SUMMARY OF ACTION: Development Services Recommendation: Approve subject to conditions. DEVELOPMENT SERVICES REPORT: The Development Services Report was received by the Examiner on June 15, 2010. PUBLIC HEARING: After reviewing the Development Services Report, examining available information on file with the application, field checking the property and surrounding area; the Examiner conducted a public hearing on the subject as follows: The following minutes are a summary of the June 22, 2010 hearing. The legal record is recorded on CD. The hearing opened on Tuesday, June 22, 2010, at 9:01 a.m. in the Council Chambers on the seventh floor of the Renton City HaII. Parties wishing to testify were affirmed by the Examiner. Exhibit No. 8: New Floor Plan The hearing opened with a presentation of the staff report by Rocale Timmons, Associate Planner, Community and Economic Development Department, City of Renton, 1055 S Grady Way, Renton, Washington 98055. The site is located in the Benson Hill area on the south side of SE 188th Street, just east of 116` Ave SE. It is approximately 1.1 acre in area and is within the Residential Low Density Comprehensive Plan designation and the R-4 Zoning designation. The proposal is to convert an existing mechanical shop into a religious institution for the St. Thomas Orthodox Church. The applicant is proposing to expand this existing structure by approximately 2,000 square feet. There are two homes located on site, one a 1,600 square foot residential home and a smaller guest home. The guest home would be removed and the residential home would remain to be used as housing for the clergy of the church. A Conditional Use Permit was granted for this church in 2008, LUA-08-102. The applicant is proposing an extension of the parking stalls on site. Currently there are 14 gravel parking stalls used for the mechanical shop, an additional 18 stalls have been proposed. All stalls would be paved. Access would be via SE 188`h Street only. There would be no access via I I8`h Ave SE, the applicant has proposed a fence along the eastern border of the site. The Environmental Review Committee issued a Determination of Non -Significance — Mitigated with 2 mitigation measures. No appeals were filed. The applicant's proposal does comply with the policies of the Residential Low Density Comprehensive Plan. Religious institutions are allowed in the R-4 Zoning designation through a Conditional Use Permit. The Development Standards have been complied with for this zoning designation. All setbacks have been met or exceeded. The existing height of the structure would be maintained at 24 -feet from grade with the exception of three crosses which would be placed at the top of the pitched roof and on two tower elements along the western facade. The site contains 6 trees, none are proposed for removal and thereby complying with the tree retention for the zone. The applicant has proposed to maintain the five-foot landscape strip along SE 1186' Street, and proposed a 10 -foot landscape strip along the western and southern property line. The landscape plan provided by the applicant was not completed by a landscape professional and so prior to permitting, a new revised detail landscape plan completed by a landscape professional must be submitted. Code requires a minimum//maximum of 18 parking stalls. The applicant needs to revise the parking plan or apply for and be granted a parking modification to exceed the number of stalls due to the impacts they may create on abutting properties. The Applicant has provided 108 square feet for refuse and recycle, which exceeds the requirements. The site would be located at the northwestern portion of the site along the eastern side of the proposed access. Staff believes that surface elements should be located away from street frontages and recommend that the applicant relocate the refuse and recycle area or provide increased landscaping surrounding the area. A signage plan must be submitted detailing signs for the parking lot prior to building permit approval. St. Thomas Orthodox Church II File No.: LUA 10-016, ECF, CU -H, SA -H July 15, 2010 Page 3 There does not appear to be any adverse impact on surrounding properties and uses as long as the conditions of approval are complied with_ This expansion does not increase the seating capacity of the church. Parking on site can be adequately buffered from the surrounding residential uses. A proposed dedicated pedestrian connection from SE 188's Street to the expanded structure, in addition a waiting area has been proposed just west of the structure. The proposal would generate additional traffic as well as noise and activity on certain days. The church should be required to close all windows and doors during services, install insulation and an HVAC system in the church building in order to limit noise. All services should be limited to the hours of 7:00 am to 10:00 pm. The site is on septic, it is unclear whether they would be required to move the sewer, that would be based on a King County Health Requirement. A Certificate of Water and Sewer Availability was not submitted and needs to be provided prior to construction permits. There currently are eight religious institutions within one square mile of the site, most of those are larger in scale than this proposed church. Traffic would primarily impact SE 188'h Street, services would occur primarily on Sunday's from morning to early afternoon and then occasionally on weekdays. There would also be evening committee meetings. The applicant has obtained a Conditional Use Permit from the Hearing Examiner to convert the existing structure into a church. The conversion of this use would remain valid from the original proposal, the difference is the impacts created or accomplished through the expansion of the structure. There were letters from surrounding neighbors showing support for the proposed expansion with no comments of opposition until the day before the hearing. Babu Parayil, 2314-127`" Avenue NE, Bellevue 98005 stated that they would provide a revised landscaping plan to include additional ground cover, screening and buffering. They would like to request a waiver from the irrigation plan. The trees and shrubs they would be using require hardly any watering. The parking stall numbers should be based on the seating capacity of the assembly area and not include the increase in size of the building. The plans show a proposed waiting area separate from the parking area. They will provide a revised parking plan. Finally, a request was made for an increase in the time allowed for services, there are special occasions throughout the year that would require a late evening service and people would be at these services past 10:00 pm. A Water and Sewer Certificate has been applied for, the City has reviewed it. Sewer and water would be brought to the street along 118'x'. Pamela Nugent, 11642 SE 188`h Street, Renton 98057 pointed out on the map the location of her house, directly to the northwest of the subject site. She stated that she did testify at the previous hearing on this site, the neighbors were so opposed and she was not sure and decided to go along with the neighbors_ She wasn't strongly opposed to the project, nor strongly in favor. Renovating the original structure did not seem that it would make much difference to the area. The small amount of cars and the small development did not seem to be a real issue. However, the original application states that the proposed 90 seat church was based on a 10 -year projection. It is now a year and nine months into this project and they are asking for an increase of 2,000 square feet to the St. Thomas Orthodox Church 11 File No.: LUA 10-016, ECF, CU -H, SA -H July 15, 2010 Page 4 existing structure. This church has reached its 10 -year projection. There is not another building in this residential area that has 4,000 square feet in it. If they intend to expand, they should be looking for a new location, this is not the place for this size of congregation. Traffic coming from 192nd to 116`h to SE 188th and other traffic coming off of 120'h westbound waiting to turn left into this 24 -foot driveway, the entire street would feel the impact. The street is 21.6" wide with no curbs, sidewalks and no place for a vehicle to pull over and allow any other traffic in the neighborhood to pass when you have 35 cars waiting to come in for a church service. This is excessive and intrusive to the neighborhood. The noise level will increase. Rocale Timmons stated that there is a Cade requirement that would require the applicant to provide half street improvements to SE 188`h Street. That would include a 10 -foot curb, gutter and sidewalk along the frontage of the parcel. Mr. Par_ayil stated that they were not adding any more people, the church is still the 90 -seat that was previously proposed. There will only be 19 parking stalls. The new area they are asking for is just the entry area for the church and a social hall on the south side. The front of the property will be completely renovated so that there is enough space for cars to pass and not create any excess noise or congestion. Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing stopped at 9:47 a.m. FINDINGS, CONCLUSIONS &_RECOMMENDATION Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: The applicant, Babu Parayil for St. Thomas Orthodox Church, filed a request for a Conditional Use Permit and Site Plan approval. 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit 91. The Environmental Review Committee (ERC), the City's responsible official determined that the proposal is exempt from environmental review. 4. The subject proposal was reviewed by all departments with an interest in the matter. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of rural residential uses, but does not mandate such development without consideration of other policies of the Plan. The subject site is currently zoned R-4 (Single Family - 4 dwelling units/acre). 7. The subject site was annexed to the City with the adoption of Ordinance 5327 enacted in March 2008. A Conditional Use Permit was approved that allowed the conversion of an existing mechanical shop to a church. The decision to allow a church was upheld by the City Council after an appeal had been filed. The applicant applied for building permits but has not started construction. The applicant has subsequently decided to enlarge the existing building and new permits are necessary. St. Thomas Orthodox Church II File No.: LUA 10-016, ECF, CU -H, SA -H July 15, 2010 Page 5 8. The subject site is located at 11651 SE 188th Street. It is bounded on its east margin by a private street, 118th Avenue SE. The easement creating this street runs through the subject site. The subject site is approximately 1.1 acres or 48,351 square feet. 10. The subject site is essentially flat. The subject site contains a single family home, a guesthouse (a second single family home) and a shop building. The two homes are located in the north third of the property. The shop building is located in the southeast quarter of the property. 11. The applicant proposes converting the shop building into a church. The building is 1,960 square feet and one-story or 24 feet in height. The applicant proposes adding approximately 1,920 square feet of additional space to the existing building. The expansion would occur along the existing building's south and west sides. There would be cosmetic changes to the facade including new windows and doorways and the addition of a cross. The small "guest" home would be demolished. The second home would serve as the clergy's home. 12. Access to the site would be via 188th which is the public street running along the north side of the subject site. A fence would bar access to the subject site from the east, 118th Avenue. 13. The proposal would maintain a seating/assembly capacity of 90 parishioners. The proposed additions would accommodate new rest rooms and a social hall. 14. The applicant would provide 32 paved parking stalls. The parking stalls would be located along the south and western areas of the site including stalls north of the church building. 15. The applicant proposes additional landscaping along the eastern, southern and western edges of the site and south of the home and north of the church building in the middle of the site. 16. There was opposition to the original request and there is still opposition that suggests that the use is intrusive in a single family neighborhood and that the narrow street cannot support the traffic demands of the proposed use. There were also letters of support from some neighbors. 17. Staff reviewed the new design and based on that new design recommended that the proposal be approved. They recommended a series of conditions to reduce impacts on the neighboring property. 18. Access would be via a paved driveway from the north. It would include a paved hammerhead turnaround to accommodate emergency access. The parking lot would be paved. 19. There would be parking per code requirements and the applicant would provide 32 stalls, 13 more than the originally proposed 19 stalls. This would reduce potential parking in the neighborhood. Staff noted that a parking modification would be required for excess parking. 20. The converted church would have an assembly capacity of 90 parishioners which remains the same capacity as originally proposed. The current congregation is approximately 45 persons with an anticipated attendance of approximately 60 in five years. Growth beyond the capacity would have to be addressed if and when that occurred, as the space would be limited without additional renovation. 21. The applicant was concerned about conditions that would limit hours of operation as the limitation could affect Easter and other services. St. Thomas Orthodox Church II File No.: LUA 10-016, ECF, CU -H, SA -H July 15, 2010 Page 6 CONCLUSIONS: Conditional Use Permit The applicant, for a Conditional Use Permit must demonstrate that the use is in the public interest, will not impair the health, safety or welfare of the general public and is in compliance with the criteria found in Section 4-31-36 (C), which provides in part that: a. The proposal generally conforms to the Comprehensive Plan; b_ There is a general community need for the proposed use at the proposed location; G. There will be no undue impacts on adjacent property; d. The proposed use is compatible in scale with the adjacent residential uses, if any; e. Parking, unless otherwise permitted, will not occur in the required yards; £ Traffic and pedestrian circulation will be safe and adequate for the proposed project; g. Noise, light and glare will not cause an adverse affect on neighboring property; h. Landscaping shall be sufficient to buffer the use from rights-of-way and neighboring property where appropriate; and i. Adequate public services are available to serve the proposal. The requested conditional use appears justified. 2. The only significant change since the original application is an expansion that would provide a social hall but not increase the seating capacity of the building. The congregation's size would still be limited and therefore, the impacts of the church on the neighborhood would not increase. As a matter of fact, the applicant agreed in advance to some of the original conditions including paving the parking area and removing the smaller guest house. They also asked to provide additional parking to reduce impacts on the neighborhood. Again, the church would supplant a mechanical shop which might be considered less compatible with a single family neighborhood. A mechanical shop is not permitted in a single family zone whereas a church is a permissible use. The division of the lot into potentially four new lots would increase traffic in the area by approximately 10 new trips per home on a daily basis whereas the church use would be confined to the weekend with occasional mid -week use. Churches are generally allowed in most areas of the City by the Comprehensive Plan. Although that plan suggests they be Iocated at the periphery of residential neighborhoods and be located along arterial streets those are not mandated by code. Those two criteria are guidelines. The larger, one -acre lot allows some inherent separation from its immediate neighbors. In addition staff has recommended some conditions that will help screen the site and attenuate noise. Air conditioning and sound containment are appropriate. This office has determined that ascertaining community need for a church serving any particular religious denomination is an inappropriate criterion given Constitutional constraints. 5. While there may be impacts of establishing a church on this site they do not appear to be unduly intrusive. The realignment of the access to the public street from the narrow private roadway will considerably reduce traffic impacts on the neighboring properties. The recommendation to create more separation between the parking and surrounding properties will also reduce impacts. This office believes that while a modification to allow the additional parking on the site would also help reduce impacts on the neighborhood. The rather modest one-story, building is already located on the subject site and the one-story expansions St. Thomas Orthodox Church II File No.: LUA 10-016, ECF, CU -H, SA -H July 15, 2010 Page 7 into the Iarge south and western yards is also modest and one-story, so there is no new intrusive building proposed. The appropriate yards will be provided or maintained, The applicant shall provide 10 feet of setback and landscaping on the west to screen the parking area. Traffic circulation is safe and adequate. Church services and the voices of the congregants can occasionally spill out of the building and therefore, staff's recommendation to contain noise by using climate control appears appropriate. The separation of the church from its neighbors is not substantial so limiting the impacts is appropriate. 10. Additional landscaping will help buffer the neighbors from the more intense uses that occur when up to 90 people gather on a property zoned for rural residential uses and surrounded by rural residential uses. The applicant shall provide at least 10 feet of landscaped buffer along the west and south property lines. Site Plan Review 11. The site plan ordinance provides a number of specific criteria for reviewing a site plan. Those criteria are generally represented in part by the following enumeration: a. Conformance with the Comprehensive Plan; b. Conformance with the Building and Zoning Codes; c. Mitigation of impacts on surrounding properties and uses; d. Mitigation of the impacts of the proposal on the subject site itself; e. Conservation of property values; f. Provision for safe and efficient vehicle and pedestrian circulation; g. Provision of adequate light and air; h. Adequacy of public services to accommodate the proposed use; The proposed use satisfies these and other particulars of the ordinance. 12. The Site Plan review criteria in many ways mirror those of the Conditional Use criteria. Churches are permitted in single family zones. The setbacks and bulk of the building comply with the Zoning Code. Building and Fire Code compliance are determined when permit applications are submitted. 13. There will be impacts on the surrounding properties but they do not appear to be untoward. There was a mechanical shop on the site and its uses could change and be substantial. The site is large and additional landscaping, additional parking and paved parking areas will reduce the impacts on neighboring property. The use of 188th for access eliminates use of a very narrow street for access. It also contains turning maneuvers to the main street. 14. The applicant will be installing additional landscaping to help buffer the use. Paved parking will decrease St. Thomas Orthodox Church II File No.: LUA 10-016, ECF, CU -H, SA -H July 15, 2010 Page 8 dust and reduce noise. 15. The paved parking and limited access provides safe and reasonable vehicular and pedestrian circulation. 16. The one-story building located away from the edges of the site should allow light and air on the property and on surrounding properties. 17. There are adequate public services for the subject site. 18. In conclusion, the establishment of a church on this property will change the character of the neighborhood and will have some additional impacts on that neighborhood but they do not appear to be unreasonable if the project is developed as now proposed and subject to the conditions suggested by staff. DECISION: The Conditional Use Permit and Site Plan are approved subject to the following conditions: 1. The applicant shall comply with the two mitigation measures issued as part of the Determination of Non - Significance Mitigated, dated May 24, 2010. 2. The applicant shall submit a detailed landscape plan designed by a certified landscape architect or other landscape professional. The plan shall include fence elevations and additional vegetation, including groundcovers, which give consideration to sunlight/shading on site. The revised detailed landscape plan shall be submitted to and approved by the Current Planning Project Manager prior to building permit approval. 3. The applicant shall be required to submit screening detail for the refuse and recyclable deposit area prior to building permit approval. 4. The applicant shall be required to submit a signage plan detailing among other points, signs for the parking lot, prior to building permit approval. 5. The applicant shall revise the site plan to depict I8 parking stalls or apply for and have granted a parking - modification for the parking stalls that exceed the number required by code. The revised site pian shall be submitted or parking modification granted prior to building permit approval. 6. The applicant shall be required to relocate refuse and recycle deposit areas away from the pedestrian environment or enhance landscaping in the immediate area of the service element. A revised landscape or site plan shall be submitted to and approved by the Current Planning Project Manager prior to building permit approval. 7. The applicant shall provide detail differentiating the waiting area from the parking lot through the use of a change in elevation, difference in materials or other method. The detail shall be submitted to and approved by the Current Planning Project Manager prior building permit approval. 8. The applicant shall be required to submit a lighting plan subject to review and approval by the Planning Division Project Manager prior to building permit submittal. The lighting plan shall depict the type of lighting proposed, the direction of the lighting, and the location of all of the exterior lights. 9. The applicant shall be required to close windows and doors of the church during services. The applicant shall also be required to install insulation and Heating/Ventilation/Air Conditioning (HVAC} in the church building to reduce the amount of noise emitting from the structure. 10. The applicant shall obtain a Certificate of Water and Sewer Availability, from the Soos Creek Water and Sewer District, prior to the approval of any building or construction permits. The existing single-family dwelling proposed to be retained shall be converted to clergy residential housing in order to avoid conflicts with the proposed church use. The applicant shall be required to record a restrictive covenant prior to building permit approval, stating the single-family residence be used solely for clergy of the St. Thomas Orthodox Church. 12. The applicant shall limit the hours of operation of church activities to the hours of 7:00 a.m. to 10:00 p.m. The applicant may have extended hours no more than ten (10) times during the year for specific events and services. 13. The applicant shall build a six-foot fence along the west property line to screen any potential glare onto the abutting property to the west. The fence design would need to be submitted to the Planning Division Project Manager for approval prior to issuance of a building permit. The fire flow was calculated without the use of the fire sprinkler credit. Please provide water availability certificate. 2. REQUIRED HYDRANTS & SPACING: The minimum number of hydrants required shall be two. One hydrant shall be required to be within 150 feet of the front of the building and the other within 300 feet of the front of the building. The following comments on development and permitting issues are based on the pre -application submittals made to the City of Renton by the applicant and the codes in effect on the date of review. The applicant is cautioned that information contained in this summary may be subject to modification and/or concurrence by official decision -makers (e.g., Tearing Examiner, Community & Economic Development Administrator, Planning Director, Development Services Director, Public Works Administrator, and City Council). Review comments may also need to be revised based on site planning and other design changes required by City staff or made by the applicant. The applicant is encouraged to review all applicable sections of the Renton Municipal Code. The Development Regulations are available for purchase for $50.00 plus tax, from the Finance Division on the first floor of City Hall or on the City's website www.rentonwa.gov Current Use: The site is located on a 1.1 acre parcel with access off of SE 1881h Street via private driveway. There are three existing structures onsite. Two are residential and the third Being the shed that would be converted to the worship hall. Project Proposal: The applicant is proposing to remodel an existing shed and convert it to a worship hall. The applicant has already applied for and was granted a Conditional Use Permit [LUA08-102] to allow a religious institution within the Residential -4 (R-4) zoning designation. The current structure is 2,016 square feet in area and the proposal would add an additional 1,360 square feet. The addition would include facilities office space, three classrooms, and additional pews. The proposal would also include 19 new parking stalls, a 197 -foot driveway with hammerhead turnaround, and a courtyard. As part of the Conditional Use Permit approval, the existing driveway along 118th Avenue SE will be abandoned. The smaller of the two existing residential structures would be removed to provide the driveway and hammerhead turnaround. The applicant proposes a private driveway of 24 feet in width that tapers down to 20 feet in width after a hammerhead turnaround. The revised proposal differs from the original Conditional Use Proposal by proposing more pews and other programmed spaces such as three classrooms, office space, a storage area, and much larger kitchen area as well as enlarging the worship area. Density Requirements: Density requirements are not applicable to this proposal. Development Standards: The project would be subject to RMC 4-2-110A, "Development Standards for Residential Zoning Designations" effective at the time of complete application (noted as "R-8 standards" herein). A copy of these standards is included within packet provided to applicant. Minimum Lot Size. Width and Depth — Minimum lot size, width and depth are not applicable to this proposal. ., St Thomas Orthodox Church Expa November 12, 2009 Page 2 of 3 Building Standards —The R-4 zone allows a maximum building coverage of 35% of the lot area or 2,500 square feet, whichever is greater. Building height is restricted to 30 feet. Any detached accessory structure must be below a height of 15 feet. The gross floor area must be less than that of the primary structure. Accessory structures are also included in building lot coverage calculations. Detached accessory structures (garages, sheds, etc.) are permitted at a maximum number of two per lot at 720 square feet each, or one per lot at 1,000 square feet in size. The 1,770 squarefoot existing house and the 3,376 square foot proposed worship hall which would calculate to a total of 5,146 square. The lot coverage for these structures would be 10.696 — meeting lot coverage standards. Setbacks— Setbacks are the minimum required distance between the building footprint and the property line or private access easement. The required setbacks in the R-4 zone are 30 feet in front for the primary structure; 15 feet combined is allowed with a minimum side yard of 5 feet for one of the sides; and 25 feet in the rear yard. The proposal meets the setback requirements for the R-4 zoning designation. Landscaping: The proposal must meet the landscape requirements approved as part of the Conditional Use Permit [LUA08-102] as well as a 5 -foot off-site landscape strip along street frontages. Tree Retention: A new tree inventory and a tree retention plan shall be provided with the formai land use application. The tree retention plan must show preservation of at least 30`Y of protected trees [those with a minimum diameter 6 -inches when measured four and a half feet above grade], and indicate how proposed building footprints will be sited to accommodate preservation of significant trees that will be retained. If 30% tree retention cannot be achieved, then the replacement ratio is 6:1 with a minimum 2 -inch caliper trees. Access/Parking: The applicant proposes a private driveway of 24 feet in width that tapers down to 20 feet in width after a hammerhead turnaround_ The 19 parking stalls would be located west of the driveway. Of these 19 parking stalls, the applicant proposes 11 full-size spaces, 7 compact spaces, and 1 ADA compliant space. The revised proposal differs from the original Conditional Use Proposal by adding more pews and other programmed spaces such as three classrooms, office space, a storage area, and much larger kitchen as well as enlarging the worship area. There were 90 seats in the original proposal, which would account for the 19 parking spaces. The new proposal would exceed the original proposal's parking requirements. New parking calculations would have to be submitted based on the areas of the different uses between the original and new proposals. Based on 1 parking space for every 5 seats, the proposal would raise the total capacity of seats from 90 (the original —approved number) to 112. This increase would require at least 4 new parking spaces. Additional landscaping may be required due to the increased number of parking spaces — For 15 to 50 parking stalls 15 square feet of landscaping is required per parking space. A tree must be planted for every 6 parking spaces within the lot interior. Shrubs shall be planted at a rate of 5 per 100 square feet of landscaped area and shall have a mature height between 3 and 4 feet. Fences: Permitted fence height is 48 inches in the front yard and side yards along a street, and 72 inches in the rear yard and interior side yards. Fences cannot exceed 42 inches in height in the clear vision area of corner lots. Please see enclosed handout on fences for specific details. The previous CUP conditioned the applicant to construct a 6 -foot fence along the west property line as part of the Conditional Use approval. Public works Construction Permit — For Street improvement, Sewer & Water Current Zoning: - Residential Low Density; R-4 Current Use: - Approved CUP to build a Church Site Features: - The site is flat and do not have any wetland or water bodies. Soil type and drainage conditions: - The soil type is Alderwood Gravelly Sandy Loam. The property is flat and there are no Wetland or water bodies in or adjacent to the property. Existing V -ditches along the east (SE 118th) and north side (188th) of the property provides drainage of the property and the property does not have any drainage issues. A drainage report is submitted. Proposed use of property: At present there is a single family home, a guest house and a workshop in the 1.1 acre property. We have an approved Conditional Use Permit to remodel the existing 2,016 Sq Ft workshop to a 2,000 Sq Ft church. Under this CUP, the guest house will be demolished for providing a direct access driveway from 188th street instead of from the SE 188th street. This change was proposed in the earlier CUP hearing. The current fourteen (14) gravel parking lot will be paved and the number of parking stalls to be increased to nineteen (19). The existing single family home will remain as it is. We have submitted the building permit application and is preparing the responses to the review comments. St. Thomas Orthodox Church — Project Narrative This CUP application is to increase the size of the church building from 2,000 sq. ft. to 3,920 Sq ft. to include a narthex (entry hall), social hall, a business office and a class room. A bigger area gives a chance to incorporate the Orthodox Church features such as Altar, Chancel, Nave and a Narthex. It also gives us a social gathering area, a business office and a class room. Combining the remodel work with the extension will reduce the future construction cost and church members will have an opportunity to have a better facility now. The parking area will be reconfigured to give more parking to accommodate the increase in size of the building. An increase of thirteen (13) new parking stalls is proposed making the total number of stalls to be thirty two (32). There will be two (2) ADA parking stalls with one Van accessible. No change to the existing single family dwelling unit'is proposed, this will be used for a clergy residence. We have approached all the neighbors around the proposed building and discussed them in detail about the proposed increase in size of the building. They have given written "no objection" letter to us. Signed letters are included Scope of work: Following is the extent of proposed work. Church Building: The building will be extended 20 feet to the west and 16 feet to the south. The completed size of the building will be 70'X56', of wood frame construction with a composite roof. The main assembly area will be 70'x40, which will include Altars, Chancel, Nave, Class Room, Office and Narthex. The Social Hall is of size 70'x16'. Two rest rooms are proposed. The building height will be 28'; this includes the height of a 4' cross and will not obstruct views of any neighbors. Fire protection: Smoke detectors will be placed in the buildings and the building will be equipped with a necessary number of fire extinguishers. The existing fire hydrant is 150 feet away from the proposed building. A new fire hydrant will be installed about 100 feet away from the facility. HVAC: Natural gas heating and air conditioning will be provided at the facility. Plumbing: Two restrooms, one for men and another one for women with adequate stalls with ADA accessibility will be added. Another addition will be a small kitchen with only reheating capability. St. Thomas Orthodox Church — Project Narrative 2 Electrical systems: The building has separate power 120/240V Power panel supplied by the Puget power. Lighting will be enhanced to meet 25-35 fc inside the building. Doors: Wooden or Fiber glass doors will be provided. One of the access doors will have ramp for ADA compliance. Windows: Double paneled vinyl windows. Flooring: Flooring will be carpeted. Altar and chancel area will have raised floors. Seating: Seating capacity of the worship area is for about 90 people. The current average attendance is about 50. Our plan is to have worship/study on Sundays from 9:00 AM to 12:00 noon. Water System: A new water connection will be added to the facility. Soos Creek water district is the water provider and has approved this new water connection. Sanitary Sewer Systems: The Soos Creek water and sewer district has approved to extend the sewer main line to this location. They have completed the sewer extension design along 118th Ave. Access: The access to the proposed building is directly from SE 1881h Street same as proposed in the first CUP application. Attached is the approved site plan showing, access, .parking, landscaping, etc for the first CUP application. Parking: An asphalt parking area will be constructed and will be reconfigured to have a total of thirty two (32) parking stall. The current approval is for nineteen (19) parking stalls, two (2) will be designated as ADA parking with one (1) Van accessible. Proposed off-site improvements: Sewer line will be extended along 118th Ave SE. A new water connection and a fire hydrant line will be extended from 188th Street to the property line. Improvements to 188th street will be done as per city standard. Natural gas line will also be extended to be church building. Landscaping: St. Thomas Orthodox Church — Project Narrative 0 I] Adequate landscaping will be provided to the surrounding of the church building to screen the building and parking. A landscaping drawing is included in the submittal. There are six (6) evergreen trees on the east side of the property along SE 118th and there is no plan to remove any one of this. The trunk diameter of these trees varies from 6" to 12". Ever green shrubs are all along the north side and part of the east side of the property. No trees will be removed from the property. Property Value: Total estimated construction cost for the building improvement is $45,000. This does not include the sewer and water extension. When complete the estimated fair market value of the property will be approximately $500,000. Building Height: The building height will be 28 -feet and is below the 35 -feet building height standard. Comprehensive Plan: The proposed use shall be compatible with the general purpose, goals, objectives and standards of the comprehensive plan, the zoning ordinance and any other plan, program, map or ordinance of the City of Fenton. The application is to obtain Conditional Use Permit for increasing the size of the approved church building from 2,000 sq ft to 3,920 sq ft. No new structures are proposed. We already have an approved CUP to convert the existing 2,016 sq ft workshop to a 2,000 sq ft church. Attached is an approved site plan from the first CUP application. The zoning of the site is RLD (Residential, Low Density). RMC section 4-2- 060 "Zoning Use table" allows "Religious Institutions" in the RLD zoning. The project complies with setbacks, maximum height and minimum lot size. There is only two buildings in this 1.1 acre lot. With the average house size of 2,000 sq ft, in the RLD zoning, the total area of the building could be well. over 8,000 sq ft for this 1.1 acre site. With the proposed increase in the building size, the total building area is less than 6,000 sq ft including all the existing buildings. B. Community Need: There shall be a community need for the proposed use at the proposed location. in the determination of community need, the reviewing official shall consider the following factors among all other relevant information: 1. The proposed location shall not result in either the detrimental overconcentration of a particular use within the City or within the immediate area of the proposed use. The church facility will provide convenient, local opportunities for the residents of the surrounding area to attend church services. The church services are on Sunday mornings. The Service usually lasts for three hours and a maximum of sixty people attend the service. There will be no increase in traffic compared to weekday peak traffic volumes in the neighborhood or surrounding area.The total traffic volume generated will be about twenty cars on Sunday. Since the service starts with an hour of morning prayers, and end with another hour of Sunday school for the kids, the traffic will be staggered. The main service is from 10:00 -12:00. There will be ample parking space within the compound. The increased building size will give an opportunity for the members to have the convenience of a social hall, entrance hall, class roam .and business office. Also the church can be constructed with the traditional orthodox features with altars, chancel nave, etc. The construction cost will also considerably lower if it is done now than this expansion is done at a future date. 2. The proposed location is suited for the proposed use. The project area is about 1.1 acre and is rectangular in shape with easy access to 188t`' St. The site is mostly flat and there is no sensitive areas on the site. The existing trees and shrubs provide screening of the building and the parking space. Also considerable amount of landscaping and fence is proposed. C. Effect on. Adjacent Properties: The proposed use at the proposed location shall not result in substantial or undue adverse effects on adjacent property. The building is away from the main street and higher setbacks and existing trees lessen the visible effect of the church to the neighboring properties and the street. We have talked about the expansion of the church to the neighbors and they are very co-operative about this. They have signed a "no -objection" letter to this construction. Signed letters are included in this proposal. 0 In addition the reviewing official shall also consider the following items when analyzing the application. • Compatibility: The proposed use shall be compatible with the residential scale and character of the neighborhood. The project is to increase the size of the building from 2,000 Sq. ft to 3,920 sq. ft. The building will be extended towards the west. The east side of the church is screened by the existing trees from the public. The west and the south side of the property has 6 foot fence and has landscaping trees. The perimeter landscaping screens the building and the parking lot. Benson elementary school and the Presbyterian Church are in close proximity to the proposed project. The proposed changes will in no way affect the permitted development or use of neighboring properties. • Parking: Parking under the building structure should be encouraged. Lot coverage may be increased to as much as 75% of the lot coverage requirement of the zone in which the proposed use is located if all parking is provided underground or within the structure. Parking under the building structure is not planned. The asphalt parking lot has nineteen (19) parking stalls under the approved CUP. The proposal is.,to increase reconfigure the parking lot to give thirty two (32) parking stalls with two (2) ADA spaces. The existing bushes and trees will provide screening of the parking lot. There will be designated pedestrian walkway and waiting area in the parking lot. The project meets the parking ratios and ADA parking standards set forth in RMC code 4-4-080. • Traffic: Traffic and circulation patterns of vehicles and pedestrians relating to the proposed use and surrounding area shall be reviewed for potential effects on, and to ensure safe movement in, the surrounding area. 116th Ave S.E. is the principal arterial close to the project and it is about 600 ft. west of the project. The direct access to the site is from 1881" St. We expect about twenty (20) cars that will come and go at various times during the four (4) hour Sunday service. This small increase in Sunday traffic is almost the same as the week day traffic and will not have any effect on the existing traffic patterns or pedestrian movements in the area. • Noise, Glare: Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the location of on-site parking areas, outdoor recreational areas and refuse storage areas. The Sunday service will generate only minimal noise and this will be confined within the closed dors of the church. There is no plan to light the parking area, since we will not have any activities in the night time. The outside building lights will be on photocell with motion sensor. So the noise, light and glare impacts are minimal to none to the neighborhood. Besides, fence, landscaping screens any light coming out of the area. • Landscaping: Landscaping shall be provided in all areas not occupied by buildings or paving. The Hearing Examiner may require additional landscaping to buffer adjacent properties from potentially adverse effects of the proposed use. Most of the pervious surface are covered by grass. The existing pine trees, evergreen bush and privacy plants and flower beds cover 3/4t" of the project area. The landscaping lessen the church and parking are visibilty from the street and the adjacent neighbors. A ten (10) foot wide landscaping is proposed all around the property. Also a six (6) foot fence is on the west and south side of the property. Accessory Uses: Accessory uses to conditional uses such as day schools, auditoriums used for social and sport activities, health centers, convents, preschool facilities, convalescent homes and others of a similar nature shall be considered to be separate uses and shall be subject to the provisions of the use district in which they are located. There will not be any accessory use for the building. The place is strictly for Sunday worship. • Conversion: ilio existing building or structure shall be converted to a conditional use unless such building or structure complies, or is brought into compliance, with the development standards. The proposed building modification will meet all building codes and development standard as given in RMC 4-2-110A. • Public Improvements: The.proposed use and location shall be adequately served by and not impose an undue burden on any public improvements, facilities, utilities and services. Approval of a conditional use permit may be conditioned upon the provision and/or guarantee by the applicant of necessary public improvements, facilities, utilities and%r services. The existing public facilities that will serve this project include the adjacent public roadway and nearby intersections, emergency services for fire and police protection, public water, electric service, sewer and natural gas. None of these existing systems will experience adverse impacts from the proposed project. The project has obtained water and server extension from sooscreek water district -Telephone, gas and electricity are already availble at the site. The project has very minimal impact on roadways and intersection since it brings only about 20-25 cars on Sunday mornings. Road improvements to the frontage of the property as per city standard is proposed. • Lot Coverage: Lot coverage in residential districts (SF and MR) shall not exceed fifty percent of the lot coverage of the zone in which the proposed use is to be located. Lot coverage in all other zones shall conform to the requirements of the zone in which the proposed use is to be located. The proposal is to increase the size of the building from 2,000 sq ft to 3,920 sq, ft. The lot coverage is well within the required limits. • Yards: Yards shall conform to the requirements of the zone in which the proposed use is to be located. A combination of field indicators, including vegetation, soils, and hydrology was used to detennine whether wetlands are present on the site. The site was inspected using methodology described in the Washington State Wetlands Identification and Delineation Manual, Washington State 11 Re: Parayil Property SWC Job#10-010 March 3, 2010 Page 2 of 3 Department of Ecology, March 1997, Ecology Publication No. 96-94. This is the methodology currently recognized by City of Renton and the State of Washington for wetland determinations and delineations. Weiland areas would also be considered wetlands when using the methodology described in the Carps of Engineers Wetlands Delineation Manual (Environmental Laboratory, 1987), as required by the US Army Corps of Engineers. Streams would be identified by the presence of a naturally defined channel that contains flowing surface water at some time of the year. Observations This site has been developed with a single family residence with several out buildings. According to the current land owner, the property was previously used as storage for large equipment and a significant amount of waste material was removed from the site. During our site visit we observed several remaining very large tractor tires and debris. A road side ditch is located along the eastern and northern property boundaries. The ditches were observed as having slow moving water during our site visit due to the rainfall conditions. The entire site appears to have been historically disturbed through its uses as a single family residence. Dominant vegetation on the site included ornamental plants associated with the residential area. In addition, native plants found on site included Douglas fir (Pseudotsuga menziesii), Red Alder (Alnus rubra), Rhododendron (Rhododendron sp.), Himalayan Blackberry (Rebus armeniacus), Indian Plum (Oemleria cerasiformis), Sword Fern (Polystichum munitum), dandelion (Taraxacum ofjlcinale), Orchard Grass (Dactylis glomerata), velvet grass (Holcus lanatus), bent grass (Agrostis sp.) and creeping buttercup (Ranunculus repens). A very small linear depression was observed in the southwest corner of the property. This area appears to be the result of land alterations given the topography of the property immediately off-site to the west. There is a i to 1.5 -foot topographic break on the western property boundary which results in this low lying area on the site. This area was looked at to determine if wetland conditions were present. Soil saturation was present during the time of our field investigation within this area. The area did exhibit some indicators of hydropbytic vegetation due to the presence of creeping buttercup. However, soil pits excavated in this area revealed high chromas. This area does hold water during downpours, but appears to be artificially created through previous land altercations. Soil pits excavated within the area revealed a gravelly sandy loam A -horizon with a color of IOYR 312; an underlying gravelly sandy loam B -horizon revealed a color of I OYR 4/3 and l OYR 414 with few fine distinct redoximorphic features. Given this information, Sewall Wetland Consulting, Inc does not believe this area to contain a naturally occurring wetland nor conditions which meet all three parameters for wetland conditions. CONTINUATION OF INSURANCE The coverage of this policy shall continue in force as of Date of Policy in favor of an Insured, but only so long as the Insured retains an estate or interest in the Land, or holds an obligation secured by a purchase money Mortgage given by a purchaser from the Insured, or only so long as the Insured shall have liability by reason of warranties in any transfer or conveyance of the Title. This policy shall not continue in force in favor of any purchaser from the Insured of either (i) an estate or interest in the Land, or (ii) an obligation secured by a purchase money Mortgage given to the Insured. 3. NOTICE OF CLAIM TO BE GIVEN BY INSURED CLAIMANT The Insured shall notify the Company promptly in writing (i) in case of any litigation as set forth in Section 5(a) of these Conditions, (ii) in case Knowledge shall come to an Insured hereunder of any claim of title or interest that is adverse to the Title, as insured, and that might cause loss or damage for which the Company may be liable by virtue of this policy, or (iii) if the Title, as insured, is rejected as Unmarketable Title. All information designated as confidential by the Insured Claimant provided to the Company pursuant to this Section shall not he disclosed to others unless, in the reasonable judgment of the Company, it is necessary in the administration of the claim. Failure of the Insured Claimant to submit for examination under oath, produce any reasonably requested information, or grant permission to secure reasonably necessary information from third parties as required in this subsection, unless prohibited by law or governmental regulation, shall terminate any liability of the Company under this policy as to that claim.
