Administrative Special Fence Permit, the fourth in a series of four requests, for a 6 -foot high
cedar fence along the east property line within a side yard along a street (Elma Court NE) in the
Residential - 8 dwelling units per acre (R-8) zone (Exhibit 1). The proposed fence would extend
southerly from the existing rear yard fence by approximately 43 linear feet and then westerly
by approximately 11 feet to the existing house. The proposed fence would be 5 feet from the
easterly property line.
Fence materials would include 1 inch by 4 inch or 1 inch by 6 inch cedar boards and pressure
treated 4 inch by 4 inch fir posts with cedar post caps (Exhibit 2). The fence posts would be
placed at a minimum of every 4 feet and a maximum of every 8 feet. Approved plat
landscaping, including trees and shrubs, would be planted in front of the proposed fence
(Exhibit 3).
Renton Municipal Code (RMC 4-4-040D.2.d) allows fences with a maximum of 48 inches (4 feet)
in height in a side yard along a street; the applicant proposes to construct a 6 -foot fence in this
area.

The applicant states the purpose of the proposed fence is for privacy and security. The subject
property is located in a developing neighborhood and is one of four lots in a unique "island"
surrounded by streets. Because each of the four lots has a driveway which accesses the
garages from the front yards (along NE 2"d Place and NE 3rd Place), no sight distance issues
would be encountered as a result of the proposed side yard fence. An existing sidewalk abuts
the property.
The submitted site plan (Exhibit 4) indicates the location of the proposed fence. Staff
recommends approval of the Lozier at Laurel Crest Special Fence Permit 4, LUA 12-050, SF, as
proposed.

APPEALS: Appeals of permit issuance must be filed with the City of Renton Hearing Examiner
by 5:00 p.m. on July 26, 2012. Appeals must be filed in writing, together with the required fee
to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA
98057. City of Renton Municipal Code Section 4-8-110 governs appeals to the Hearing
Examiner. Additional information regarding the appeal process may be obtained from the
Renton City Clerk's Office, (425) 430-6510.
RECONSIDERATION: Within 14 days of the decision date, any party may request that the
decision be reopened by the approval body. The approval body may modify his decision if
material evidence not readily discoverable prior to the original decision is found or if he finds
there was misrepresentation of fact. After review of the reconsideration request, if the
approval body finds sufficient evidence to amend the original decision, there will be no further
extension of the appeal period. Any person wishing to take further action must file a formal
appeal within the 14 -day appeal time frame.

RE: Special Fence Permit Lot 21
Date: 6/29/12
Dear Sir/Madam,
It is our desire to construct a permanent cedar 6' privacy fence encroaching in to the 15' sideyard
setback at the north east part of the property line of Lot 21 at Laurel Crest. This fence will be facing east
and have approved plat landscaping in front of it. The fence would extend into the 15' setback line on
the side yard of the property by 10', will be 5" off the sidewalk and return to the house approximately
15' off the rear corner per the site plan. This will not encroach into the front corner siteline. This
property is part of a unique "island" formation in our development. It will be similar in design and
material to the other approved fences located in the development. The purpose of this fence is to
provide a private enclosure for the buyer's small dog and also for security. We are also installing a fence
along the opposite property line for security and privacy. We feel this maintains a consistent application
of the look and feel of the community.
