PROJECT DESCRIPTION: The applicant is requesting a Tier II Temporary Use
Permit in order to continue to temporarily site parking/storage for large vehicles, including large
trucks and buses. The site is 14,454 square feet in size. Along the north boundary of the
property there is a 6 -foot high chain link fence with curtain slats for the length of the property.
A Temporary Use Permit, for large vehicle temporary parking, was issued for the site on July 30,
2008 and expired on July 30, 2010 (LUA08-077, TP, ECL).
As part of the original Temporary Use Permit the applicant planted off-site landscaping to screen
the temporary parking area on the north side of the existing chain link fence. The offsite
landscaping consisted of a 4 -foot wide evergreen shrub line with beauty bark, on the abutting
property to the north also owned by Bryant Motors, Inc. Additionally, a 6 -foot high chain link
fence, along Meadow Ave N, was constructed as part of the original approval.
No grading, permanent structures, or other permenant improvements are included in the
proposal. The subject site is designated Commercial Arterial (CA) on the City's zoning map.
The following Tier II Temporary Use Permit is hereby approved and subject to the following
conditions:

CONDITIONS OF APPROVAL:
1) Access to the temporary parking area shall be restricted to the abutting alley only.
2) No bus or truck parking shall be allowed on the following streets: N 2nd Street, Bronson
Way N, and Meadow Ave N. Large vehicle parking, along the east side of Garden Ave N,
shall be restricted to a one hour maximum during business hours for Bryant Motors Inc.
Temporary large vehicle parking on weekends will be allowed on Garden Ave N; all
vehicles must be moved to the temporary storage area, by 9:00 am, on the following
business day.
3) The applicant shall continue to actively work with the City on redevelopment plans for
the entirety of the Bryant properties in the area, within reason considering annually
reviewed economic and market conditions. Within two years from the issuance of the
temporary use permit, the applicant shall submit to the City preliminary architectural
plans and redevelopment scenarios for the subject property that create the most
desirable and beneficial uses for the applicant, the neighborhood, and the City.
4) The applicant's compliance with the conditions mentioned above will be subject to the
review and approval of the Planning Division for the duration of the temporary use. If
conditions of approval are not met the Administrator may revoke the temporary use
permit upon ten (10) days' written notice, unless an emergency exists, in which case the
Administrator may declare such an emergency and immediately revoke the temporary
use permit.

by 5:00 p.m. on December 2, 2010. Appeals must be filed in writing, together with the required
fee to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA
98057. City of Renton Municipal Code Section 4-8-110 governs appeals to the Hearing
Examiner. Additional information regarding the appeal process may be obtained from the
Renton City Clerk's Office, (425) 430-6510.

• A Temporary Use Permit will be required
• Zoning designation of site is CA. Adjacent property zoning is CA
• Site is currently being used as large vehicle parking T.U_P 4 LUA08-077, TP,
ECF.
• There are no special site features
• Site currently is mostly a paved parking lot complete with "in ground" drains.
• Bryant Motors proposes to use the parking area for new and used trucks while
they are awaiting delivery to customers for the period allowed by the Temporary
Use Permit. This request is for an extension
• Access to the temporary parking will be restricted to the abutting alley only
• No plats will be requested at this time
• On the North boundary of the property a 6' high chain link fence is installed with
curtain slats in the chain links the entire width of the property, approximately
103'. On the North side of the chain link fence a 4' wide area Evergreen Shrub line
the entire length of the fence is planted complete with beauty bark. Additionally a
4' high chain fence is installed running North to South approximately 160' so as to
connect with Bryant Motors current fence along the edge of the sidewalk on
Meadow.
• No construction cost is involved
• No fill or other material will be required for this project. Approximately 40 shrubs
and miniature trees are planted along the Evergreen Shrub line
• There will not be any new lots created by this project
• There will be no job shacks or trailers of any kind used for this project.

This agreement is made by and between the City of Renton, Washington, a municipal corporation of the State
of Washington ("City") and 1161,4 ow AioV6i25 T..r [� _ ("Owners").
Recitals
The Owners own real property in the City legally described in Exhibit A, attached.
The Owners have submitted an application for building permit(s) and/or a Temporary Use Permit to construct
model homes on the real property prior to recording of a short plat or final plat. Since changes to the short plat
or final plat may be necessary after construction of the model homes rendering the homes illegal, there is some
risk in building the model homes.
In consideration of the inherent risks associated with the construction of buildings in advance of the recording of
the plat, the City requires the owner to execute an indemnification agreement prior to any model home
construction activities.
Agreement
The parties agree to the following:
1. The City authorizes the Owners to do the work as described in the Temporary Use Permit application
No. once building permits have been obtained.
2. The owners assume the risk that the model home(s) must be removed or reconfigured and therefore
release and discharge the City and its representatives from all known and unknown losses, Bairns,
damages or causes of actions which the owners have or may have relating to buildings or structures
authorized by the Temporary Use Permit.
3. As a condition of granting Owner permission to construct model homes, Owner agrees to indemnify,
defend and hold the City of Renton Harmless from any claims or liens that may be exerted against the
property as a result of construction of model homes and use of the unrecorded plat of
4. Owners understand and acknowledge that, should the model home construction not comply with the
proposed lot configuration of the final plat, that no variances to development standards for either the
lots or the homes may be granted as such a situation would be considered a "self-induced hardship".
5. Owners acknowledge that they understand that any construction begun prior to the recording of the final
plat must be in compliance with all City zoning and subdivision requirements (e.g. setbacks, lot
coverage, etc.) or removed prior to recording of the final plat. If the final plat is not recorded prior to the
expiration of the Temporary Use Permit, Owners acknowledge that the homes must be removed unless
complying with all applicable code requirements (e.g. one home per lot, etc.).
6. Applicant will also provide an Abatement Agreement and a security device acceptable to the City to
ensure removal of any structures not in compliance with City regulations at the time of expiration of the
Temporary Use Permit and understands construction of the model homes is at Owners' own risk.
7. The provisions of this agreement shall bind the parties, their legal heirs, representatives, successors
and assigns and shall expire upon the recording of the final plat of
