The outdoor seating area is proposed along the northwest corner of the building. The seating area would take up three (3) of the existing 42 onsite surface parking stalls used by the restaurant. The outdoor seating area measures approximately 12 feet (12’) in width by 21’ 6” in depth (approx. 259 square feet) and would hold three (3) tables and six (6) chairs for outside dining. According to Renton Municipal Code (RMC) 4-4-080F.10.e, eating and drinking establishments and taverns require a minimum and maximum of 10 per 1,000 square feet of dining area in the Commercial Arterial (CA) zone. According to the site plan (Exhibit 2), the restaurant dining area is 1,959 square feet and would therefore require 20 parking spaces (1,959 square feet x 0.01 = 19.59 stalls). The removal of three (3) surface parking stalls for temporary outdoor seating would bring the restaurant closer to compliance with the minimum and maximum parking code requirement of the code for the existing restaurant use with 39 remaining stalls. The temporary seating area would be buffered from the street and surrounding parking by a combination of metal barrier fencing and planter boxes. No interior work is being proposed. The applicant anticipates that the operating schedule of the temporary outdoor dining would be from May to September, seven (7) days a week, from 11:00 am to 9:00 pm. See Exhibit 2 for additional site plan information. The Temporary Use Permit is hereby Approved with Conditions* .: *CONDITIONS OF APPROVAL: 1. A City of Renton Business License must be obtained prior to operation. All requirements, standards, and permits required by the City of Renton Building Department and Seattle- King County Public Health Department must be met and approved prior to operation. 3. The site occupied by the temporary use shall be left free of debris, litter, or other evidence of the temporary use upon completion of removal of the use, or when the operation of the use ceases to exist. 4. The site occupied by the temporary use shall be restored to the original condition when the use ceases to exist including restoration of site elements such as, but not limited to, landscaping, vegetation, and parking stall striping. 5. The area of temporary use shall only be used for operation during business hours. 6. Any additional uses, activities, or expansion of the area of temporary use that is outside of the approved description of work (listed above), shall be in violation of the approval of this permit and shall result in the removal of the temporary use, which may result in code compliance action. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation or fact. After review of the Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on August 5, 2024. Appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted electronically. The appeal submitted in person may be paid on the first floor in our Finance Department. Appeals to the Hearing Examiner are governed by RMC 4- 8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov. EXPIRATION: This Temporary Use Permit is valid from the effective date of the permit to the expiration date listed above. The Community & Economic Development Administrator or designee can establish a shorter time frame or in this case, the applicant has requested that the permit be valid beyond the one-year expiration. An applicant can request an extension for up to five years (from the effective date of the permit) and can be made at the time of application or prior to permit expiration. EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to permit expiration to the Department of Community & Economic Development Administrator.
