Two items were noted in the short plat as needed correction
I. Dimension from side yard setback was noted as less than 5 ', non compliant.
Dwg now inputs dimension and exceeds 5 '-0, thus compliant.
2. 20' easement documents included to extinguish and enlarge 15' existing
easement. Noted can be filed concurrently with recording signatures.
Drawings and all other documentation shows compliance to decision.

ACCESS AGREEMENT-EASEMENT
This ACCESS EASEMENT is entered into this 8th day of September, 20 l Oby and between the Grantor, Marilee
Karnofski, James P. Brennan, Mary T. Brennan, Cynthia McMahon, Gerald F. Brennan, co-owners of 3401 Lake
Washington Boulevard North, Renton, Wa. ("Landowner") and Grantee, Gerald F. Brennan and Mary P. Brennan,
3405 Lake Washington Boulevard North, (Easement Holder)
RECITALS
A. The Landowner's are the sole owner of certain real estate in the City of Renton, King County
State of Washington, which is legally described in Exhibit A, Access Agreement Legal Description and
incorporated herein by this reference (the "Landowner's Property").
GRANT OF ACCESS EASEMENT
In consideration of the facts recited above, the Landowner and Easement Holder agree as follows:
1. Grant of Easement. The Landowner hereby grants and conveys to the Easement Holder a perpetual,
nonexclusive, rent-free, twenty-foot wide easement (the "Access Easement") for ingress and egress to the 3405
Lake Washington Boulevard North and 10' Easement From 3405 to 3411 Lake Washington Boulevard North,
over and through that portion of the Landowner's Property described in Exhibit A, which is incorporated herein
by this reference (the "Easement" Property). The location of the Easement Property is shown on the Access
Easement Map on Exhibit B.
2. Use of Access Easement. The purpose of the Access Easement is to provide year-round pedestrian and
vehicular access to and from the property to the BNRR easement and continuing to Lake Washington Boulevard
North. Nothing in this Access Easement is intended to prohibit use of the Access Easement by the Landowner,
provided such use does not interfere with the use of the Access Easement by the Easement Holder.
3. Improvements. The Landowner and Easement Holder shall have the right, but not the obligation, to construct,
at its sole expense, improvements upon the Easement Property to make the Easement Property suitable for
vehicular and pedestrian use. Any improvement shall be in compliance with the current city standards. The
Landowner shall not be obligated to install any of these improvements.
4. Maintenance. The Easement Holder shall be responsible for maintaining the Easement Property to the extent
necessary for the uses described in this Access Easement. Private Access and Land Improvement Maintenance
Agreement: New private exclusive easement for ingress and egress is to be created upon the sale of lots shown on
this short plat. The owners of lots shall have an equal and undivided interest in the ownership and responsibility
for maintenance of the private access easement appurtenances/land improvements. These appurtenances and
maintenance responsibilities include the repair and maintenance of the private access road, drainage pipes. and
storm water quality and/or detention facilities within this easement, private signage, and other infrastructure not
owned by the City of Renton. Maintenance costs shall be shared equally. Parking on the paving in the access
easement is prohibited, unless pavement width is greater than 20'.

· 5. Damage to Easement Property. The Landowner and Easement Holder shall be responsible for any damage
they may cause to the Easement Property. The party responsible for such damage shall promptly make all needed
repairs, restoring the Easement Property to its condition prior to the damage.
6. Obstructions to Use of the Easement Property. Neither the Landowner, Easement Holder nor any person
permitted to use the Easement Property under the terms of this Access Easement may utilize the Easement
Property in a way that interferes with its use by any other person permitted to use it. Any obstructions or
impediments to the use of the Easement Property may be removed, with reasonable notice, by the Landowner or
Easement Holder and the cost of such removal shall be borne by the party causing or responsible for such
obstruction.
7. Enforcement of Agreement & Indemnity The Landowner and Easement Holder shall have the right to legally
enforce this Access Easement and the covenants, conditions and restrictions set forth herein, by whatever action
or actions are legally available, including, without limitation, enjoining any violation or threatened violation
hereof. Easement Holder agrees to indemnify the Grantor from and against any liability incurred as a result of the
Easement Holders negligence, but nothing herein shall require the Easement Holder to indemnify the Grantor for
that portion of any such liability attributable to Grantor or any other party.
8. Amendment. This Access agreement cancels and supersedes all previously recorded access easements,
specifically King County Recording# 19990628001967 and 19990628001967 recorded June 28, 1999 This
Access Easement may not be modified, amended or terminated except by execution and recording of a written
instrument signed by both the Landowner and Easement Holder.
9. Successors. All of the terms, covenants, conditions, and obligations set forth in this Access Easement shall
inure to the benefit of and bind the Landowner and Easement Holder, and their respective personal
representatives, heirs, successors, transferees and assigns, and shall continue as a servitude running in perpetuity
with the Landowner's Property.
9.A Declaration of Covenant: The owner of land embraced within this short plat, in return for the benefits
to accrue from this subdivision, by signing hereon covenants and agrees to convey the beneficial interest in the
new easements shown on this short plat to any and all future purchasers of the lots, or of any subdivision thereof.
The covenant shall run with the land as shown on this short plat.
9. B Private Access and Utilities Maintenance Agreement: New private exclusive easement for ingress
and egress is to be created upon the sale of lots shown on this short plat. The owners of lots shall have an equal
and undivided interest in the ownership and responsibility for maintenance of the private access easement
appurtenances/land improvements. These appurtenances and maintenance responsibilities include the repair and

10. Severability. If any provision or specific application of this Access Easement is found to be invalid by a court
of competent jurisdiction, the remaining provisions or specific applications of this Access Easement shall remain

11. Governing Law. This Access Easement shall be governed by and construed under the laws of the State of
Washington.
