Additionally, the construction had to stop as the applicant "neglected to realize that it would put the fence posts through the drainage area of the new [retention] wall, and it would be outside of our property line" (Exhibit 5). Renton Municipal Code (RMC 4-4-040D.2.d) limits fences to a maximum height of 48 inches (4 feet) where it intersects the width ofthe required side yard setback along a street. The side yard setback along a street in the R-8 zone is 15 feet; the applicant proposes to construct a fence at a height of 72 inches (6 feet) within the side yard setback at 137 feet in length. The proposed fence encroaches 14 feet into the R-8 zone side yard setback along the street of Monterey Avenue NE. The applicant proposes to have landscaping placed between the top of the retention wall and fence (Exhibit 2 and Exhibit 4). As listed in on the Special Fence Permit Application, the landscaping to be installed is a mix of beauty bark, Columnar Sky Pencils (llex Crenata) in front of every fourth post, ground cover plants and/or decorative grasses that are permanent, between the top of the retention wall and where the fence is installed 1-foot into the site from the property line (Exhibit 6). This landscaping would be within public view from the street and sidewalk, in front of the proposed fence. No fencing is proposed within the Clear Vision Area at the corner of the property where NE 20 th Street and Monterey Avenue NE intersect. City staff made a site visit to the applicant's property on April 24, 2012 and took photos of the general location for the proposed fence (Exhibit 7). 'j J , l i I i , i ) I I i I I I I IEXHISIl :i April 2, 2012 , of Renton Ining Division R-62D12 Dear City of Renton Planning Division, lPJ~rt;~UW'~ 0 My husband and I are requesting a Special Fence Permit in order to install a fence on the west side fffJ our property located at 2001 NE 20th Street, Renton WA 98506. This is part of a project to repair a faulty rockery that used to be On the west side, and provide a safer, more aesthetically pleasing neighborhood environment. This project actually was initiated in 2006. In 2006, the City of Renton agreed to replace the rockery on the west side of our property. In order to replace it and build a proper wall, our holly trees and our dogwood tree had to be cut down. We agreed to lose our trees in order to create a safer environment. The rocks had been falling out of the rockery and landing on the sidewalk below and kids were climbing on the wall as well, which was bad. We agreed to have the trees removed. There were, I believe, eleven holly trees and one dogwood tree that was cut down. The holly trees were old growth, I'm estimating 30 to 40 feet tall, and ran the length of our western border from North to South and stopped just south of the existing city trees on our north side. (You can see on the detail drawing where the existing trees planted by the City of Renton still stand.) Because our property is situated on a hill, visibility was never an issue with the old growth trees, and in all the years I have lived at this address, I have never seen an accident at this corner. Now that these trees are gone, we have lost the privacy that our trees provided and lost the sunscreen that protected us from the hot afternoon sun beating down from the west. We have always used the west side of our home as our "back yard" as the layout of our property doesn't provide us anywhere else to use for recreation. This is where we have always had our patio. The trees we used to have acted as a natural privacy screen. Now that they are gone, we are wide open to the street. Not only does a four foot fence not provide privacy or protect us from the hot afternoon sun, it also doesn't hide anything we own that we keep in our patio area. Our barbecue grill, table and chairs, and everything else we kept in our "back yard" are now wide open for view and close enough to the street to grab and run away with. We would like to regain some privacy and security. The fence we would like to install is 6 feet high, much shorter than the trees were. Even with a six foot fence, the area is more open than it has ever been (at least since I've known it since 1963). The retaining wall sits 4 feet tall, and our property is pretty much level with that, so without the trees it's almost like we're up on a stage. One of our neighbors lives in a Split-Level, so a 4 foot fence doesn't do much. Even with the 6' fence, visibility is very clear and does not pose a problem and our highest neighbors can still see in, but the general public can't stare up at us. Again, because of the elevation of our property, visibility wasn't a problem with the prior trees and absolutely will not be with the new fence. The fence will stop at the north end of the retaining wall. We have no intention of installing anything else north of the retaining wall in the clear visibility area. This fence is not in that zone. Also, we now have a new issue with the safety of the retaining wall. Some of the neighborhood children like to walk the retaining wall as if it were a balance beam. Because of my concerns regarding safety, we decided to place the fence against the retaining wall thinking it wouldn't leave room for someone to climb along the top of the wall and fall off. We neglected to realize that it would put the fence posts through the drainage area of the new wall, and it would be outside of our property line. We have gone back to our original idea of placing the fence two feet to the east from the east edge of the retaining wall and planting on the west side of the fence to provide a beautiful landscape along the backdrop of the fence and also to deter from foot traffic. By placing the fence 2 feet to the east, we are inside our property boundary, we line up beautifully with the neighbor's existing fence, and we keep the area to be able to walk on to a minimum. If we bring the fence in any further to the east, it will look ridiculous as the fence will jut out of the existing fence and look very awkward along the long stretch of street. It would also allow more room to climb along the west side of the fence and along the top of the wall. Two feet would look the best, be beautiful when it's done, and be the safest. We spent much time selecting the fence. We wanted something durable and pretty that would retain its good looks and not deteriorate and shrink after a few years, as wood fences so often do. We also wanted something that would look good over a long stretch, so we chose one with wider slats and with horizontal lines running across to break up the look. This is a lifetime warranty fence and all it requires is washing to maintain it. It is white and it will look great. We plan to install the fence two feet to the east of the eastern edge of the retaining wall. We will plant in the area between the retaining wall and the fence. This area is dirt that is over the gravel. It is deep enough to easily provide for planting. We are not planting large trees here, only columnar shrubs and ground plants. By placing the fence 2 feet from the wall, we will line up with our southern neighbor's existing fence. If we go east any further, we won't line up with the existing fence, which will look out of place and jutted in. Also, if we leave too much room between the rockery and the fence, then it becomes a "balance beam" hazard again. We can fill the 2 foot area nicely and I believe it will be beautiful when we are done. We are hiring a professional landscaper to create this with us. Here's why we feel we have met the justifications for the Special Fence Permit: 1. Permanent Landscaping along the front of the fence? Yes. We will plant lIex Crenata Sky Pencils every fourth post. lIex is deep green and will contrast beautifully against the white of the fence. It is low maintenance, sun tolerant, and doesn't require pruning. It doesn't grow fast or very high. It will be 4 - 5 feet tall. We will put beauty bark in along this two foot strip and fill with ground plants. Our landscaper has suggested Cottoneaster Dameri because if walking on the fence is still an issue, we can let the plant vine a little if needed and it can be a deterrent by covering a portion of the top of the blocks, but only if we allow it to. The Cottoneaster Dameri will be between the Sky Pencils. 2. Quality fence material? Yes. We have purchased a white vinyl fence that is better quality, longer lasting, easier maintenance, lifetime warranty, and more pleasing to the eye than wood for this particular treatment. I have chosen a model that has wider slats that is more pleasing given the length of the fence, and it also has horizontal lines running across as well to break it up. We have selected large post caps that are very attractive and match the shape of the columns on our front porch, so the fence will match the structure of our home. We plan to put solar fence caps at each end of the fence as well. We decided not to go with wood because it's a huge maintenance and often becomes shabby looking and shrinks after only a few years. It gets very unsightly if not maintained. 3. Modulation of the fence? The fence will drop two inches at the posts where necessary to conform to the slope of the street. It looks beautiful against the natural slope of the terrain. The fence is sturdy and will be built to stand. 4. Similar design and material as other fences in the surrounding neighborhood? Other fences in our neighborhood are far and few between. There are no "standards." There are cyclone fences, wood fences, and vinyl fences scattered throughout the area. The most attractive ones are the vinyl ones. Our neighbor to our southern border has a fence along our property line, but it is wood and falling apart. It is rather unsightly. The nearest fence other than our neighbor's is to the north of us across the street at the intersection of NE 20th St and Lincoln Place. It is a 6 feet tall wooden fence at the intersection. It is one of the few good looking wood fences around. Most of the others are cyclone and on Aberdeen Ave NE. The fence we have chosen will look the best for framing our property and giving a bright, beautiful, and clean look to the neighborhood. It will definitely give a fresh look. This is part of a project to repair a faulty rockery that used to be on the west side, and provide a safer, more aesthetically pleasing neighborhood environment. This project actually was initiated in 2006. In 2006, the City of Renton agreed to replace the rockery on the west side of our property. In order to replace it and build a proper wall, our holly trees and our dogwood tree had to be cut down. We agreed to lose our trees in order to create a safer environment. The rocks had been falling out of the rockery and landing on the sidewalk below and kids were climbing on the wall as well, which was bad. We agreed to have the trees removed. There were, I believe, eleven holly trees and one dogwood tree that was cut down. The holly trees were old growth, I'm estimating 30 to 40 feet tall, and ran the length of our western border from North to South and stopped just south of the existing city trees on our north side. (You can see on the detail drawing where the existing trees planted by the City of Renton still stand.) Because our property is situated on a hill, visibility was never an issue with the old growth trees, and in all the years I have lived at this address, I have never seen an accident at this corner. Now that these trees are gone, we have lost the privacy that our trees provided and lost the sunscreen that protected us from the hot afternoon sun beating down from the west. We have always used the west side of our home as our "back yard" as the layout of our property doesn't provide us anywhere else to use for recreation. This is where we have always had our patio. The trees we used to have acted as a natural privacy screen. Now that they are gone, we are wide open to the street. Not only does a four foot fence not provide privacy or protect us from the hot afternoon sun, it also doesn't hide anything we own that we keep in our patio area. Our barbecue grill, table and chairs, and everything else we kept in our "back yard" are now wide open for view and close enough to the street to grab and run away with.
