proposes to replace the bulk fuel secondary
containment system and primary fuel piping at the
Black River Pump Station. The facility was constructed
in 1969 to prevent flooding. It includes a concrete
dam and pump house with eight flood control pumps
and seven 270-gallon interior aboveground storage
tanks in the pump house, three 16,900 gallon
aboveground diesel fuel storage tanks, 100 I.f. of
buried steel fuel transfer piping, and a control building
with a standby generator and small day tank. The
proposed facilities include replacing the existing

temporary containment berm (that was installed in
response to a spill event in 2005) with a new 64,600
gallon concrete containment wall (30-inches in height);
replacing the existing fuel transfer pump, piping and
valves inside the existing berm; cleaning and recoating
of the exterior of the three aboveground storage
tanks; and replacement ofthe buried steel fuel
transfer pipe with a double-wall pipe from the
containment area to the pump building.

An exemption from a Shoreline Management Substantial Development Permit is hereby granted
on the proposed project in accordance with RMC4-9-190C. Exemptions from Permit System
and/or for the following reason(s):
3. Maintenance and Repair: Normal maintenance or repair of existing structures or
developments, including damage by accident, fire or elements.
a. "Normal maintenance" includes those usual acts to prevent a decline, lapse, or
cessation from a lawfully established condition.
b. "Normal repair" means to restore a development to a state comparable to its
original condition, including but not limited to its size, shape, configuration, location
and external appearance, within a reasonable period after decay or partial
destruction, except where repair causes substantial adverse effects to the shoreline
resource or environment.
c. Replacement of a structure or development may be authorized as repair where
such replacement is the common method of repair for the type of structure or
development and the replacement structure or development is comparable to the
original structure or development including, but not limited to, its size, shape,
configuration, location and external appearance and the replacement does not cause
. substantial adverse effects to shoreline resources or environment.

Background:
The Black River Pump Station is a flood prevention station located in the City of Renton at 550 Monster Road
SW. The facility was built in 1969 and includes a concrete dam and pump house set across the Black River
Channel, eight flood control pumps and seven 270 gallon interior aboveground storage (day) tanks in the pump
house, three 16,900 gallon outdoor aboveground diesel fuel storage tanks, approximately 100 linear feet of buried
steel fuel transfer piping, and a control building with a standby generator and small day tank. The recent diesel
fuel spills at the station prompted a station evaluation, from which several critical upgrades were identified. The
work associated with this project is a result of the deficiencies identified in the fuel transfer and containment
system.
Project Scope:
New Facilities include
o The exiting temporary containment berm that was installed in response to a 2005 spill will be replaced
with a new 64,600 gallon concrete containment wall. Interior height of the containment walls will be 30
inches tall.
o The existing fuel transfer pump, piping, and valves inside the existing berm will be replaced.
o The exterior of the three aboveground storage tanks will be cleaned and recoated.
o The buried steel fuel transfer pipe will be replaced with buried double wall pipe from the containment
area to the pump building.

is exempt from SEPA. See below for my request for concurrence from the City of Renton and their

Yes, City of Renton concurs with your determination that the proposal to replace the bulk fuel secondary

SEPA per WAC 197-11-800 (3). The project does require a Shoreline Exemption from City of Renton.

Jennifer,
As I believe you are aware, King County, at the direction of the Renton Fire Department, is moving
quickly toward the replacement of the bulk fuel secondary containment system and primary fuel piping
at the Black River Pump station. We have hired Parametrix to do the design work and most of the
permitting so you can expect them to contact you soon if they have not done so already. However, if we
are required to prepare a SEPA checklist and determination for this project, we prefer to handle these
products in-house at King County.
After reviewing WAC 197-11-800 I believe that this project is categorically exempt from SEPA. WAC 197-
11-800 (3) describes categorical exemptions and includes remodeling of public structures that involve no
material expansions or changes in use beyond that previously existing. The proposed project includes
only replacement of existing structures (containment berm) and equipment (underground fuel pipe) so
there is no change in previously existing use. The project will not include any work in lands covered by
water.
We have not completed our design yet;, however there is a chance that the footprint of the secondary
containment berm will change slightly as we move from an oval shaped earthen berm to a rectangular
concrete structure. We believe that this potential small change in footprint is not significant enough to
trigger the SEPA process.
The purpose of this e-mail is to determine whether the City of Renton concurs with our interpretation
that this project is categorically exempt. If we do need to go through the SEPA process for this project
we need to know as soon as possible so that we can get started. Please call if you need additional

In the body of this email-below -is a photo of the site vicinity. The three white tanks are sitting out in
front along Monster Road.
Attached is a photo showing the existing berm system around the tanks.
The proposal is to -
1) Replace the existing berm system with a new 3' high concrete wall and a new concrete slab-
leaving the tanks in place
2) Replacing the existing single wall piping with double wall piping. New parallel trenches would
be dug and pipes installed. The old pipes would be abandoned in place.
We would like to think it meets the definition of "maintenance and repair" per the highlighted text
below -but of course it is your call.

diesel drive pump has its own 270 gallon diesel storage day tank. Just south of the mechanical building is
a control building which houses all the electrical equipment and a diesel generator. The fuel piping
between the three large tanks and the buildings is all underground and single wall pipe. The goal for this
project is to provide secondary containment everywhere and bring the station into compliance with
current codes. We will be
replacing all the underground piping with dual walled pipe,
constructing a large concrete berm around the three large storage tanks, and
upgrading the control/monitoring equipment.
