North, Range 4 East, W.M. , in King County, Washington,
described as follows:
Beginning at the intersection of the north line of South 153rd
Street, with the east line of said Northwest 1/4 of the

5. Should permittee fail to remove, at the proper time, materials, works and structures referred to under paragraph 4,
the Director reserves the right to have it done at the expense of the permittee. . .
6. Any alteration of plans for works and structures made subsequent to the filing of application or the issuance of
permit shall be subject to approval by the Director.
7. The Director shall be notified by the permittee of the completion of works under this permit in order that he may
,make final inspection and give final approval.

Noting continuation of the item following approval of
phase one of the request , the Planning Director
advised that phases two through five of the proposal
are now open for consideration . He then described the
area involved in the various phases and indicated cur-
rent progress regarding the phase one portion of the
development. Partial fill only had been approved pend-
ing completion of a study of the Green River Valley
proposed drainage system. With the completion of that
study , approval is now requested for additional filling
in order to continue the proposed development . Noting
no committee report , the Planning Director referred the
Commission to a staff report , which recommends approval
of the final phases of the proposed development plan
subject to the conditions previously imposed with regard
to phase one and preservation of areas proposed for
retention as wetlands .

A review of the location , description and size of the site ;
and natural characteristics of the area was provided by
the Planning Director . It was noted that Puget Western has •
applications in process for a Shoreline Management permit fl
and a King County Hydraulics permit .
Applicant comment was invited by the Chairman . Gary Mix ,
Puget Western , Bellevue , reviewed the status of other per-
mits being applied for that are applicable to the proposal .
He stated that the .Special Studies Committee report had
been reviewed with them and that they concur .
A brief ,discussion relating to relevance of the Shoreline
Management Act followed .
The Chairman called for the. committee report . Commissioner
Wik , Chairman of the Special Studies Committee , stated that
the site had been visited and the topography noted . Sur-
rounding land characteristics abutting Springbrook Creek
are their primary concern . Natural characteristics of the
site were described , and their recommended conditions for
.approval were reviewed . .
Discussion ensued with regard to the recommended setback
from Springbrook Creek , effect on the P-1 Channel , runoff
control , and maximum height of fill suggested .
The Chairman invited comments from the audience in favor or
opposition to the application , but none were received . IT
WAS THEN MOVED BY S€HOLES , SECONDED BY WALKER , THAT THE
PUBLIC HEARING BE CLOSED . MOTION CARRIED .
SPECIAL STUDIES COMMITTEE REPORT
SEPTEMBER 8 , 1976
ITEM: PUGET WESTERN INC. , SPECIAL USE PERMIT FOR FILL
FINDINGS AND
RECOMMENDATION: The Committee conducted a field trip and study of the
request on August 31 , 1976 . The primary areas of con-
cern were as follows ;
1 . The effects of the fill on Springbrook Creek , the
primary drainage channel until the P- 1 channel
project design is finalized and constructed .
2 . The height and relationship of the fill to the
surrounding properties , the freeway , and Grady
Way.
3 . The effects on traffic along Grady Way during
the operation .
4. The timing of the operation .
5. The relationship to the comprehensive plan for
the valley , which specifies eliminating Spring-
brook Creek in this area and creating a green-
belt along the proposed P-1 channel . The restri -
ctive covenants running with the land specify a
minimum 20 foot setback from Springbrook Creek .
The Committee , after review and study , recommends
approval of the subject application subject to the
following conditions ;
1 . The toe of the proposed fill shall maintain a
minimum thirty ( 30 ' ) foot temporary setback
from the top of the bank of Springbrook Creek
until construction of the P-1 drainage channel
project.
2 . The maximum height of the fill shall be five
(5 ' ) feet from the average existing grade .
3 . The fill area shall be maintained in a. systematic
level position . Piles of unleveled fill mat-
erial shall not be permitted .
4 . The fill permit shall extend for a maximum 2
year period and shall expire on September 8 ,
1978 .
5 . All slopes shall be properly maintained and

RE : PUGET WESTERN , INC . - PROPOSED FILL AND GRADE BETWEEN
GRADY WAY AND FREEWAY , ADJACENT TO THE EAST SIDE OF
SPRINGBROOK CREEK. •
This is to remind you that the Puget Western fill proposal was
referred to the Special Studies Committee for review and report
back at the September 8th meeting . You might want to take a
field trip on your own ; or I ' ll be happy to take you .
The primary questions are the impacts to Springbrook Creek , the
control of the ongoing operation , and impacts to traffic along
Grady Way. Also , the proposed fill height should be diminished .
Adequate setbacks from Springbrook Creek (designated as green-
. belt on the Valley Comprehensive Plan ) should be considered at
least temporarily until the decision on the valley drainage
project is made . Puget Western has indicated that they would
not be adverse to such reasonable temporary setbacks to protect
the creek.
We should meet to discuss this item soon .

Dear Mr. Smith:
In answer to questions posed in your letter of July 8,
1976 , we do not feel traffic to and from our land during
filling operations will create much problem since we
can enter the property off Grady Way some 100 feet or
so east of the bridge end and utilize the unopened
Oaksdale Avenue Southwest. Grady Way' s alignment through
this area is rather straight which should not pose any
hazardous sight distance problems leaving or entering
the site.
We propose to continue filling operations over a
period of some two to three years, and perhaps less,
all dependent upon availability of suitable fill
material.
Any drainage facilities installed would be those
required by the fish and game permit for which appli-
cation has been submitted.
We will comply with any reasonable requirements the
City may place upon the property regarding setbacks
from Springbrook Creek. However, we feel that such
setbacks should be temporary until a final determina-
tion has been made with regard to the valley drainage
channel systems proposed by the Soil Conversation
Service.

A review of the application by the staff was requested by
the Chairman . Associate Planner Smith displayed maps and .
excavation , filling and grading plans , noting the property
location , zoning , development in the vicinity , size and
character of the site , and proposals for grading . Slides
and aerial photographs of the area were viewed .
Chairman Garrison invited a presentation from the applicant .
Jim Platt , 6001 - 140th N . E . , Redmond , representating the
applicant, advised the Commission of previous use of the site
which had created mounds of sand that required removal and
grading . He stated that while an architect had made a recom-
mendation regarding site development, there were no specific
plans at present. He responded to queries by the Commis-
sioners regarding preservation of natural vegetation and
plans for movement and removal of material . Mr. Platt
advised the Commission regarding their response to staff
inquiries relating to time limits , proposed date of opera-
tion , proposed drainage facilities , the amount of fill ,
traffic ,. noise and future plans for the property . He stated •
they are anxious to begin operations prior to the rainey
season in anticipation of construction in the spring .
Discussion among the Commissioners ensued relating to environ-
mental impact.
Noting no further questions of the staff , the Chairman called
for comments in favor or opposition from the audience , but
none were received . IT WAS THEN
ACTION:
MOVED BY WIK, SECONDED BY TEEGARDEN, THAT THE MATTER BE
REFERRED TO THE SPECIAL STUDIES COMMITTEE FOR STUDY AND REPORT

I talked today with Gary Mix, Puget Western representative,
regarding the proposed fill and grade. He said that they
were revising the plans and that he would send them together
with a detailed written explanation of the items expressed
in our July 8 , 1976 letter to him.
He also said that they would be agreeable to a setback from
the top of the bank of Springbrook Creek, and a reduction
in the height of the proposed fill. He said that Puget' s
publication personnel were handling the public notice portion
of the shoreline permit.
I reiterated our specific concerns with respect to the fill
including its appropriateness at this time.

Upon review of the above project , the following items
need further consideration :
1 . To mitigate the impact on Springbrook Creek ,
setbacks and vegetative bank and site restora-
tion should be proposed .
2 . Resolution No . 1923 requires that" in granting
commercial /industrial development permits with
the Green River Flood Control Zone District,
all land not needed or used for other purposes
be planned and managed for wildlife open-space
until such time as it is utilized in additional
developments . " This is in regard to the appli -
cation statement that there is "no intended use
of property at this time . "
3 . What is being proposed for surface water run-
off control ?

Dear Mr . Mix:
As per our previous telephone conversations it is our under-
standing that you will be publishing the Shoreline Permit
Notice and providing this department with an affidavit of pub-
lication . It has also been explained that the review period
cannot commence until the last date of publication . There is
also a need for an additional ( 4) copies of the revised plans
and vicinity map , and notorizing of the Shoreline application .
Upon reviewing the Environmental Impact Checklist and the
plans submitted with both the Shoreline and Special Permit
applications we feel that additional information is needed
• regarding the following specific concerns ;
1 . ,How do you propose access to the site for filling
purposes ? Access from Grady Way will cause serious
traffic and safety problems .
2 . What is the timing of the proposed operation?
3 . What drainage facilities do you propose , especially
with regard to reduction of possible impacts to
Springbrook Creek?
4 . Because of the proximity of Springbrook Creek , its
recognition in the Shoreline Master Program , and
its designation as a greenbelt on the City ' s Compre-
hensive Plan , there is a need to provide a reasonable
setback from the top of the creek bank . What measures
do you propose to comply with this objective and to
minimize possible impacts to Springbrook Creek?
