Dear Alex Morganroth,
As mentioned via your email dated January 31, 2018 we are submitting this request for
modification of the street frontage improvements for the Huynh Short Plat located at 2007
Union Ave NE. The requested improvements would consist of the following:
•44' Roadway Width
•0.5' curb
•8' landscape planter
•8' sidewalk
•1' clear space at back of sidewalk
•80' Right‐of‐Way (10' dedication)
The requested reductions from the standard minor arterial requirements include the following:
•54' Roadway width (not including parking)
•91' Right‐of‐Way (15.5' dedication)
Justification for the modification to the standards per RMC 4‐9‐250‐C5d are as follows:
a.That the applicant suffers practical difficulties and unnecessary hardship and thevariance is necessary because of special circumstances applicable to subject property,
including size, shape, topography, location or surroundings of the subject property, and
the strict application of the Zoning Code is found to deprive subject property owner of
rights and privileges enjoyed by other property owners in the vicinity and under
identical zone classification;
The proposed modification results in a curb line that is consistent with the
neighboring properties. Strict application of the standard section would result in a
road section that creates potential confusion for drivers with a staggered curb line.

b.That the granting of the variance will not be materially detrimental to the public
welfare or injurious to the property or improvements in the vicinity and zone in which
subject property is situated;
The Transportation section has reviewed the existing curb to curb width (44') of
Union Ave NE and determined it to be sufficient. The requested modification will
not reduce the existing width and therefore will not result in a negative impact on
the public welfare.
c.That approval shall not constitute a grant of special privilege inconsistent with the
limitation upon uses of other properties in the vicinity and zone in which the subject
property is situated;
The existing curb line of Union Ave NE matches the proposed modification and the
City does not intend to expand the street further. The modification is available to all
applicants and does not constitute a grant of special privilege.
d.That the approval is a minimum variance that will accomplish the desired purpose. The
proposed modification results in a road section that is consistent with the actual
needs of the City and does not request more reduction than what is needed for that
purpose.
