PROJECT DESCRIPTION/BACKGROUND: '1inistrative Variance Report & Decision LUA12·040, V·A Page 2 of 6 The project site is located at 720 South 23'd Street (APN 7222000090) and is currently vacant. The proposal is to construct a single-family house with a 13-foot rear yard setback where a minimum of 20 feet is required per RMC 4-2-110A (Exhibit 3). The applicant proposes to comply with all other development standards required of single-family residences in the R-8 zone. The lot was created as one of three lots in the Park View Place Short Plat, lUA06-132, SHPl-A, and is generally flat. The proposed 13-foot rear yard would back up to the front yards of the other two lots in the Park View Place Short Plat which are located to the north of the project site. ~ C. FINDINGS: Having reviewed the written record in the matter, the City now makes and enters the following: 1. Request: The applicant has requested approval of an administrative variance from RMC 4-2-110A for a rear yard setback of 13 feet where a minimum of 20 feet is required. 2. Administrative Variance: The applicant's administrative variance submittal materials comply with the requirements necessary to process a variance request. The applicant's site plan is provided as Exhibit 3. 3. Existing Land Use: The two lots immediately north of the subject property are vacant; to the north ofthose lots are single-family houses and to the east and west are single family houses in the R-8 zone; Thomas Teasdale Park is across South 23'd Street to the south. The subject property is surrounded by R-8 zoning (Exhibit 2). 4. Zoning: The subject property is in the Residential-8 dwelling units per acre (R-8) zone (Exhibit 2). 5. Topography: The site is generally flat. 6. Lots and Building Size: The total area of the lot is 8,327 square feet. 7. Water Availability: The proposed residence would be well over 4,000 square feet. A certificate of water availability is required with the building permit application; additional hydrants, a larger water meter, or a fire sprinkler system may be required (Exhibit 5). CONSISTENCY WITH VARIANCE CRITERIA: ninistrative Variance Report & Decision LUA12-040, V-A Page 3 of6 Section 4-9-2508.5.a lists 4 criteria that the Planning Director is asked to consider, along with all other relevant information, in making a decision on an Administrative Variance application. These include the following: The Planning Director shall have authority to grant an administrative variance upon making a determination, in writing, that the conditions specified below have been found to exist: a. That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: The applicant maintains that special circumstances apply to the subject site as a result of its location at the intersection of a public street (South 23 rd Street) and a private access easement along the west side of the property. Setbacks required in the R-8 zone are: 15 feet front yard; 15 feet side yard along a street (including access easements); 5 feet internal side yard; and 20 feet rear yard. The front yard of the subject property is oriented toward South 23 rd Street; the side yard along an access easement is located along the west side of the property; the internal side yard is located along the east side of the property; and the rear yard is located along the north side of the site. Most of the neighboring lots are smaller in size than the subject property. However, these lots do not have side yard setbacks located along streets or access easements and, therefore, are not subject to providing a is-foot side yard setback as is the subject property. In order to build an adequately sized single-family house, the applicant is proposing to reduce the required 20-foot rear yard setback to 13 feet. While the size of the subject site is larger than many of the lots in the vicinity, those other lots do not have a required is-foot side yard setback along a street or access easement (Exhibit 1). The fact that the subject site has a required is-foot side yard setback along an access easement, therefore, limits the bUilding envelope to a smaller size than could potentially be built on a comparably sized lot. Because of location, staff concurs with the applicant that special circumstances apply to the subject property in that adhering strictly to all of the yard setback requirements would restrict the size of the future house to be built on this lot. Requiring the applicant to comply with all of the setback regulations would impose an undue hardship on the applicant. The applicant would adhere to front, side yard along a street, and internal side yard setback requirements. b. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: The applicant contends that the proposed rear yard setback would not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the property is situated. The front of the proposed house would be is feet from the front property line (along South 23 rd Street), 15 feet from the access easement along the western side of the property, and 5 feet from the eastern property line. The proposed 13-foot rear yard would abut the front yards of the two undeveloped lots to the north (Exhibits 1 and 2). Variance Report 12-040.doc City of Renton Department of Community & .I. )mic Development GILL SETBACK VARIANCE Report of July 23, 2012 ninistrative Variance Report & Decision LUA12-040, V-A Page 4 of 6 Because the applicant would adhere to the required front and side yard setbacks, and the requested reduced rear yard setback would abut the front yards of two lots to the north, there would be a minimum building separation of 28 feet between the proposed house on the subject site and future houses on the two lots to the north. Staff believes that this would provide adequate building separation from the front of the future houses on those two lots. Therefore, staff concurs with the applicant that the proposal would not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone. No comments were received from neighboring property owners. Comments were received from CED Property Services (Exhibit 4) which states that because there is a fireplace which would be constructed on the rear wall of the future residence, the rear yard setback from that fireplace would be 11 feet. RMC 4-2-110D.4.a allows fireplace structures to project 24 inches into any setback. The comments in Exhibit 4 also state that shadows from a 30-foot high house as close as 13 feet to the rear property line would cast shadows on the abutting properties to the north for much of the year. RMC 4-2-110A allows a maximum building height of 30 feet. As noted above, the minimum building separation between the rear of the proposed house on the subject site and the future houses on the two lots to the north would be 28 feet. While staff acknowledges that shadows would occur on the two lots to the north for much of the year, staff believes that shadows of incremental length would be cast on the abutting properties even if a 30-foot structure was to be constructed at the 20-foot required rear yard setback. RMC 4-2-110A limits building lot coverage to 35% or 2,500 square feet, whichever is greater. Property Services staff estimates the building footprint at 2,575 square feet and 35%. This footprint calculation is based on the applicant's site plan (Exhibit 3) which includes eave overhangs. The comments in Exhibit 4 also state that the impervious surface calculation without accounting for paved walkways and patios is 56%. RMC 4-2-110A allows a maximum of 75% impervious surface area. c. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: The applicant contends that the proposed rear yard setback variance would not constitute a grant of special privilege. Several other properties along the north side of South 23 rd Street on the same block have existing rear yard setbacks of less than 20 feet (Exhibit 1). Therefore, staff believes that approval of a reduced rear yard setback would not constitute a grant of special privilege. d. That the approval as determined by the Planning Director is a minimum variance that will accomplish the desired purpose: The applicant contends that the request for a 13-foot rear yard setback is the minimum variance needed to accomplish the goal of constructing a future single-family residence. While a house with a smaller footprint which would satisfy the required rear yard setback could be built on the subject site, the requested 13-foot rear yard setback is the minimum variance that would accomplish the applicant's desired purpose of constructing an adequately sized house on this lot. Staff agrees with the applicant that this is the minimum variance to accomplish the applicant's desired purpose and, therefore, supports the variance for less than the required 20-foot rear yard setback in the R-8 zone. Zoning: The proposal would meet the development standards of the R-B zone with the exception of the rear yard setback for which the variance from RMC 4-2-110A is being sought, 2. Administrotive Variance: The applicant's proposal for a 13-foot rear yard setback meets the four criteria to be considered in making a decision on a variance request as specified in RMC 4-9-2506.5: (a) The applicant suffers undue hardship and the variance is necessary because of special circumstances that apply to the property; (b) The granting of the variance would not be materially detrimental to the public welfare or injurious to property or improvements in the surrounding area; (c) The approval is not a grant of special privilege; (d) The approval of the variance is the minimum to accomplish the desired purpose. 3. Existing Surrounding Land Uses: The proposal will not result in changes to existing land uses which are single-family residential to the north east, and west, and Thomas Teasdale Park to the south. Several houses in the surrounding area have been constructed with rear yards less than the required 20 feet. 4. Topography: The subject property is generally flat, The project will not impact steep slopes or result in extensive grading. 5. Building Proposal: The proposal would result in the future development of a single-family house which would comply with all development standards except the required 20-foot rear yard setback. 6. Recommendation: Staff recommends approval of the requested variance from RMC 4-2-110A to allow a rear yard setback of 13 feet which is less than the 20 feet required in the R-B zone as shown in Exhibit 3. The fact that the existing setback requirements were not taken into consideration during the design process doesn't create a hardship. Although the setback from the foundation for this proposal is 13 feet in actually there will only be 11 feet between the back wall of the cantilevered fireplace and the property line. The plans submitted show the fireplace as both cantilevered and not; see page A7/ A8 'Right Elevation.' Having a thirty foot tall structure this close to the property line is going to cast significant slladows on the adjacent properties to the north for much of the year. One reason this lot is larger than the surrounding lots is that it is encumbered by an easement for access to three other back lots. The submittal shows a lot coverage of 35% but doesn't provide figures for the size of the building foot print or other impervious surface areas. By rough calculation the building the footprint is 2575 square feet with an impervious coverage surface area of at least 2780 square feet.
