Since there were none, the hearing on File No. R-344-79 was closed by the Examiner at 10:40 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a reclassification of +5,000 square feet of property from G-6000 to L-1 in order to develop a parking facility on the property. 2. The Planning Department report sets forth the issues, applicable policies and provisions, findings of fact, and department recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 2. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance has been issued for the. subject proposal by Gordon Y. Ericksen, responsible official, subject to use of the property as a parking facility only. 4. Plans for the proposal, have been reviewed by all city departments affected by the impact of this development and no adverse comment was expressed. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of, Sections 4-712 and 4-718 of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The subject property was annexed into the city by Ordinance No. 1745, dated April 14, 1959. The current "G" was applied at that time. 9. The subject property is located at the southwest corner of S.W. 13th Street and Seneca Avenue S.W. The southern property• line lies along FAI-405. 10. The site is generally level and is covered by scrub grass. 11. West and east of the subject site are single family homes. Property directly north of the site and across S.W. 13th is being developed by the applicant with business uses. 12. The zoning in the area consists of a mixture of districts. To the east is an L-1 district. The applicant's property to the north is also L-1. R-4 property is located north of the subject site. Further north there are still areas zoned G-6000. To the south, as indicated above, is FAI-405. 13. The Comprehensive Plan indicates that this area is suitable for development as a manufacturing park. 14. The applicant proposes to develop a parking facility for six automobiles on the subject site. The Planning Department has indicated that two possible parking configurations are available to the applicant. Of these two plans, the preferred plan (Plan 2, Exhibit #3) would provide parking parallel to FAI-4,05 and would comply with the Parking and Loading Ordinance. 15. The increased traffic expected to occur as a result of the parking lot is within the acceptable levels for the access streets. 16. The applicant has agreed to restrict use of the subject site to parking only. He also indicated that he would be willing to provide landscaping as approved by the Planning Department. CONCLUSIONS: 1. The applicant of a rezone must be able to demonstrate that certain conditions exist which pertain to the property for which the reclassification was requested. One of these conditions is that the property has not been the subject of an area wide rezoning action. The subject property was zoned "G" in 1959 and has not been the subject to any other rezone actions. RECOMMENDATION: Hearing Examiner: Approval with. restrictive covenants PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on May 24, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on, file with the application, and field checking the property and 'surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing, was .opened on May 29, 1979 at 10:30 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and' reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Steve Munson, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: • Exhibit #2: Vicinity Map with-staff comments Exhibit #3: Staff's Proposed Parking Layout The Examiner noted a typographical error contained in Section L.1 of Exhibit #1 which . denotes approval of •Ordinance No. 3053 in August, 1979. He also inquired regarding the reason for application for a rezone •rather than a .special permit.to utilize the property for parking .purposes. Mr. Munson indicated that because other rezones to L-1 have occurred in the area, the proposed rezone provides consistency with the' existing zoning pattern. The Examiner inquired regarding the rationale to request rezone of the property to L-1 rather than B-1 designation.. Mr. Munson indicated that .the applicant ,had requested L-1 zoning, on the site. The Examiner inquired if the parking lot will be located the proper distance'from the proposed business use north of the site. Mr. Munson responded affirmatively, and responding to the Examiner's earlier inquiry, advised that no other . B-1 zoning exists in the immediate vicinity. The Examiner referenced B-1 zoning designated on a vicinity map attached to Exhibit #1 for the property directly north of the subject site. David Clemens, Senior Planner, indicated that the map is in error and should reflect L-1 zoning on the property. The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Gary Hohmann 14006 N.E. 74th Redmond, WA 98052 Mr. Hohmann indicated his concurrence in the report with the exception of page 3 which had been inadvertently included'and does not pertain to the subject request. The Examiner requested confirmation that the site will be utilized strictly for parking • purposes, will contain six spaces, and will not allow signing designating the proposed U business use to the north. Mr. Hohmann confirmed the applicant's intent. The Examiner 7'' inquired if 'retention and detention systems will be provided on site. Mr. Clemens advised that conformance is .required by ordinance. 4 The' Examiner requested testimony in support or opposition to, the request. There was no 3.•; response. He then, requested a final recommendation from the Planning Departmentat,i representative. Mr. Munson indicated that the recommendation contained in Exhibit #1 j[J would remain as submitted. yU rl t.t' r. R=34Y -v.9 Page Four Pursuant to Title IV, Section 3015 of the City's.Code, request for reconsideration must be filed in writing on or before June 18, 1979. Any aggrieved person. feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen 14) :days from the date of the Examiner's decision. This request shall. set forth the . specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that• such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting other specified 'requirements. Copies of this ordinance are available for inspection in the Finance Department, first floor of City Hall, or same may be purchased at cost in said department. R-344-79 Page Three 2. 'The Comprehensive Plan was enacted in 1965 and indicated that the area in which the • subject site is located would be suited for a manufacturing park. The property is only about. 5,000 square feet and the designation of this site for such a purpose would provide little practical effect. Other continuing uses in the area would probably prevent the successful acquisition of a parcel large enough to allow development of a manufacturing park. On the other hand, the applicant intends to use the property as a parking area to serve his nearby business. , The designation of this property as L-1 would permit the applicant to make reasonable use of the property. The intended use in conjunction with the applicant's nearby business Would be compatible with the general purposes of a manufacturing park to provide suitable location for business uses, and adjacent parking. 3. The L-1 designation would also be compatible with the property located to the east and north which bears the same L-1 designation. The reclassification would have no appreciable effect on FAI-405 to the south and the intended parking facility would not cause any adverse effects on traffic on• that roadway. To insure that the property will not .be used for purposes other than parking, a covenant should be required of the applicant. 4. Since the annexation and designation of this parcel, FAI-405 has been. built which resulted in this small triangular lot. The intended use of the property appears to be the only reasonable use of this small lot. While a single family home could be built here, the location of FAI-405 immediately to the south would appear to hamper such development potential. The landscaped parking facility will actually create a buffer between FAI-405 and the uses across S.W. 13th Street. RECOMMENDATION: it is the recommendation of the Examiner to the City Council that the reclassification of the subject property from G-6000 to L-1 be approved subject to the following conditions: 1. Construction of the parking facility according to the plan recommended by the Planning Department. 2. Submission of a landscape plan subject to approval by the Planning Department. 3. Execution of restrictive covenants which: a. Limit the use of the subject property exclusively to parking; and b. The report stated the average savings for low-income elderly would amount o $41 .58 per year. This would result in a reduction to the Current Fund revenue of approximately 12,000 per year. Approval CORRESPONDENCE Letter from Renton Police Officers Guild, James Foust, President, Historic Building presented a resolution declaring the building on Lots 18 and 19, Declaration Block 9, Town of Renton, a "Historic Building" (located at 1025 South 3rd St. ) The letter told the history of the building which Former Puget Power was built in 1898. The Snoqualmie Falls Power Co. Sub-Station and then Holmes No. 2 .is the oldest brick building in Renton and served as a Electric Building receiving and switching station for electricity from Snoqualmie at Mill Ave. S. Falls, Washington's first hydroelectric plant. The letter and S. 3rd St. ) requested the declaration to establish historical value and to allow restoration under the "Historic Buildings" Section of the Uniform Building Code.
