REPORT AND DECISION.
APPLICANT:

SUMMARY OF REQUEST: The applicant requests a variance from the city's Shoreline
Master Program to permit construction of a floating dock 180
feet in length, 80 feet in excess of the allowable 100 feet.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions.
I Hearing Examiner Decision: Approval with restrictive covenants.
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on February 14, 1980.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on February 19, 1980 at 9:30 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.

Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following
additional exhibits into the record:
Exhibit #2: King County Assessor's Map
Exhibit #3: Cross Section of Proposed Dock
Mr. Blaylock noted that the only alternative to extension of pier length would be to
dredge the area which would create greater impact and is specifically prohibited in
provisions of the Shoreline Master Program. He corrected Section L.5 of Exhibit #1 which
refers to Section 7.12.03 (C) (1) (6) of the Shoreline Master Program and should be revised
to reflect the designation (b) instead of (6) . Mr. Blaylock advised that specific soundings
or measurements should be submitted to substantiate information reflected in Exhibit #3.
He also added a recommendation to require that the substantial development permit when
issued would specifically require that all other necessary state and federal permits be
obtained for the site.
The Examiner requested testimony by the applicant. Responding was:

Mr. Seaborn ;submitted an aerial photograph, 1"-200' scale, to illustrate the conformity
of the proposal to existing piers in the general vicinity, and show the existing shallow
water shelf which extends beyond 200 feet from shore. Referencing departmental
recommendation M.1 of Exhibit #1 which requires submission of data to substantiate the
depth of the water as depicted on the cross section, Exhibit #3, Mr. Seaborn requested
clarification of the intent of the requirement. Mr. Blaylock advised that soundings
could be provided by a licensed engineer or hydrologist to aid the department in
determining Ithe appropriate dock length. Mr. Seaborn indicated that other jurisdictions
had previously allowed a staff member to accompany him by boat to view subject sites and
witness sounding procedures. The Examiner stated that submission of soundings should
have been accomplished prior to the public hearing to enable the Planning Department to
arrive at aispecific conclusion regarding the proposal. He indicated his preference to
continue the public hearing to allow submission of required data. He also noted that the
Building Division had submitted comments stating the opinion that adequate water depth
exists at 100 feet from shore to accommodate a pleasure craft. Mr. Seaborn objected to

continuation of the hearing, citing many delays incurred by the applicant in processing
the application through the Planning Department, and his unawareness of the required
submission until receipt of the Planning Department report in the mail.
The Examiner requested further testimony in support or opposition to the application.
There was no response. He then requested testimony by Building Division staff.
Responding was:

Mr. Nelson expressed concern regarding establishment of dock length without knowledge
of water depths in the vicinity of the proposed dock. He indicated willingness to review
additional data upon submission and provide further recommendations from the Building
Division.
The Examiner advised that the public hearing would be continued not for the purpose of
further testimony, but to allow the applicant additional time to provide documentation
of certified soundings. He indicated that upon receipt of the information no later than
5:00 p.m. on Monday, February 25, 1980, he would proceed with review of the application
and the report would be issued within 14 days from that date.
The Examiner requested further testimony. Responding was:

Mr. Dana inquired if the soundings could be taken by the Building Division or other city
staff. Although the Examiner indicated that city departments could be contacted regarding
such procedures, it was his opinion that staff support is not generally available to the
private developer.
Mr. Blaylock entered an additional exhibit into the record which was labeled as follows:
Exhibit #4: Letter to Planning Department from Mr. & Mrs.
John Parks, dated February 18, 1980, supporting
approval of variance for dock length.
The Examiner continued the public hearing to close of business, February 25, 1980, for the
purpose of submission of further documentation. He also advised that an extension of time
may be possible upon request. Since there were no further comments, the hearing regarding
File No. V-006-80 was closed by the Examiner at 10:03 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters :the following:
FINDINGS:
1. The request is for approval of a variance from the provision :of the Shoreline Master
Program which limits structures built over the water to 100 feet in length.
2. The Planning Department report sets forth the issues, applicable policies and provisions,
and departmental recommendations in this matter, and is entered as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 4.3.21.C. , as amended, the subject proposal has been
determined exempt from the threshold determination by Gordon Y. Ericksen, responsible
official.
4 . Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. All existing utilities are available and in close proximity.
6 . The subject property was annexed into the city in 1960 and the G-6000 (General;
Single Family Residential; minimum lot size - 6,000 square feet) zoning was applied
at that time.
7. The site is generally level sloping down to Lake Washington. The lake bottom continues
this gentle slope dropping approximately five feet over 180 feet.
8. The lake bottom in this area is composed of mud which is the result of stream
sedimentation. There is also debris along the lake bottom from the former logging
operations which previously occupied the site.

9. The applicant proposes constructing a 180--foot pier in order to moor a boat in
water deep enough to provide both safe passage and safe moorage. The applicant
indicated that the pier would be 12 feet in width but without further variance,
piers may not exceed eight feet in width.
10. There are numerous pilings in the lake extending out about two hundred feet into the
lake. These pilings are from the former commercial operations which occupied the
area in the past.
11. There are similar structures up to approximately 180 feet in length located north of
the subject site which permit the owners of these northerly properties to moor boats
in water of adequate depth.
12. The applicant has submitted data in the form of soundings which substantiate the
cross-sections of Exhibit #3.
CONCLUSIONS:
1. In order for an applicant to receive a variance from the requirements of the Shoreline
Master Program of the City of Renton, the applicant must demonstrate that the
following criteria have been met:
a. That extraordinary conditions apply to the subject property and do not apply to
other property in the same vicinity, and the imposition of the bulk standards,
i.e. 100-foot pier length, will deny the applicant reasonable use of his property.
b. The variance will preserve or permit a valuable property right possessed by
other property owners in the same vicinity.
c. The use permitted by the variance will not be materially detrimental to the public
welfare or injurious to other property in the same vicinity.
d. The variance will be in harmony with the general purpose of the Master Program.
e. The public welfare will not be harmed and that the harm done to the area will
not be greater than the harm done to the applicant (W.A.C. 173-14-150(3) ;
Shoreline Master Program 8.02) .
The applicant has demonstrated that the requested variance is warranted.
2. The topography of the lake bottom immediately off shore of the subject property
creates a shallow bench which is unique to the area. This condition makes it
difficult if not impossible for the applicant to safely moor a boat within the
required 100 feet of shore. One hundred foot piers are generally sufficient in
most areas of the lake to allow safe and useful moorage but in this case the
applicant cannot use his lakefront property in a similar manner as other property
owners in the vicinity use their properties because of the extreme shallow depth.
3. The presence of old pilings extending out about 200 feet into the lake in the area
just south of the subject property and the shallow depth already limit navigation
in the area. The 180-foot pier proposed by the applicant will not cause any harm
to the general public and will not harm neighboring property.
4. The Master Program was established to preserve shorelines in the City of Renton and
to also permit those uses of shorelines which are natural and consistent with
waterfront property. The approval of the variance will permit the occupant of a
single family home to make appropriate use of his waterfront and will not harm
the general welfare nor inhibit navigation in the area.
5. Presently, the applicant cannot safely moor nor operate boats in the shallow area
without encountering mud and debris. The general public also encounters these
conditions if they travel within 180 feet of shore. Approval of the variance will
not interfere nor conflict with public passage in the area.
6. The applicant has not applied for and is not granted a variance from the provisions
establishing the maximum width of piers as eight feet.
DECISION:
The variance from the Renton Shoreline Master Program to construct a 180-foot pier is
granted subject to:

Gentlemen:
As neighbors of Mr. Donald Dana at 5219 Ripley Lane North, and
of Mr. Herb' Nissen at 5201 Ripley Lane North, we wish to go on record
as being in support of their requests for variances in constructing
docks exceeding one hundred feet in length as allowed by the Shoreline
Master, Plan.
This shoreline area of Lake Washington has an accumulation of
silt that results in very shallow water depth close to the shoreline.
We own property at 5227 Ripley Lane North, and reside at 5301 Ripley
Lane North, so we are personally aware of silt and the shallow water
depth problem caused by the silt . A dock of one hundred seventy to
one hundred eighty feet is necessary in order to have enough water
depth : for. boat moorage and in order to have a safe swimming area and
other safe recreational uses of the waterfront .
We support Mr. Nissen 's request for a one hundred s gYrty foot
dock, and Mr. 'Dana's request for a one hundred foot dock.

The subject site was annexed into the City by Ordinance
1823 dated April 21 , 1960 , at which time the present
zoning classification was applied .

I. Topography : The site of the dock is basically
level sloping gently to the west . The lake bottom
drops approximately 5 feet in 180 feet , according
to the cross section submitted in the application .

2 . Soils :, The houses rests on Indianola loamy fine
sand, 0-4% slopes' ( InA) . Permeability is rapid ,
runoff is slow and the erosion hazard is slight .
This soil is used for timber . The thick layer
of mud lies adjacent to the shoreline under the
water . This is a result of sedimentation from
and intermittent stream.
3 . Vegetation : The mud does provide a sufficient
base for vegetation to attach to . Free floating
vegetation is found in the water .
4 . Wildlife : The mud provides some habitat for micro-
organisms .
5 '. Water : Not applicable .
6 . Land Use : Single family residence .
E . NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are principally single family
residential in nature . The area was used in the past
for logging operations . There are numerous pilings
south of the Nissen residence .

1 . The applicant is requesting a variance from the
Shoreline Master Program which allows a maximum.
dock length of 100 ° . The applicant proposes to
construct a dock of 180 ' in length .
2 The site involved is at the mouth of an old stream
bed that presently has some intermittent flow.
The lake bottom is a shallow shelf consisting of
mud . The water depth varied from 2 to 7 feet at
approximately 180 ° feet fromthe existing shoreline .
The mud lake bottom along with the shallow depth
of the water causes a major problem to the applicant
in using a motor boat . The mud sucks up into the
engine . The applicant is restoring an old tug
boat , The Little David , which is presently grounded
on the mud .
3 . The Shorelines Management Act governs development
on the shoreline . The proposed pier will cost more
than the allowed $2500 and a substantial development
permit has been applied for . The Revised Code of
Washington and the Washington Administrative Code
require that specific criteria established under
WAC 173-14-150 be applied . The variance is not
granted by the City of Renton , the variance is granted
by the State of Washington . The City of Renton
makes a recommendation to the state and the state
must concur in that recommendation for the variance
to become valid . The variance criteria differs
whether the development is in the water or on the
upland portion from a shoreline . The following
analysis addresses each of the six criteria to be
reviewed by the state :
a. "That strict application of the bulk , dimensional
or performance standards as set forth in the
applicable master program precludes a reasonable
permitted use of the property. "
The physical limitations of the shelf extending
from the residence precludes the use of a standard
dock less than 100 ° in length . A 100 ° dock

would allow the motor boat' to sit in approxi-
mately 4 ' of water thus sucking up the mud from
the bottom of the lake . This• would cause unreasonable
damage to the boat and to the property owner .
The Shoreline Master Program•, Section':7 . 12 .03 (C) ( 1) (a)
suggests that 8 feet of water depth is necessary
for residential docks . In addition , the Army
Corps of Engineers varies the level of Lake
Washington for flood control . - The lake level
fluctuates approximately 2 feet . In the winter-
time it is lower , and in the summertime it is
higher .
b . "That the hardship described in WAC• 173-14--150
3 ) (A) above is specifically related to the
property , and is a result of a unique condition
such as irregular. lot shape , size, or natural
features and the application of the Master Program
and not , for. example , from deed restrictions
or the applicant ' s own action . "
The physical limitation is a result of the mud
bottom of the lake and a very shallow shelf
extending from the property . This shelf extends
approximately 180-200 feet from the existing
shoreline . In the past , this area was used for
a log storage area and the bottom of the lake
has added debris from logs . The applicant is •
not responsible for the natural feature of the
lake bottom .
c . "That the design of the project will be compatible
with other permitted activities in the area
and will . not cause adverse effects to adjacent
properties or to the shoreline environment designation . "
The property owner to the south has 'requested
a similar pier (see File No . V-005-80) . The
property immediately adjacent to the north of
the subject site presently has a pier which
is approximately 170 ° long . :;The natural underwater
shelf. continues to narrow as it goes to the
north and approximately 3 more residences to
the north the docks can be of standard size .
The area to the south has been used in the past
for a log storage facility and substantial pilings
and piers were constructed to at least 200 '
from the shoreline . Therefore , the design of
the project appears to be compatible with the
other established and permitted activities in
the area and it will not cause an adverse effect
to the adjacent properties .
d . "That the request for the variance will not
constitute a grant of special priviledge not
enjoyed by the other property owners in the
area and will be the minimum necessary to afford
relief. "
The length of the dock at 180 ' will be minimum
necessary to allow the functional use of the
moorage site for a motor. boat . It will not
be a special privilege in that there are other
examples of existing docks which are in the
approximate neighborhood of 160-180 feet in
length .

e , "That the public rights of navigation and use
of the shoreline will not be adversely affected
by the granting of the variance . "
The numerous pilings to the south already provide
a blockage of navigation within 200 ' of the
shoreline . The existing single family residential
dock to the north provides another blockage.
Therefore the area inbetween will not appear
to infringe upon that public right , it would
be continuation of .the existing patterns established
along the shoreline at this time .
f . "That the public interest will suffer no substantial
detrimental affect . "
The public use of the shoreline has been eliminated
by previous subdivision of the shoreline in
this area. The use of the water surface itself
has been limited by previous development and
by the fact that the area is very shallow (less
than 7 ' ) . It would appear that the public interest
is not going to be substantially impacted in
a negative manner by the proposed development
of the site .

The length of the dock at 180 ' appears to provide
more than enough length to allow the docking
of more than one boat . The dock should be used
exclusively by the property owner for his use .
It should not be used on a commercial basis
for other individuals . Moorage space is at a
premium throughout the Pacific Northwest and
approving a dock which could allow more than
personal use should be discouraged .
5 . Section 7 . 12 . 03 (C ) (1 ) (6) establishes the maximum
dock width..at• 8 feet . The proposal shows a
12-foot width . Therefore the plans will have
to be modified or a variance requested .
6 . The applicant has not submitted justification
to substantiate the variance request . The contractor
alludes to accurate soundings ; however , nothing
was provided to the Planning Department . A
cross section of the lake bottom and pier were
submitted without supporting data . -

Based upon the above analysis it is recommended that
the variance request , File No . V-006-80 be approved
with the following conditions :
1 . Submission of data to substantiate the depth of
the water as depicted on the cross section .
2 .'. Narrowing of the dock to 8 feet from 12 • feet .
3 . The filing of restrictive covenants that would preclude
the use of the pier for any commercial purposes .

1823 dated April .21 , 1960, at which time the present
zoning classification was applied .
D . PHYSICAL BACKGROUND:
1 . ' Topography : The site of the dock is basically
level sloping gently to the west . The lake bottom
drops approximately 5 feet in 180 feet , according
to the cross section submitted in the application .

2 . Soils : The houses rests on Indianola loamy fine
sand , 0-4% slopes ( InA) . Permeability is rapid ,
runoff is slow and the erosion hazard is slight .
This soil is used for timber . The thick layer
of mud lies adjacent to the shoreline under the
water . This is a result of sedimentation from
uhd intermittent stream .
3'. Vegetation : The mud does provide a sufficient
base for vegetation to attach to . Free floating
vegetation is found in the water .
4 . Wildlife : The mud provides some habitat for micro-
organisms .
5 . Water : Not applicable .
6'. Land Use : Single family residence .
E . NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are principally single family
residential in nature . The area was used in the past
for logging operations . There are numerous pilings
south of the Nissen residence .
F . PUBLIC SERVICES :
1 . Water and Sewer : An 8" water main and an 8 " sewer
main run north-south on Ripley Lane .
2 . Fire Protection : Provided by the Renton Fire Department
per ordinance requirements .
3 . ' Transit : Metro Transit Route #240 operates along
I-405 within 1/4 mile to the east of the subject
site .
4. Schools : Hazelwood Elementary School is approximately
1/3 of a mile to the east . McKnight Junior High
School is 1-3/4 miles to the southeast. The high

1 ; The applicant is requesting a variance from the
Shoreline Master Program which allows a maximum.
i dock length of 100 ° . The applicant proposes to
construct a dock of 180 ° in length .
21 The site involved is at the mouth .of an old stream
bed that presently has some intermittent flow.
The lake bottom is a shallow shelf consisting of
I mud . The water depth varied from 2 to 7 feet at
f. approximately 180 ' feet fromthe existing shoreline .
The mud lake bottom along with the shallow depth
of, the water causes a major. problem to the applicant
in using a motor boat . The mud sucks up into the
engine . The applicant is restoring an old tug
boat , The Little David , which is presently grounded
on the mud .
3,. ' The Shorelines Management Act governs development
on the shoreline . The proposed pier will cost more
than the allowed $2500 and a substantial development
permit has been applied for . The Revised Code of
Washington . and the Washington Administrative Code
require that specific criteria established under
WAC 173-14-150 be applied . The variance is not
granted by the City of Renton , the variance is granted
by the State of Washington . The City of Renton
makes a recommendation to the state and the state
must concur in that recommendation for the variance
to become valid . The variance criteria differs
whether the development is in the water or on the
upland portion from a shoreline . The following
analysis addresses each of the six criteria to be
reviewed by the state :
a. "That strict application of the bulk , dimensional
or performance standards as set forth in the
applicable master program precludes a reasonable
permitted use of the property. "
The physical limitations of the shelf extending
from the residence precludes the use of a standard
dock less than 100 ' in length. A 100 ' dock

would allow the motor boat' to sit in approxi-
mately 4 ' of water thus sucking up the mud from
the bottom of the lake ® This would cause unreasonable
damage to the boat and to the property owner .
The Shoreline Master Program•, Section: 7 . 12 ,03 (C) (1 ) (a)
suggests that 8 feet of water depth is necessary
for residential docks . In addition , the Army
Corps of Engineers varies the level of Lake
Washington for flood control . The lake level
fluctuates approximately 2 feet . In the winter-
time it 'is lower , and in the summertime it is
higher .
b , "That the hardship described in WAC 173-14-150
3 ) (A) above is specifically related to the
property , and is a result of a unique condition
such as irregular lot shape , size , or natural
features and the application of the Master Program
and not , for. example , from deed restrictions
or the applicant ' s own action . "
The physical limitation is a result of the mud
bottom of the lake and a very shallow shelf
extending from the property . This shelf extends
approximately 180-200 feet from the existing
shoreline . In the past , this area was used for
H' a log storage area and the bottom of the lake
has added debris from logs . The applicant is
not responsible for the natural feature of the
lake bottom .
c . "That the design of the project will be compatible
with other permitted activities in the area
and will not cause adverse effects to adjacent
properties or to the shoreline environment designation ,"
The property owner to the south has requested
a similar pier (see File No . V-005-80 ) . The
property immediately adjacent to the north of
the subject site presently has a pier which
is approximately 170 ' long . ;The natural underwater
shelf continues to narrow as it goes to the
north and approximately 3 more residences to
the north the docks can be of standard size .
The area to the south has been used in the past
for a log storage facility and substantial pilings
and piers were constructed to at least 200 '
from the shoreline . Therefore , the design of
the project appears to be compatible with the
other established and permitted activities in
the area and it will-- not cause an adverse -effect
to the adjacent properties .:
d . "That the request for the variance will not
constitute a grant of special priviledge not
enjoyed by the other property owners in the
area and will be the minimum necessary to afford
relief, "
The length of the dock at 180 ' will be minimum
necessary to allow the functional use of the
moorage site for a motor boat . It will not
be a special privilege in that there are other
examples of existing docks which are in the'
approximate neighborhood of 160-180 feet in
length .

e . "That the public rights of navigation and use
of the shoreline will not be adversely affected
by the granting of the variance , "
The numerous pilings to the south already provide
a blockage of navigation within 200 ' of the
shoreline . The existing single family residential
ii dock to the north provides another blockage .
Therefore the area inbetween will not appear
l to infringe upon that public right , it would
be continuation of the existing patterns established
along the shoreline at this time ,
f. "That the public interest will suffer no substantial
detrimental affect . "
The public use of the shoreline has been eliminated
by previous subdivision of the shoreline in
this area . The use of the water surface itself
has been limited by previous development and
by the fact that the area is very shallow (less
than 7 ' ) . It would appear that the public .interest
is not going to be substantially impacted in
a negative manner by the proposed development
of the site .
4 . The length of the dock at 180 ' appears to provide
more than enough length to allow the docking
of more than one boat . The dock should be used
exclusively by the property owner for his use .
It should not be used on a commercial basis
for other individuals . Moorage space is at a
premium throughout the Pacific Northwest and
approving a dock which could allow more than
personal use should be discouraged .
5 . Section 7 ,12 . 03 (C ) (1 ) (6 ) establishes the maximum
dock width. at 8 feet . The proposal shows a
12-foot width. Therefore the plans will have
to be modified or a variance requested .
1 6 . The applicant has not submitted justification
to substantiate the variance request . The contractor
alludes to accurate soundings ; however , nothing
was provided to the Planning Department . A
cross section of the lake bottom and pier were
submitted without supporting data . -
MM . DEPARTMENTAL RECOMMENDATIONS:
Based upon the above analysis it is recommended that
the variance request , File No . V-006-80 be approved
with the following conditions :
1 . Submission of data to substantiate the depth of
the water as depicted on the cross section ,
2'. Narrowing of the dock to 8 feet from 12 feet .
3 . The filing of restrictive covenants that would preclude
the use of the pier for any commercial purposes .

Gentlemen:
As legal agent for the above, I am requesting a
variance of 80 ' from your 100 ' maximum length re-
quirement as outlined in your master program. This
180 ' long pier will be a floating pl.fLand constructed
our of fir and there will -be approximately seven
piling supporting this pier structure. Additionally,
we are asking that three mooring piling be driven out-
side the 100 ' limit.
After takingKeveral accurate soundings it has been deter-
mined that there is s allow water shelf in the area.
This shelf runs in a Southerly direction for several hun-
dred feet and a Northerly direction for a few hundred feet,
then the water depth returns to normal . Without the
granting of this variance, Donald Dana cannot possibly
use his property for boat moorage beyond a small ski boat.
Because this shallow water shelf extends even further than
the proposed pier, this project will not hinder the normal
navigation of vessels in the area.
The proposed length of th^ pier is not unusual to piers in
the surrounding vicinity. I feel the proposed pier will
be in harmony with the general purpose and intent of the
master program.

COMMENTS :
Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a, major action.
Please answer the 'following questions as completely as you can with the information
presently available to you. Where explanations of your answers are required, or where
you believe an explanation would be helpful to government decision makers , include your
explanation in the. space provided, or use additional pages if necessary. You should
include references to any reports or studies of which you are aware and which are rele-
vant to the answers you provide. Complete answers to these questions now will help all
agencies involved with your proposal to undertake the required environmental review with-
out unnecessary delay.
The following questions apply to your total proposal , not just to the license for which
you are currently applying or the proposal for which approval is sought. Your answers
should include'the impacts which will be caused by your proposal when it is completed ,
even though completion may not occur until sometime in the future. This will allow all
of the agencies which will be involved to complete their environmental review now, with-
