The applicant, King County Department of Elections, is requesting approval of an Administrative
Sign Variance from RMC 4-4-100C.9 in order to locate a sign within the right-of-way along the
frontage of their site. The variance would allow the applicant to site their 8-foot monument sign
on the north side of the property line within the right-of-way. The proposed sign would be located
no more than 6 feet, the width of the sign, into the public right-of-way approximately 10 feet from
the back of the sidewalk and 17 feet from the improved street.
Signs on public right-of-way other than real estate kiosk signs, temporary and portable signs, City
sponsored signs, public service signs, and safety information signs are prohibited. Therefore, an
administrative variance is needed in order to site the monument sign at the proposed location.
The proposed sign would be approximately 45 square feet in area and would be internally
illuminated. The site is located on the south side of SW Grady Way where Powell Ave SW
intersects at 919 SW Grady Way. The subject site is approximately 4 acres in area and is located
within the Commercial Office (CO) zoning classification.

I D. FINDINGS:
Having reviewed the written record in the matter, the City now makes and enters the following:
1. Request: The applicant has requested approval of an Administrative Variance from the
prohibition of signage within the right-of-way (RMC 4-4-100C.9). The request is to site a 45
square foot freestanding ground-related monument sign approximately 17 feet from the
improved street right on the north side of the subject property's north property line within the
right-of-way. The proposed project is located at 919 SW Grady Way.
2. Administrative Variance: The applicant's submittal materials comply with the requirements
necessary to process the administrative variance. The applicant's site plan and other project
drawings are provided as Exhibits 2-4

4. Zoning: The site is located within the Commercial Office (CO) zoning classification.
I E. CONSISTENCY WITH VARIANCE CRITERIA:
Section 4-9-2508.5.0. Lists 4 criteria that the Planning Director is asked to consider, along with 01/
other relevant information, in making a decision on an Administrative Variance application. These
include the fol/owing:
The Planning Director shall have authority to grant an administrative variance upon making a
determination, in writing, that the conditions specified below have been found to exist:
a. That the applicant suffers undue hardship and the variance is necessary because of special
circumstances applicable to subject property, including size, shape, topography, location or
surroundings of the subject property, and the strict application of the Zoning Code is found
to deprive subject property owner of rights and privileges enjoyed by other property owners
in the vicinity and under identical zone classification:
The applicant contends that the variance is necessary due to the location of the office building
and visibility along the high-traffic corridor of SW Grady Way. The building is oriented towards
the parking lot and in large part not visible due to the street trees which are located along the
front of the site. The applicant contends that due to the lack of visibility from the street, it is
vital that the sign be closer to the street to allow better visibility in both the northbound and
southbound directions.
Staff concurs that the location of the structure and location of existing street trees prohibit
visibility from the main arterial (SW Grady Way). Staff agrees that the sign would be more
visible closer to the street.
b. That the granting of the variance will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity and zone in which subject property
is situated:
The applicant stated that there will be no impacts to the property or public welfare by granting
the variance request. Historically a 6-foot x 6-foot sign, identifying an adjacent medical office,
was located in the exact location of the proposed sign. The sign was set far enough back from
the street and sidewalk as to not interfere with vehicular traffic or sight distance.
Staff has reviewed the applicant's proposal to locate the proposed sign within the public right-
of-way and has determined it would not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity and the zone in which the property is
situated based on the scale of the proposed sign. Although the permitted signage within the
CO zone allows a much larger sign, the applicant has limited their sign to a 45 square foot sign
to be no taller than 8 feet above grade.

The applicant contends that other signs of similar quality, size and location are located along
the SW Grady corridor. The applicant contends that approval of the proposed setback variance
would not constitute a grant of special privilege inconsistent with the limitation upon uses of
other properties in the vicinity and zoning designation.
Staff concurs that the granting of the variance would not constitute a grant of special privilege
inconsistent with other incidences of similar nature within the same zoning classification and
vicinity.
d. That the approval as determined by the Planning Director is a minimum variance that will
accomplish the desired purpose:
The applicant contends the location of the proposed sign age on the north side of the north
property line, within the right-of-way, would be the minimum required to locate the sign in the
same view location as the similar signs within the surrounding area.
Staff reviewed the variance request and concludes that the proposed location of the signage
would be the minimum required variance to enjoy the same privileges as other similar signs in
vicinity.
i F. CONCLUSIONS:
1. The subject site is located at 919 SW Grady Way, within the Commercial Office (CO) zoning
classification.
2. The CO Zone allows an ori-site freestanding ground-related monument sign. The applicant is
proposing a freestanding ground-related sign which is located offsite, north of the property
line, within the right-of-way as depicted on Exhibit 2.
3. The analysis of the proposal according to variance criteria is found in the body of the Staff
Report.
4. The proposed sign height variance meets the four criteria to be considered in making a
decision on a variance request as specified in RMC 4-9-2S0BS.a. SpeCial circumstances apply to
the subject site which impose undue limitations on the property; the granting of the variance
will not be materially detrimental to the public welfare or injurious to the property or
improvements in the vicinity and zone in which the subject property is situated; the granting of
the variance does not constitute a grant of special privilege inconsistent with the limitation
upon the use of other properties in the vicinity and zone in which the subject property is
located; and the approval of the variance request would be the minimum ·variance necessary
to accomplish the desired purpose.

The administrative land use decision will become final if the decision is not appealed within 14 days of
the effective date of decision.
APPEAL: This administrative land use decision will become final if not appealed in writing to the
Hearing Examiner on or before 5:00 PM on December 23, 2011. An appeal of the decision must be
filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Appeals to the
Examiner are governed by City of Renton Municipal Code Section 4-8-110. Additional information
regarding the appeal process may be obtained from the Renton City Clerk's office, Renton City Hall-
7th Floor, (425) 430-6510. Appeals must be filed in writing. together with the required fee to the
Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057.
RECONSIDERATION: Within 14 days of the effective date of decision, any party may request that the
decision be reopened by the approval body. The approval body may modify his decision if material
evidence not readily discoverable prior to the original decision is found or if he finds there was
misrepresentation of fact. After review of the reconsideration request, if the approval body finds
sufficient evidence to amend the original decision, there will be no further extension of the appeal

one (1) year extension may be requested pursuant to RMC 4-9-250B_17.
THE APPEARANCE OF FAIRNESS DOCTRINE: provides that no ex parte (private one-on-one)
communications may occur concerning the land use decision. The Doctrine applies not only to the
initial decision,but to Appeals to the Hearing Examiner as well. All communications after the
decision/approval date must be made in writing through the Hearing Examiner. All communications
are public record and this permits all interested parties to know the contents of the communication

located along SW Grady Way at the entrance to King County Elections. It will be set back approximately
17' from the street and be situated on a downward slope adjacent to a row of street trees. The sign will
be no higher than eight feet above grade (as measued from the slope). Sign materials are aluminum
and acrylic with a concrete base.

King County Elections headquarters Is located on the south side of SW Grady Way. We will be placing a
building-mounted sign at the top of the south facing wall which is intended to serve more or less as a
"landmark" -so people know where we are when driving by on 1-405. We would like to add a freestand-
Ing 10 sign at the main entrance drive which would be visible to vehicular traffic. At eight feet In height,
this sign will exceed the six foot height limitations of the City of Renton sign code. Following are the
reasons for this variance request:
As a governmental agency, the King County Elections headquarters differs from private enterprise In
many ways. We represent all citizens of King County and have a responsibility to serve them well. Being
constantly in the public eye, any action we take or Image we create -such as building slgnage -Is vitally
Important to the people we serve. We want people to be able to find us when they need to.
We are a regional facility that serves people from all over King County. People who come here are most
likely unfamiliar with the area so ciear Identification of our facility is therefore more essential. The
wall-mounted sign visible from 1-405 will help Identify the vicinity of the building but without a highly
visible sign at the entrance from Grady Way, the building could easily be missed. The speed limit on
Grady Way is higher than that of other nearby city streets and, with its five lanes and substantial fast
moving traffic, a newcomer looking for an unfamiliar address could be confused. Additionally, there is a
traffic light at the entrance to our site that also demands attention by a driver. Although our building is
quite large, it Is difficult to see because of the street trees lining Grady Way.
There are other signs along Grady Way that are much larger than our proposed sign, such as that of the
Cummins Building just to the east of our site. Although it is most likely not in the public right-of-way, it Is
nonetheless huge In comparison to our sign. They were able to construct such a sign In part because of
the openness of their site (no street trees, etc.).
Until recently, there was six foot wide by six foot high sign identifying an adjacent medical office. It was
evident from that sign, which was in the exact location of our proposed sign, that it was set far enough
back from the street and sidewalk so as not to interfere with vehicular traffic entering or exiting the site.
We believe the best way to meet our objectives Is with a larger sign than Is currently allowed. Our
proposed sign will be approximately eight feet high (above sloped grade) and six feet wide and will be
positioned approximately 10 feet in from the building side of the sidewalk (±17 feet from the outer edge
ofthe curb). Although it exceeds the six foot height requirement for such signs, we believe it sets nicely
in the space and Is a nice transition between the sidewalk and the street trees. Without these trees, the
need for a larger sign would not be as critical since one could more easily see the building and the
wall-mounted sign however, we have no desire to remove any trees and would rather fit the sign into
the existing landscape.
We believe this Is the minimum variance that will provide effective identification of our site entrance.
