aquatic shoreline in the vicinity of the project area
provides quality habitat for juvenile salmonid prey
and a suitable migratory path for juvenile salmonids
due to the presence of large woody debris,
overhanging vegetation, and minimal overwater
structure. The majority of the overwater structure
associated with the existing pier is oriented
perpendicular to the shore, and the last span of the
fishing pier is located approximately 80 feet from
the upland and 2.5 feet above the water surface in
8 to 1 O feet of water. The existing and proposed
condition of the pier is not anticipated to obstruct
juvenile salmonid passage or increase shading
near the water surface. The proposed project
encompasses restoring the pier to its original
configuration by: 1) Removing and salvaging
connection materials from the damaged deck
structure, hand rails, bull rails, and a bench; 2)
Repairing two existing timber piles, an x-brace on
the pile, an overhead shelter, and steel tubes to
shelter column supports; and, 3) Replacing the
damaged deck structure, hand rails, bull rails, pile
connections and a bench. All removal and salvage
work would be conducted over water from either
the structure surface or a small boat within 200 feet
of the Ordinary High Water Mark (OHWM). It is
estimated that approximately 70 percent of work
would occur from the pier surface and the
remaining 30 percent from a small boat. All repair
and maintenance activities associated with this
requested Certificate of Exemption would take
place within the construction window established by
the Washington State Department of Fish and
Wildlife, July 16 -December 31. No increases in
water column turbidity are anticipated, and as hand
tools would be used for repairs, construction noise
is expected to be negligible. Water supply would
not be affected by the proposed project.

Dear Mr. Wasser:
The City of Renton Parks Division ("Parks") plans to repair components of the last span of a fire-
damaged fishing pier at Gene Coulon Memorial Beach Park on the southeastern shore of Lake
Washington. Damage to the pier occurred on September 8'", 2008. Proposed project elements include
restoring the pier to its original configuration by I) removing and salvaging connection materials from the
damaged deck structure, hand rails, bull rails, and a bench, 2) repairing two existing timber pile, an x-
bracc on the pile, an overhead shelter, and steel tubes to shelter column supports, and 3) replacing
damaged deck structure, hand rails, bull rails, pile connections, and a bench. Gene Coulon Memorial
Beach Park is located within the NW quadrant of Section 5 in Township 23N, Range 05E W.M. Repair
activities will occur exclusively at the fishing pier, which is located at the northern end of the park within
a City of Renton Urban shoreline environment. The completion of the proposed work will enable
"optimum utilization of the shoreline" by the public (RMC 4.3.090.J).
Based on proposed project elements presented in detail in the enclosed Joint Aquatic Resources Perrnit
Application (JARPA), we suggest that pier repair actions are exempt from substantial development pcnnit
requirements (WAC 173.27.040) due to "damage by ... fire" (WAC 173.27.040.2.b). The proposed repairs
will serve to "prevent a ... cessation from a lawfully established condition", and to restore the structure to a
"state comparable to its original condition" (WAC 173.27.040.2.b). Repairs will not cause "substantial
adverse effects to shoreline resources or environment". Salvaging and repairing the damaged components
are "common methods of repair for the type of structure" existing along the Lake Washington shoreline,
and the replacement structures will be "comparable to the original structure'' in terms of size, shape, and
location (WAC 173.27.040.2.b). Further, we are requesting a forrnal letter of exemption from shoreline
review pursuant to the WAC 173.27.050. The shoreline structures repair proposed along a navigable
waterway will require a U.S. Army Corps of Engineers (Corps) Section 10 permit (WAC 173.27.050.1.a).
The proposed project may also be exempt from SEPA review under the WAC 197.11.800 and is not
excluded based on language within the WAC 197.11.305. Categorical exemptions include repair and
maintenance activities (WAC 197.11.800.3) such as those associated with existing public srructures. The
proposed project elements do not involve "material expansions or changes in use beyond that previously
existing". Minor repairs authorized for structures existing on lands covered by water include ''repair or
replacement of piling, ... or minor repair. .. of docks" (WAC 197.11.800).

Lake Washington is considered a Class l water (perennial salmonid-bearing water that is classified by the
City and State as a Shoreline of the State) (RMC 4.3.050.L. l.a.i) and as such, is not subject to Critical
Areas regulations within the City (RMC 4.3.050.B.1.j.iii). Therefore, we are not submitting a Critical
Areas Exemption Fann, Habitat Data Report or Standard Lake Study. As there will be no ground
disturbance associated with the proposed project, we are also not submitting a Geotechnical Report or
Grading Plan. Finally, as no drainage control will be necessary for the reconstructed pier, a Drainage
Control Plan and Drainage Report are not being submitted with this application.

PROJECT DESCRIPTION:
The City of Renton Parks Division ("City") plans to repair components of the last span of a fire-damaged fishing pier at
Gene Coulon Memorial Beach Park on the southeastern shore of Lake Washington (Sheets 1-3; Photographs 1-3).
Damage to the pier occurred on September 8'", 2008. Proposed project elements include restoring the pier to its original
configuration by 1) removing and salvaging connection materials from the damaged deck structure, hand rails. bull rails,
and a bench, 2) repairing two existing timber pile, an x-brace on the pile, an overhead shelter, and steel tubes to shelter
column supports, and 3) replacing damaged deck structure, hand rails, bull rails, pile connections, and a bench (Sheets 2.
3). All proposed repairs will occur within an approximately 18 x 8-foot (144 112
) area over the water surface, and only
approximately 30% of work will require use of a small boat.

a) The Gene Coulon Memorial Beach Park is a public park available for recreational use and is located between the
southeastern bank of Lake Washington and Burlington Northern Santa Fe-owned railroad tracks (Sheet 1 ). The
fishing pier is situated at the northern end of the Park and currently provides a location for the public to fish in Lake
Washington. The fishing pier is connected to all other Park features by a paved footpath.
b) The upland Park property encompasses boat ramps, picnic shelters, playground equipment, tennis and volleyball
courts, concessions, and restroom facilities. Within the Project Area at the northern end of the Park, only the fishing
pier, benches and an overhead shelter exist (Sheet 2). Extending alongshore and landward of the end of the fishing
pier are several rows of remnant timber pile not associated with the fishing pier (Photograph 1 ).
c) The upland adjacent to the Project Area is characterized by several overhanging western red cedar, big leaf maple,
and Pacific willow, but is dominated along the shoreline by Himalayan blackberry, reed canary grass, hardhack and
small-fruited bulrush. A portion of the shoreline adjacent to the Project Area is covered by a mowed lawn. The
aquatic shoreline is characterized by large gravel to cobble with errant small boulders to the north of the pier, as well
as large woody debris. No submerged aquatic vegetation is visible along the aquatic shoreline in the vicinity of the
fishing pier. The aquatic shoreline in the Project Area provides quality habitat for juvenile salmonid prey and a
suitable migratory pathway for juvenile salmonids due to the presence of large woody debris, overhanging vegetation,
and minimal overwater structure.
The majority of the overwater structure associated with the existing fishing pier is oriented perpendicular to shore, and
the last span of the fishing pier is located approximately 80 feet from the upland and 2.5 feet above the water surface
in 8-10 feet of water (Sheets 1, 3; Photograph 1). As such, the existing and proposed condition of the pier is not
anticipated to obstruct juvenile salmonid passage or increase shading near the water surface.

This application is for fishing pier maintenance at Gene Coulon Memorial Beach Park on Lake Washington in response to
fire damage to the last span of the structure (Sheets 1-3). The proposed activities involve 1) salvaging viable timber and
connection hardware, 2) repairing damaged timber components and an overhead shelter and support columns, and
3) replacing damaged timber components and connection hardware, as needed. All work will be conducted over water
within 200 feet of the Ordinary High Water Mark (OHWM). Details of proposed project elements are presented below.
1) Removal and Salvaging of Reusable Pier Components
Several components of the existing damaged section will need to be removed and some may be salvaged for use in the
reconstruction of this section. Currently it is anticipated that the transverse cap clips, stringer clips, rail posts, the bull rail
and chocks, and the bench and its attachments will be salvageable (Photograph 2). The reuse of connection hardware
will be determined upon closer inspection. All removal and salvage work will occur overwater and from either the
structure surface or a small boat.
2) Repair of Damaged Pier Components
Some damaged portions of the pier will be repaired in place, including two 12" timber pile, an x-brace to the pile, the
overhead shelter, and the steel tubes attached to the pile that support the overhead shelter (Sheet 3). The pile tops were
damaged and will need to have char removed. The x-brace will be trimmed to remove the fire damaged section and then
this structure, the shelter, and steel tubes will be reattached once pile top repair and decking surface replacement are
completed. As with removal and salvaging of materials, repair of damaged components will occur either from the pier
surface or from a small boat.

3) Replacement of Damage ___ er Components
After removal. salvaging, and repair of reusable pier components. new materials and attachments will be added to the
existing structure to restore its original condition. New pile caps will be placed on the two repaired pile, and then the
transverse beams at the end of the pier, the stringers, fascia, and additional timber deck material will be reconstructed
and connected with C channels, thru-bolts, and attachment welds, as necessary (Sheet 3; Photograph 3). On the
restored decking surface, the reconstructed bull rail and chocks along with the top rail, bottom rail and chain link fence
material of the handrail, and the bench will be added. Reconstruction work may require use of a small boat due to limited
work space.
It is estimated that approximately 70% of work will occur from the pier surface and the remaining 30% from a small boat.
No heavy machinery will be required for the proposed repairs and therefore only hand tools will be used for removal and
salvaging, repair and replacement of damaged pier components.

OF ENGINEERS AND COAST GUARD REQUIRE DRAWINGS ON 8-1/2 X 11 INCH SHEETS. LARGER DRAWINGS MAY BE REQUIRED BY OTHER AGENCIES.
7b. Describe the purpose of the proposed work and why you want or need to perform it at the site. Please explain any specific needs that
have influenced the design.
The end of the fishing pier is not currently safe for public use and restricts the area available for recreational fishing within
Gene Coulon Memorial Beach Park. The purpose of the proposed work is to restore the original condition of the fire-
damaged fishing pier. The location of the site along the southeastern shore of Lake Washington and the mouth of the
Cedar River is ideal for recreational fishing.
7c. Describe the potential impacts to characteristic uses of the water body. These uses may include fish and aquatic life, water quality,
water supply, recreation and aesthetics. Identify proposed actions to avoid, minimize, and mitigate detrimental impacts and provide
proper protection of fish and aquatic life. Identify which guidance documents you have used. Attach a separate sheet if additional
space is needed.
The characteristic uses of the water body within Gene Coulon Memorial Beach Park will be restored after completion of
the proposed project. Although no in-water work is proposed, use of a small boat for construction staging will be
necessary. As such, all work within the Project Area will occur during in-water work windows approved by the U.S. Army
Corps of Engineers and Washington Department of Fish and Wildlife to avoid and minimize impacts on listed fishes and
designated critical habitats. No increases in water column turbidity are anticipated, and as only hand tools will be used for
repairs, construction noise is expected to be negligible. Water supply will not be affected by the proposed Project.
The following best management practices (BMPs) will be employed throughout project construction to avoid short-term
environmental impacts:
• Short-term impacts to water quality will be limited during overwater pier structure maintenance by careful removal
and installation of components.
• The contractor will be required to capture any debris associated with Project construction and not allow it to enter
Lake Washington.
• Excess or waste materials will not be disposed of waterward of the OHW mark.
