PROPOSAL DESCRIPTION: Removal of 4 dead/damaged trees located within the
wetland and stream buffer. In addition the applicant is proposing the removal of dead limbs
and the tops of another 4 trees.
EXEMPTION JUSTIFICATION: Pursuant to RMC4-3-050C.5.c.iii Dead or Diseased
Trees, of the Critical Areas Regulations an exemption is hereby granted:
iii. Dead or Diseased Trees: Removal of dead, terminally diseased, damaged, or dangerous ground
X cover or hazard trees which have been certified as such by a forester, registered landscape architect,
or certified arborist, selection of which to be approved by the City based on the type of information
required, or the City prior to their removal.
FINDINGS: The proposed development is consistent with the following findings pursuant to
RMC section 4-3-0500.5:
1. The activity is not prohibited by this or any other chapter of the RMC or state or federal
law or regulation.

2. The activity will be conducted using best management practices as specified by industry
standards or applicable Federal agencies or scientific principles if submitted plans are
followed and the conditions of approval of this exemption are met.
3. Impacts will be minimized and disturbed areas will be immediately restored, if
submitted plans are followed and the conditions of approval of this exemption are met.
4. Where wetland or buffer disturbance occurs during construction or other activities in
accordance with this exemption, the site will be revegetated with native vegetation as
required as a condition of approval for this exemption.
5. All removed trees shall be retained as large woody debris in the stream/buffer and
wetland/buffer corridors, where feasible.
DECISION: An exemption from the critical areas regulations is approved for the tree
removal activies, listed above, within the wetland and stream buffer.

Article I - NAME
The name of the corporation is WEDGEWOOD LANE HOMEOWNERS ASSOCIATION, hereinafter called the
"Association."
Article 2 - REGISTERED OFFICE AND AGENT
The name of the Registered Agent of the corporation is: Patrick Gilroy. The street address of the Registered Office,
which is also the address of the Registered Agent, is: 1560 - 144th Avenue NE, Suite 100, Bellevue, WA 98005.
Article 3 - PURPOSE AND POWERS OF THE ASSOCIATION
This Association does not contemplate pecuniary gain or profit to the members thereof, and the specific purposes for
which it is formed are to provide for maintenance, preservation and architectural control of the residence Lots within a
certain tract of property ("Property" or "Project"), and to promote the health, safety and welfare of the residents within
the above-described property and any additions thereto as may be brought within the jurisdiction oflhis Association, and
for this purpose to:
(a) Exercise all of the powers and privileges and to perform all of the duties and obligations of the Association
as set forth in that certain Declaration of Covenants, Conditions and Restrictions, hereinafter called the "Declaration,"
applicable to the property and recorded or to be recorded in the Office ofthe County Auditor for the county in which the
Property is located and as the same may be amended from time to time as therein provided, said Declaration being
incorporated herein as if set forth at length;
(b) Fix, levy, collect and enforce payment byany lawful means, all charges or assessments pursuant to the terms
of the Declaration, to pay all expenses in connection therewith and all office and other expenses incident to the conduct
of the business of the Association, including all licenses, taxes or governmental charges levied or imposed against the
property of the Association;
(c) Acquire (by gift, purchase or otherwise), own, hold, improve, build upon, operate, maintain, convey, sell,
lease, transfer, dedicate for public use or otherwise dispose of real or personal property in connection with the affairs of
the Association;
(d) Borrow money, to the extent allowed by the Declaration;
(e) Participate in mergers and consolidations with other nonprofit corporations organized for the same purposes
or annex additional property, provided that any such merger, consolidation or annexation shall have the assent of such
percentage of the members as is provided for in the Declaration; provided further, that any such annexation shall
otherwise comply with the Declaration; and
(0 Have and to exercise any and all powers, rights and privileges which a corporation organized under the Non -
Profit Corporation Law of the State of Washington by law may now or hereafter have or exercise.
Article 4 - MEMBERSHIP AND VOTING
Provisions for the qualification and voting rights of members ofthe Association are asset forth in the Declaration and the
Bylaws of the Association, as the same may be amended from time to time.
Article 5 - BOARD OF DIRECTORS
The affairs of this Association shall, upon all Class B membership ceasing, be managed by a Board of three (3)
Directors. Until all Class B membership ceases, the initial Board shall be comprised of one member. The name and
address of the person who shall serve in the capacity of director until the selection of successors is the same as the
registered agent and registered office set forth in Article 2 above.
At the first annual meetingaflter the date all Class B membership ceases (or at a special meetingcalled afterthat
date), the members shall elect a three-member Board of Directors. At each annual meeting thereafter the members shall

elect the number of directors equal to the number of directors whose term shall expire that year. The number ofdirectors
may be changed by Amendment of the Association Bylaws.
Article 6 - LIABILITY
Provisions limiting the liabilityof Board members and other persons participating in the management ofthe Association,
and providing for indemnification of such persons by the Association, are as set forth in the Declaration, as the same may
be amended from time to time.
Article 7 - DISSOLUTION
The Association may be dissolved with the assent given in writing and signed by not less than 75% of each class of
members. Upon dissolution of the Association, other than incident to a merger or consolidation, the assets of the
Association shall be dedicated to an appropriate public agency to be used for purposes similar to those for which this
Association was created. In the event that such dedication is refused acceptance, such assets shall be granted, conveyed
and assigned to any nonprofit corporation, association, trust or other organization to be devoted to such similar purposes_
Article 8 - DURATION
The corporation shall exist perpetually.
Article 9 - AMENDMENTS
Amendment of these Articles shall require the assent of 75% of the entire membership; provided, until Class B
membership ceases, any such amendment must also be approved by Declarant.
Article 10- INCORPORATOR

Dear Mr. Gilroy,
I visited Vercello last week to examine some of the trees located within the designated green
spaces. My initial tour here was through the wooded wetland in Division 4, Tract A. This is just
west of Jericho Street between 91h Pl. and 10t'. The accompanying map roughly locates the trees;
the list below describes them, any defects they have that threaten persons or property, and
recommendations to abate risk.
1. Bigleaf maple, 14" diameter (dbh), no apparent risk.
2. 4 stem bigleaf maple, sizes from 10 —18" dbh. Remove 2 dead stems and all dead and
broken tops threatening fence, road, sidewalk and home to north.
3. Bigleaf maple, small, no apparent risk.
4. Bigleaf maple, small, no apparent risk.
5. Bigleaf maple, small, no apparent risk.
6. Red alder, 16" dbh, no apparent risk,
7. Red alder, 10" dbh, no apparent risk.
8. Black Cottonwood, 44" dbh. This tree is 20' from a recently failed large cottonwood. The
failed tree had a severe stem decay issue that also affected many structural roots, and was
also located in a very wet soil with much standing water. This specimen tree is above the
saturated area and has no observable wounds or decay.
9. Group of red alders, all small in diameter, along north perimeter. Very low risk.
10. Black cottonwood, 12" dbh, no apparent risk.
11. Black cottonwood, 20" dbh, located on edge of pond, very close to failed tree. Remove tree,
12. Red alder, 14" dbh, no apparent risk.
13. Dead red alder leaning over trail and fence. Remove tree.
14. Bigleaf maple, 30" dbh, Remove dead limbs hanging over trail and fence.
15, Black cottonwood, 24" dbh., growing entirely over trail, fence, lawn and roof of adjacent
home. This tree has been completely suppressed by very large Cottonwood nearby and has a
severe growth angle to the south. Remove this tree.
16. Black Cottonwood, 40" dbh. Remove large low limb extending out over trail, fence and
lawn.
17. Black cottonwood, 18" dbh. This tree is partially uprooted and leaning severely towards the
trail, Remove tree.
18. Black cottonwood, 12" dbh. No apparent risk,

19. -- 22. All black cottonwoods, ranging from 10 —18" in diameter. No apparent risk.
In addition to the above trees, I also noticed that two alders across the streets have dead tops.
Both of them are located between 952 and 964 Jericho St. Both trees are leaning to the south,
threatening 952. Remove dead top portion of two trees.

Dear Mr. Gilroy:
On February 25, 2010 you sent me an e-mail addressing trees that fell onto a home
currently under construction in the VerCello residential development. The attached
arborist report identified 19 different trees located in Division 4, Tract A. The arborist
recommended that 5 of these trees be removed and that some limbs of 2 additional
trees be removed. The arborist also recommended that the tops of 2 trees east of
Jericho Street be removed.
I visited the VerCello site to look at the trees that are recommended for
removal/trimming. I concur that the trees can be felled into the open space and left
behind. The trunks and large limbs will provide habitat for critters. If the tree faller is
inclined, and the trees are not too close to the trail, he could leave a tall stump (10 to 20
ft tall) as additional snag habitat.
To make up for the 5 trees that will be removed, it looks like there is room to install 20
trees at about 14 feet on center in Division 4, Tract A (see attached map for the tree
installation area). 1 recommend that the trees be a mixture of Douglas -fir and western
red cedar with a minimum size of 2-0 bare root to a maximum size of 2 -gallon
containers. The vegetation within about 3 feet of the planting spots should be scalped of
all vegetation and at least 3 inches of mulch should be placed around each tree. The
cedar trees can be located closer to the edge of the water and the fir trees closer to the
trail. There are no spaces available to add trees to the area east of Jericho Street.
