30.4 sq ft for refuse and recycling storage. Pursuant to RMC 4-4-090 the total minimum area for
refuse/recycling storage is 100 sq ft of area. The modification was triggered by a building permit

Dear Mr. Bond,
This letter is sent in response to your July 19, 2010 request (attached) for modification from the City's
Refuse & Recyclables regulations (RMC 4-4-090).
Summary of Request
The applicant proposes to reduce the area available for trash and recyclables area for the lntegra site
located at 700 SW 39th Street. The area is presently 366 square feet (30'-6" long x 12' wide). An existing
eight-yard trash enclosure occupies a total of 39.4 square feet (measuring 80" wide and 71" in length).
The proposed generator would occupy 57.5 square feet (measuring 161-1/2" in length and 51-1/4" in
width) within a 211 square foot fenced-off area.
Section 4-4-090F allows the Administrator to grant modifications from the refuse and recyclable
standards for individual cases, provided the modification meets the following criteria (pursuant to RMC
4-9-250.D.2):
a. Will meet the objectives and safety, function, appearance, environmental protection
and maintainability intended by the Code requirements, based upon sound engineering
judgment; and
b. Will not be injurious to other property(ies) in the vicinity; and
c. Conform to the intent and purposed of the Code; and
d. Can be shown to be justified and required for the use and situation intended; and
e. Will not create adverse impacts to other property(ies) in the vicinity; and
Background
The applicant, Dave Bond, has requested a modification from the City' Refuse and Recyclables Standards
(RMC 4-4-090C.2) in order to reduce the area available for trash and recyclables area from 366 square
feet to 155 square feet for the site located at 700 SW 39th Street. An existing trash enclosure area is
being retrofitted to accommodate a standby emergency generator. The location of the existing trash

enclosure is within a parking lot on the north side of an existing building between an access easement
and the parking lot for an office development. The applicant intends to retain an 8-yard trash dumpster
within a portion of the enclosure. The remainder is proposed for n:,trofitting in order to accommodate a
generator Renton Municipal Code requires that inn office, educational and institutional developments, a
minimum of two (2) square feet per every one thousand (1,000) square feet of building gross floor area
shall be provided for recyclables deposit areas and a minimum of four (4) square feet per one thousand
{1,000) square feet of building gross floor area shall be provided for refuse deposit areas. A total
minimum area of one hundred (100) square feet shall be provided for recycling and refuse deposit
areas.
Analysis
a) Will meet the objectives and safety, function, appearance, environmental protection and
maintainability intended by the Code requirements, based upon sound engineering judgment;
The proposal would meet the objectives and safety, appearance, and maintainability intended
by the Code requirements, based upon sound engineering judgment. However, the function
and environmental protection of the site may be compromised by the lack of an enclosure that
could accommodate recyclables. It is recommended that the applicant be required to replace
the area lost within the enclosure on-site to offset the impact of decreasing the area available
for trash and recyclables.
b) Will not be injurious to other property{ies} in the vicinity;
The proposal would not injure other properties in the vicinity. The appearance of the existing
trash enclosure would not change, and the recommended replacement area could be
reasonably accommodated on site within the existing parking lot.
c) Conform to the intent and purposed of the Code;
The proposal would not meet the minimum requirements for provision of a recyclables area on
the site. Therefore, staff recommends that the applicant be required to provide an area for
recyclables that replaces the area lost to the generator.
d) Can be shown to be justified and required for the use and situation intended;
The proposal to reduce the area within the existing trash enclosure to accommodate a
generator is appropriate only if a comparable area for trash and recycling is replaced on site.
e) Will not create adverse impacts to other property(ies) in the vicinity
The proposal would not likely create adverse impacts to other properties in the vicinity.

Decision
The refuse and recyclable modification is approved subject to the following condition:
1. The applicant shall create an additional enclosure area far refuse and recycling ta replace the
area that is being converted for generator use. The area shall meet the applicable standards
for location, screening, etc. and be a minimum size of 211 square feet. The replacement area
shall be provided for and installed within 4 months of the date of this decision.
Appeal Process
Appeals of this administrative decision must be fried in writing on or before 5:00 p.m., November 9,
2010. Appeals must be filed in writing, together with the required appeal fee with the City of Renton
Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057. Appeals to the Examiner
are governed by the City of Renton Municipal Code Section 4-8-110.B. Additional information regarding
the appeal process may be obtained from the Renton City Clerk's Office (425)430-6510.

Dear Jennifer Henning:
EC Company requests a modification from the standard (4-4-090) for 'Refuse and Recyclables Standards' that will
allow the installation of the proposed 275kW standby generator to occupy the same enclosure as that current
designated for refuse and recyclables.
The generator will occupy only a portion of the trash enclosure. With the proposed generator in place, the enclosure
will still have ample room to house the eight yard trash dumpster that the building currently is using.
The existing trash enclosure is a total of 366 square feet, with overall measurements of 30' -6" in length and 12' in width.
The eight yard trash enclosure occupies a total of 39.4 square feet, and measures 80' wide and 71" in length.
The proposed generator would occupy 57.5 square feet and measures 161-1/2" in length and 51-1/4" in width.
The fenced off area for the generator would occupy 211 square feet.
The objective of a safe and aesthetic location for trash storage and collection will not be impacted. The enclosure
currently has wooden gates at the entry and these would remain. We will only be using the space in the enclosure
that is currently not being used.
There will be no offending or injurious components that will affect or offend the surrounding community.
An effective and adequate location for the storage and collection of trash will still be in place after the proposed
generator is installed and this modification will not diminish the purpose of the ordinance.
The parking area around the 700 SW 39'h Street building is at a premium. Placing the generator in the unused portion
of the existing trash enclosure will save parking spaces.
lntegra needs reliable standby power in the performance oftheir business. They will not be able to meet their
business obligations without the provision of back-up power.
The modification of the standard will in no way create adverse impacts to the adjacent properties.
