expected to generate considerable use of this cross street because it will. be the only east/west .street between N.E. 4th Street and N.E. 12th Street. ' Such useage will inevitably impact residents along N.E. 10th Street. The impact of opening N.E. 10th Street was not 'fully reviewed at the hearing on the subject matter. N.E. 10th Street has the potential of becoming a major east/west connector between the large commercial shopping areas west on Sunset Boulevard N.E. and the expansive residential communities to the east. Unlike property along N.E. 4th Street and N.E. 12th Street which are zoned or used for either commercial or multifamily uses, most of the properties along N.E. 10th Street are single family residential. Single family uses should be protected from heavy traffic. On page 4 of the Renton • Urban Area Comprehensive Plan (1965) a residential neighborhood is described as an area of relatively solid patterns of homes, linked. by quiet streets. . .". "In planning neighborhoods,. the creation of residential districts free of overcrowding influences, arterial traffic, . . .are important objectives." "(Arterials) should not conflict or interfere with the functions of residential neighborhoods." At the same time the Arterial and Street Plan for the Renton Urban Area has designated N.E. 10th Street as a Community Arterial (Map, page 13; Table 2, page 35) . A Community Arterial is -defined- on page 6 as a street which "should be located on neighborhood boundaries and should serve major traffic volumes generated within the community. They should serve as a secondary connecting link between residential areas and major facilities, such as shopping centers, located therein.' N.E. 10th Street appears to cut through a neighborhood rather than pass along its boundaries. It would pass through not only the subject proposal but also the single family area to the west. Further review would appear to be indicated before N.E. 10th Street is opened as a community arterial." The addition of this 18-lot plat will not of itself generate enough traffic to warrant such opening. The public safety and welfare would be better served by a review of the particular impacts which such an opening would have on the R-2 -79 Page Three PP-334-79, E-347-79 3. Pursuant to .the'City of Renton'.s Environmental Ordinance and the State:Environmental ' Policy Act of -1971-, R.C.W-. 43.21.C. , as amended, a Declaration of Non-Significance . has been issued for the subject.proposal -by Gordon Y. Ericksen,' responsible official. 4. Plans for the proposal have been reviewed by, all city, departments -affected by. the impact. of this development. • 5. There was no opposition to the proposal- expressed. 6. The Public Works Department indicated that sewer and water service can be made available for the subject property. 7. The proposal is compatible with the' required setbacks, lot coverage and height- requirements of Section-.4-704 of Title IV, Ordinance No. 1628, Code of General Ordinances-. 8S. The subject site. is• located along Union Avenue-N.E. in the vicinity .'of- N.E. 10th Street. Approximately the eastern two-thirds' of the site is covered by grasses, with the western one-third- covered mostly by-Douglas Fir trees and some deciduous trees.- 9. ' The- subject site was-annexed into 'the the City of Renton by'.Ordinance No. 1609, dated April 29, 1957. The current OS-1 zoning was applied at that 'time: 10. The subject site is just north of Kiwanis Park. Development in the area generally consists of single family residences. There is a- hub of commercial growth occurring- on or near N.E. 4th Street and Union -Avenue N.E. The same is true along Sunset Boulevard N.E. The subject site is the last sizeable area in this vicinity to .be proposed for development. The site is crossed in the western-portion by the BPA. transmission line- easement. 11. The Comprehensive Plan indicates that this area is suitable for -single family residential use.- Except for the park to the south, single family uses of various densities- surround the site. Development to the north and northwest is in a G-7200 zone. Lots to the west, are.`developed- in. a GS-1 zone and lot size'varies. To the east, which consists- of -both unincorporated--King County and the-City of Renton, development is also .single family residential.' 12. , Union Avenue: N.E. is a north-south arterial. The major 'east-west routes in the ,area are N.E. '4th Street. to the- south and N.E.- 12th Street to the. north. The Planning Department has indicated that N.E. 10th Streetwill be opened. through the 'proposed. plat. N.E. ' 10th Street 'would then become a direct route to Sunset Boulevard N.E: from Union Avenue N.E. 13. - Both sewer and water service will have to be extended to the proposed-plat. -Standard • fees for hookup will 'apply. 14. Since annexation, the area has not been the subject of any other rezone requests. The Comprehensive Plan was the only review of the subject area. The Comprehensive Plan indicated a single ,family suitability for, this area. 15: If the :rezone is approved ,the applicant proposes, developing an -18-lot subdivision on the subject property. _ The plat would-consist of 17 lots of approximately 7500 .square. feet and one large 'lot which is developed' with. the applicant's residence. Lot 4' of the-.proposed subdivision would have a pipestem' access 20 feet wide and about 64 feet long. There .is currently no public street in the vicinity- of -the proposed pipestem lot, and none is proposed. An exception is. required to create a pipestem lot pursuant to -Section 9-1108.23 (F)3(d) . CONCLUSIONS:- (Rezone) 1: , The proponent -of.a rezone.must- demonstrate compliance with at least one of. the three' criteria- listed in Section. 4-3014 which providesin part that; a. Gustafson Preliminary Plat I have reviewed the.Planning Department's request for reconsideration and find that at this time there is no merit in reconsidering the above captioned matter. While the Examiner's Report on the matter implies reconsideration per Recommendation No. 4, ,this was to occur after review by the Planning and Public Works Departments in consultation with other city agencies mentioned in your memorandum of June' 20, 1979. The implication was that reconsideration would be limited to whether or not the applicant should open and improve a • public right-of-way, not whether to create a community arterial on N.E. 10th Street. . The City Council has just had Occasion within the last two, weeks to study the Six Year Transportation Improvement Program & Arterial Plan.• The matter of the extension and opening of N.E. 10th Street was not brought up at any of those public hearings or meetings. .That would.have been an appropriate forum for further review and discussion with affected members of the general public about the extension. of. N.E. 10th Street. As the Examiner's Report notes, the definition of a "community arterial" and the definition of a "residential neighborhood," which the subject subdivision in part represents, appear to clash. 'The same clash of obectives occurs along N.E. 10th Street west of the subject property. The creation of an arterial is a policy matter to be ultimately determined by the City Council subsequent to a public hearing. However, the right-of-way in question will .be required to be dedicated to the city' for public access per Recommendation No. 4 and 'could be opened at some future date. Fred J. As noted in conclusion #7 , this matter was not fully reviewed at the hearing; and it is our opinion that the matter of whether through access should be allowed is of vital importance. As noted in paragraph 3 of conclusion #7 , N.E. 10th is designated as a community arterial street; and the street right-of-way to the west is 60 feet, which would be consistent with this classification. Due to the location of this street, it provides : a. Less circuitous Fire Department access to areas east of Union Avenue and Redmond Avenue from the Highlands Station.. b. TGenerally improved traffic circulation for all areas east of Monroe Avenue in accordance with the adopted arterial street program. Due to the fact that the matter of the street extension was not fully reviewed and considered by the public, staff, and applicant at the public hearing, we would recommend that the Hearing Exami- ner reconsider the matter of the street extension at ,a public hearing providing for input from affected departments, the appli- cant, and the affected general public. This would appear to be consistent with the intent of 9-1106. 2.E (2) , which states that The City. . . shall inquire into the public use and interest proposed to be served, . . .
