PROPOSAL: Change out a n existing 5' b y 15' internall y li t cabinet s ign with
another internally li t 5' by 15' cabinet s ign. Work w ill occur approximately 40-feet from a Class 2 stream.
The s tandard setback for a Class 2 stream for new construction is 100 feet.
CRITICAL AREA: The s ubject project will occur within the 100-foot buffer of a
C lass 2 s tream.
EXEMPTION JUSTIFICATION : Pursuant to RMC section 4-3-050.C.5.eii of the Cntical Areas
Regulations, an exe mption from the Critical Areas regulations is hereby granted for the following reason:

in exi stence on the date t hi s s ection becomes effective and that do not meet the setback or
buffer requirements of thi s secti on provided the work comp li es with th e criteria in RMC 4-
10-090.
DECISION: The proposed development is con sistent with the following finding s pursuant to RMC
section 4-3-0 50 .C.5 .c :
1. The activity is not prohibited by thi s or any other c hapter of the RMC or state or federaHct,v--or--
re gulat ion;
2. The activity will be conducted using best manageme nt practices as s pecified by industry
standards or applicable Federal agencies or sc ient ific principles; and,
3. Impacts are minimized and, where applicable, di s turbed areas arc immediately restored to the ir
origina l state , unless the exemption is a wetland below the s i7,e thres holds pursuant to RMC 4 -3-
050.C.5.f. land f.2 .
