LLA LUA07-124 Dear Ms. Timmons; Initially we submitted lot line adjustment drawings (really a lot consolidation) for the Dunn property showing only the property Dunn, NW owned (A 35 strip from the railroad, a 30 foot strip from the railroad and a portion of Car works Addition, including vacated streets. These drawings were much the same as those approved for LUA-03-102-LLA (really a lot consolidation), which is an adjoiner to the south of the Dunn parcels. After our initial submittal we were told that we needed to approach this differently than the adjoining, approved LLA south of the Dunn parcel. It seems that there was some concern with the way Dunn acquired the parcels from the railroad. At that time we were told to show the railroad property and its subsequent joining to the Dunn parcel. We were also told that the railroad would have to sign on the document for transfer. This resulted in the second set of drawings. That paperwork then showed a Parcel A and B, (Parcel A being what Dunn is lot consolidating and Parcel B being what the railroad would retain). This resulted in the letter dated January 24, 2008 with an attached memo (the memo erroneously being dated as January 24, 2007). The following are comments pertaining to that letter and our drawing dated 2/15/08, Listed are our responses to the revisions asked for by Rocale Timmons, dated January 24, 2008, which are numbered: 1. Note the square footage of land in private access easements There are no private access easements on the property. 2. Note the gross and net square footage of existing and revised lots (net reflects the deduction of access easements). This does not apply, see comment 1. 3. Depict Parcel B its entirety while maintaining a l '=50' scale. Parcel Bis shown on page 2 of 3. 4. Clearly depict old and new lot lines. Old and new lot lines are shown on pages 2 and 3. 5. Remove all information not requested in the submittal requirement checklist for Lot Line Adjustments unless specifically requested in the enclosed memo. Items as requested for the attached memo are reflected in the comments below. Listed are our responses to the memo attached to the letter dated January 24, 2008 (I have lettered the paragraphs from the memo starting with the first paragraph heing the letter A, for ease of responding): A. Note the City of Renton land use action number and land record number, LUA-07-124-LLA and LND-30-0338, respectively, on the drawing in the spaces already provided City of Renton LUA numbers were added to the drawing. B. Show ties to two City of Renton Survey Control monuments. The geometry will be checked by the city when the ties have been provided. Ties to the City of Renton Control Network were added to the drawing of 2115/08 (See drawing page 1) / C. Note what was found when visiting the existing monuments (including those monuments not yet shown per proceeding paragraph). Existing monuments are shown on the drmi'ing of 2/ 15/08 (See pages 1 and 3) D. Show the common quarter section line between the Northwest quarter AND the Northeast quarter of Section 17 on the drawing (Sheet 3 of 3). Include the Northwest of the Northeast quarter at Section 17 in the indexing blocks, a well as a reference to Government Lot 4 (Southeast quarter of the Northwest quarter of Section 17) on all drawing sheets. Lot 13 and a portion of Lot 12, plus a portion of vacated street right, of way, etc. are located in said Government Lot 4. It is possible that a portion of the most northeasterly comer of"Parcel 3" is in the Northwest quarter of the Northeast quarter of said Section 17. Review and revise as needed. Common quarter section line between the NW and NE Y, of Sec. 17 is shown. pages 2 & 3; the NW Y, of the NEY, has been revised to show on page I; Reference to Government Lot 4 is shown on pages /, 2 and 3; A portion of Lot Bis in the NW of the NE Y, and that quarter section has been added to the drawing. E. Was anything set the intersection of the north line of the parcel deeded to ANT LLC, per Rec. No. 1999-05002498, with the southwesterly right of way margin of Factory Ave. North (radius of 390.00)? Sheet 3 of 3 shows the northwest comer and the northeast comer of said parcel being set, but not that point lying 16.53' easterly of said northwest comer that intersects with said right of way. No we did not set the point on the north line of the parcel deeded to ANT, LLC. F. The "NEW LEGAL DESCRIPTIONS" block (Sheet I of3) is not needed and was not reviewed. Remove said block from the drawing. The new legal description will be Lot I ( or whatever other name is applied) of the Lot Line Adjustment. New legal descriptions were removed from the drawing. G. Provide a distinct name for the new parcel of land created via this instrument per preceding paragraph. We provided a distinct name for the new parcel, we called them New Parcel 1 and New Parcel 2 H. The purpose statement should simply relate that Parcel A is to be combined with those portions of Parcel B previously conveyed by deeds from the railroad and now held by Dunn Lumber into a single parcel via a legal subdivision process. As in reads now it reiterates the legal descriptions without coming straight to the point The purpose of the Lot Line Adjustment was revised on the drawing dated 2/15108. I. Pursuant to the previous paragraph Dunn Lumber Company acquired two strips of land that are included in this lot line adjustment. The first was acquired via a Quitclaim Deed, Rec. No. 9807270376 in June 1998 from the Burlington Northern and Santa Fe Railroad Company. The second was acquired via a Quitclaim Deed. Rec. No. 20070214001230 in February 2007 from Aloha Associates, UP. The intent is to make one large parcel out of these strips, plus the other contiguous properties owned by Dunn. The lot line adjustment as presented flies in the face of this since there are legal descriptions Parcel A and Parcel B under "NEW LEGAL DESCRIPTIONS" when the desired result is a single unrifled parcel pursuit to the Purpose statement and the Master Application for this land use action. Further, sheets 3 of 3 show a separate Parcel B distinct from either the parcels conveyed by the railroad, which is currently within the railroad right of way. This sane parcel is also shown distinctly without reference on sheet 2 of 3. On our initial map in 2005 we showed only the 3 parcels that Dunn owned, (the two quit claim deeds from the railway and those portions of Car Works Addition and vacated streets). It was a very simple drmving to illustrate the combining of those parcels into one unified parcel, a lot consolidation. Then we were told to illustrate the railroad parcels combined with the Dunn parcel and in doing so also illustrate the parcel that was being retained by the railroad. Now we have come from the very simple aspects of combining the 3 Dunn parcels to a very complicated process. Knowing and showing what the railroad owns, hunting down someone at the railway to sign this document and making sure they agree with the final legal descriptions was a tedious 2 process in its self But this paragraph calling.for revisions to our drawing makes me wonder if the person reviewing this actually knew that someone at the City of Renton had asked fur us to clarify the way Dunn acquired the parcels jiwn the railroad. We will gladly go back to our initial application and show only the 35 strip from the railroad, a 30 foot stripfram the railroad and portions of Car Works Addition, including vacated streets; to simplify this process. J. Note all easements, covenants and agreements ofrecord on the drawing. Since the city does not have a title report, it is assumed that all such records are noted on the lot line adjustment submittal (Sheet2 of3). Easements in the title report are shown or referenced on the drawing. K. On the final lot line adjustment submittal, remove all references to utilities facilities (including those referenced in the "LEGEND" block on Sheet 3 of 3) and other items not directly impacting the subdivision References to utilities, either in the legend or drawing have been removed from the drawing. L. Because the subject property falls within Zone I of the City of Renton Aquifer Protection Arca, the See the attachment. The Aquifer protection notice was added to the drawing. M. Note that if there are easements, restrictive covenants or agreements to others (City of Renton, etc.) as part of this lot line adjustment, they can be recorded concurrently with the lot line adjustment submittal. The lot line adjustment submittal and the associated document(s) are to he given to the Project Manager as a package. The recording number(s) for the associated document(s) are to be referenced on the lot adjustment submittal. Provide spaces for the recording numbers thereof. There are no easements, restrictive covenants or agreements as part of this LLA. N. Add KING COUNTY to the "Department of Assessments"" approvals block (Sheet l of 3) King County was added to the Dept of Assessments block Sheet 1 of 3. 0. The "OLD LEGAL DESCRIPTION" be re-titled as "EXISTING LEGAL Description" and as stated previously the name of the newly adjusted parcel should be something other than "PARCEL A" -such as LOT I or other. Make said lot name prominent on the drawing (Sheet 3 of 3) and deemphasize the lines which aren't the boundary of the adjusted property. The Old Legal Description was re-titled as Existing Legal Descriptions. The new name for the Parcels was added to the drawing "New Parcel 1 and New Parcel 2 ". The new boundary is shown in bold line style. We hope that this clears up any problems with the drawings we provided. Two new sets of the drawings are attached to this letter. What is now "Parcel 2" on Sheet 2 of 3 needs lo be outlined in a bolder line, similar to "Parcel 1 ".
