SUMMARY OF ACTION: PLANNING DEPARTMENT RECOMMENDATION: Approval w/conditions HEARING EXAMINER DECISION: Approval w/conditions PLANNING DEPARTMENT The Planning Department preliminary report was received by REPORT: the Examiner on February 4, 1980. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on February 5, 1980 at 9:40 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It wa reported that the Hearing Examiner and the applicant had received and reviewed the Panning Department report, and the report was entered into the record as Exhibit #1. Steve Munson, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Short Plat as submitted Exhibit #3: Short Plat with staff comments Exhibit #4: Parking Lot Plan Referencing Section L.3 of Exhibit #1, the Examiner inquired regarding the location of a required utility easement. . Roger Blaylock, Associate Planner, reported that because the location of a proposed pump station in the area has not yet been determined, designation of the utility easement has not occurred. The Examiner corrected Section M.4 of Exhibit #1 which refers 'to comments contained in Section L.8 of the analysis and should reference Section L.6. Mr. Blaylock clarified that }n the northern area of the property, the requirement for easement width is .29 feet in the jogged area designated on Exhibit #3. The Examiner inquired if the Planning Depar+ment proposes a lot line adjustment to delete the jog if a proposed revision to the Parking and Loading Ordinance is approved. Mr. Blaylock responded affirmatively. The Examiner requested testimony by the applicant. Responding was: Rosalie Mabin 4445 Talbot Road S. Renton, WA 98055 Ms. Mabin, secretary. for Dr. Kay and Dr. Hubbard, advised concurrence in the Planning Department recommendations. The Examiner requested further testimony in support of the application. Responding was: Fred Reebs 4300 Talbot. Road S. Renton, WA; 98055 Dr. Reebs, purchaser of the property, indicated that he had discussed proposed Planning Department revisions with Dr Kay, and it was their opinion that all requirements can be '. met. The Examiner requested further testimony, in support or opposition to the application. There1 was. .no response. ;.` ,He then requested final comments'from the Planning Department :staff. . P1. 459-79 Page Two was closed by the Examiner at 9:50 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a two-lot short plat on +1.89 acres. 2. The Planning Department report sets forth the issues, applicable policies and provisions, and departmental recommendations in this matter, and is entered as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been determined exempt from the threshold determination by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. • 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-709.A (R-3; Medium Density Multifamily Residential; minimum lot size 5,000 square feet) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The subject property is located on Talbot Road S. just south of S. 43rd Street. The applicant proposes dividing the subject property into two lots. Proposed Lot 1 would be approximately 38,000 square feet and proposed Lot 2 would be approximately an acre in size. 9. The subject site was annexed into the city in March of 1968 and was rezoned from G (General; Single Family Residential; minimum lot size 35,000 square feet) zone to R-3 in the same year. 10. The subject property slopes downward from east to west at approximately an 8-10% grade. Approximately two-thirds of the easterly portion of the site is covered with shrubs and brush and the remainder of the site is covered with fairly dense stands of evergreen and deciduous trees. 11. An existing medical clinic is located on the southernmost lot (proposed Lot 1) . 12. The applicant proposes creating a 24-foot east/west easement along the southern property line of proposed Lot 2 for access to proposed Lot 1. The requirements of Section 4-2204(2) (A) require a jog in the property lines and easement so that the entry drive is no less than five feet from the property line of Lot 1. 13. Section 9-1108.24.A(4) requires each lot to be served by a public street which precludes the use of the proposed easement to serve proposed Lot 1. 14. The general area in which the subject property is located is developed with a number of medical clinics to the north and south. Valley General Hospital is located north of the subject property. There is an attorney's office located to the east and the East Valley Freeway is to the west. 15. Zoning in the area consists of the subject property's R-3, P-1 (Public) north and south of the subject site and G (General) east, south and west of the subject site. 16. The subject property was the subject of an illegal division and sale without the benefit of the city's Subdivision Ordinance requirements. 17. The Planning Department indicated that an amendment to Section 4-2204.2,A is being considered to permit adjoining properties to develop common driveways on their respective property lines. • Sh. P1. 459-79 Page Three g CONCLUSIONS: 1. The proposed short plat appears to serve the public use and interest with the exception of the proposed access easement on Lot 2. • The division of the subject property will enable the development of the two separate medical facilities on the adjacent parcels and will recognize the actual ownership of the two portions of the subject property. 2. The access easement is' in violation of the requirements of Section 9-1108.24.A(4) which requires that "every lot and block be 'served from a publicly dedicated street." City policy is to avoid the creation of private streets, thoroughfares and easements for any lot. There would,be little or no point in requiring frontage on a public Street (See Definitions - Sections 4-702(9) and 9-1101(8)A and B) , if the applicant then provided access via a private easement through another lot. The city maintains control over important aspects of public streets such as grade, Surface material and maintenance. Without uniform standards, safe passage by emergency vehicles could be jeopardized. Such considerations should not be left to agreement between private parties. An access easement can be dissolved by a future agreement of. the parties without city 'approval, and it is very difficult for the city t10 monitor the condition of private roads and easements. • 3. The applicants have created their own hardship ,by acquiring land which was not legally subdivided, building upon it and then proposing an.access easement,as the only alternative for further development. Applicants should not be permitted to thwart city policies and ordinances, and therefore, each lot in the proposed short plat shall provide direct access to a public street via a driveway from the lot. 4. Permission to 'provide a private access easement would grant the applicant a special plrivilege not afforded other applicants with similarly situated property, and would provide an undue precedent. • 5. Because of the layout of the existing clinic and associated parking area on proposed Loot 1 and .the need to access the parking spaces to the north and west, the proposed property line between the two parcels should be relocated a distance of 24 feet to the north. DECISION: Exhibit #2 is approved subject to relocation of the northern property line of proposed Lot 1 a distance of 24 feet to the north, and development of separate methods of access . on each of the proposed lots with each access driveway entering and/or exiting a publicly dedicated street. Topography : The site slopes downward from east to west at approximately an 8-10% slope . 20 Soils : Alderwood gravelly sandy loam (AgC) . Per- meability is moderately rapid in the surface layer and subsoil . Runoff is slow to medium, and the erosion hazard is moderate . This soil is usesd for timber , pasture , row crops , and urban develop- ment . 3 . Vegetation : The easterly two thirds of the subject site consists of scrub brush while fairly dense evergreen and deciduous trees are found in the westerly one-third . 4. Wildlife : The existing vegetation on the site provides suitable habitat for birds and small mammals . 5 . Water : No surface water was observed on the subject site (January 18, 1980) . 6 . Suitable utilities are available to the subject site, although some possible water main extensions and/or cost participation in the existing water main on Talbot Road may be required . A utility easement will also have to be granted . Standard hook-up fees will apply as well as special charges for a high pressure water system to be constructed in the future . The water mains and fire hydrants will need to be installed and serviceable prior to construction , and access roads shall meet the minimum standards of the Uniform Fire Code . See other comments of the Fire Department . 5 . The Engineering Division advises that off-site improvements , will be required on Talbot Road South. These normally consist of curbs , gutters , sidewalk, street paving , and similar public street appurtances . 6 . The parking lot design for the Kay Hubbard Clinic located on lot 1 utilizes access across proposed lot 2 . The proposed short plat does not include that joint access parking lot aisle . The existing curb cut would violate Section 4-2204 (2) (A) which requires that the driveway be a minimum of five (5 ) feet from the property line , if the east- west line separating the two parcels was extended directly to the public right-of-way . The "jog" in this property line does meet the minimum requirements of the section noted above. 7 . An amendment to the Parking and Loading Ordinance is in draft form which would allow jointly used driveways to straddle the joint property line . If the Ordinance amendment is adopted prior to recording of the short plat , the property line will be extended directly to the street . 8 . The joint access easement will have to be placed on the short plat . The easement will have to be 24 feet in width to meet the minimum aisle width of the Parking and loading Ordinance . • 9 . Topography : The site slopes downward from east to west at approximately an 8-10% slope . 2 .. Soils : Alderwood gravelly sandy loam (AgC) . Per- meability is moderately rapid in the surface layer and subsoil . Runoff is slow to medium, and the erosion hazard is moderate . This soil is usesd for timber , pasture, row crops , and urban develop- ment . 3 . Vegetation : The easterly two thirda of the subject site consists of scrub brush while fairly dense evergreen and deciduous trees are found in the westerly one-third . 4. Wildlife : The existing vegetation on the site provides suitable habitat for birds and small mammals . 5 . Water : No surface water was observed on the subject site (January 18, 1980 ) . 6 . Land Use : An existing medical clinic is located on Lot 2 of the proposed short plat . The remainder of the site is undeveloped . Other similar clinics are located to the north and south . . An attorney ' s office is to the east and the .East Valley Freeway is found on the west . E . NEIGHBORHOOD CHARACTERISTICS : The surrounding area is developed into a medical-professional complex with some scattered single family residences on the fringes . F . PUBLIC SERVICES : 1 . PLANNING DEPARTMENT m,N1A1ILYSI[S : 1 . -The proposed short plat is consistent with the Comprehensive Plan and zoning for the site and surrounding rea. 2 . Both of the proposed lots exceed the minimum lot size and frontage requirements of the Zoning and Subdivision Ordinances . 3 . Suitable utilities are available to the subject site , although some possible water main extensions and/or cost participation in the existing water main on Talbot Road may be required . A utility easement will also have to be granted . Standard hook-up fees will apply as well as special charges for a high pressure water, system to be constructed in the future . • 11111 011 + 1 PLANNING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING FEBRUARY 5 , 1980 PAGE FOUR 4 . The water mains and fire hydrants will need to be installed and serviceable prior to construction , and access roads shall meet the minimum standards of the Uniform Fire Code . See other comments of the Fire Department . 5 . The Engineering Division advises that off-site improvements will be required on Talbot Road South. These normally consist of curbs , gutters , sidewalk , street paving , and similar public street appurtances . 6 . The parking lot design for the Kay Hubbard Clinic located on lot 1 utilizes access across proposed lot 2 . The proposed short plat does not include that joint access parking lot aisle . The existing curb cut would violate Section 4-2204( 2) (A) which requires that the driveway be a minimum of five (5 ) feet from the property line , if the east- west line separating the two parcels was extended directly to the public right-of-way . The "jog" in this property line does meet the minimum requirements of the section noted above . 7 . An amendment to the Parking and Loading Ordinance is in draft form which would allow jointly used driveways to straddle the joint property line . If the Ordinance amendment is adopted prior to recording of the short plat , the property line will be extended directly to the . street . 8 . The joint access easement will have to be placed on the short plat . The easement will have to be 24 feet in width to meet the minimum aisle width of the Parking and loading Ordinance . • 9 .
