' 44120 s East Valley Highway, midway between Olympic Pipe Lin Mobil Oil site and Longacres Race Track. The subject site is also situated just north of the City's 20 acre • wetlands area and just west of the Springbrook drainage channel. - SUMMARY OF REQUEST: Applicant requests special permit pursuant to the City's Mining, Excavation and Grading Ordinance to allow removal • of a portion of the existing fill on the southerly half of the subject property and ,placing it on the northerly half of the subject site to obtain an overall site subgrade elevation of 14.5 feet. SUMMARY OF Planning Department: Approval subject to conditions. RECOMMENDATION: Hearing Examiner: Approval subject to conditions. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on July 5, 1977. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 12, 1977 at 9:10 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were sworn. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1 and entered the following additional exhibits into the record: Exhibit #2: King County Assessor's Map Exhibit #3: Existing Topography Map Exhibit #4: Drainage Plan Exhibit #5: Cross Section Map Exhibit #6: Access Warranty Deed Exhibit #7: Letter from Public Works Department, dated July 11, 1977 Exhibit #8: Letter from applicant, dated May 23, 1977 Mr. Smith reviewed Exhibit #7 which recommends installation of a two-foot berm around the site following filling operations to provide 50-acre feet of storage for storm water. Smith indicated that no response had been received to date. from the King County Hydraulics Division. The Examiner inquired about Item P.1. on Exhibit #1 regarding the portion of the site within 60 feet of the centerline of the Springbrook Drainage Creek and asked the relationship of the recommendation to the Mining, Excavation, and Crading ordinance setback requirements of 751feet. Mr. Smith indicated that the ordinance requirement referred to surface mining operations and was not considered a mandatory requirement. • In reference to Exhibit #1, Item P.4.� the Examiner asked if the requirement for utilization of 2% of .the site for landscape wildlife mitigation referred to existing or installed landscaping. Mr. Smith indicated that the site contained no significant vegetation and that a plant list for 'suitable material for on site development would Ibe • available from the Planning Department. The Examiner inquired about the compatibility of the proposed development with the Glacier Park fill project. Mr. Smith reported that the proposal is compatible with the existing development, although the 29 acres of wetland in the Glacier Park area did not create a typical site because of ,the difference in°character of the property. He suggested requiring specific site planning at the time of development and to obtain requirements for landscaping from the Soil Conservation Service as an alternative for' a donation of land for wildlife mitigation. • • The Examiner inquired about Item P.7. of Exhibit #1 in regards to a requirement for a hold harmless agreement pertaining to drainage, problems. Mr. Smith indicated that while the agreement was not required on the Glacier Park property, it may be necessary in this particular case because of cumulative impacts of filling the valley prior to the Soil Conservation Service P-1 and P-9 projects. In regard to Item P.B. of Exhibit #1, the Examiner asked Mr. Smith the relationship of minimum setback requirements for slope toes found in Section 4-2314 to the Planning Department report recommending the toe of the slopes to be placed entirely within the, subject site. Mr. Smith indicated that the recommendation found in the code relates to mining operations only and the recommendation found in Exhibit #1 had been imposed to prevent fill material from sloughing onto adjacent properties as had occurred previously in careless operations. He also felt that because of unknown problems related to the eventual pattern of fill in the valley area, it would be helpful to retain drainage areas to offset the possible impact of fill operations. The Examiner, asked Mr. Smith if similar requirements had been imposed on other landfill projects • in the area and if variances had been granted. Mr. Smith responded negatively to both inquiries, and indicated that the decision had been an administrative interpretation. In regard to Item P.9. of Exhibit #1 relating to suitable temporary access for filling and grading, the Examiner asked if future improvements to S.W. 27th Street were scheduled in the Six-Year Street Plan. Mr. Smith indicated that improvements had been scheduled on the street plan and also in the city's Comprehensive Land Use Plan. The Examiner asked about the necessity for a safety fence and if the applicant had submitted a rehabilitation plan for the slopes. Mr. Smith responded negatively to both questions. The Examiner asked Mr. Smith to estimate the gross amount of fill which would be moved. Mr. Smith estimated ,eighty thousand cubic yards, and although the applicant had not yet submitted a phase plan, he assumed the operation would not require more than one annual license to complete. The applicant requested permission to allow the representative from the Olympic Pipe Line Company to testify. Responding, after being sworn, was: Frank Jacobs Olympic Pipe Line Company P.O. Box 236 Renton, WA , 98055 • Mr. Jacobs clarified the •letter submitted by the Olympic Pipe Line Company and stated that the company had no opposition to the project. • The Examiner called for a ten minute recess at 10:15 a.m. The hearing reconvened at 10:25 a.m. with all parties present. ' The Examiner asked the applicant if he concurred in the Planning Department, report. Responding was: James Tripp , 324 S.W. 16th • Renton, WA ' 98055 SP- 046-77 Page Three t•tr. . Tripp indicated that while he concurred in the major recommendations. in the report, he was concerned about setback requirements designated in Item P.1. of Exhibit 451. Ile reported that he approved of recommendations to establish a dyke surrounding the property and to hydroseed the slopes. In regards to access, he indicated that the intended access to the property is from Lind Avenue through a 60-foot easement. He reported that completion of the grading within one year would depend upon the timing of the issuance of the permit and weather conditions. The Examiner referred to Exhibit #10, letter from Olympic Pipe Line Company, and asked the applicant about the use of the access roadway. Mr. Tripp stated that the concern originated from •tbe use of the company's private roadway located between Lind Avenue and the East Valley High"way, and he indicated that he did not intend to utilize the private road for access. Mr. Tripp stated that some additional fill in the form of crushed concrete would be required to bring the elevation height to 15 feet and°'that buildings would be fleod- proofed to that elevation. The Examiner asked the applicant about a temporary access agreement with Longacres Race Track and other properties to the west. Mr. Tripp reported that although Burlington Northern Railroad owns property to the west, he did not have a formalized agreement from that property. In response to the Examiner's question about the present condition of Lind Avenue, Mr. Smith reported that the street would require additional fill. Mr. Tripp stated that no problems exist for access to the property for the proposed project. He reported that hydroseeding the slope would improve esthetics for planting purposes and the 40-foot setback requirement would set aside 4% of the property to meet the Soil Conservation Service requirement of 2% for landscape wildlife mitigation. In response to the Examiner's inquiry regarding the contingency of the issuance of the special permit upon approval by the King County Hydraulics Division, Mr. Smith answered affirmatively. The Examiner referred to specific requirements in the Mining, Excavation and Grading Ordinance, Section 4-2311, relating to landscaping and reuse of the site. Mr. Smith stated that when development occurs, a reuse proposal would include requirements for setbacks, landscaping and type of materials. The Examiner asked for further comments in support or opposition of the application. There was no response. The Examiner asked Mr. Smith for modifications or additions to the staff report. Mr. Smith indicated concerns regarding improvements to S.W. 27th Street, additional fill required because of sloughing conditions, hydroseeding subject to departmental approval, removal of existing fill on the south half of the property within the 60-foot area from the centerline of Springbrook Drainage Creek in relationship to South 27th Street, and the possibility of additional right-of-way requirements. The Examiner asked for further comments. Since there were none, the hearing on Item #SP-046-77 was closed by the Examiner at 10:45 am. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a Special Permit for grading and filling pursuant to requirements of the Mining, Excavation and Grading Ordinance' (C hapter 23, Title IV) . 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference • as set forth in full herein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State 'Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance . has been issued for the subject proposal by Gordon Y. Erickson, responsible official, provided suitable mitigation measures are taken. 4. Plans for the proposal have been reviewed by. all city departments affected by the impact of. this development and no adverse comment was expressed. 5. -There was no opposition to the proposal expressed. 6. All existing utilities except water and sewer are available and in close proximity. 7. The Comprehensive Land Use Map indicates the property to be Manufacturing Park. A greenbelt designation is given Springbrook Creek, P-1 and P-9 drainage channels. SP-046-77 Page -Four , 8., A Flood Control Zone Application 'has been submitted to the King County Department of I-3ydraul.ics Division and the Department of Ecology; however, approvals 'have not, yet been given by these agencies . ' 9. Existing zoning on the property is H-1, Heavy Industry. The-applicant stated that the future plans for the property are for office and warehouse uses. - 10. The proposal consists of removing approximately 83;000 cubic yards of existing fill material on the southern portion of the ,site for deposit on the northern portion.' Upon completion of the grading and filling, an average elevation of 14.5 feet will result. It is estimated that the project will be completed,within two months and • that eventual development might occur within one year. No .pavipc'or import of fill, - material will occur in this phase- of development. 11. Substantial landfill projects have occurred and are occurring in .this general area. The proposed design generally conforms to the design of..these•projects. • In general, the elevation of these projects is approximately tpe. same' as proposed; for the site. The Department of Ecology and King County Hydraulics Division design. standard of an elevation of 21.8 feet in this area is being re-evaluated and is expected to be revised. If the revision does not occur, the applicant stated that measures would be taken in the future to meet the standard. . 12. Lying along the eastern boundary of the site is the Springbrook Drainage Creek of . a dedicated 40-foot easement. Past- precedent has been established in this area (e.g. Glacier Park Company landfill) to require a 60-foot from centerline setback for landfill and grading to enhance the Creek drainage and wildlife habitat. 13. Two other substantial drainage channels border the site. The P-1 Channel lies along the western property line,' and the P-9 channel along.the ,northern property line. Directly adjacent to the South property line is located the wetland area owned by' the city, , 14. After review of the drainage plan, the Public Works Department recommended a dyke ' . system around the perimeter of the top of the fill. The -applicant expressed . agreement with this modification to the original proposal. ' 15. Plans for stabilizing the banks of the fill' and grading were not submitted; however the applicant stated that hydroseeding of the banks would be utilized for that purpose. . . . 16. Adequate access exists to the subject site-via what would.be S.W. 27th Street for the temporary purpose of access for the grading equipment. ' :Olympic Pipe Line 1 . Company objects to continual use by heavy equipment ove'r' this shared easement. Lind Avenue would be connected to S.W. 27th for the purpose of this access. Permanent access will be resolved in the future. . 17. Section 4-2303.2.C. requires approval by the Examiner of the, eventual: use of the property, which would reasonably include the final site plan. 18. A safety fence to enclose the project was not felt necessary (Section 4-2311.1) ., 19. Section 4-2311.2 specifies that a 75-foot setback of grading from the property • line may be imposed. This was found unnecessary due to other conditions being applied to 'the proposal. .. ' CONCLUSIONS: . ' 1. The proposal generally conforms to the Green River Valley Comprehensive Plan. . The I goals listed on page 4 of the plan are 'met in this initial phase of, eventual development. Specific compliance will be determined during review of the proposed site plan. ' The objectives outlined in pages 5 through 7 are also met or can be met • as a result of the Examiner's decision. Areas for greenbelt and wildlife habitat purposes are encouraged. Compliance with the Soil Conservation, Service requirement. for 2% of the ,site for,wildlife can be achieved as well by maintaining°a greenbelt of 40 feet -along -the eastern-property. . . ' line coincidential with the Springbrook Creek (total of 60 feet from centerline of . the creek as implemented elsewhere in the area) . This drainage channel should be hydroseeded if regrading occurs' (Section 4-2311.2) . A mixture of, coniferous and deciduous trees would also be desirable for planting to provide the, animal habitat ' and enhance future landscaping installed during final development (Section 4-2311.2) . • Only the hydroseeding is required which will result in.character similar to that on other properties in the vicinity. . • " ' SP-046-77 Page Five 2. Section 4-•2303.2,B. of the Mining, Excavation and Grading Ordinance requires that the Examiner conclude that the Special Permit ". . .not be unreasonably detrimental to the surrounding area. " .Based upon the evidence submitted in the hearing, the proposed grading and filling is compatible with and similar to existing landfill operations in the immediate vicinity. Since the project will occur in a drainage area, some conditions to the Special Permit are necessary. to control erosion, mitigate loss of animal habitat, and facilitate water drainage. These conditions will make the Special Permit not detrimental to the adjacent properties and surrounding area. 3. The P-1 and P-9 drainage channels require protection from sloughing of landfill into the channels, thereby reducing their drainage effectiveness (Section This can be accomplished via hydroseeding the banks of the landfill and perhaps "stair-stepping" the slopes (Section 4-2311.2.) . Furthermore,, the landfill should occur entirely within the boundaries of the site, not in the drainage channels or Springbrook Creek easement (Section 4-2314.) . 0 • 4. Drainage of the storm water that will accumulate atop the fill can be accomplished several ways. The Public Works Department's suggestion of dykes around the top and perimeter of the site seems the most simple and reasonable solution. Such a system will provide more than adequate holding capacity for recharge into the landfill. Upon submittal of the site plan for final development, this drainage plan will again be reviewed as revisions will be necessary. 5. In order to help control dust and erosion, the entire grading and fill operation should be hydroseeded except where existing vegetation is retained. 6. Per Section 4--2303.2.C. the final uses and site plan must be approved by the Examiner. A public hearing will be required, and the Examiner must conclude that the uses and site plan conform to the Comprehensive Plan and are compatible with the vicinity as well as`applicable zoning requirements. 7. Sufficient access to the property exists via Lind Avenue and the easement across Olympic Pipe Line Company property for the proposed phase of development of the property. Only slight grading is necessary to implement this access., However, • subsequent phases of development will require re-evaluation of the access. Olympic Pipe Line Company is on record opposing regular, continual use of the improved road in the easement. At this phase, only one-time access onto and off the subject site is necessary, but future improvements (filling, paving, construction) will require continual vehicular access for heavy and light equipment. The applicant is actively pursuing the future access, which must be resolved prior to the Examiner's review of the final development site plan. The proposed development of what would be S.W. 27th Street should be investigated by the applicant with the Public Works Department. This improvement may meet the future, permanent access requirements. DECISION: • Based upon the record, findings and conclusions, the grading and filling Special Permit . is approved, subject to 1. Forty-foot greenbelt area of existing vegetation be set aside along the eastern property line. Any fill in this area is to be removed and the area regraded to the grade of the drainage channel and hydroseeded. The toe of the landfill will not extend into this greenbelt. The Examiner inquired about Item P.1. on Exhibit #1 regarding the portion of the site within 60 feet of the centerline of the Springbrook Drainage Creek and asked the relationship of the recommendation to the Mining, Excavation, and C,rading Ordinance setback requirements of 75 feet. Mr. Smith indicated that the ordinance requirement referred to surface mining operations and was not considered a mandatory requirement. In reference to Exhibit #1, Item"P.4. the Examiner asked if the requirement for utilization of 2% of the site for landscape wildlife mitigation referred to existing or installed landscaping. Mr. Smith indicated that the site contained no significant vegetation and that a plant list for suitable material for on site development would be available from the Planning,Department. " • The Examiner inquired about the compatibility of the proposed development with the Glacier Park fill project. Mr. Smith reported that the proposal is compatible with the existing development, although the 29 acres of wetland in the Glacier Park area did not create a typical site because of the difference in character of the property. He suggested requiring specific site planning at the time of development and to obtain • requirements for landscaping from the Soil Conservation Service as an alternative for a donation of land for wildlife mitigation. The Examiner inquired about Item P.7. of Exhibit #1 in regards to a requirement for a hold harmless agreement pertaining to drainage problems. Mr. Smith indicated that while the agreement was not required on the Glacier Park property, it may be necessary in this particular case because of cumulative impacts of filling the valley prior to the Soil Conservation Service P-1 and P-9 projects. In regard to Item P.8. of Exhibit #1, the Examiner asked Mr. Smith the relationship of minimum setback requirements for slope toes found in Section 4-2314 to the Planning Department report recommending the toe of the slopes to be placed entirely within the subject site. Mr. Smith- indicated that the recommendation found-in the code relates to mining operations only and the recommendation found in Exhibit #1 had been imposed to prevent fill material from sloughing onto adjacent properties as had occurred previously in careless operations. He also felt that because of unknown problems related to the eventual pattern of fill in the valley area, it would be helpful to retain drainage areas to offset the possible impact of fill operations. The Examiner asked Mr. Smith if similar requirements had been imposed on other landfill projects in the area and if variances had been granted. Mr. Smith responded negatively to both inquiries, and indicated that the decision had been an administrative interpretation. In regard to Item P.9. of Exhibit #1 relating to suitable temporary access for filling and grading, the Examiner asked if future improvements to S.W. 27th Street were scheduled in the Six-Year Street Plan. Mr. Smith indicated that improvements had been scheduled on the street plan and also in the city's Comprehensive Land Use Plan. The Examiner asked about the necessity for a safety fence and if the applicant had submitted a rehabilitation plan for the slopes. Mr.. Smith responded negatively to both questions. The Examiner asked Mr. Smith to estimate the gross amount of fill which would be moved. Mr. Smith estimated eighty thousand cubic yards, and although the applicant had not yet submitted a phase plan, he assumed the operation would not require more than one annual license to complete. The applicant requested permission to allow the representative from the Olympic Pipe Line Company to testify. Responding, after being sworn, was: Frank Jacobs Olympic Pipe Line Company P.O. The Examiner called for a ten minute recess at 10:15 a.m. The hearing reconvened at 10:25 a.m. with all parties present. The subject site is also situated just north of the City's 20 acre wetlands area and just west of the Springbrook drainage • channel. SUMMARY OF REQUEST: Applicant requests special permit pursuant to the City's Mining, Excavation and Grading Ordinance to allow removal of a portion of the existing fill on the southerly half of the subject property and placing it on the northerly half of the subject site to obtain an overall site subgrade elevation of 14.5 feet. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on July 5, 1977. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 12, 1977 at 9:10 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were sworn. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1 and entered the following additional exhibits into the record: Exhibit #2: King County Assessor's Map Exhibit #3: Existing Topography Map Exhibit #4: Drainage Plan Exhibit #5: Cross Section Map Exhibit #6: Access Warranty Deed Exhibit #7: Letter from Public Works Department, dated July 11, 1977 Exhibit #8: Letter from applicant, dated May 23, 1977 Mr. Smith reviewed Exhibit #7 which recommends installation of a two-foot berm around the site following filling operations to provide 50-acre feet of storage for storm water. The Examiner entered the following two exhibits into the record: Exhibit #9: Application to King County Hydraulics Division Exhibit #10: Letter from Olympic Pipe Line Company, dated July 7, 1977 SP-046-77 Page Four 8. A Flood Control Zone Application has been submitted to the King County Department of Hydraulics Division and the Department of Ecology; however, approvals have not yet been given by these agencies. 9. Existing zoning on the property is H-1, Heavy Industry. The applicant-stated that the future plans for the property are for office and warehouse uses. 10. The proposal consists of removing approximately 83,000 cubic yards of existing fill material on the southern portion of the site for deposit on the northern portion. Upon completion of the grading and filling, an average elevation of 14.5 feet will result. It is estimated that the project will be completed within two months and that eventual development might occur within one year. No paving or'import. of fill . material will occur in this phase of development. 11. Substantial landfill projects have occurred and are occurring in this general area. The proposed design generally conforms to the design of these projects. In general, the elevation of these projects is approximately the same as proposed for the site. The Department of Ecology and King County Hydraulics Division design standard of an elevation of 21.8 feet in this area is being re-evaluated and is expected to be revised. If the revision does not occur, the applicant stated that measures would be taken in the future to meet the standard. 12. Lying along the eastern boundary of the site is the Springbrook Drainage Creek of a dedicated 40-foot easement. Past precedent has been established in this area (e.g. Glacier Park Company landfill) to require a 60-foot from centerline setback for landfill and grading to enhance the Creek drainage and wildlife habitat. 13. Two other substantial drainage channels border the site. The P-1 Channel lies along the western property line, and the P-9 channel along the northern property line. Directly adjacent to the south property line is located the wetland area owned by the city. I 114. After review of the drainage plan, the Public Works Department recommended a dyke 1 system around the perimeter of the top of the fill. The applicant expressed 1 agreement with this modification to the original proposal. 115. Plans for stabilizing the banks of the fill and grading were not submitted; however the applicant stated that hydroseeding of the banks would be utilized for that purpose. I16. Adequate access exists to the subject site via what would be S.W. 27th Street for the temporary purpose of access for the grading equipment. Olympic Pipe Line Company objects to continual use by heavy equipment over this shared easement. Lind Avenue would be connected to S.W. 27th for the purpose of this access. 1 Permanent access will be resolved in the future. ; 17. Section 4-2303.2.C.• requires approval by the Examiner of the eventual use of the property, which would reasonably include the final site plan. 18. A safety fence to enclose the project was not felt necessary (Section 4-2311.1) . ! 19. Section 4-2311.2 specifies that a 75-foot setback of grading from the property 1 line may be imposed. This was found,unnecessary due to other conditions being applied to the proposal. CONCLUSIONS: 1. The proposal generally conforms to the Green River Valley Comprehensive Plan. The goals listed on page 4 of the plan are met in this initial phase of eventual development. Specific compliance will be determined during review of the proposed 1 site plan. The objectives outlined in pages 5 through 7 are also met or can be met as a result of the Examiner's decision. 1 Areas for greenbelt and wildlife habitat purposes are encouraged. Compliance with the Soil Conservation Service requirement for 2% of the site for wildlife can be achieved as well by maintaining a greenbelt of 40 feet along the eastern property line coincidential with the Springbrook Creek (total of 60 feet from centerline of the creek as implemented elsewhere in the area) . This drainage channel should be hydroseeded if regrading occurs (Section 4-2311.2) . A mixture of coniferous and deciduous trees would also be desirable for planting to provide the animal habitat and enhance future landscaping, installed during final development (Section 4-2311.2) . Only the hydroseeding is required which will result in character similar to that on other properties in the vicinity. 1 • • SP-046-77 Page Three Mr. Tripp indicated that while he concurred in the major recommendations in the report, he was concerned about setback requirements designated in Item P.1. of Exhibit #1. He reported that he approved of recommendations to establish a dyke surrounding the property and to .hydroseed the slopes. In regards to access, he indicated that the intended access to the property is from Lind Avenue through a 60-foot easement. He reported that completion of the grading within one year would depend upon the timing of the issuance of the permit and weather conditions. The Examiner referred to Exhibit #10, letter from Olympic Pipe Line Company, and asked the applicant about the use of the access roadway. Mr. Tripp stated that the concern originated from these of the company's private roadway located between Lind' Avenue • and the East Valley Highway, and he indicated that he did not intend to utilize the • private road for access. • Mr. Tripp stated that some additional fill in the form of crushed concrete would be required to bring the elevation height to 15 feet and that buildings would be flood- proofed to that elevation. The Examiner asked the applicant about a temporary access agreement with Longacres Race Track and other properties to' the west. Mr. Tripp reported that although Burlington Northern Railroad owns property to the west, he did not have a 'formalized agreement from that property. In response to the Examiner's question about the present condition of Lind Avenue, Mr. Smith reported that the street would require additional fill. Mr. Tripp stated that no problems exist for access to the property for the proposed project. He reported that hydroseeding the slope would improve esthetics for planting purposes and the 40-foot setback requirement would set aside 4% of the property to meet the Soil Conservation Service requirement of 2% for landscape wildlife mitigation. In response to the Examiner's inquiry regarding the contingency of the issuance of the special permit upon approval by the King County Hydraulics Division, Mr. Smith answered affirmatively. The, Examiner referred to specific requirements in the Mining, Excavation • • and Grading Ordinance, Section 4-2311, 'relating to landscaping and reuse of the site. Mr. Smith stated that when development occurs, a reuse proposal would include requirements for setbacks, landscaping and type of materials. The. Examiner asked for further comments in support or opposition of the application. There was no response. The Examiner asked Mr. Smith for modifications or additions to the staff report. Mr. Smith indicated concerns regarding improvements to S.W. 27th Street, additional fill required because of sloughing conditions, hydroseeding subject to departmental approval, removal of existing fill on the south half of the property within the 60-foot area from the centerline of Springbrook Drainage Creek in relationship to South 27th Street, and the possibility of additional right-of-way requirements. The Examiner asked for further comments. Since there were none, the hearing on Item #SP-046-77 was closed by the Examiner at 10:45 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: • 1. The request is for approval of a Special Permit for grading and filling pursuant to . requirements of the Mining, Excavation and Grading Ordinance (Chapter 23, Title IV) . 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this, matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full herein. 3. Section 4-2303.2.B. of the Mining, Excavation and Grading Ordinance requires that the Examiner conclude that the Special Permit ". . .not be unreasonably detrimental to the surrounding area." Based upon the evidence submitted in the hearing, the proposed grading and filling is compatible with and similar to existing landfill operations in the immediate vicinity. Since the project will occur in a drainage area, some conditions to the Special Permit are necessary to control erosion, mitigate loss of animal habitat, and facilitate water drainage. These conditions will make the Special Permit not detrimental to the adjacent properties and surrounding area. 3. The P-1 and P-9 drainage channels require protection from sloughing of landfill into the channels, thereby reducing their drainage effectiveness (Section 4-2313.4.) . This can be accomplished via hydroseeding the banks of the landfill and perhaps ' "stair-stepping" the slopes (Section 4-2311.2. ) . Furthermore, the landfill should occur entirely within the boundaries of the site, not in the drainage channels or Springbrook Creek easement (Section 4-2314.) . 4. Drainage of the storm water that will accumulate atop the fill can be accomplished several ways. The Public.Works Department's suggestion of dykes around the top and perimeter of the site seems the most simple and reasonable solution. Such a system will provide more than adequate holding capacity for recharge into the landfill. Upon submittal of the site plan for final development, this drainage plan will again be reviewed as revisions will be necessary. 5. In order to help control dust and erosion, the entire grading and fill operation should be hydroseeded except where existing vegetation is retained. 6. Per Section 4-2303.2.C. the final uses and site plan must be approved by the Examiner. A public hearing will be required, and the Examiner must conclude that the uses and site plan conform to the Comprehensive Plan and are compatible with the vicinity as well as applicable zoning requirements. - ' 7. Sufficient access to the property exists via Lind Avenue and the easement across Olympic Pipe Line Company property for the proposed phase of development of the property. Only slight grading is necessary to implement this access. However, subsequent phases of development will require re-evaluation of the access. Olympic Pipe Line Company is on record opposing regular, continual use of the improved road in the easement. At this phase, only one-time 'access onto and off the subject site is necessary, but future improvements (filling, paving, construction) will require continual vehicular access for heavy and light equipment. The applicant is actively pursuing the future access, which must be resolved prior to the Examiner's review of the final development site plan., The proposed development of what would be S.W. 27thh Street should be investigated by the applicant with the Public Works Department. This improvement may meet'the future, permanent access requirements. DECISION: Based upon the record, findings and conclusions, the grading and filling Special Permit is approved, subject to: 1. Forty-foot greenbelt area of existing vegetation be set aside along the eastern property line. Any fill in this area is to be removed and the area regraded to the grade of the drainage channel and hydroseeded. The toe of the landfill will. not extend into this greenbelt. Existing trees shall be retained in this area. 2. Filling not to occur in the P-1 and P-9 drainage channels. Any existing fill in these channels is to be removed and the area regraded to the established grade of the channel and hydroseeded. Existing vegetation is to be retained in these drainage channels. The toe of the landfill is to be within the subject site, and the grade hydroseeded and constructed to prevent sloughing of landfill into the drainage channels. 3. Interim storm water retention be accomplished via construction of a two-foot berm around the top and perimeter of the site. 4. The entire regrading and landfill be hydroseeded as soon as possible after the completion of the grading, except for portions where existing vegetation is retained. 5. Final approval of the engineering design and supervision of the grading and filling for compliance with the requirements of. HISTORY/BACKGROUND: The subject site was originally owned by Glacier Park Company . The property was later bought by Shell Oil Company, who proposed the site for a petroleum storage distribution facility . Shell Oil Com- pany elected not to proceed with development of the site and subse- quently sold the site to Tripp and Harper. The southerly approxi - mate one-half of the site was filled by Shell Oil Company to a height of approximately 18 . 5 feet . The northerly one-half has remained in a grassy pasture , partially wetland area . E. PHYSICAL BACKGROUND: 1 . Topography : The southerly half of the site , which has been previously filled , is level and at a height of 18 to 25 feet . The northerly half, which is proposed to b.e filled and graded ,. has an existing elevation of approximately 11 feet. Approxi - mately 4 feet is to be shifted from the southerly portion of the site to the northerly location . 2 . Soils : Woodinville Silt Loam (Wo ) . Permeability is moderately slow. The seasonal high water table is at or near the surface ; runoff is slow; and the hazard of erosion is slight. This soil is used for row crops , pasture , and urban development . Some Puyallup Sandy Loam (Py) may exist on the westerly portions of this site . This soil has moderately rapid permeability , slow runoff, and slight erosion hazard. This soil is also used for row crops , pasture , and urban development . 3 . Vegetation : The southerly half of the site , which has been previously filled , contains various species of scrub grasses that have regenerated subsequent to the filling process . The northerly half of the site appears to have been previously pasture area and consists primarily of grasslands . There are scattered cattails indicative of wetland situations and a scattering of small cottonwood trees . There are a number of ! significant cottonwood trees and vegetation adjacent to the Springbrook Creek channel along the easterly edge of the sub- ject site . 4. Wildlife : The existing vegetation on the site provides suitable habitat for birds and small mammals . 5 . Water: Most of the vegetation on the site seems to indicate a general absence of surface water. However, there are certain areas containing cattails , which would indicate the possibility of surface water during certain portions of the year. The site , however, does not appear to be typical wetland area of . the type similar to the City ' s 20 acre wetland area directly south of the subject site . The existing Springbrook Creek channel flows along the westerly boundary of the subject site . 6 . Land Use : The site is presently entirely undeveloped . The • Olympic Pipe Line facility and the Mobil . Oil Company tank storage distribution center are located to the east of the subject site across the Springbrook drainage channel . Long- acres Race Track is located north and west of the subject site ; the Washington Horsebreeders horse auction facility and offices are located about one-fourth mile west of the subject site . The City ' s 20 acre wetland area and 39 acre optional wetland area is situated directly south of the subject, site . The proposed P- 1 drainage channel is located along the westerly edge of the subject site with the smaller P-9 drainage channel located along the northerly edge of the subject site . The property owned by Glacier Park Company lying south of the subject site was the subject of a similar fill permit request of a much greater scope . The special permit for the 300 plus acre area wa,s approved subject to certain conditions on November 19, 1975 , and October 13 , 1976 . An environmental impact statement was prepared for, that proposal . The analysis and con- clusions contained in that document can be applied to the sub- ject proposal . As a 'means of mitigating certain impacts of the fill and to conform with the City ' s Comprehensive Plan , Glacier Park Company donated 20 ac, 'es and reserved an additional 39 acres for wetland preservation programs . Springbrook Creek has also been preserved as a 120 foot wide greenbelt/wetland/storm water retention area . 5 . The applicant has not submitted any plans for mitigation of the impacts of fill . Retention of the Springbrook greenbelt should be a condition of any filL permit for the subject site to provide mitigation measures siimila'ir to those provided by Glacier Park Company. 6 . The subject site is located directly adjacent to the proposed location of the P-9 drainage channel on the north and the P- 1 channel on the west . It may be necessary to excavate portions of these channels abutting,' the subject site to retain a proper balance in the drainage pattern for the area . This would be considered an interim[lmeasure to assist in reducing drainage impacts on other properties in the valley . 7 . ' Temporary retention/sedimentation ponds will be necessary to reduce impacts of drainage 'lland siltation on the Springbrook Creek and adjacent wetland areas . • 8 . Proper erosion control methods will be necessary on the slopes of the proposed fill . No public access exists to the site at the present time , although a 60 foot easement exists from the site to Lind Avenue . The applicant has also attained a verbal access agreement from Longacres ' for the filling and grading opera- tion only . 11 . No plans for site development have been submitted with the subject request . 12 . Temporary drainage plans were submitted in written form. Detailed temporary drainage plans should be prepared to reduce any off-site impacts from the fill . P. PLANNING DEPARTMENT RECOMMENDATION : Due to lack of proper access , specific site use , and suitable impact measures , the application appears to be premature. However, to off- set these elements , approval of the subject request should be subject to the following conditions : 1 . The portion of the site within 60 feet of the centerline of the Springbrook Drainage Creek shall be retained in its natural state . No trees or vegetation shall be removed or disturbed , including , but not limited to , the large cottonwood trees near the easterly boundary of the site . This requirement is to conform to the Comprehensive Plan indicating a greenbelt designation for this area and to assist in mitigating the potential drainage impacts of the subject proposal by creating additional storm water retention area . This shall include removal of existing fill on the south half of the property within this 60 foot area . 2 . Interim drainage plans with detention/siltation ponds suitable to control potential drainage and siltation impacts on adjacent drainage channels , wetlands , and other properties shall be sub- mitted to and approved by the Public Works Department at the • time of annual license application and prior to beginning the project . 3. Final approval of proposed fill and grade by King County Depart- ment of Hydraulics Division (State Flood Zone Control Permit) . 4 . In view of the lack of specific development plans for the sub- ject fill proposal , the lack of adequate public access , and the proximate location to establish wetland and greenbelt areas , any specific site development shall be subject to site plan approval of the Land Use Hearing Examiner. Permanent on-site drainage retention facilities shall be provided at the time of site plan approval . Setbacks and landscaping shall be consistent with the M-P standards . All setback areas shall be landscaped a minimum 10 feet in width with plant material suitable to enhance wild- life food and habitat . Landscape plans for site development shall be submitted at the time of site plan approval . This shall be in addition to the Soil Conservation Service requirement for landscape wildlife mitigation on 2% of the site . 5 . The portion of the site' withlin 60 feet of the centerline of the Springbrook Drainage Creek shall be retained in its natural state . No trees or vegetation shall be removed or disturbed , including, but not limited to , the large cottonwood trees near the easterly boundary of the site . This requirement is to conform to the Comprehensive Plan indicating a greenbelt desig- nation for this area and to assist in mitigating the potential drainage impacts of the subject proposal by creating additional storm water retention area . This shall include removal of existing fill on the soluth half of the property within this 60 foot area . 2 . Interim drainage plans with detention/siltation ponds suitable to control potential drainage and siltation impacts on adjacent drainage channels , wetlands , and other properties shall be sub- mitted to and approved by the Public Works Department at the time of annual license appli at.ion and prior to beginning the project. 3 . Final approval of proposed fill and grade by King County Depart- ment of Hydraulics Division (State Flood Zone Control Permit) . 4. In view of the lack of specific development plans for the sub- ject fill proposal , the lack of adequate public access , and the proximate location to establish wetland and greenbelt areas , any specific site development shall be subject to site plan approval of the Land Use Hearing Examiner. Permanent on-site drainage retention facilities shall be provided at the time of site plan approval . Setbacks and landscaping shall be consistent with the . M-P standards . All setback areas shall be landscaped a minimum 10 feet in width with plant material suitable to enhance wild- life food and habitat. ' Landscape plans for site development shall be submitted at the time of site plan approval . This shall be in addition to the Soil Conservation Service requirement for landscape wildlife mitigation on 2% of the site . 5 . The area to be utilized for the P-9 drainage channel shall be retained in its natural : state. 6 . Suitable erosion control methods shall be provided , including proper hydroseeding of site and slopes subject to Planning Department approval . The Public Works Department shall review the need for dedication of any portions of the subject site for future right-of-way purposes and shall require dedication , if necessary , as a condition of approval of the annual license application. 10 . ATTACHMENT A I . BACKGROUND Nature of Proposal I , The proposal is to regrade compacted fill from the South half of the site to the North half of the site, creating a level fill over the entire area. The northern portion exists as a open pasture with some standing water and wet spongy ground. The southern portion is covered by 8 feet of compacted fill . Regrading of the site will result in a uniform fill over the entire area for future Light Industrial or Manufacturing Park use. Location The site is 2. 59 acres, of ground located in the Green River Valley, in the Northeast 1/4 of the Northeast 1/4 of Section 25, Township 23, Range 4 E. , W.M. near the Southeast corner of the Longacres Race Track, Renton, Wa. 11 . ENVIRONMENTAL IMPACTS 1 . Earth The 1973, King County Soil Survey indicates two types of soil on the site. These are Woodenville silt loam (Wo) and Puyallup fine sandy loam (Py) . Woodenville soils are formed under grass and sedges, are poorly drained and have seasonal high water table. The permeability is low and the chance for stream overflow is great. Puyallup soils are well drained soils formed in alluvium. They form natural levees in valley bottoms where they are found. The permeability is moderate to rapid, although, runoff is slow due to slight slope. The proposal is to grade the site creating level fill over the entire area. The site is essentially flat except the 8 foot raise created by the fill . The northern portion exists as an open pasture with some wet and spongy ground. Filling the entire area will stabilize the earth conditions creating a desirable site for future .development. There will be little change, in the relief features as the ground will remain flat but raised approximately 4 feet over its entirety. Filling should create no increase in erosion, siltation or deposition on the site. 2. Air Emissions to the ambient air or objectionable odors created by the machinery will be temporary, lasting only as long as the grading activities. Due to the open and out of the way nature of the site, the exhaust emissions created. by machinery are not anticipated to generate objections or complaints. 3. Water The site lies in the floodplain of the Green River. Springbrook Creek formerly ran through the site but was displaced to the open ditch that runs along the eastern boundary by previous filling on that ground. There is still standing water in the old creekbed - that has not been filled and two small ponds -- with rushes and wet ground. The proposed P-1 Channel which may eventually run along the western boundary will eliminate flood hazard in this area. Filling will eliminate standing water on the site and displace it to the drainage ditch along the eastern boundary. Storm water runoff will be drained into this open ditch. 4. Flora Filling of the northern portion will eliminate natural fauna that exists there. Pasture grasses predominate over most of the site although pond grass, cattails and rushes occur in areas with sufficient moisture. There are several small willow trees scattered over the site. Filling will eliminate reveg- etation of natural species although there are some hearty pioneer species flourishing on the present fill . No known unique, rare or endangered species of flora exist on the site nor will the acreage of any agricultural crop be reduced. 5. Fauna Reduction of habitat will reduce natural species such as mice, frogs, garter snakes, moles, lizards, sparrows, etc. by 90 percent. Species such as ducks, hawks, herons, bitterns, blackbirds, swallows, robins, etc. , that visit the site regularly will be displaced and eventually eliminated through competative exclusion. To our knowledge, no known unique, rare, or endangered species will be jeopardized by development. 6. Noise Noise levels will be intermittently high throughout the grading activities, but will be limited to waking hours. 7. Light and Glare There will be no increase in the amount of light and glare on the site. 8. Land Use The site is presently unused but has been developed to the extent that half the site has been filled. To the East is a Tank Farm and to the Northwest is the Longacres Race Track. The Green River Valley Comprehensive Plan designates the site as Manufacturing Park. Grading to spread fill over the entire area will create a site suitable for manufacturing or light industrial useage. 9. Natural Resources Grading of the site will not increase the use of any natural resources nor will it cause the depletion of any non-renewable resources.. 13. Transportation/Circulation Grading will not create any significant increase in traffic. Access and adequate parking is available along the East side of Longacres Race Track. 14. Public Services Grading will not generate the need for additional public services on the site. 15. Energy IIIL No excessive demands will be made. on energy sources, nor will grading require any new sources of energy. • - • I I 16.
