The first two pages of the attachment are the Articles of Incorporation for the Shamrock Heights HOA. I have highlighted two areas on page 2 which indicate that Shamrock Heights, LLC is the Declarant and have a majority of the votes until 75% of the homes have been closed and since the closings are only at 64% we remain the Declarant with overriding voting. Also the Director on the board is Eric Campbell, president of Camwest Development which is the managing member of Shamrock Heights, LLC, On page 3 you will see the definition of Declarant and page 4 the definition of Board of Directors and Membership and Voting Rights for the recorded CC&R's. These all indicate that Shamrock Heights, LLC is still the Declarant, manager and Board of Directors for the HOA. I have also included Article 4. Management of the Association which provides in Section 4.4 the authority of the Association to do what is deemed reasonably necessary to carry out the duties of the Association. It is deemed necessary that the Association deed Tract T to King County. Please let me know if you need any further information_ Thanks. KC needs a copy of the approved mylars & prints of the Luminaires on 148th SE. - The revised mylar will be signed/approved on 10129 and copies made for delivery to DDES on 10/30. How many copies do you want? 2. Tract T pond (north pond): 11/14/2008 50C Page 2 of 3 Pond is required to be in a dedicated KC tract per the Hearing Examiner Conditions. Currently, the tract is recorded private. - A draft Quit Claim Deed and Affidavit of Correction have been provided to Steve Van Patten for review. He is expediting review and I will provide timeline for approval as soon as I can. Provide verification that pond's vegetation meets the requirement for combined detention and storm water wetland (section 6.4.4 of 98 SWDM)(pg.6-94) by certified arborist. - A letter from our certified biologist will be delivered with the 10130 submittal package. The letter will provide verification that the combined detention and storm water wetland is vegetated and function in general conformance with the requirements. Provide verification of implementation of hydrologic monitoring per L04V0003. - Attached is an email between Steve Foley and Aaron Hollingbery of CamWest regarding the hydrologic monitoring which is just starting. Aaron is in charge of the monitoring associated with Adjustment L04V0003, I am covering all other aspects of the project completion and monitoring. 3. Final Corrected Plan / Final Corrected TIR: Correct plans to reflect recorded plat for boundary of Tract T and recorded name of SE 125th Street. — Corrected mylar sheets will be included in the 10134 submittal package. The sheets that have been revised are 1, 3, 4, 13, 19, 20, 31 and 32. The sheets can be replaced in the current mylar set that was submitted previously. TIR doesn't contain O&M manual for Tract T vegetation maintenance per H.E. Cond 151. O&M manual was supposed to be reviewed and approved with the engineering plans and weltand mitigation plan, - An O & M Manual will be provided for inclusion in the Corrected TIR copies that you have. The first two pages of the attachment are the Articles of Incorporation for the Shamrock Heights HOA. have highlighted two areas on page 2 which indicate that Shamrock Heights, LLC is the Declarant and have a majority of the votes until 75% of the homes have been closed and since the closings are only at 64% we remain the Declarant with overriding voting. Also the Director on the board is Eric Campbell, president of Camwest Development which is the managing member of Shamrock Heights, LLC. On page 3 you will see the definition of Declarant and page 4 the definition of Board of Directors and Membership and Voting Rights for the recorded CC&R's. These all indicate that Shamrock Heights, LLC is still the Declarant, manager and Board of Directors for the HOA. I have also included Article 4. Management of the Association which provides in Section 4.4 the authority of the Association to do what is deemed reasonably necessary to carry out the duties of the Association.
