It is unlawful for any person to keep, store or park, or to permit any other person to keep,
store or park, any disabled vehicle or boat, or unlicensed vehicle or boat, on any
residentially zoned property within the City unless that vehicle or boat is stored and parked
outside public view within a fully enclosed building at all times. Vehicles and boats which are
kept on site and outside of an enclosed building shall be operational and currently
registered.
•RMC Violation: RMC 4-4-085.D.4 Parking of Vehicles on Residential Property: Maximum
Number of Vehicles per Lot
A maximum of four (4) vehicles, not including motorcycle or mopeds, may be parked on a
lot unless vehicles in excess of the allowed number are kept within an enclosed building.
Additional vehicles may be allowed if:
a.More than four (4) licensed drivers reside at the same address, an additional motor
vehicle for each licensed driver over four (4) may be parked at that particular address,
provided that each licensed driver and said vehicle are registered to the same address; or
b.An Additional Vehicles Permit is obtained (see RMC 4-9-105).

Impermissible Parking Locations
Except for recreational vehicles and commercial vehicles being used for development
activity pursuant to a valid City-issued permit, all motor vehicles shall be parked on a
lawfully established driveway or an approved impervious surface. A separate violation of
this Section shall be deemed to have occurred when, after issuance of a citation, twenty
four (24) or more consecutive hours passes and the offending vehicle remains in an
impermissible location, regardless of whether or not the vehicle has been relocated from
the original location. For the purpose of this Section, driveways consisting of compacted
dirt and/or gravel established prior to the effective date of this Section shall be considered
a permissible parking location.

RMC 4-4-030 I: Habitation of Travel Trailers or Recreational Vehicles: Except as authorized
in RMC 4-9-240, Temporary Use Permits, recreational vehicles, travel trailers, tents, or other
temporary shelters shall not be used for habitation.”

June 30, 2023: I went to the property to perform an inspection. The inspection revealed
overgrown vegetation, people appear to be living in RV on property, impermissible
parking, and unlicensed vehicles.
July 20, 2023: The City opened a new Code Case, referred from CODE22-000119. I went
to the property to perform an inspection. The inspection revealed unlicensed vehicle(s)
including, but not limited to Montana trailer (license plate #1371-NW), garbage cans
impermissibly placed by front fence area, over 4 vehicles on property, impermissible
parking of white vans and travel trailers, overgrown vegetation along fence line and
roadway, people appear to be living in RV on property.
Warning of Violation letter was sent to the property owner with a compliance due date
of August 4, 2023.
September 20, 2023: I went to the property to perform a follow up inspection. The
inspection revealed unlicensed vehicle(s) including, but not limited to Montana trailer
(license plate #1371-NW), garbage cans impermissibly placed by front fence area, over 4
vehicles on property, impermissible parking of white vans and travel trailers, and people
appear to be living in RVs on property.
September 21, 2023: Second Warning of Violation letter was sent to the property owner
with a compliance due date of October 6, 2023.
November 6, 2023: I went to the property to perform a follow up inspection. The
inspection revealed unlicensed vehicle(s) including, but not limited to Montana trailer
(license plate #1371-NW), over 4 vehicles on property, impermissible parking of white
van, Recreational Vehicles, and travel trailers, and people appear to be living in RVs on
property.
November 15, 2023: Third and final Warning of Violation letter was sent to the property
owner with a compliance due date of November 30, 2023.
February 29, 2024: I went to the property to perform a follow up inspection. The
inspection revealed unlicensed vehicle(s) including, but not limited to Montana trailer
(license plate #1371-NW), over 4 vehicles on property, impermissible parking of white
van, Recreational Vehicles, and travel trailers, and people appear to be living in RVs on
property.
March 1, 2024: Notice of Violation and Order to Correct was sent to the property owner
with a compliance due date and deadline for appeal of March 16, 2024.
March 19-June 25, 2024: Multiple calls, emails and correspondence between The City
and Mr. Carner.

July 1, 2024: Mr. Carner met with Rob Shuey and Gina Estep to discuss the violations.
Mr. Carner admitted that there are people living in least two of the RVs on the
property. Both RVs are connected to the primary residence’s side sewer.
The city’s position is that more than ample time has been granted to make substantial
gains in bringing the property into compliance, which has not happened. The property
owner was made aware of the violations on the property several times and did nothing
about it. The choice of the property owner to state that the above-mentioned
“violations do not apply” to him, does not negate from the effort of city staff to bring
the property into compliance or lessen the property owner’s responsibility for paying
the accrued fees.

Waste Carts: The City of Renton Municipal Code regulates the placement of garbage cans for
curbside collection. The code specifically states “it shall be unlawful for a person residing in a
single family residence to place garbage, recyclables, or yard waste at the curbside for
collection by the city’s collection contractor, more than 24 hours prior to regular collection date
for his or her single family residence. It shall also be unlawful for a person residing in a single
family residence to leave garbage cans, recycling bins or yard waste carts at the curbside
more than 24 hours after collection by the city’s collection contractor. Further, it shall be

unlawful for a person residing in a single family to maintain, place or store any garbage cans
recycling bins or yard waste carts at a location other than adjacent to the residential structure

Corrective Action:Do not place or store any garbage cans, recycling bins or yard waste carts at curbside, more
than twenty-four (24) hours prior to pickup and remove the cans within twenty-four (24) hours
after pickup. When garbage cans, recycling bins and yard waste carts are not located at
curbside for collection the containers must be kept adjacent to a building on the property or
within a fully enclosed building or garage. Garbage cans need to be removed from fence area.

Premises and exterior property shall be maintained free from weeds or plant growth in excess
of twelve (12) inches on developed property or twenty four (24) inches on vacant land. Noxious
weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and
vegetation other than trees or shrubs provided however this term shall not include cultivated
flowers and gardens.
Corrective Action:Mow and maintain all vegetation to a maximum of twelve (12) inches in height on developed
property at all times. This includes but is not limited to vegetation lining fence and roadway.

I write in response to your email dated April 5, 2024 responding to the Notice of Violation and Order to Correct
dated March 1, 2024.
In order to address our earlier communications challenges, in addition to this email I am also sending via USPS to
your address of record and will post this notice at the property. For similar reasons, and in consideration of our
phone conversations and the follow up email from you I am suspending enforcement of the March 1, 2024
Notice of Violation and Order to Correct, and re-issuing the Notice of Violation and Order to Correct to be dated
today.

Please note that the attached Notice and Order includes instruction on how to appeal the Notice within 15 days
of it being issued. As you will see below, I am temporarily suspending enforcement of Violation 1 related to
disabled or unlicensed vehicles to the extent you continue to make progress in permitting a fully enclosed
building in which those vehicles may be stored. I have also identified specific requests for documentation or
verification of information in order to correct other violations. The City’s primary interest is following our Code
to maintain the safety and welfare of our residents.
I would also like to address the February 21, 2019 Renton Hearing Examiner Decision for CODE17-000628
(“Decision”) for this same address. The document was provided earlier, but is also available online here:

To the extent that your storage of noncommercial vehicles was “grandfathered” in at your property, the
referenced decision gave you a year-long amortization period to terminate (“abate”) the use (Decision, p.3).
Violation 1 in the Decision is substantially the same as the present Violation 2 (maximum number of vehicles on-
site).

With respect to that violation, and relevant to the current Notice of Violation, the Decision finds that while up to
five noncommercial vehicles are “grandfathered”, they are still subject to current City regulations limiting the
number of parked vehicles on the property (Decision, Conclusions of Law, 3. Nonconforming use, pp. 7,9). The
2017 Code violation for excess vehicles was sustained, meaning the Hearing Examiner agreed that the excess
number of vehicles was a violation on your property and subject to fine (Decision, Conclusions of Law, 5. Code
Violations, pp9-11), with the fine waived only when and if the violation is abated.
RE: Violation 1: (Disabled/Unlicensed Vehicles)
You appear to admit that you have disabled/unlicensed vehicles stored and/or parked “outside of an
enclosed building” in violation of RMC 4-4-085.D.2 (quoted below, emphasis added)
2.Disabled or Unlicensed Vehicles and Boats: It is unlawful for any person to keep, store or
park, or to permit any other person to keep, store or park, any disabled vehicle or boat, or
unlicensed vehicle or boat, on any residentially zoned property within the City unless that
vehicle or boat is stored and parked outside public view within a fully enclosed building at
all times. Vehicles and boats which are kept on site and outside of an enclosed building shall
be operational and currently registered.
I understand you are working with the City to obtain a permit to construct a fully enclosed building to
correct this violation. So long as you continue to make substantial progress to correct, we will suspend
enforcement on this violation.
RE: Violation 2: (Maximum number of vehicles)
You indicated that since there are 8 licensed drivers at your address, you believe Renton Municipal Code
(“RMC”) 4-4-085.D.4 allows you to have 8 vehicles parked at the property. Please note that all recreational
trucks, recreational vehicles, buses, boats, trailers, and heavy equipment also fall within the definition of
“vehicle”. To correct this violation, please provide documentation that either:
•“each licensed driver and … vehicle are registered to the … address” (RMC 4-4-085.D.4(a)) or
•that you have obtained an additional vehicles permit (RMC 4-4-085.D.4.c referencing RMC 4-9-105)
RE: Violation 3: (Parking in Impermissible Locations)
You appear to admit that you have vehicles that are not parked on an impervious surface, however that
“driveways consisting of compacted dirt and/or gravel established prior to the effective date of this
Section shall be considered a permissible parking location” (RMC 4-4-085.D.3, emphasis added).
To correct this violation, please confirm that the gravel surfaces where you have the vehicles parked are,
in fact, considered a “driveway.” You may need to contact City Planning to document this.
