Dear Mr. Kohlhase:
The. City of Renton is in receipt of your request (received April 14, 2011) to modify the minimum
standards of the design regulations for the proposed Sherwin Williams retail paint store. The .
store is proposed at the southwest corner of Duvall'Avenue NE and NE 4th Street, addressed at
4615 NE 4th Street (Exhibit 1). The proposal is.to construct a 3,871 square foot Sherwin Williams
retail building, create surface parking for 16 vehicles, and install a plaza (Exhibit 2). The property
is located in the Commercial Arterial (CA) zone and Urban Design District'D' (Exhibit 3). The
following provides a summary of your request, analysis, and decision.
Summary of Request
The applicant has requested modifications of the minimum standards of the Urban Design
District 'D standards for building character and massing, ground level details, and pedestrian
amenities on the proposed building which would be located 4615 NE 4tn Street (Exhibit 1). The
modification would be from RMC 44-100E3, Pedestrian Amenities, RMC 4-3-100E5, Building
Character and Massing, and RMC 4-3-1001=5, Ground Level Details.
Analysis
Pedestrian Amenities
RMC 4-3-100E3 specifies that pedestrian overhead weather protection in the form of awnings,
marquees, canopies, or building overhangs shall be provided.. These elements shall be a
minimum of 4% -feet wide along at least 75% of the length of the building fagade facing the
street, a maximum height of 15 -feet above the ground elevation, and no lower than, 8 -feet .
above ground level.
The applicant is`requesting that the canopy'be allowed at approximately 65%.of the length of the
north fagade because this canopy has been designed to fit the proportions of the fagade. The
applicant is also requesting that the canopy be allowed at approximately'55% of the length of
the west fagade because as designed this canopy would be centered over the main building entry ,
with transparent windows on either side of the entry tower -which would convey a sense of
symmetry to this fagade (Exhibit 4 j.
Staff supports the applicant's request to modify the length of canopies on the north and west
facades of the proposed building. The intent of the Urban Design Guidelines is met by creating
attractive spaces that unify the building and street environments and ore.inviting for

Analysis
-Pedestrian Amenities.:
RMC 4-3-100E3 specifies that pedestrian overhead weather protection in the form of awnings,
marquees, canopies, or building overhangs shall be provided. These elements shall be a

street, a maximum. height of 15 -feet above the ground elevation, and no lower than 8, -feet
above ground level.

north fagade because this canopy has been designed to fit. the proportions of the facade. The
applicant is also requesting that the canopy be allowed at approximately55% of the, length of
the west facade -because as designed.this canopy would be centered over the main building entry
with transparent windows on either side of the entry tower which would convey a sense of
-symmetry to this facade (Exhibit 4).-'
Staff supports the applicant's request to modify the length of canopies on the north and west,
facades of the proposed building. The intent of the Urban Design Guidelines is met by creating
attractive spaces that unify the building and street environments and are inviting for

pedestrians; and provide publicly accessible areas that function for a variety of year-round
activities, under typical seasonal weather conditions.
Building Character and Massing
RMC 4-3-100E5 specifies that: All building facades shall include modulation'or articulation at.
intervals of no more than 40 -feet; and; modulations shall be a minimum of 2 -feet deep, 15 -feet
in height, and 8 -feet in width.
The applicant is requesting that the modulation requirement on the east fagade of the proposed
building be increased to 40 feet, 6 -inches and that the height requirement be reduced to 12 feet
in height on the east fKade (Exhibit 4). The applicant contends that such dimension reductions
would center the building nodulation under the proposed canopy on this fogade. The applicant
also states that the proposed dimensions would be proportional to the overall scale of the
proposed building. which would be 21 feet, 6 -inches in height. The east fagade would also be
partially screened by landscaping.
The applicant is also requesting that the modulation requirement on the south fagade of the
proposed building be increased to 50 feet because this is a utilitarian fagade and not a publicly
used facade (Exhibit 4).
Further, the applicant is requesting that the modulation requirement on the west facade of the
proposed building be increased to 43 feet; 6 -inches because this fagade defines the main.entry to
the building (Exhibit 4). The applicant, believes that a 40 foot modulation would detract from
such architectural emphasis on the main entry as well as other architectural elements. The west
fagode would further be enhanced by a landscaped area at its southern end.
Staff supports the. applicant's request to modify the modulation requirements on the east, south,
and west facades of the proposed building.. The intent of the Urban Design Guidelines is met by
ensuring that the proposed building would not be bland and would appear to be. at a human
scale, .as well as ensuring that ail sides of the proposed building which could be seen by the
public would be visually interesting.
Ground Level Details
RMC 4-3-100E5 specifies that any fagade.visible to.the public shall be comprised of at. least -50%
transparent windows and/or doors for at.least the portion of the ground floor fagade that is
between 4 -feet and 8 -feet above ground (a's measured'on the true elevation).. .
The applicant is requesting that the percentage of transparent windows between, 4 -feet and 8 -
feet on the eost fa;ade be approximately 23% and approximately 36% on the west fagade of the
proposed building because the'southern portionof the proposed building will be used for. product
staging and storage (Exhibits 4 and 5). The provision of transparent windows in such areas
would be impractical for promoting product security.
Staff supports the applicant's request to modify the percentage of required transparent windows
and/or doors on the east and west facades of the proposed building.. The, intent of the Urban
Design Guidelines is met by.ensuring that the architectural design of the proposed building is
visually interesting and reinforces the'intended human -scale character of the pedestrian

environment; and ensures that all sides of the proposed building within near or distant view hove
visual interest.
Decision Criteria
RMC 4-3-100F allows the Planning Director to modify the minimum standards of the design
regulations subject to the provisions of RMC 4-9-250D and the following requirements:
1. The project as a whole meets the intent of the minimum standards and guidelines in
subsections El, E2, E3, E4, E5, E6, and E7 of the design regulations;
2. The.requested modification meets the intent a.nd'guidelines of the applicable design
standard;
3. The modification will not have a detrimental effect on nearby properties and the City as
a whole;
4. The deviation manifests high quality design; and
5. The modification will enhance the pedestrian environment on the abutting and/or
adjacent streets and/or pathways.
RMC 4-9-250D2 requires that the following criteria must be met for modifications:
1. .Will meet the objectives and safety, function, appearance, environmental protection
and maintainability intended by the Code requirements, based upon sound engineering
judgment; and
2. Will not be injurious to other property(les) in the vicinity; and
3.. Conform to the intent and purpose of the Code; and
4. Can be shown to be justified and required for the use and situation intended; and,
5. Will not create adverse impacts to other property(ies) in the vicinity.
Decision
The proposal.satisfies the 5 requirements to modify -the minimum standards as specified in RMC
4-3-100F. in addition the 5 criteria listed in RMC 4-9-250D2 have also been met. Therefore, the
modifications of the Urban Design Diistrict,'W'standards for pedestrian amenities, building ,
character and massing,.and ground level details for the proposed building located at 4615 NE 4ti'.
•Street are approved.
The decision to approve the proposed modification is subject to a fourteen (14) day appeal
period from the date of this letter.
Within 14 -days of the effective date of decision, any party may request reconsideration that a
decision may be reopened by the Administrator (Decision -maker). The Administrator (Decision -
maker) may modify his decision if material evidence not readily discoverable prior to the original .
decision is found_ or if he finds there was misrepresentation of fact. After review of the
reconsideration request, if the Administrator (Decision -maker) finds -sufficient evidence to
amend the original decision, there will be no further extension of the appeal period.- Any person

wishing to take further action mustfile a formal appeal within the 14 -day appeal timeframe with

The decision to approve the proposed modification will become final if not appealed in writing

Floor, (425) 430-6510. Appeals must be filed in writing, together with the required fee to: `

Note to applicant. 12 feet of right-of-way dedication.is required along the NE 4 h Street and
Duvall Avenue NE frontages. Prior to building permit approval revised'plans showing the
right-of-way dedication and required street improvements must be submitted to the
Development Services Director.for review and approval. Such street improvements must
include an 8 -foot planting strip, a 6 -foot sidewalk, curb and gutter.

As the City of Renton has suggested in our first round of planning comments, we are
submitting a design modification request to adjust the requirements for building
modulation and canopies along lengths of building fairades facing the street. Below I have
outlined the requirements per the City code and how we intend to meet the intent of the
code. We are only requesting one change from the cities suggestions in the planning
comments. All other items have been revised to match the suggestions of city staff. We
hope the city finds that this is adequate In addressing the overall intent of the code to
create a pedestrian friendly environment that entrances the character of the neighborhood.
RMC4-3-100E, Building Character and Massing
Requirements:
1. All building facades shall include modulation or articulation at intervals of no more
than forty feet.
2. Modulation shall be a minimum of two feet deep, sixteen feet in height, and eight
feet in width.

North Elevation
No modification required. Elevation meets the requirements of the code.
East Elevation
We are requesting a design modification to increase the 40 foot modulation
requirement to 40 foot 6 inches. Also requesting a design modification to decrease
the 16 foot height requirement to 12 feet.
In order to create a more human scaled fagade, we brought the modulation at the
center of the building to the underside of the canopy. These dimensions are also
more proportional to the overall scale of the building, which is only 21 foot 6 inches
tall in a zone which allows for a 50 foot height. This facade will also be partially
screened by landscaping.

South Elevation
We are requesting a design modification to increase the 40 foot dimension to 50
feet.
The city has acknowledged that this is a utilitarian facade and not public.
West Elevation
We are requesting a design modification to increase the 40 foot required dimension
to 43 feet 6 inches.
The modulation on this fa;ade defines the entry to the building. Creating more
modulation, in our opinion, will take emphasis away from the main entry to the
building, and take away from the hierarchy of elements. This facade is also broken
down by a large planting island on the southern portion.
RMC4-3-100E, Ground Level Details
Requirements:
1. On any facade visible to the public, transparent windows and/or doors are required
to comprise at least fifty percent of the portion of the ground floor fa ade that is
between four -feet and eight feet above ground (as measured from true elevation).
2. Building facades must have clear windows with visibility into and out of the building.
However, screening may be applied to provide shade and energy efficiency. The
minimum amount of light transmittance for windows shall be fifty percent.
Modifications Requested:
To satisfy this requirement, City staff has recommended that the East Fayade be
redesigned to add (4) transparent windows that match the upper portion of the
storefront windows (above the spandrel glass) as proposed on the east fa ade. Staff
has also recommended that we add transparent windows on the West fagade (south of
the entry). Both of these Items have been incorporated into the building elevations,
and all windows have been shown as transparent.
RMC4-3-100E, Pedestrian Amenities
Requirements:
1. Pedestrian overhead weather protection in the form of awnings, marquees,
canopies or building overhangs shall be provided. These elements shall be a
minimum of four and one-half feet wide along at least seventy five percent of the
length of the building facade facing the street, a maximum height of fifteen feet
above ground elevation, and no lower than eight feet above the ground level.
Modifications Requested:
The canopy along the East facade of the building has been increased to 75% of the
length of the building as required. No modification is being requested.
At approximately 65% of the length of the North fagade, we are requesting a design
modification for this canopy to remain as designed. This canopy has been designed to
this length to fit the proportions of the fagade. Per the planning comments, city staff is
supportive of this facade as designed.
The South Fagade will also remain as designed. Per the planning comments, city staff
supports this as a utilitarian, and not a public facade. No modification is being
requested.
On the West fagade, the city has asked that this canopy be increased from
approximately 55% to 75% in order to break up the wall. We are requesting that this
canopy be allowed to remain at the approximately 55% length. The canopy, as currently
designed, is centered over the main entry with transparent windows on either side of

the entry "tower". By extending the canopy to the south, we would be taking away
from the symmetry of the entry tower.
In addition, the canopy extends approximately 79% the length of the fagade that fronts
the pedestrian sidewalk. There is a landscaped island along the southern half of the
facade, that is not accessible to pedestrians. We believe that the landscape features at
this portion of the building will help to reduce the scale of the facade.
We believe the modifications, as outlined above, meet the intent and purpose established
by the Urban Design Regulations. These modifications will not be injurious or create
adverse impacts to neighboring properties. We believe the building facades and pedestrian
amenities substantially implement the code requirements, and create a public space that
will be a valued addition to the community. A copy of the building elevation sheet, as
modified to that stated above, has been included with this request. Please let me know if
