PROJECT DESCRIPTION & ANALYSIS: The applicant is requesting approval of an
Administrative Special Fence Permit for a 6 -foot high cedar fence along the rear property line
within the side yard setback along a street in the Residential - 8 dwelling units per acre (R-8)
zone (Exhibit 1). The proposed fence would extend along the rear property line to 5 -feet east
of the easterly side property line.
Fence materials would include 1"x4" or 1"x6" cedar boards and pressure treated 4"x4" posts
with cedar post caps (Exhibit 2). The fence posts would be placed at a minimum every 4 feet
and a maximum of 8 feet.
Renton Municipal Code (RMC 4-4-040D.2.d) allows fences with a maximum height of 72 inches
(6 feet) along the rear property line except the fence shall be limited to 48 inches (4 feet) in
height where it intersects the width of the required side yard setback of the side street. The
side yard setback along a street in the R-8 zone is 15 feet; the applicant proposes to construct a
6 -foot rear yard fence which encroaches 10 feet into the side yard setback along the street
(Elma Place NE).

The applicant states the purpose of the proposed fence is for privacy. The subject site is
located in a developing neighborhood and is one of four lots in a unique "island" surrounded by
streets (Exhibit 3). Because each of these four lots have driveways which access the garages
from the front yards (along NE 3rd Place and NE 2nd Place), no sight distance issues would be
encountered as a result of the proposed rear yard fence. An existing sidewalk abuts the
property.
The submitted site plan (Exhibit 4) indicates the location of the proposed fence. Staff
recommends approval of the Lozier at Laurel Crest Special Fence Permit, LUA11-093, SF, as
proposed.

ADVISORY NOTE: The applicant should contact the Utility Notification Center, by dialing 800-

electric), which may be located behind the sidewalk.
APPEALS: Appeals of permit issuance must be filed with the City of Renton Hearing Examiner
by 5:00 p.m. on December 23, 2011. Appeals must be filed in writing, together with the
required fee to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way,
Renton, WA 98057. City of Renton Municipal Cotte Section 4-8-110 governs appeals to the
Hearing Examiner. Additional information regarding the appeal process may be obtained from
the Renton City Clerk's Office, (425) 430-6510.
RECONSIDERATION: Within 14 days of the decision date, any party may request that the
decision be reopened by the approval body. The approval body may modify his decision if
material evidence not readily discoverable prior to the original decision is found or if he finds
there was misrepresentation of fact. After review of the reconsideration request, if the
approval body finds sufficient evidence to amend the original decision, there will be no further
extension of the appeal period. Any person wishing to take further action must file a formal
appeal within the 14 -day appeal time frame.

Dear Sir/Madam,
It is our desire to construct a permanent cedar 6' fence at the rear property line of Lot 23
at Laurel Crest. This fence will be facing south into the rear of the future home on lot 24
which is directly behind lot 23. The fence would extend into the 15' setback line on the
side yard of the property by 10', will be 5' off the sidewalk and is similar in design and
material to the other approved fences located in the development. The purpose of the
fence is to provide privacy to the rear yards of these two lots. We feel this maintains a
consistent application of the look and feel of the community.
