Dear Mr. Hughes, This office is in receipt of your request, dated April 22, 2012; in which you requested reconsideration for the denial of your Special Fence Permit application made on April 13, 2012. It appears the request is for the City to allow fencing above 48-inches in the front yard setback with clarifications about your original application. Your letter states that part of the fence in the front yard setback will be no more than 48-inches in height where the yard is already 2 feet above the sidewalk and the rest ofthe fence parallel to Edmonds Ave NE in the front yard setback would be 6 feet. Following the review ofthe additional information you have provided and the ornamental planting examples that would be placed in front of the fence towards Edmonds Ave NE and public view, we have revisited the original denial of your application. Therefore, staff concurs that the applicant's request should be granted and that the Special Fence Permit will be approved with conditions outlined below. DECISION The requested reconsideration has been evaluated and based on staff review, the Special Fence Permit application is approved subject to the following Conditions of Approval: I May 21, 2012 Page 2 Where the fence in the front yard setback is above the maximum allowed height of 48-inches, all three conditions must be met: 1. Any fencing above the allowed maximum of 48-inch height in the front yard setback along a street in the R-8 zone shall be set back a minimum of 5 feet from the property line along the public street with additional landscaping being added. 2. Vegetation must be provided in view from the sidewalk along the whole length of the fence where it is above 48 inches, except for the driveway area where plantings would not work, and the vegetation plantings must grow to a minimum mature height of 2 feet. 3. Prior to installation of the fence, a basic landscaping plan shall be provided to the Planning Division Project Manager for review and approval with a list of the vegetation to be installed, size of the proposed plants at planting and maturity, and where it will be located. 4. The applicant shall within 90 days of this approval call the Project Manager at (425) 430-6593 for an inspection of installed landscaping. Therefore, the fence is approved, subject to conditions 1-4 above. This administrative land use decision will become final if not appealed in writing to the Hearing Examiner on or before 5:00 p.m. on June 4, 2012. Appeals to the Examiner are governed by City of Renton Municipal Code Section 4-8-110. Additional information regarding the appeal process may be obtained from the Renton City Clerk's Office, (425) 430-6510. Appeals must be filed in writing, together with the $250 appeal fee to: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057. I'm writing this to clarify my original application and asking you to reconsider it in light of below. Design Clarification: 1. About one-half of the property (to the north) is elevated 2 feet from the street level, as seen in Exhibit 1. 2. I would like to install4-feet fence on that north portion of our property, per city guidelines. 3. I would like to install6-feet (or lower) fence in the remainder of the front yard in order to make the front yard fence even and aesthetically pleasing. Otherwise, one portion of the fence will be 6-foot from the street level, while the other one will be only 4-feet 4. Permanent landscaping will be applied. I will plant evergreen Thuja accldentalis 'Emerald Smaragd' or similar every 5 foot for the length of the front yard fence. Evaluation Criteria: 1. 'limits blank walls along walkway': In the original application I specifically stated that 'Decorative Bushes / Plants (evergreen)' will be used to limit 'blank walls'. As mentioned in Design Clarification #4 above, Thuja evergreens will be planted for the length of the fence. 2. 'Aesthetically Pleasing: Although criteria is very subjective, I firmly believe that using quality materials, having an even-height fence, and planting Thuja evergreens in front of the fence will make it aesthetically pleasing. 3. 'In scale with neighborhood': I agree that adjacent houses don't have fences. However, using this logic, 6-feet fences will never be erected on the street because no neighbor would have one. Nevertheless, this is clearly not the case. Exhibit 2 shows four properties on 27'" St. NE (which becomes Edmonds Ave NE). All of these properties are less than half-a-mile from the house in question. All of these properties have similar fences to what I'm planning to erect. Only " , few of the fences have perennial improvement applied to them. And none of them are 'in scale with neighborhood'. On one hand, if there's a legitimate reason for these fences that doesn't apply to mine, I would like this explained to me in order to avoid a misperception that city of Renton does not treat its residents fairly and equally. On the other hand, if these fences are illegal, I would like the city to apply the rule of law equally to all taxpaying citizens. Thank you very much for your consideration. I hope I provided enough evidence that the fence will look aesthetically pleasing, limit blank walls along walkway, and be in scale with neighborhood (if 'neighborhood' can be extended to less than 0.5 mile distance from the house).
