Dear Mr. Tharp:
This office has reviewed your request (dated November 23, 2009) to extend an
approved short plat (File No. LUA09-110, SHPL-A) that will expire on December 3, 2009.
Pursuant to RMC 4-7-070M, the municipal code allows the original approving body to
issue a single one (1) year extension. Therefore, your short plat extension request is
approved. The short plat will expire on December 3, 2010.
You should be aware this office is empowered to issue only one such extension. If the
final short plat approval is not recorded by December 3, 2010 it will expire and cannot
be extended again.

Dear Mr. Simon:
This letter is regarding the Special Administrative Fence Permit LUA09-110, SF that was issued
for the fence located at 420 SW Sunset Blvd, on September 16, 2009. The appeal period for the
permit ended on October 1, 2009 and no appeals were filed, therefore, this decision is final.
As stated in the permit conditions, you are required to:
■ The fence shall be constructed in compliance with the plans and elevations
submitted on September 2, 2009 with the following revision: the applicant shall
modulate the fence to create off -set sections at regular intervals for a distance of
40 feet from the mid -point of the existing deck to the existing Cedar tree. This is
subject to the review and approval of the Planning Division Project Manager.
■ Permanent landscaping, i.e.-•tall shrubs or small trees shall be installed and
maintained between the fence sections and the top of the slope in front of the
modulated fence sections. The applicant shall submit a proposal for landscaping
subject to the review and approval of the Planning Division Project Manager. The
applicant must install the required landscaping within 90 days of the granting of
the fence permit.

PROJECT DESCRIPTION & ANALYSIS: The applicant is requesting a Special Fence Permit in order
to be allowed to build a permanent 6 -foot cedar privacy fence along the southern property line which is
the side yard along a street (SW Sunset Blvd). The fence, constructed for noise abatement and privacy,
would be approximately 100 -feet long inside the property side and on top of the steep slope abutting
SW Sunset Blvd. The fence would be located approximately 10 feet above the street grade. The slope
located between the sidewalk and the proposed fence location is covered with English Ivy. Grass lawn is
within the yard area between the south side of the house and the top of the slope. A mature Cedar tree
is present on the southwest corner of the property, and evergreen ornamental shrubs/low trees are
located on the southeast corner of the site (between the southeast corner of the house and the south
property line). This fence would not affect the clear vision area.

CONDITIONS OF APPROVAL:
1) The fence shall be constructed in compliance with the plans and elevations submitted on
September 2, 2009 with the following revision: the applicant shall modulate the fence to

To Whom It May Concern:
With respect to the justification for a special fence permit, I would simply state that with
my home being 30'+/- from SW Sunset Blvd, a five lane principal arterial carrying
approximately 22,000 vehicles a day traveling at an average speed of 48 mph (Traffic
Engineering's data) and being a designated truck route as well as having articulated buses
passing every 12 minutes during peak hours, I need every opportunity to mitigate the
traffic noise which at times is well in excess of 90 decibels. There are other mitigating
factors as well such as the visual disruption, privacy and property value concerns.
My home sits approximately 10 feet above street grade which means the fence will not be
at driver or pedestrian eye levels nor will it affect site distance issues whatsoever. The
fence will be constructed primarily of cedar and will be stained a gray pigment to match
my home. The front of the property below the fence line consists of a 1.5:1 slope which is
covered with English Ivy and has a large mature Cedar tree (see attached photos). No
additional landscaping is planned at this time. The fence design will incorporate the same
pattern, front and back and overall will benefit the surrounding properties and property
owners. The fence will provide privacy so that I do not have to continue to look out at
surrounding properties such as 440 SW Sunset Blvd or 380 Stevens Ave SW (whose
property has been maintained twice in 2009), 345 Lind Ave SW (who utilizes their front
yard and adjoining public right of way as a car lot) and 2151315 SW Sunset Blvd which
operates a junk yard under the premise that it's a used car lot.
