PROJECT DESCRIPTION & ANALYSIS: The applicant is requesting approval of an
Administrative Special Fence Permit, the third in a series of three request, for a 6-foot high
cedar fence along the rear and portions of the side (south) property line within the side yard
setback along a street in the Residential-8dwelling units per acre (R-8) zone (Exhibit 1). The
proposed fence would extend along the rear property line to 10-feet north of the southern side
property line. The proposed fence would then extend for approximately 32 linear feet before
stepping north, outside of the side yard along-a-street setback.
Fence materials would include 1"x4" or 1"x6" cedar boards and pressure treated 4"x4" posts
with cedar post caps (Exhibit 2). The fence posts would be placed at a minimum every 4 feet
and a maximum of 8 feet.
Renton MuniCipal Code (RMC 4-4-040D.2.d) allows fences with a maximum height of 72 inches
(6 feet) along the rear property line except the fence shall be limited to 48 inches (4 feet) in
height where it intersects the width of the required side yard along-a-street setback. The side
yard setback along-a-street in the R-8 zone is 15 feet; the applicant proposes to construct a 6-

foot rear yard fence which encroaches 5 feet into the side yard setback along the street (Elma
Court NE).
The applicant states the purpose of the proposed fence is for privacy. The subject site is
located in a developing neighborhood and is one of four lots in a unique "island" surrounded by
streets. Because each of these four lots have driveways which access the garages from the
front yards (along NE 3rd Place and NE 2nd Place), no sight distance issues would be encountered
as a result of the proposed rear yard fence. An existing sidewalk abuts the property.
The submitted site plan (Exhibit 3) indicates the location of the proposed fence. Staff
recommends approval of the Lozier at Laurel Crest 3 Special Fence Permit, LUA12-030, SF, as
proposed.

ADVISORY NOTE: The applicant should contact the Utility Notification Center, by dialing 800-
424-5555, to determine the location of underground utilities (telephone, streetlights, cable,
electric), which may be located behind the sidewalk.
APPEALS: Appeals of permit issuance must be filed with the City of Renton Hearing Examiner
by S:OO p.m. on May 8, 2012. Appeals must be filed in writing, together with the required fee
to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA
98057. City of Renton Municipal Code Section 4-8-110 governs appeals to the Hearing
Examiner. Additional information regarding the appeal process may be obtained from the
Renton City Clerk's Office, (425) 430-6510.
RECONSIDERATION: Within 14 days of the decision date, any party may request that the
decision be reopened by the approval body. The approval body may modify his decision if
material evidence not readily discoverable prior to the original decision is found or if he finds
there was misrepresentation of fact. After review of the reconsideration request, if the
approval body finds sufficient evidence to amend the original decision, there will be no further
extension of the appeal period. Any person wishing to take further action must file a formal
appeal within the 14-day appeal time frame.

Dear Sir/Madam,
It is our desire to construct a permanent cedar 6' privacy fence encroaching in to the 15' sideyard
setback at the south east part of the property line of Lot 20 at Laurel Crest. This fence will be facing
south and have approved plat landscaping in front of it. The fence would extend into the 15' setback
line on the side yard ofthe property by 5', will be 10' off the sidewalk and return to the house
approximately 6' off the rear corner per the site plan. It will be similar in design and material to the
other approved fences located in the development. The purpose of this fence is to provide privacy and
security to the rear yard of this lot. We feel this maintains a consistent application of the look and feel
of the community.
