CASE# 24-2156 OF COLLISION 02/27/24 16:10 OF CbLLI510N NARRATIVE 24-2156 On 02/27/2024 at approximately 1621 hours, I was dispatched to a non-injury and non-blocking vehicle at the intersection of Benson Drive South and Benson Road South approaching, within the City Limits of Renton, County of King, State of Washington. While en route, Dispatch advised that both vehicles were pulled off the roadway at the intersection 108th Ave SE and SE 172nd Street. Upon arrival, I confirmed there were no complaints of injury requiring immediate medical response at the time of report. While on scene, I collected each involved party's information and involvement leading up to the collision. The driver of Unit#1 stated he and his two passengers (1 adult, 1 juvenile) were traveling southbound in about the 17200 block of Benson Drive South and approaching the intersection of Benson Road South. The driver of Unit#1 stated that he had pulled into the dedicated left-turn-lane (lane 3 of 3) to yield to traffic for an upcoming left-turn. The driver of Unit#1 stated he intended to proceed eastbound onto Benson Road South (a.k.a. 108th Ave SE) following the turn. The driver of Unit#1 stated that the traffic light was green and that he believed he had sufficient space to complete the turn. The driver of Unit#1 stated that he saw Unit#2 traveling in the approaching lanes of travel, however, the driver of Unit#1 still proceeded out into the intersection. The driver of Unit#1 stated that he assumed Unit#2 would brake for him making the statement, "she did not even brake for me" while turning. Both Unit#1 and #2 collided in the intersection subsequently causing minor damage to rear passenger quarter panel of Unit#1. The driver of Unit#2 said she was the sole occupant of her vehicle and was traveling northbound in about the 17200 block of Benson Drive South in lane 1 of 2. The driver of Unit#2 stated she was intending to continue north through the intersection. The driver of Unit#2 stated while continuing through the intersection, with a green light displayed, Unit#1 turned in front of her vehicle. The driver of Unit#2 stated she was unable to avoid the collision and struck Unit#1 causing minor damage to the front passenger bumper of Unit#2. The driver of Unit#2 stated that Unit#1 then began to flee the scene. The driver of Unit#2 followed Unit#1 until it pulled over at SE 172nd Street/ 108th Ave SE. Based on the above statements, I determined that the Driver of Unit#1 (MARCIAS HERNANDEZ) was the predominant factor for the collision due to not granting the right of way during a left turn causing a collision. The driver of Unit#1 violated RCW 46.61.185.1 by not granting the right of way to Unit#2 traveling in the roadway which had the right of way and was already underway. A DOL WACIC check confirmed that MARCIAS HERNANDEZ was in violation of RCW 46.20.015- Driving any motor vehicle upon a highway in the State of Washington without a valid Washington State driver's license listed in his name. MARCIAS HERNANDEZ was not only an unlicensed driver, but he was an uninsured motorist. I cited MARCIAS HERNANDEZ in-person for the Improper Left Turn and NVOL with Identification. MARIAS HERNANDEZ was issued a correction notice for operating a motor vehicle without insurance. Unit#1 was impounded due to not having a licensed driver available to retrieve the vehicle. A family member had later shown up to the scene after a tow truck had already arrived and lifted the vehicle. Unit#2 was able to be driven away without further incident.
