HISTORY and BACKGROUND The Subdivision Technical Committee (STC) of King County has conducted an on-site examination of the subject property. The STC has discussed the proposed development with the applicant to clarify technical details of the application and to determine the compatibility of this project with applicable King County plans, codes, and other official documents regulating this development. As a result of preliminary discussions, the applicant presented the Technical Committee with a revised site plan on January 9, 2006. The revision to address some of the technical issues was minor. No change to the road or lot layout was made. Report & Decision Page I of9 L04S0065 D. NATURAL ENVIRONMENT 1. Topography: The site slopes down gently from west to east. The maximum slope is3%. 2. Soils: One soil type is found on this site per King County Soil Survey, 1973. The entire site is classified AgB. The following are characteristics of AgB soils: AqB -Alderwood gravely, sandy loam; 0-6% slopes. Runoff is slow and the erosion hazard is slight. This soil type has moderate limitations for low building foundations due to a seasonally high water table, and severe limitations for septic tank filter fields due to very slow permeability in the substratum. 3. Wetlands: A wetland and report was prepared by Altmann Oliver Associates dated December 22, 2004. The report identified a small (175 sq.ft.) isolated shallow wetland partly on site. This wetland is exempt from regulation. The site lies within the Soos Creek drainage basin. 4. Vegetation: This site is primarily covered in grasses. Scattered evergreen and deciduous trees and sherubs occur in limited numbers. 5. Wildlife: Small birds and animals may inhabit this site; however, their population and species are limited due to nearby development. No threatened or endangered species are known to exist on or near the property. 6. The Sensitive Areas Folio does not identify any mapped sensitive areas as being present on this site. E. NEIGHBORHOOD CHARACTERISTICS: The property lies within a gradually urbanizing area east of the City of Renton. The proposed subdivision of Fleuve Des Voies, KC File L04P0002, with 38 residential lots is on parcels east of the site and is currently under review by DOES. There are larger lots with potential for re-subdivision to the west and north of the site. The properties south of the site are developed with single family residences. The site and the surrounding parcels are zoned Residential (R-6) with six dwelling units per acre. The proposed subdivision site is undeveloped. F. DESIGN FEATURES 1. Lot Pattern and Density: The proposed density and lot layout meets the density requirements of R-6 and the Short Subdivision Code. 2. Access/Roadway Section: The site obtains access to 1201 h Avenue SE via a 30- foot wide easement extending east from the road to the site. The easement will be improved to an urban minor access road standards consisting of curb, gutter and sidewalks on the north side of the road. 3. Drainage: Currently drainage from the property leaves the site in the form of sheet flow. After development, storm water runoff (from the proposed under ground vault) will be conveyed eastward (same direction) to a proposed development on the neighboring property. The on-site vault will be located in the southeast corner of the property. It will be designed for Level II flow control and basic water quality (1998 Surface Water Design Manual). 3. Other Design Features: The proposal includes a 3,173 square foot recreation tract located southeast of the site. This tract will be improved with landscaping and a toy structure for the benefit of the subdivision's future residents. Report and Decision L04S0065 •• G. PUBLIC SERVICES 1. Sewage Disposal: The applicant proposes to serve the subject subdivision by means of a public sewer system managed by the Soos Creek Water and Sewer District. A Certificate of Sewer Availability, dated December 2004 indicates this sewer district's capability to serve the proposed development. 2. Water Supply: The applicant proposes to serve the subject subdivision with a public water supply and distribution system managed by the Soos Creek Water and sewer District. A Certificate of Water Availability dated December 17, 2004 indicates this water district's capability to serve the proposed development. 3. School facilities: The subject subdivision will be served by Benson Elementary, Nelson Middle, and Lindberg Senior High Schools, all located within the Renton School District. 4. School Access: The District has indicated that the future students from this subdivision will walk to Benson Elementary and the middle and high school students will be bussed at the intersections of 1201h Avenue SE and SE 1881 h Street and at the intersection of SE 1881h and 1161h Avenue SE respectively. Current/X, there are no sidewalks along 120th Avenue SE to its intersection with SE 188 Street. Sidewalk improvements are expected along SE 188th Street by other subdivision proposals in the area. 5. Parks and Recreation Space: The nearest public park is Soos Creek Park located along SE 192"d Street a few miles southeast of the site. KCC 21 A.14 requires subdivisions in the UR and R zone classifications to either provide on- site recreation space or pay a fee to the Parks Division for establishment and maintenance of neighborhood parks. At this time, the applicant is proposing to . provide a 3,100 square-foot recreation tract on the site. The site of the recreation tract is encumbered by the Soos Creek utility easement. The Soos Creek Water and Sewer District has agreed to reduce the easement to 10-foot wide for water main. The District has no objection to development of a recreation tract on the easement provided no toy structure is anchored within the easement, see attachment i. KCC 21A.14.190 requires subdivisions to provide tot/children play areas within the recreation space on-site. The proposal must include a 270-square-foot play area with the required recreation tract. The recreation tract plan must be reviewed and approved by the Soos Creek Utility District. G. SEPA THRESHOLD DETERMINATION: Pursuant to the State Environmental Policy Act (SEPA), RCW 43.21C, the responsible official of the LUSD issued a mitigated threshold determination of non-significance (MONS) for the proposed development on March 24, 2006. This determination was based on the review of the environmental checklist and supporting documentation filed with the application, resulting in the conclusion that the proposal would not cause probable significant adverse impacts on the environment provided the following measures are attached to the project as conditions: In accordance with the requirements with RCW 58.17.110 (2), the Applicant shall improve 120th Avenue SE, from the plat entrance in the 19000 block northward to the intersection of SE 188th Street/120th Avenue SE by providing a paved walkway along the easterly side of 120th Avenue SE. The walkway, per Section 3.09 of the KCRS shall be selected and designed by the Applicant's engineer in accordance with any one of the following standards, and upon approval by DOES, constructed. A. A full width (8 feet) paved shoulder B. A paved shoulder of no less than four (4) feet in width, separated by vehicle traffic by either an extruded curb or an unpaved gravel shoulder strip Report and Decision L04S0065 C. A concrete curb and gutter, and sidewalk section H. FINDINGS/CONCLUSIONS: The subject subdivision will comply with the goals and objectives of the King County Comprehensive Plan and will comply with the requirements of the Subdivision and Zoning Codes and other official land use controls of King County (e.g. 1993 King County Road Standards, 1998 Surface Water Design Manual, etc.), based upon the conditions for final short plat approval. A paved shoulder of no less than four (4) feet in width, separated by vehicle traffic by either an extruded curb or an unpaved gravel shoulder strip Report and Decision L04S0065 C. A concrete curb and gutter, and sidewalk section Other Considerations A. Preliminary approval of this application does not limit the applicant's responsibility to obtain any required permit or license from the State or other regulatory body. This may include, but not be limited to, obtaining a forest practice permit, an HPA permit, building permits, and other types of entitlements as necessitated by circumstances. B. The short subdivision shall conform to KCC 16.82 relating to grading on private property. C. Development of the subject property may require registration with the Washington State Department of Licensing, Real Estate Division Appeal Information and Parties of Record Report and Decision L04S006S RIGHT TO APPEAL This action may be appealed in writing to the King County Hearing Examiner, with a fee of $250 (check payable to King County Office of Finance). As required by KCC 20.20.090 and 20.24.090, the appeal period shall be twenty one (21) calendar days and shall commence on the third day after the notice of decision is mailed. Filing an appeal requires actual delivery to the King County Land Use Services Division prior to the close of business (4:30 p.m.) on April 24, 2006. Prior mailing is not sufficient if actual receipt by the Division does not occur within the applicable time period. The Examiner does not have authority to extend the time period unless the Division is not open on the specified closing date, in which event delivery prior to the close of business on the next business day is sufficient to meet the filing requirement. If a timely Notice of Appeal has been filed, the appellant shall file a statement of appeal within a 21-day calendar period commencing three days after the notice of decision is mailed. The statement of appeal shall identify the decision being appealed (including file number) and the alleged errors in that decision. The statement of appeal shall state: 1) specific reasons why the decision should be reversed or modified; and 2) the harm suffered or anticipated by the appellant, and the relief sought. The scope of an appeal shall be based on matters or issues raised in the statement of appeal. Failure to timely file a notice of appeal, appeal fee, or statement of appeal deprives the Examiner of jurisdiction to consider the appeal. Appeals must be submitted to the Department of Development and Environmental Services, addressed as follows: LAND USE APPEAL Land Use Services Division Department of Development and Environmental Services BlackRiver Corporate Park 900 Oakesdale Avenue Southwest Renton, WA 98055-1219 Any party may make a request for a pre-hearing conference. SHORT SUBDIVISION File No. L04S0065 DESIGN FEATURES 2. Access/Roadway Section: The proposal obtains access off 20th Avenue SE by means of a private easement. The road serving this short plat will be improved to the urban minor access street standard. It will terminate at a cul-de-sac bulb located near the center of the property. 3. Drainage: Currently drainage from the property leaves the site in the form of sheet flow. After development storm water runoff (from the proposed under ground vault) will be conveyed easterly (same direction) to a proposed development on the neighboring property. The on-site vault will be located in the southeast property corner. It will be designed for Level II flow control and basic water quality (1998 Surface Water Design Manual). DECISION: 2. Access Requirements 1993 King County Road Standards (KCRS) (KCC 14) Final short plat approval shall require full compliance with the provisions set forth in the King County Road Standards (KCRS), including engineering plans for all road and site improvements. The engineering plans shall be prepared by a professional civil engineer licensed in the state of Washington. DOES strongly recommends that the engineering plans be submitted at least two years prior to the expiration date of the project. All construction and upgrading of public and private roads within this short plat shall comply with the following requirements unless otherwise approved by ODES (KCRS Section1 .03). a. The road serving the property shall be designed as an urban minor access street (Section 2.03). It shall extend from 20th Avenue SE to the cul-de-sac (CDS) bulb located at its eastern terminus (Section 2.07). b. A permanent CDS bulb shall be improved as shown on the revised site plan (KCRS Section 2.08). c. The off-site portion of the road improvements may remain in the existing easement. However, the on-site improvements shall be place in a tract. The tract shall be an undivided ownership to the lots it serves, and the lot owners shall be responsible for its maintenance. d. The proposed road improvements shall address the requirements for road surfacing outlined in KCRS Chapter 4. As noted in section 4.01 F, full width pavement overlay is required where widening existing asphalt. e. Modifications to the above road conditions may be considered by King County pursuant to the variance procedures in KCRS 1.08. m. The following notes shall be shown on the final recorded short subdivision: (1) All private easements and/or tracts to be maintained, repaired, and/or rebuilt by the owners of the parcels having legal access there from and their heirs, assigns or successors, unless and until such roads are improved to King County standards and are dedicated and accepted by King County for maintenance. Report and Decision L04S0057 & L04S0058 (2) All restrictions, easements, tracts, and their purpose shall be shown on the final recorded short subdivision. 3. Surface Water Management and Control 1998 King County Surface Water Design Manual (SWDM) (KCC 9) The proposed short plat qualifies for full drainage review as outlined in chapter one of the SWDM, Final short plat approval shall require full compliance with the drainage provisions set forth in King County Code 9.04. A professional civil engineer licensed in the State of Washington shall prepare drainage plans and a technical information report as outlined in Chapter 2 of the drainage manual. The drainage plan submittal shall demonstrate compliance with all applicable Core and Special Requirements. Compliance may result in reducing the number and/or location of lots as shown on the preliminary approved short plat. Preliminary review has identified the following conditions of approval, which represent portions of the drainage requirements. All other applicable requirements in KCC 9.04 and the Surface Water Design Manual (SWDM) must also be satisfied during engineering and final review. a. Engineering plans and analysis shall comply with the SWDM. Prior to short plat recording, the applicant shall submit engineering plans to address the required short plat improvements. King County approval of drainage and roadway plans is required prior to any construction. Permit fees for review and inspection shall be paid as required by County codes and policies. Bonding for the drainage plans will also be established as determined by DOES prior to plan approval. After receiving drainage plan approval, the applicant shall contact the ODES Land Use Inspection Section to schedule a pre-construction meeting prior to performing work on the site. b. Current standard plan notes and ESC notes, as established by ODES Engineering Review shall be shown on the engineering plans. c. The following note shall be shown on the final recorded plat: "All building downspouts, footing drains, and drains· from all impervious surfaces such as patios and driveways shall be connected to the permanent storm drain outlet as shown on the approved construction drawings # on file with DOES and/or the Department of Transportation. This plan shall be submitted with the application of any building permit. All connections of the drains must be constructed and approved prior to the final building inspection approval. For those lots designated for perforated stubouts, dispersion, or infiltration systems, the designs shall be constructed at the time of the building permit and shall comply with the plans on file." SITE SPECIFIC CONDITIONS: The conceptual drainage plan for this short plat proposes to discharge surface water run-off into a future piping system. The future piped conveyance would be constructed and located on the adjacent property to the east under a proposed subdivision application (L04P0002). Prior to engineering plan approval, the applicant shall provide proof that assures the offsite conveyance will be constructed and located in easements where appropriate. Should the proposed offsite conveyance not be available at engineering review, and prior to plan approval the applicant shall submit a revision to this application with a new conceptual drainage plan. Since this will require a substantial change this project may be re-vest to the current SWDM (20.20.080 KKC). Report and Decision L04S0057&L04S0058 ~ Lang Associates, Inc. We are writing in response to your Notice of Request for Additional Information dated January 19, 2006 regarding the Subject Project. Our responses are enumerated similar to your original letter and are in bold. Original County comments appear in Italics. A .. Road 1 .. 2. \_/ It appears as depicted on the revised site plan that the sidewalk and grading associated with the construction of the new road at the intersection of the entrance road with 120th A venue SE, extends beyond the perimeter of the existing road easement. Please provide a letter of intent from the neighbor, tax lot # 6199000125 to allow for additional easement for construction of the road. This letter must be provided prior to the preliminary approval. The actual easement must be recorded prior to the engineering plan approval. The subject intersection has been reconfigured to show all of the new Improvements within the existing right-of-way or easement As shown the proposed private road accessing the short subdivision does not meet KCRS Section 2,07. The road must contain a vertical curb along its south edge per KCRS Drawing #1-010. Please revise the site plan to show this. ,- The proposed road cross section has been revised to meet KCRS. The proposed project is within the designated "urban" area. The proposed thickened edge and asphalt shoulder is not permitted for the on-site road per the KCRS, Section 2.03 in urban areas unless a variance from the standard is obtained. The proposed road cross section has been revised to meet KCRS. The private road as proposed is acceptable however an agreement to use the cu/.<:Je.sac bulb by the neighboring property (Tfl)( Lot # 6199000125) will be required. A note to this effect will be recorded on the face of the short plat. Comment acknowledged.· B. Drainage 1. The ventilation grates for the underground RID vault cannot be located in the roadway per KCSWDM, Section 5. 3. 3. 1. Please revise the RID design to show the grates outside the travel lane. r,; ' Ms. Dehkordi February 28, 2006 Page 2 of3 The RID vault has been reconfigured and the ventilation grates are no long in the roadway. 2. A 3 to 1 length to width ratio is required for the RID facility. Please demonstrate / how this is accomplished. The RID vault has been reconfigured to meet the 3 to 1 ratio requiremenl 3. The Level 1 (last page) shows a pipe extending easterly from the RID facility to the street drainage system within the plat of Flevue Des Voiles, KC File L04P0002. This conflicts with the engineering v-plans for the plat. A conceptual drainage plan is required demonstrating how the two drainage systems will connec!t. Please coordinate this with the proponent of Flevue Des Voiles. We have contacted the applicant of Flevue Des Voiles and determine that they are changing their plan to show drainage connection to Yee Short Plat per easement agreemenl 4. The proposed short plat depends on the completion of Flevue Des Voiles plat for drainage discharge. The proposed drainage facility along with the discharge pipe crossing the tax parcel to the east must be completed in the event Flevue Des Voiles plat fails. A letter of intent from the tax parcel (6199000220) directly east of the site must be provided to allow construction of the discharge pipe. Letters of Intent along with a Mutual Easement Agreement were previously submitted to the County. The agreement has provisions for the construction of the discharge pipe. In the event Flevue Des Voiles falls (which is unlikely), alternative drainage systems acceptableio the County would be proposed. If no acceptable alternative is available, it would not be financially fe~ible for a 6 lot short plat to construct the entire drainage discharge system, then the short plat would not be constructed. Further more property ownership of Flevue Des Voiles is in the process of changing hands. The new owner, who has been working with us during the entire short plat process, has agreed to sign any necessary document when the transaction Is completed. C. Recreation Plan D. The conceptual recreation plan does not show the location of water main easement. Please be advised that no anchored or permanent structure can be placed within the water easement without approval from the Water District. A detailed recreation and landscaping plan will be required during engineering review plan. This will be a condition of approval. Comment acknowledged. Tree Replacement Please remove the proposed tree replacements from the site plan. A separete tree replacement plan will be required for roview and approval during the Engineering Review phase. The tree replacement plan must be propared showing tree species and other details and must be submitted along the road and drainage plans. This will be a condition of preliminary approval. Comment acknowledged. Other comments 1. Four copies of a conceptual drainage plan showing the items discussed above. This plan must be prepared, stamped, and signed by a professional engineer licensed in the State of Washington. Four copies of the revised conceptual drainage plan are enclosed. ., Ms. Dehkordi February 28, 2006 Page3 of3 2. Letters of intent from tax parcels 61990Q0125 and 6199000220 as discussed above. Please see responses to Item B4. 3. Four copies of a revised site plan to match the revised conceptual drainage plan. Revision to the Conceptual Drainage Plan did not require changes to the site plan. 4. Two copies of a reduced site plan 8 1/2 by 14. Revision to the Conceptual Drainage Plan did not require changes to the site plan. If you need the reductions of the previously submitted site plan please let me know. Our responses are enumerated similar to your original letter and are in bold. Original County comments appear in Italics. 1. A revised conceptual plan must be prepared to show an appropriate drainage discharge location. If the discharge location will be into a sensitive area, then a conceptual discharge design must be shown: Since you plan to locate the detention vault under the road, please show that in the revised drainage plan. Road plan revised to show detention in the proposed cul-de-sac and conveyance going to the east via the existing water easement out side the area with toy structures and into to the proposed adjacent development conveyance system. Letter of intent form the adjacent property is included in the Preliminary TIR. ~ 2. If you plan to make the proposed road a public road, then a letter of agreement from the property owner directly to the west shall be provided to allow for dedication of his property road frontage. 3. 4. There is no plan to dedicate the proposed road. That portion of the cul-de-sac containing the detention vault could be dedicated to the County if required. The conceptual road plan shows a drainage system located in the center of the road. KCRS Drawing 1-003 requires a crowned centerline unless a variance to this requirement is approved. This will be a condition of approval. Road design changed to show a crowned centerline per KCRS Standard Drawing 1- 003. Please be advised that the County will require that all toy structures be safely and pennanent/y anchored. This may conflict with the Utility District's easement. Please prepare a conceptual recreation tract showing the location of the easement, landscaping, toy facilities and any other improvements. The conceptual recreation plan must be / ,,, Ms, Dehkordi January 5, 2006 Page2 of2 • reviewed by the district to determine that no conflict will exist. Soos Creek Water and Sewer in a letter had agreed to relinquish the north 20' of the existing 30' water line easement subject to final review. All toy structures that require anchoring will be located out side the remaining south 10' of the water line easement. Conceptual Recreation Space Plan is now added to Sheet 2 of 2 of the Short Plat map. 5. The preliminary TIR proposed the use of infiltration for flow control. If infiltration is to be used, a soils report must be prepared and submitted for review by ODES. The report must include the infiltration rate. Alternatively, the TIR and conceptual drainage plan may be revised to reflect a larger pond size without the use of infiltration. Infiltration at this time will not be used. The TIR calculations show detention sizing per Level 2 Flow control. Addendum 1. The current discharge point located in the Soos Creek Plat (off-site) does not appear to comply with the natural discharge location. KCSWDM Section 1. 2. 1 states the following: "All surface water runoff from a project must be discharged at the natural location so as not to be diverted onto or away from downstream properties. The manner in which it is discharged from the project must not create a significant impact to downhill properties or drainage systems (see "Discharge Requirements').· A SWDM adjustment will be required with the next submittal, Since the Plat of Fleuve Des Voiles does not drain to the natural discharge location. A revised concep\ual plan must be prepared to show an appropriate .drainage discharge location. If the discharge location will be into a sensitive area, then a conceptual · discharge design must be shown. Since you plan to locate the detention vault under the road, please show that in the revised drainage plan. 2. If you plan to make the proposed road a public road, then a letter of agreement from the property owner directly to the west shall be provided to allow for dedication of his property road frontage. 3. The conceptual road plan shows a drainage system located in the center of the road. KCRS Drawing 1-003 requires a crowned centerline unless a variance to this requirement is approved. This will be a condition of approval. 4. Please be advised that the County will require that all toy structures be safely and pennanently anchored. This may conflict with the Utility District's easement. Please prepare a conceptual recreation tract showing the location of the easement, landscaping, toy facilities and any other improvements. The conceptual recreation plan must be reviewed by the district to detennine that no conflict will exist. Please submit the following by October 24, 2005: 1. Ms. Fanny Y. and Philip M. Yee own the property adjacent to and west of the Ritz Trust property near its northern edge. The Soos Creek Water and Sewer District, in its Water Availability Certificate of June 17, 2005, indicates that development of the Fleuve des Voiles plat will require a connection to the existing stubbed out water line on the Yee's property. The Yees are desirous of allowing treated storm water to drain through the future Fleuve des Voiles storm system. The Ritz Trust and the Yees have agreed to the language of a -Mutual. Re: Yee Short Plat-Responses to Notice of Request for Additional lnfonnation King County File No. L04S0065 ', Dear Fereshteh: It is so nice to work with you again. We are writing in response to your Notice of Request for Additional lnfonnation dated March 15, 2005 regarding the Subject Project. Our responses are enumerated similar to your original letter and are in bold. Original County comments appear in Italics. A. Access and Traffic: A power pole is located in the area where the new road is proposed. KCRS (Section 5. 11) requires 10 feet of clearance between the obstacle (power pole) and the edge of the travel lane (or 5.5 feet from the face of a vertical curb). Because of road improvement, the power pole must be relocated unless a variance from this requirement is granted. Acknowledged. We will take care of this during construction. B. Drainage. King County Surface Water Design Manual ISWDMI: 1. Drainage appears to leave the site in the foITTJ of sheet flow. A drainage conveyance system must be provided to convey concentrated runoff across the down-slope properties to an acceptab/e_disch[Lrg!zpo/nt. As proposed, this proposal will depend on the approval and construction of the proposed plat of Soos Creek, KC File L04P0002. Because of uncertainty regarding the completion and timing of the Soos Creek Plat, this proposal may have to be placed on hold until Soos Creek plat rec~ives a preliminary approval. Otherwise, an off-site conveyance system from the site to an f!Epropriate discharrze point together with appropriate easements across neighboring properties must be secured. Letters of intent from neighboring property owners indicating a willingness to grant easements are required. We have obtained letter of intent from abutting owner and contract purchaser of neighboring property for the exchange of easements. Please see attached letters. As suggested by Mr. Bruce Whittaker, We are also / Ms. Dehkordi July 20, 2005 Page 2 of2 --==-- orking with the pllcant of "Fleuve Des Voiles" to provide drainage discharge-co nectlon. 2. The property contains a wetland along the east property line and a storm drainage system running just off site along the northern property boundary. Dellneetlon of the 100 year flood plain for the wetland and drainage course Is required prior to preliminary approval. Our understanding Is that applicants of the subject short plat and Fleuve Des Voiles both Intent to alter the non-regulated wetland. Therefore,. rt delineation of the 100-year flood plain would no be useful. ..,___ () ~ / ~ . . . ~0G- c. Platting and Survey requirements: tJ!'-~-· 1. The contours must be based on a field survey per KCC 19A.08.150B.2. A statement to this effect must be shown on the site plan. A copy of the topographic survey certified by Mr. Dale Oaks, PLS (Certification No. 19635) was included in the initial submittal of the subject short plat We can submit another one if the map is misplaced. · 2. The site plan shows a fence and a shed encroachment along the south boundary of the site. This encroachment issue must be resolved prior to the final engineering plan approval. Please show how this encroachment will be resolved. 3. These encroachments are recent and do not have adverse possession rights. Ms. Yee had granted property owners temporary easement for the encroachments. Grantees are required to relocate the encroaching elements on demand (AF# 20041130000990 & 20041130000991 copies enclosed). As proposed, the recreation tract and the detention vault will be located within a 30-foot water main easement (recording No 7810020168). This easement must be relocated. A letter of agreement from the easement holder to allow relocation or relinquishment of the easement must be provided. Soos Creek Water & Sewer District does allow the use of the easement for vault and/or recreation spaces. The · 1c w1 nly use the south 1 O' of the easement and the detention facility (most likely a, detention tank) would fit within the remaining 20'. Letter from~is forth coming. Please provide a copy of easement AF# 711006608 to show that it allows the required road improvement within the easement. This item was clarified by Mr. Pat Simmons in his email dated 4/1/05 (attached). In addition, the Yees had reserved an easement when they sold the Tax Parcel 619900125 (AFN 8203220316 copy enclosed). .. , Ms. Dehkordi July 20, 2005 Page 3 of3 D. Recreation Tract The proposed combined drainage and recreation tract must allow for a full improvement of the recreation tract as an active recreation area together with landscaping and other related improvements. If other design constraints require the relocation of the vault, it will be preferable to locate the recreation tract where Lot 2 is proposed. The district has indicated that we can use the easement for recreation as long as nothing Is anchored to the ground. Letter from the District is forth coming. Why is there an application for 6 homes? Our cul-de-sac is about 2.5 acres, and only 8 homes. We purchased property because of the view we have (for now) and the amount ofland that each homeowner owns. We dispute the necessity of 6 homes on this property. We are concerned about the amount of water that flows underground all the properties in this area and the amount of potential pollution of Soos Creek. Although we are on the hill, we are not at the high point of the hill, and there can be a tremendous amount of water flow underground during a wet season. Topically, we've had some driveways flood/washout in past years; one home lost their basement to flooding several years ago. The property involved in this application does not have evergreen trees on it, which, we understand, means a higher water table. More houses, more water problems. On the south side of SEl92"d, we know ofa house that ended up with a "sink hole" in their front yard. They just happen to be east of a newer cul-de-sac with 25 homes in it. Isn't it possible the sink hole was caused by excess water flowing and being disturbed underground from the construction of all those homes? 3. The traffic congestion is getting worse. There is a new area tinder construction with 58 homes in it -IO feet between each house. Calculating 2 vehicles per house, and then counting all the applications in process in the one square mile around us, we're looking at probably 300 more vehicles and pollution from them on our roadways. Already, we find it is more difficult to get out on our major road from our cul-de-sac entrance. It used to be waiting for a car to go by; now it can be a dozen or more. Used to take just a minute, now can take 2-5 minutes or more! Other than Benson Road, all our roads are 2 lanes and can barely handle the traffic as it is. We don't want more lanes, we want less traffic! 4. And what about fire safety between homes? With only 10 feet between houses, how can a fire department properly protect the neighborhood? 5. Wir, have paid high property taxes in King County for this urban property we own for all these years, and we highly dispute what King County has done to our zoning rights. The last meeting we were notified of and attended, this area was zoned at one house per half acre. We have had no other notification, but it appears that somehow, these properties were changed to R6 zoning and those of us with more land highly disapprove of this dense construction that is being allowed. This particular application appears to indicate 6 homes per half acre? What kind of zoning is that? 6. We are NOT city dwellers. Ifwe had wanted to live close to our neighbors, we would have moved within the city limits! What about OUR property rights and OUR quality of life? We can understand people wanting to develop their land, but WHY does it have to be so dense? People want open space between their units, not just a tiny patch of green space on a comer of the property. In general, people have sized down their families; what happens to all these huge homes when they are no longer needed or wanted? We request that you reconsider the number of homes on this property, if the application itself cannot be denied. ® King County Department of Development and Environmental Services 900 Oakesdale Avenue SW Renton, WA 98055-1219 March 15, 2005 De-En Lang Lang Associates Inc. 10658 Riviera Place NE Seattle, WA 98125 . The site is undeveloped and consists primarily of an upland deciduous forest. Topography on the site gnerally slopes gently down from west to east. One small wetland (Wetland A) was identified along the eastern property boundary (Figure 1) and was delineated utilizing the methodology outlined in the 1997 Washington State Wetlands Identification and Delineation Manual. Wetland A consists of a small (175 s.f. on-site) isolated shallow tcipographic depression that extends slightly off-site to the east. The project site is comprised of three parcels; ( Parcel # 6199000220, 6199000240, 6199000260). The project site is dominated by mature and sub-mature forest, with single-family residences, managed and maintained lawns, and unmanaged portions. Onsite assessment of the project site following the procedures outlined in the Washington State Wetlands Identification and Delineation Manual. (Wash. Manual) and the Corps of Engineers Wetlands Delineation Manual (1987 Manual) resulted in the identification of two areas that exhibited hydric soils, wetland hydrology, and hydrophytic vegetation consistent with the established criteria of both the Wash. and 1987 Manuals. This assessment, completed in accordance with King County regulations, included an evaluation of the function and value rating for the identified wetlands, a classification of the wetland following the U.S. Fish and Wildlife methods, and an identification of the standard King County buffer width required for these wetlands. · WETLAND SIZE CLASSIFICATION KING FUNCTION STANDARD ONSITE (USFWS) COUNTY AND VALUE BUFFER WIDTH (square RATING RATING feet) A Offsite -PFOE 1 High 100 ft. The U.S. Army Corps of Engineers and King County, as well as a number of other local, state, and federal agencies, regulate activities in and . around identified wetland and drainage corridor areas. Such regulations focus on the avoidance of adverse impacts to wetlands, streams, associated buffers and the mitigation of such impacts that cannot be avoided. King County has established criteria to categorize wetlands for purposes of regulation and the establishment of buffers. In addition, King County allows a limited amount of alterations to wetlands (i.e. isolated wetlands, roadway crossings) provided such impacts are mitigated pursuant to an approved mitigation plan. The Selected Action Plari of the Soos Creek Plat project site focuses on the creation of independent lots suitable for the development of single-family homesites consistent with the King County Comprehensive Plan. . .
