The developer for the referenced project, J. G. Real Estate Group NW (Principal), has not completed
the work as outlined in a No Approval dated January l l, 2006 (Site and Right of Way) and punch list
dated August 25, 2005 {Landscape). On August 5, 2005, this department's Financial Guarantee
Management Unit made a claim on financial guarantee LB77l l, to Contractor's Bonding and
Insurance Company (Surety) and the assignment of funds in the Washington First International Bank
(Bank). On April 26, 2006, this department's Financial Guarantee Management Unit made a claim on
financial guarantee LB8799, to the Surety. As of the date of this memo neither the Surety, the Bank
nor the Principal have adequately responded to the claims nor has significant progress been made on
completing the requirements for Final Construction Approval.
Given these facts, l am requesting that your office take appropriate action, including filing a lawsuit if
necessary, to secure completion of the items listed in the above referenced "punch lists" or "no
approvals" or gain the forfeiture of the financial guarantees from the Surety and the Bank.
Attached with this memo are copies of the inspection and bond file documents. They provide a
complete chronological history and include all correspondence for this project's inspection and
financial guarantee compliance process.

This agreement is made and entered into this LB__~ay of A;ln/ , 20~/, between the King County
Department of Development and Environmental Services, hereinafter called the COUNTY, and the above named
developer, hereinafter called APPLICANT.
Basis for AGREEMENT:
WHEREAS the undersigned APPLICANT wishes to construct right of way improvements and/or perform site work at
The above location, and
WHEREAS the County will authorize site work or limited right of way use andpermit said construction upon agreement
by the APPLICANT to comply with all terms of this AGREEMENT; and
NOW THEREFORE, the APPLICANT hereby agrees and binds itself and it's legal representatives, successors, ancl
assigns, as follows:
Terms of the AGREEMENT:
1. The APPLICANT guarantees that construction, maintenance and restoration of roadway, drainage, and
retention/detention facilities will occur in full compliance with the approved construction plans and profiles,
including any approved amendments thereto, and in full conformance with applicable COUNTY ordinances,
standards and specifications, to the satisfaction of the Director ofDDES or his/her designee.
2. If the subdivision is not recorded or the building does not receive any certificate of occupancy, the APPLICANT
agrees to restore the right of way to original condition or better AND stabilize the site or comply with the conditions
of any permit or approval, including corrective work necessary to provide drainage consistent with approved plans
and conditions, and to protect the public health, safety, and welfare, including effects on water quality.
3. Unless otherwise authorized by the COUNTY in writing, all work shall be completed within six months following
the issuance of the certificate of occupancy, or two years after recording of the plat, or prior to the expiration or
completion of the right of way use and/or grading permit, whichever occurs first.
4. The COUNTY must approve (in writing) any proposed changes from the approved plans prior to the Applicant
beginning such work.
5. Prior to beginning construction, a preconstruction conference shall be held with the COUNTY, the APPLICANT
and the Applicant's contractor(s) · ·
6. The APPLICANT shall be responsible for costs of any corrective work on or off the site or within the right-of-way
to the extent that such corrective measures are associated with work performed and/or not completed.
7. The APPLICANT shall pay any fees required in conjunction with the project pursuant to Title 27 of the King
County Code. ·
8. The APPLICANT shall implement all necessary erosion-sedimentation facilities to insure sediment-laden water will
not enter natural or manmade drainage facilities and will maintain them until such time as erosion potential is past.
In the event erosion and sedimentation is observed, the APPLICANT shall immediately take actions to mitigate
erosion on or off the site. The COUNTY may take immediate action to remedy the problem. The applicant shall

9. If the APPLICANT fails to proceed with due diligence and in good faith in the constrnction and maintenance work
provided herein, the APPLICANT shall remove all or part of constrncted facilities and restore all disturbed areas to
the original or better condition at the Applicant's sole expense. The APPLICANT shall not stop, delay or abandon
the project without first rectifying any damage, stabilizing and restoring the right of way or site by grading,
hydroseeding, and/or landscaping as may be required by King County.
IO. Prior to the County's approval and authorization of constrnction, the APPLICANT shall provide the COUNTY with
a financial guarantee in the amount and in a form approved by the COUNTY to secure compliance with all terms of
this AGREEMENT. The financial guarantee shall remain in force and effect until written release by the COUNTY.
At least $7,500 of the guarantee shall be in the form ofan assignment of funds or a cash deposit with the COUNTY.
The Applicant's obligation to perform work and pay fees or other amounts is not limited to the amount of the
associated financial guarantee.
11. Upon completion of the required public improvements to the satisfaction of the COUNTY, the APPLICANT shall
file such further financial guarantees and agreements in the amounts and forms acceptable to the COUNTY to secure
the successful operation and maintenance of the improvements for a minimum period of two years after constrnction
approval (KCC 9.04.100, 14.28.050, 19.36.060 and 21.50.090 as applicable). In the event that the applicant fails to
post such additional financial guarantee instruments, the COUNTY may demand payment on the performance
financial guarantee instrnment and may utilize such amount to secure operation and maintenance of improvements in
accordance with the King County Code and this AGREEMENT.
12. The APPLICANT shall furnish to the COUNTY a set of "final corrected plans" (photo mylar quality or equivalent)
of all required public facilities when applicable.
13. The APPLICANT shall be responsible for the proper performance, safe conduct and adequate policing and
supervision of the project. This responsibility shall not be lessened or otherwise affected by the County's approval
of plans, specifications, or work, or by the presence at the work site of the County's representative(s), or by the
compliance by the APPLICANT with any requests made by said representative(s).
14. The APPLICANT shall indemnify and hold the COUNTY and it's agents, employees and/or officers hannless from
and shall process and defend at it's own expense all claims, damages, suits at law or equity, actions, penalties, losses,
or costs of whatsoever kind or nature, brought against the COUNTY arising out of, in connection with, or incident to
the execution of this AGREEMENT and/or the Applicant's performance or failure to perform any aspect of the
AGREEMENT. Provided, however, that nothing herein shall require the applicant hold harmless or defend the
County from any claim arising from the sole negligence of the COUNTY'S agents, employees and/or officers.
15. In the event that any party deems it necessary to institute legal action or proceedings to enforce any right or
obligation under this AGREEMENT, the parties hereto agree that any such action or proceeding shall be brought in a
court of competent jurisdiction situated in King County, Washington.
Release Requirements: This AGREEMENT shall remain in effect and the associated financial guarantee shall not be
released until all terms of this AGREEMENT have been completed to the satisfaction of the Director ofDDES or his/her

4. In the event that this project becomes part of an incorporated area, King County may transfer its rights and

incorporated into the City of Renton. Jurisdiction was transferred on March 12, 2008. The City
of Renton and King County entered into an interlocal agreement to define the process to close
and complete the existing projects under various levels of construction effective on that date.
King County records show that Larson Parke defaulted and the permits have expired. King
County has turned over the files to the City of Renton to do the final paperwork associated with
the closeout, including the release of any performance or maintenance bonds.

I write in response to your August 21, 2006 letter with respect to the Larson Parlee
project. We disagree with DDES' August 14, 2006 letter stating that the punch list has not been
perfomu;d. J.G. Real Estate's response to the Jlinuary 11, 2006 punch list follows:
• "IOI. Clean storm drainage system and remove all CB fabric filters": This has
already been performed. In the interest of resolving this, J.G. Real Estate will
clean the storm drainage system again.
• "120. Install pond sign": A pond sign has been installed.
• "140. Complete the gravel access road into the pond by smoothing and
compacting gravel": This has been completed.
• "505. Special Use Permit is required if rockery in tract is to remain": J.G. Real
Estate disputes the obligation to provide a Special Use Pennit. The rockery was
approved when installed and no mention of the need for a permit was made before,
during or after installation.

necessary to provide a seed/mulch protection on the newly exposed soil": J.G.
Real Estate is installing seed/top soil protection on an expedited basis.
• "180. Pond fence tubing does not meet aimensional requirements of WSDOT
specifications as required in SWDM": The pond fence tubing has been in place for
years. No objection was made when installed and the issue was not raised until the
January 11, 2006 punch list after installation an4 after previous punch lists did not
raise the issue. J.O, Real Estate requests information as to how the pond fence
tubing allegedly does not meet WSDOT specifications.
J.G. Real Estate fw-ther objects to ODES' failure to tailor its demand against the final
guarantee to a fair reasonable estimate of the value of the unperformed work contrary to code
and interpretation thereof. DOES has improperly demanded the full amouut of the financial
guarantees without limiting the demand to the value of the work at issue. For these reasons, we
request that CBIC decline the County's demand.

CBIC received your claim and forwarded it to the principal for comment. In response,
the Principal informed us that the project was inspected and accepted·two years ago, pending the
completion of some punchlist items. The Principal alleges that, since that time, DOES has
continued to add new items to the punchlist, including items previously inspected and accepted,
and has failed to finalize the project on the basis of these new items in violation of their
obligations as project owner. The Principal states that the punchlist items listed on the "No
Approval" form dated January 11, 2006, were either completed, previously accepted, or
otherwise addressed, and they are working with the County to close out the project.
Based on this, we understand that your claim against the above-referenced Bond and
Principal is currently being resolved. Please let-us.know if this understanding is incorrect as we
intend to take no further action on your claim unless we hear back from you. In the event this
matter cannot be resolved between the parties, please reply in writing and include any additional
supporting documentation necessary for evaluation of the merits of this dispute.

812 DRAINAGE FACILITY LIABILITY POLICY (KCC 9.04.100) Any person required to
construct a drainage facility (except downspout roof drain infiltration systems) shall
maintain a liability policy in the amount of $1,000,000 which shall name King County as
an additional insured. This policy shall remain in effect until construction approval or
acceptance for maintenance, whichever is last. THE POLICY FOR THIS PROJECT
MUST NOT EXPIRE BEFORE THE FINANCIAL GUARANTEES ARE RELEASED.
THE POLICY MUST BE EXTENDED TO CONFORM TO THE KING COUNTY

The referenced project was recorded on January 15, 2002. A requirement of recording was a
financial guarantee to assure the completion of the required improvements for final construction
approval within two years from the date of recording. In accordance with King County Code, on
March 18, 2004 a time extension was granted allowing an additional six months to complete all
requirements for final construction approval. A recent inspection of the project site found the
improvements uncompleted.
The failure of the Principal, J.G. Real Estate Group NW, LLC, to comply with the requirements
for final construction approval compels King County to enforce the Surety Bond, number
LB7711, and the terms of the Agreement. Please contact Stacy Graves within thirty days of this
notice and advise us of your decision of whether you are electing to either (A) remedy the
default, or (B) tender to King County, within an additional thirty (30) days, the amount of the
surety bond. Ifwe do not receive a response by September 2, 2005, we will have no choice but
to forward this case to the prosecuting attorney for legal action.
If you elect option:
(A) Please contact Mike Meins, of the Land Use Inspection Unit, at 206-296-6678 for details
of the required work, submittal documents and fees owing.
(B) Please send your check in the full amount of the bond to the above letterhead address,
attention Stacy Graves, no later than October 7, 2005. The check shall be made payable
to the King County Office of Finance. King County will then arrange for the remaining
punch list items to be completed. A detailed accounting of the funds used will be
provided at the completion of the work. If the cost of the remaining punch list items
exceeds the.amount of the defaulted financial guarantee, the principal will be billed for
the remainder. If the amount of the defaulted financial guarantee exceeds the cost of
completing the outstanding punchlist items, the remainder of the financial guarantee will
be returned to Contractors Bonding and Insurance Company.

The Land Use Services Division has a computer tracking system that uses project and
activity numbers. Please refer to both the project and the activity numbers when
inquiring about this project.
This official punch list is valid for 30 days. Changes will not be made within the 30-day
limit without the expressed review and approval of the Senior Engineer, Land Use
Inspection Section. Any extensions to the 30-day limit must be approved by the

I have reviewed your September 5, 2001 submittal and have the following Comments.
Please submit a recreation/park plan prepared by a qualified landscape architect
incorporating the following:
I. Additional landscaping (mix of trees, shrubs and groundcover) shall be added to the
recreation tract, Variety of species, size and location to be determined by the
landscape architect. The landscaping materials shall be placed in a way to create a
buffer separating public and private spaces. There shall be a minimum of 5-fDOt-
walkwayof concrete (or other materials approved by DDES) from the access tract to
the play area.
2. One bench shall be located in the vicinity of the play structure. The exact location
is to be determined by the landscape architect.
3. The equipment (play structures, benches, etc.) shall meet, af a minimum, Consumer·
Product Safety Standards and be appropriately anchored. Please provide
manufacturing specification for the play equipment, bench, and picnic table.
4. The tot lot area shall be a minimum of 400 square feet and not less than 20-feet in
width.
5. A Bound Quantity Worksheet (BQW) shall be prepared and submitted with the
recreation/park plan (see attached).
The landscaping and recreation space improvements (i.e., play structures) must be installed
and inspected or a performance bond posted, prior to plat recording. An inspection fee is
also due prior to recording. This fee covers the cost ofan installation inspection and a

maintenance inspection. If a perfonnance bond is posted, the improvements must be
installed within one year's time from the posting date.
Please submit 5 copies of a revised recreation/park plan addressing the items mentioned

INSTRUCTIONS TO ENGINEER/APPLICANT: Engineering plan review for your submittal has been completed and ready
to be approved for construction after the fees shown above have been paid and Right-of-Way/Restoration financial
guarantees are posted. Please make checks for payment payable to the King County Office of Finance.
EXPLANATION OF FEES: Re-submittal review fees cover costs for additional engineering review hours after initial plan
review. Other fees may also be indicated that are past due.
Inspection fees, as authorized in Ordinance 13332, are based on a percentage of the estimated total average inspection
hours for your type of project. Actual hours spent on your project may be more of leas than the estimated hours depending
on the size, complexity, and site development problems you may encounter. As the applicant, you will be notified each
inonth of the financial status of this deposit and any inspection hours accrued during that one month period will be billed at
the current hourly rate. Payment shall be due within 15 days of mailing and the initial construction inspection fee deposit
. shall be maintained though the life of the project.
Failure to pay monthly bills and/or maintain the minimum deposit may result in delays in receiving final approvals, release
of any Financial Guarantee, suspension of requested inspections, code enforcement action, stop work and/or civil
penalties.
FINANCIAL GUARANTEES: The restoration surety(s) listed must also be submitted prior to approving plans for
construction. Up to $7,500 of the restoration guarantee must be a cash deposit or assignment as approved by DOES. The
remaining portion may be other forms of guarantees as so authorized. For subdivisions, the site improvement F .G. portion
is required prior to plat recording if plat improvements are not complete. This surety may also be in the form of cash, check
or other surety approved by the DOES. Surety amounts shown have been rounded down to the nearest $100.
MEETING REQUIREMENTS: After receiving plan approval, the applicant (representative) is required to contact the Land
Use Inspection Section at 296-6642 to schedule a pre-construction conference. Site clearing or other construction activity
on this project is prohibited until this meeting has occurred.

VIII. PRE-HEARING CONFERENCES
A. Purpose and Initiation

Pre-hearing conferences promote efficient case management by providing an informal
process for early identification of issues and resolution of procedural matters in
complex cases. Evidence generally will not be received at a pre-hearing conference,
except when required in order for the examiner to rule on a motion. (Pre-marking and
introduction of exhibits to which there is no objection may occur at the discretion of the
examiner.)
The examiner, on motion of any party or upon his/her own motion, may convene a pre-
hearing conference to:
I. Identify, clarify, limit or simplify issues.
2. Hear and consider pre-hearing motions.
3. Schedule hearings, identify parties and witnesses, determine the order of and
limits upon testimony, obtain stipulations as to facts and law, identify and
admit exhibits, order discovery, and consider and act upon any other matter
which may aid in the efficient disposition of the hearing.
B. Requests for Conference
A motion to convene a pre-hearing conference shall be made to the examiner as soon as
the need for a conference is recognized by the moving party (at least 21 days prior to
the scheduled hearing date), and shall state the reasons for the request, including any
motions to be presented. For good cause stated in the motion, the examiner may
consider a request that fails to meet the 21-day requirement.
For hearings authorized under KCC 20.24.080, a motion by any party for a pre-hearing
conference shall be granted if timely. However, unless consented to by all parties or
otherwise ordered for good cause by the examiner, no pre-hearing conference on an
appeal can be convened later than 45 days after receipt of the statement of appeal by the
hearing examiner's office.
C. Proceedings at Conference
A party who has received timely notice of a pre-hearing conference shall identify at the
conference any pre-hearing motions not previously made which he/she intends to make.
Parties or interested persons may also file timely written pre-hearing motions for
consideration at the pre-hearing conference. Failure to make or disclose a motion which
was available to the party at the time of the conference may be grounds for its denial if
subsequently made.
D. Pre-hearing Order
Following a pre-hearing conference, the examiner shall issue an order specifying all
items determined at the conference. The order shall be binding upon all parties and
interested persons who received timely notice of the conference.

CONCLUSIONS:
I. If approved subject to the conditions recommended below, the proposed subdivision will comply
with the goals and objectives of the King County Comprehensive Plan, Subdivision and Zoning
Codes, and other official land use controls and policies of King County.
2. If approved subject to the conditions recommended below, this proposed subdivision will make
appropriate provision for the public health, safety and general welfare and for open spaces, for
drainage ways, streets, other public ways, transit stops, potable water supply, sanitary wastes,
parks and recreations, playgrounds, schools and school grounds, and safe walking conditions for
students who only walk to school; and it will serve the public use and interest.
3. The conditions for final plat approval recommended below are in the public interest and are
reasonable requirements to mitigate the impacts of this development upon the environment.
4. The dedications of land or easements within and adjacent to the proposed plat, as recommended
by the conditions for final plat approval or as shown on the proposed preliminary plat submitted
by the applicant, are reasonable and necessary as a direct result of the development of this
proposed plat.
DECISION:
The proposed subdivision of Larson Parke, as revised and received on July 28, 1999, is granted
preliminary approval, subject to the following conditions of final plat approval:
I. Compliance with all platting provisions of Title 19 of the King County Code.
2. All persons having an ownership interest in the subject property shall sign on the face of the final
plat a dedication that includes the language set forth in King County Council Motion No. 5952.
3. The plat shall meet the base density of the R-8 zone classification. All lots shall meet the
minimum dimensional requirements of the R-8 zone classification or shall be generally as shown
On the face of the approved preliminary plat, whichever is larger. Minor revisions to the plat that
do not result in substantial changes may be approved at the discretion of the Department of
Development and Environmental Services.
4. The Applicant must obtain final approval from the King County Health Department.
5. All construction and upgrading of public and private roads shall be done in accordance with the
King County Road Standards established and adopted by Ordinance No. 11187, as amended.
6. The Applicant must obtain the approval of the King County Fire Protection Engineer for the
adequacy of the fire hydrant, water main, and fire flow standards of Chapter 17 .08 of the King
County Code.

7. Final plat approval shall require full compliance with drainage provisions set forth in King
County Code 9.04 and the storm drainage requirements and guidelines as established by the
Surface Water Management Division. Compliance may result in reducing the number and/or
location of lots as shown on the preliminary approved plat. The following conditions represent
portions of the Code and requirements and shall apply to all plats.
a. Drainage plans and analysis shall comply with the 1998 King County Surface Water
Design Manual. DOES approval of the drainage and roadway plans is required prior to
any construction.
b. Current standard plan notes and ESC notes, as established by DOES Engineering
Review, shall be shown on the engineering plans.
c. The following note shall be shown on the final recorded plat:
"All building downspouts, footing drains, and drains from all impervious surfaces such
as patios and driveways shall be connected to the permanent storm drain outlet as shown
on the approved construction drawings #_on file with DOES and/or the Department of

All connections of the drains must be constructed and approved prior to the final building
inspection approval. For those lots that are designated for individual lot infiltration
systems, the systems shall be constructed at the time of the building permit and shall
comply with plans n file."
8. The Applicant has received approval for the requested diversion of surface water within the
project (see Drainage Adjustment L99V0343). All conditions of approval for this adjustment
shall be met and shown on the engineering plans.
9. The design of the stormwater detention facility shall meet the Level 3 KCRTS Flow Control
Methodology, according to the 1998 KCSWDM. Other mitigation scenarios may be considered
according to Section 1.2.2.2 of the KCSWDM (Impact Mitigation).
Off-site drainage improvements are required to convey stormwater to the west across private
property to 112th Avenue Southeast, then south along the east side of 112th Avenue Southeast,
then west under 112th Avenue Southeast to an existing detention facility (Ruddells Pond). These
improvements shall be designed according to the 1998KCSWDM.
Permission for construction of off-site private property drainage improvements is required to be
submitted with engineering plans.
I 0. The proposed subdivision shall comply with the 1993 King County Road Standards (KCRS)
including the following required road improvements:
a. Southeast 183rd Court shall be improved to the urban minor access road standard.

b. The west right-of-way line for the north extension of existing 114th Avenue Southeast
shall extend to the north property line of the site.
c. Tract B shall be improved as a private access tract per Section 2.09 of the KCRS. Tract
B shall be dedicated to King County for access to the stormwater detention facility, with
an access/utility easement granted to Lots 12, 13 and 14. The easement shall be shown
on the engineering plans and final plat.
d. Modifications to the above road conditions may be considered pursuant to the variance
procedures in KCRS. 1.08.
11. KCC 16.82.150D requires seasonal limitations for construction within the Soos Creek
Community Planning Area. During the period from October 1, through March 31, clearing and
grading is not allowed unless certain provisions are complied with as outlined in the code. The
Applicant's engineering plans and construction procedures shall demonstrated compliance with
the applicable code requirements.
12. All utilities within proposed rights-of-way must be included within a franchise approved by the
King County Council prior to final plat recording.
13. The Applicant or subsequent owner shall comply with the King County Code 14.75, Mitigation
Payment System (MPS), by paying the required MPS fee and administration fee as determined by
the applicable fee ordinance. The Applicant has the option to either: (1) pay the MPS fee at final
plat recording, or (2) pay the MPS fee at the time of building permit issuance. If the first option
is chosen, the fee paid shall be the fee in effect at the time of plat application and a note shall be
placed on the face of the plat that reads, "All fees required by King County Code 14.75,
Mitigation Payment System (MPS), have been paid;" if the second option is chosen, the fee paid
shall be the amount in effect as of the date of building permit application.
14. Suitable recreation space and facilities shall be provided in Tract A consistent with the
requirements ofKCC 21A.14.180 and 190.
An overall conceptual recreation space plan shall be submitted for review and approval by
DOES, with the submittal of the engineering plans. This plan shall include location, area
calculations, dimensions, and general improvements. The approved engineering plans shall be
consistent with the overall conceptual plan.
A detailed recreation space plan (i.e., landscape specs, equipment specs, etc.) consistent with the
overall conceptual plan, shall be submitted for review and approval by DDES and King County
Parks prior to or concurrent with the submittal of the final plat documents.
A performance bond for recreation space improvements shall be posted prior to recording of the
plat.
15. A homeowner's association or other workable organization shall be established to the satisfaction
ofDDES to provide continued ownership of the recreation tract and its facilities; and
maintenance of the recreation facilities and associated landscaping, street trees, and walkway.

16. The following condition shall apply to implement the P-suffix conditions to this property:
S0-220 (Significant Trees): Significant trees shall be retained in a residential subdivision at the
rate of 20 trees per acre or ten percent of such trees, whichever is greater. A significant tree
inventory shall be submitted for review prior to or with submittal of development permit
applications. A detailed tree retention plan shall be submitted for review prior to or with
submittal of grading permit applications or other permit applications involving grading plans.
17. Lots within the Larson Parke subdivision are subject to King County Ordinance IO 162 and
Ordinance 12532, which imposed impact fees to fund school system improvements needed to
serve new development. As a condition of final approval, fifty percent (50%) of the impact fees
due for the plat shall be assessed and collected immediately prior to recording, using the fee
schedules in effect when the plat received final approval. The balance of the assessed fee shall
be allocated evenly to the dwelling units in the plat and shall be collected prior to building permit
issuance.

RE: Larson Parke Subdivision SWM Adjustment Request (File No. L99V0343)
Dear Applicant and Engineer:
The Land Use Services Division, Engineering Review Section, has completed revie"Y of the
adjustment request for the Larson Parke subdivision. You are requesting approval for an
adjustment from the 1998 King County Surface Water Design Manual (KCSWDM) Core
Requirement No. 1, Section 1.2.1, Discharge at the Natural Location. Our review of the ·
information and a site visit provides the following findings:
1. The proposed Larson Parke subdivision is located at I 14th Avenue SE and SE 183'd
Court. The 14 lot, 2.1 acre, proposed Larson Parke subdivision is filed under Land
Use Services Division (LUSD) file number L99P0003.
2. The Larson Parke subdivision is located in the Panther Creek subbasin of the Black
River basin. The parcel is subject to the Level One flow control and Basic water
quality requirements of the 1998 KCSWDM.
3. The rectangular shaped lot, with its longest length in an east/west direction, sheet
flows from east to west. In its present state with a single residence, sheet flow
leaves the site at the southwest property comer, travels west and enters a catch basin
on the east side of l l 2'h Avenue South. The flow then travels west under 112 1h
Avenue South and enters Ruddell's Pond. From Ruddell's Pond, flow travels via
piped conveyance northwest through the Maple Glen subdivision until reaching the
Maple Glen Regional Pond. At most, a half-acre of upstream flow enters the site
from the east.
4. The downstream drainage path has had historical flooding and conveyance
problems. In 1998 Capital Improvement Project (CIP) #OAL595 was constructed to
increase the volume ofRuddell's and Maple Glen Regional Ponds by 25% and
300%, respectively. No drainage complaints have been recorded since the ponds

and pipes have been upsized. Despite the recent impro\lements to the downstream
conveyance and retention ponds to reduce the downstream conveyance restriction, a
Phase II CIP has been defined to upgrade part of the conveyance system upstream of
Ruddell's Pond. It is believed that the Phase II project will complete the
improvements needed to fully remedy the flooding problem in the local vicinity.
5. The proposal is to collect most runoff from the project site and direct it to a single
detention and water quality facility located in the southwest comer of the site. The
allowed release would then be diverted from its natural discharge location and
utilize a drainage easement that travels west from the northwest comer of the site to
112'h Avenue SE and then south to the catch basin that allows flows to enter
Ruddell's Pond. Flows realign to their natural discharge path when they enter this
catch basin. Nuisance flows to the parcels west of the site would be eliminated.
6. The applicant's engineer has already explored an alternate route suggested by the
DDES adjustment committee for released flows to bypass Ruddell's Pond and enter
the drainage system on SE 183'd Court. The applicant's engineer believes that this
alternative route also has conveyance restrictions that would require an even greater
amount of improvements to correct. If the applicant's suggestion of crossing under
1121h Avenue SE is utilized, then the existing pipe capacity would be evaluated for
the additional 100-year, developed, undetained flows.
7. Despite the recent pond and conveyance upgrades through CIP #OA1595, there
remains concern for the capacity of the downstream system beyond the Meadow
Glen Regional pond. Because of these concerns, the applicant is offering to
increase the flow control standard used for the site from Level One to Level Two.
However, this suggestion assumes the completion of the Phase II CIP to rid the local
vicinity of its flooding problem. Because of the potential timing problem between
plat development and Phase II CIP improvements, other options exist. The
applicant could provide Level Three Flow Control on-site and ignore downstream
problems. The applicant could also provide some or all of the improvements
defined by the Phase II CIP. The applicant could also contribute to the Phase II
CIP.
8. No decorative ponds or shallow wells would be affected by the proposed diversion.
9. A consolidation of facilities for the proposed subdivision will be more economical
in long term maintenance.
Based on these findings, we hereby approve this adjustment to allow the diversion of
released flows around the downstream lots through piped conveyance with the following
conditions:
I. The release rates for the detention facility will be based on the land naturally
draining from the site in all directions. The allowed release rate will be reduced by

any undetained flows that would bypass the proposed subdivision drainage
facilities.
2. The volume for the detention facility will be based on all flows directed to the
facility at full development under current zoning. Th·e detention volume will be
sized using the methodology of the 1998 KCSWDM imp9sed through plat
conditions. A volumetric factor of safety of between 10 and 20 percent shall be
applied. The design Technical Information Report shall state the factor of safety
selected and the basis of that determination.
3. Water quality facilities must be sized based on the entire proposed subdivision
draining to the facilities including any required frontage improvements.
4. All onsite or offsite drainage facilities must be located in a public right-of-way or
storm drainage tract dedicated to King County.
5. Conveyance in a closed pipe system for the diversion route must be in accordance
with Core Requirement #4.
6. Additional storm drainage requirements identified by SEPA or the plat hearing
review will apply to this project.

A complete set of the original mylars (mylars with mat tac and/or shading will not be
accepted), photographic fixed line mylars or mylars printed on 4 mil, double matte mylar
film by a Xerox 8855 copier or equal are required. Record drawings shall be archival
quality and not easily erased or scratched. In addition, one (1) blue-line copy of the
complete construction plan set is required. All plans must reflect all Minor and Design
Plan Changes. The blue-lines must have all Minor and Design Plan Changes highlighted

Dear Mr. Daley:
I have reviewed your September 5, 2001 submittal and have the following Comments.
Please submit a recreation/park plan prepared by a qualified landscape architect
incorporating the following:
1. Additional landscaping (mix of trees, shrubs and groundcover) shall be added to the
recreation tract, Variety of species, size and location to be determined by the
landscape architect. The landscaping materials shall be placed in a way to create a
buffer separating public and private spaces. There shall be a minimum of 5-fDOt-
walkwayof concrete ( or other materials approved by DDES) from the access tract to
the play area.
2 .. One bench shall be located in the vicinity of the play structure. The exact location
is to be determined by the landscape architect.
3. The equipment (play structures, benches; etc.) shall meet, at a minimum, Consumer
Product Safety Standards and be appropriately anchored. Please provide
manufacturing specification for the play equipment, bench, arid picnic table.
4. The tot lot area shall be. a minimum of 400 square feet and not less than 20-feet in
width.
5 .. A Bound Quantity Worksheet (BQW) shall be prepared and submitted with the
recreation/park plan (see attached).
The landscaping and recreation space improvements (i.e., play structures) must be installed
and inspected or a performance bond posted, prior to plat recording. An inspection fee is
also due prior to recording. This fee covers the cost ofan installation inspection and a
maintenance inspection. If a performance bond is posted, the improvements must be
installed within one year's time from the posting date.
Please submit 5 copies of a revised recreation/park plan adc\ressing the items mentioned
