UTILITIES EASEMENT
Grantor, King County Water District #90, a Municipal Corporation , for and in
consideration of mutual benefits, does by these presents, grants, bargains, sells,
conveys, and warrants to the same extent and purposes as if the rights granted had
been acquired under the laws of eminent domain of the State of Washington, unto
the City of Renton, a Municipal Corporation, its successors and assigns, an
easement for municipal utilities (including but not limited to water, wastewater,
surface water, and for public traffic signal, illumination, communication systems), and
also for utilities with franchise agreements with the City of Renton (including but not
limited to natural gas, telephone, cable, fiber optic), with necessary appurtenances

over, under, through, across and upon the following described property (the right-of-
way) in King County, Washington, more particularly described as follows:
SEE EXHIBIT A, AND AS DEPICTED IN EXHIBIT B ATTACHED
HERETO AND MADE A PART HEREOF BY THIS REFERENCE
for the purpose of constructing, reconstructing, installing, repairing, replacing,
enlarging, operating and maintaining utilities and utility pipelines, including, but not
limited to, traffic signal, illumination, communication systems, fiber optics and water,
sewer and storm drainage lines, together with the right of ingress and egress thereto
without prior institution of any suit or proceedings of law and without incurring any
legal obligation or liability therefor. Following the initial construction of its facilities,
Grantee may from time to time construct such additional facilities as it may require.
This easement is granted subject to the following terms and conditions:
1. The Grantee shall, upon completion of any work within the property
covered by the easement, restore the surface of the easement, and any private
improvements disturbed or destroyed during execution of the work, as nearly as
practicable to the condition they were in immediately before commencement of the
work or entry by the Grantee.
2. Grantor shall retain the right to use the surface of the easement as long as
such use does not interfere with the easement rights granted to the Grantee.
Grantor shall not, however, have the right to:
1. Erect or maintain any buildings or structures within the easement; or
2. Plant trees, shrubs or vegetation having deep root patterns which may
cause damage to or interfere with the utilities to be placed within the easement by
the Grantee; or
3. Develop, landscape, or beautify the easement area in any way which
would unreasonably increase the costs to the Grantee of restoring the easement
area and any private improvements therein; or
4. Dig, tunnel or perform other forms of construction activities on the property
which would disturb the compaction or unearth Grantee's facilities on the right-of-
way, or endanger the lateral support facilities; or
5. Blast within fifteen (15) feet of the right-of-way.

This easement shall run with the land described herein, and shall be binding upon
the parties, their heirs, successors in interest and assigns. Grantor covenants that
he/she is the lawful owner of the above property and that helshe has a good and
lawful right to execute this agreement.
By this conveyance, Grantor will warrant and defend the sale hereby made unto the
Grantee against all and every person or persons, whomsoever, lawfully claiming or to
claim the same. This conveyance shall bind the heirs, executors, administrators and
assigns forever.

if the rights granted had been acquired under the Eminent Domain Statute of the
State of Washington, unto the City of Renton, a Municipal Corporation, Grantee
herein, its successors and assigns, permission to use for public purposes a
temporary construction easement, with necessary appurtenances over, under,
through, across and upon the following described real estate, for Right -of -Way
purposes, situated in the County of King, State of Washington:

For the purpose of constructing the planned project improvements associated with
the NE 3`d/41h Corridor Improvements: Phase 1, Project.
The Grantee will provide continuous access to the remaining portion of the site
throughout construction. The Grantee shall, upon completion of any work within the
property covered by the agreement, restore the surface of the construction site, and
any private improvements disturbed or destroyed during execution of the work, as
nearly as practicable to the condition they were in immediately before
commencement of the work or entry by the Grantee except where modified by the
project plans and specifications.
This temporary construction easement shall become effective upon execution by the
Grantor from date hereof and shall continue for two (2) years.

The City of Renton has finished reviewing your proposed lot line adjustment and is now ready
to approve and send the final version for recording. Please submit two sets of original signed
molars and a check for $15.81 made out to Champion Couriers to my attention at. the sixth
floor counter of City Hall.
Please verify that the mylars have been signed by all owners of record and have been notarized
with an ink stamp (not embossed). The ink stamp must be legible so that King County will
promptly record the lot line adjustment.
This decision to approve the proposed lot line adjustment is subject to a fourteen (14) day
appeal period from the date of this letter. Any appeals of the administrative decision must be
filed with the City of Renton Hearing Examiner by 5:00 pm, February 10, 2012.
Appeals must be filed in writing together with the required fee with: Hearing Examiner, City of
Renton, 1055 South Grady Way, Renton, WA 98057. Appeals to the Examiner are governed by
City of Renton Municipal Code Section 4-8-110. Additional information regarding the appeal

SUBJECT: NE 3rd/4tf' Corridor Improvements: Phase 1 Intersection Improvements
LLA Project Narrative and Project Billing Number
The subject project is currently under design in the Transportation Division. The project
will signalize the intersection of NE 4th Street and Whitman Ave NE. The U.S. Post Office
is located on the southeast corner of this intersection and Safeway is located on the
north side of this intersection. Additional improvements will be made on NE 4th Street
and Whitman Ave NE to accommodate and complement the signal project.
The purpose of the project is to improve traffic operations and safety in the project
vicinity through signalization, rechannelization, and streetscape enhancements. The
project supports the NE 3rd/4th Corridor Improvement Study, adopted in 2005 by the
City Council. The project is funded by the Transportation Improvement Board (TIB) with
local matching dollars provided bythe City.
In order to accommodate the north leg of the traffic signal, the driveway into Safeway
requires additional width. This width could not be acquired from the east side of the
driveway due to the gas station and because the driveway would not align with
Whitman Ave NE. Therefore, the Safeway driveway requires widening to the west onto
King County Water District (KCWD) #90 property.
The KCWD was willing to give up property along the Safeway driveway in exchange for
an equal area of property from Safeway on the north side of the KCWD property. The
Safeway driveway is and will remain property of Safeway.
In recognition of the benefits of the project to them and the public, both Safeway and
the KCWD are willing to execute the subject Lot Line Application (LLA) for the project.
The Transportation Division is initiating the LLA for the benefit of the project; however,
the signees are the KCWD and Safeway, both private entities.
Attached is also an Interdepartmental Fund Transfer for this LLA application.
