What is a hobby kennel?
The city defines a hobby kennel as a noncommercial facility for the care and/or breeding
of four to eight adult dogs, cats, or combination of dogs and cats, older than four months
in age. If you are a resident of Renton and have more than three household pets at your
home, you may have what is considered to be a "Hobby Kennel".
Are there certain rules that apply to hobby kennels that are different from the
general requirements for keeping animals?
Yes, along with the general requirements for keeping animals, a few additional
regulations apply specifically to hobby kennels:
• All open-run areas shall be surrounded by a six-foot high fence located a
minimum of ten feet from all property lines.
• Provisions shall be made for the removal of animal and food wastes in order to
keep the kennel free from disease, infestation of insects or rodents, and to keep
the kennel free of obnoxious or foul odors.
• Shelter shall typically be provided in clean structures located only in the rear yard
unless the Development Services Division, based upon information provided by
an owner/tenant, determines that a side yard would be a better location for the
shelter. The shelter must be located at least ten feet from side and rear property
lines.
Do I need to obtain a hobby kennel license from the City?
Yes, the City requires that you obtain a hobby kennel license in order to have more than
three cats, dogs or other similar animals at your residence. To apply for a hobby kennel
license, come to the 6th floor customer service counter of Renton City Hall, 1055 South
Grady Way, Renton WA 98057, during regular business hours (M-F, 8:00 am-5pm) to
pick up an application. After you complete and submit your application as well as a one-
time fee of $20.00, City staff will review it for compatibility with the surrounding
neighborhood. If the hobby kennel license is approved, the animals will be eligible for a
pet license (renuable every two years). To learn more about pet licenses please contact
the Finance Department at (425) 430-6580 (M-F, 8:00am-5pm).
Will my neighbors be notified of my application for a hobby kennel?
Yes, the City will notify all property owners within three hundred feet of the proposed
hobby kennel property that an application has been submitted.

How long will it take to process my license application?
The review process for a hobby kennel license application can take anywhere from 3-6
weeks, and may require an inspection.
What are some factors the City takes into consideration when deciding whether to
issue a hobby kennel license?
Factors to be considered by the Development Services Director in determining
compatibility of a hobby kennel license are:
1. Whether the proposed location of the hobby kennel will have an adverse effect
on nearby properties.
2. Past history of animal control complaints relating to the animals kept by the
applicant at the address for which the hobby kennel license is applied.
3. Facility specifications/dimensions in which the dogs and cats are to be
maintained.
4. Animal size, type and characteristics of breed.
5. The zoning classification of the premises on which the hobby kennel is
maintained.
6. Compliance with the requirements of:
a) Residence-An animal owner either lives on the property where an animal is
kept or has arranged with a tenant to care for the animal.
b) Shelter Location-Shelter shall be provided in clean structures.
c) Confinement-All animals shall be kept and maintained in a manner which
confines their movement.
d) Health and Safety-All animals shall be kept in such a manner so as not to
create any objectionable noise, odor, or otherwise cause to annoy or become
a public nuisance to the health, safety or general welfare of any person.
e) Animal Waste-Animal waste shall be properly disposed of, and any
accumulated animal waste must not be stored within shelter setback area.
f) Fencing-Electric and barbed wire fences may be used to confine animals
provided that the conditions and regulations for Fences (RMC 4-4-040) are
met.

Dear Ms. Locher,
We are writing in response to a letter dated March 4, 2008.
As you are already aware, Ms. Cathleen Adkison is to appear at a public
hearing tomorrow morning, April 1st, 2008, concerning her hobby kennel
license application. Originally, our plans were to attend this meeting to be
apprised of any actions taken, etc. and to offer our input if asked.
However, we cannot attend due to an appointment at Children's Hospital in
the morning.
Even though we will not be in attendance, we hope that during the course of
the hearing our objections to the issuance of a hobby kennel license will be
heard. We still very strongly object to the presence of Ms. Adkison's dogs
in our neighbourhood, especially since these dogs are often permitted to run
loose in Ms. Adkison's back yard, being a serious nuisance with their
barking, etc.
As of this morning, there are six Boston Terriers running loose in Ms.
Adkison's back yard. Although the deadline for reducing the number of pets
on her property is tomorrow, April 1st, the presence of all these dogs TODAY
causes us to wonder if she will comply with the City of Renton's request to
limit the number of pets she keeps on her property.
Thank you for keeping us apprised of all actions taken, to date, in regards
to this matter. Hopefully, it will be satisfactorily resolved in the near
future.

permit, and appeals the March 4th 2008 denial of her application for a hobby kennel by Code
Compliance Inspector of the Planning/Building/Public Works Department named Donna Locher.

The March 4th, 2008 denial letter indicated it was denied based on the Animal Control

It is unclear from the February 10'1\ 2008 Report of Inspection by Officer D. McAskill
what in the report was the basis for the denial. If it is section 11 regarding the history of animal
control complaints, we challenge the sufficiency of these complaints justifying denial of the
permit.
If the reason for the recommended denial is section 12, which contain comments
regarding observations concerning sanitation of the garage and the difficulty that neighbors have
had in retrieving loose dogs, both are insufficient to justify a denial.
Section 9 discusses the removal of animal waste and food waste. If this is part of the
10 justification for denial of the application we would challenge the sufficiency of such a denial.

As you are aware. Appellant Cathleen Adkinson filed an administrative appeal on February 12,
2008, of the City ofRenton's ("City") denial of her application for a hobby kennel license. That
appeal was scheduled for April 1, 2008.
On February 25, 2008, the City sent Ms. Adkinson a letter explaining that the City was retracing
its denial of her application, but a decision would now be pending. I sent a letter to the Hearing
Examiner on that same date explaining that based on the City's retracting letter, the April I,
2008, scheduled hearing was not moot.
The basis of the original denial stemmed from Ms. Adkinson' s failure to submit to a home
inspection, which is required to process her license application. Her appeal of that decision to
the Hearing Examiner specifically cited that the License "was denied to the lack of an inspection,
or the attempt by the applicant to arrange such inspection ... " Appellant's Notice of Appeal,
dated February 12, 2008, at pp. 1, Ins. 21-23. However, subsequent to filing this appeal,
Appellant did submit to a home inspection. Therefore, the City informed the Hearing Examiner
that it believed the appeal to now be moot, and requested that the hearing be stricken. 1
Once the Code Compliance Division reviewed the home inspection report, it issued a subsequent
denial of Ms. Adkinson's application, this time based on a review of the substantive factors set
forth in RMC 4-9-IOOF. This new decision was issued on March 4, 2008 and included
information regarding appeal rights and deadline of March 18, 2008.
1 The City anticipated that if the hearing were held, Appellant would simply argue that the basis of the denial was
the failnre to meet the condition of a home inspection, which was now met, and therefore, U,e City could not deny
the application on that basis. The City likely would have demurred. Nonetheless, that would not have granted
Appellant her license and she would still have to await the decision of Uie City regarding her application after review
of the home inspection.

On March 11, 2008, the City learned from the Hearing Examiner's Office that you had contacted
them requesting that Ms. Adkinson' s previously scheduled hearing date of April 1, 2008 remains
set. The City maintains its position that the April I, 2008 was set as a result of the original
appeal regarding the failure to submit to a home inspection, and should be stricken. However,
the City is willing to accommodate Appellant's scheduling request to appear on that April I,
2008 date to hold the hearing to address the subsequent appeal
Appellant clearly has a right to appeal this March 4, 2008 decision. But, the City believes that
she must perfect this subsequent appeal by paying the requisite $75.00 application fee by the
deadline of March 18, 2008. She cannot simply "transfer" the $75.00 payment made for the
original appeal. That appeal has effectively been mooted, and the City contends that Appellant
created the basis for that first appeal by failing to submit to a timely inspection, and thus, her
subsequent compliance with that requirement does not entitle her to transfer the fee amount to a
new subsequent appeal. Please submit the payment to the City Clerk with the appropriate
documents. If the payment has not been made by the deadline, the City will be making a motion
to dismiss.

I had previously appealed the denial of the hobby kennel permit #LUA07-091 for
Cathleen Adkison. A hearing date of April I st was set. We received a subsequent
correspondence from the Code Compliance Inspector stating there was no need to have
that hearing because the applicant had submitted to an inspection and the city was
deciding whether or not to grant the hobby kennel license.
We have just received a letter from Donna Locher that the license has been denied.
Would you please consider my appeal letter and the $75 fee applicable to this most recent

Describe means: There are individual crates in the garage for the adults. The 8 wk old
Pups are still housed in a make shift cardboard whelping box. Adults are let out into
the back yard for exercise.

J L Past history of animal control complaints: There have been several barking
complaints fielded by Officer Hume. There was an incident on 02-04-08 where all
5 of the bostons and 2 chiahuahuas had escaped and were harassing a neighbor
which I was involved with. 5 days later all 5 of the bostons were out running the
neighborhood again. That was reported to me today and Adkison confirmed it was
true.
12. Comments regarding observations: On 02-04-08 the garage area was not as clean
as today, the garage door was open and there was more fecal smell than today.
There was no smell out side, temp was 42 degrees and a strong wind. When the
dogs have been loose they have been loose for awhile neighbors have caught
some of them taken them back and have had a hard time getting an adult to
retrieve them.

Dear Ms. Locher,
I am writing in response to a copy of a letter I received this afternoon that was originally sent to Ms. Cathleen
Adkison regarding her previous application for a hobby kennel license. The file number is: LUA07-091. The
letter states that an appeal has been filed in response to the denial of the hobby kennel license, and that a
public hearing will be held on April 1'', 2008.
Ms. Adkison's dogs have been, and continue to be, a nuisance in our neighbourhood. The dogs barked for at
least a couple of hours on the afternoon of Thursday, October 25"'. They also barked from 4:00-6: 15 p.m on
Saturday, October 27th, 2007. I have also had to recently call Animal Control to send out an officer in response
to the dogs' incessant barking on another Saturday afternoon, during which the dogs barked for close to one
and a half hours. The dogs were still in the process of barking when Animal Control arrived so the officer was
able to witness this for himself. There should be a record of my report with the Animal Control Office.
Also of note is the fact that our home is currently on the market Approximately three weeks ago, a
prospective buyer voiced her unease regarding the dogs' barking, as they were very noisy on the day a John L.
Scott Realtor brought her for a showing of our house. We are deeply concerned that the dogs' presence and
barking might turn away prospective buyers; that we will be consequently harmed if the dogs' presence
becomes a major reason no one will purchase our house.
To reiterate our previous concerns: we feel that the neighbourhood already has enough dogs. We are
currently surrounded by 14 dogs on or near our street Allowing Ms. Adkison to keep 7 dogs on her
premises is excessive, and detrimental to our enjoyment of peace and quiet in our own home. Requiring Ms.
Adkison to pare down the number of her pets seems like a reasonable request We believe that allowing her
to keep two dogs would be more appropriate, and that is what we hope the City of Renton will consider as a
resolution to this problem.
Furthermore, we fervently hope that the City of Renton will not grant an appeal regarding the kennel license.
We feel that no single homeowner within the boundaries our particular neighbourhood should be permitted
to keep 7 dogs, especially 7 yippy-yappy dogs that are not properly controlled.

The above-referenced appeal is currently scheduled for April I, 2008. The Appellant Kathleen
Adkinson is represented by Attorney Ross Radley. On January 29, 2008, the City of Renton
issued a denial of Ms. Adkinson's hobby kennel application on the basis that she did not submit
to an inspection. Since the filing of this appeal, Ms. Adkinson has submitted to a home
inspection. That report by Animal Control is still pending. Once the City Code Compliance
Officer reviews that report and any other information, she can now properly process the
Applicant's evaluation.
The Code Compliance officer has sent the Applicant a letter informing her that the City has now
retracted its denial of her application, and a decision is pending. Code Compliance still needs to
evaluate the reports to render a decision regarding the application itself. However, since the
"denial" has been retracted, the City Attorney's Office believes that the currently scheduled
April I, 2008 appeal is now moot.
Please note however, that the neither the retraction of the denial letter nor the City Attorney's
position regarding the mootness of the appeal implies that the Applicant will be automatically
granted her license. As stated above, by having complied with the inspection condition, she has
negated the "basis" for the January 29, 2008 denial, but depending on the report and evaluation,
the City may or may not grant her the ultimate license. lfher application is subsequently denied,
she would obviously still have appeal rights to that decision under a new 14 day appeal period .

Attached please find a Request for Public Records to be responded to in accordance with RCW
42.17 and City Policy and Procedure I 00-05. This request, from Ross Radley, is for records on
behalf of Cathleen Adkison regarding denial of her hobby kennel permit. Since these records
may be the responsibility of more than one department, I am asking that you forward to me any
records responsive to this request. Please be mindful that certain records are exempt from Public
Disclosure. See Policy & Procedure #I 00-05 regarding exemptions, and contact our City
Attorney if you have questions.
The City needs to respond to this request by March 5, 2008, as follows:
• Provide the records to the requestor; or
• Acknowledge the request in writing and provide a reasonable estimate of how long it will
take to respond; or
• Deny the request in writing, with reasons for the denial stated as specifically exempted by
law; or
• If it is felt the request is unclear, ask the requestor for further clarification.
While the City is not obligated by law to compile information from various records into a
specific form, we are required to produce existing records for inspection. If photocopies of
documents are requested, the City copy fee applies. (See RMC 5-1-1)
A deposit in an amow1t not to exceed ten percent of the estimated cost of copies may be required
in advance of producing the records. If a request is made available on a partial or installment
basis, a charge may be made for each part of the request as it is provided. If an installment of a
records request is not claimed or reviewed, the City is not obligated to fulfill the balance of the
request.
Please keep me informed as to the status of this request. Also, please "cc" me with any related
correspondence for my file should there be any.

permit, and appeals the January 29th 2008 denial of her application for a hobby kennel by Code
Compliance Inspector of the Planning/Building/Public Works Department named Donna Locher.
Applicant Kathleen Adkison's address is 2825 NE 4th Court, Renton, WA 98056.
The January 29th 2008 denial letter indicated it was denied due to the lack of an
inspection, or the attempt by the applicant to arrange such inspection by an animal control

On 02-04-08 at approximately I 920 hours I was monitoring my department radio. I heard that several patrol officers were being
dispatched to the 2700 block of NE 4th CT in reference to five dogs attacking a person at 2720 NE 4th CT. I am familiar with five
Boston Bull Terriers associated with the 2800 block of NE 4th CT. I advised dispatch I would be emout to that location to assist the
patrol officers with the attacking dogs.
When I arrived I saw Jhe five Boston Bull Terriers and a while Chihuahua confined in the yard of 2817 NE 4th CT. l contacted
Roxanna Johnson she had reported to dispatch the dogs at large and was requesting assistance. Johnson stated to me that the dogs
resided at 2825 NE 4th CT.
Officer Tebbets was at that location attempting to contact the owner Cathleen Adkison, she was not at home. Her roommate Heins,
Barbra was at home and responded with Oler Tebbets to retrieve the dogs.
While I was waiting for a responsible party to arrive and retrieve the dogs they began fighting amongst themselves. I was able to place
leash's on them and get them under control. The dogs were taken back to 2825 NE 4th CT. where they lived. As the dogs were being
moved the owner Cathleen Adkison arrived home. Adkison was able to get control of the Chihuahua and take it to her residence.
The dogs were taken back to Adkison's residence to confine them in the garage. I was told by Heins the she let the dogs out for a break
into the backyard. Upon looking at the backyard I saw the gate was open. The dogs most likely fled the backyard through the open
gate.
I talked with the victim K.C. Jones who lives at 2720 NE 4th CT. He told me that he had opened his garage door to take out the trash
when the dogs suddenly appeared in front of him. The dogs began to circle him growling and barking as they did so. He was in fear
the dogs were going to attack him as they were becoming extremely aggressive in their actions towards him. He grabbed a golf club to
protect him.
I talked with Roxanna Johnson who lives at 2817 NE 4th CT. She told me she had heard the barking noise and came outside and found
the dogs running and barking in the drive way of 2720 NE 4th CT. and on NE 4th CT. She did not witness the attack on Jones. She
was concerned for there welfare and was able to confine them to her fenced front yard then called for assistance.

Describe means: Since October of 2007 Adkison has been using a chemical enzyme
type. A covered plastic insert placed in a 16"-20" hole in the ground. As fecal
material is placed in the hole enzymes are placed over the top. (Out house)
I 0. Health and Safety: Are all animals kept in a manner so as not to create any
objectionable noise, odor, or otherwise cause to annoy or become a public
nuisance to the health, safety or general welfare of any person.
Describe means: There are individual crates in the garage for the adults. The 8 wk old
Pups are still housed in a make shift cardboard whelping box. Adults are let out into
the back yard for exercise.
11. Past history of animal control complaints: There have been several barking
complaints fielded by Officer Hume. There was an incident on 02-04-08 where all
5 of the bostons and 2 chiahuahuas had escaped and were harassing a neighbor
which I was involved with. 5 days later all 5 of the bostons were out running the
neighborhood again. That was reported to me today and Adkison confirmed it was
true.
12. Comments regarding observations: On 02-04-08 the garage area was not as clean
as today, the garage door was open and there was more fecal smell than today.
There was no smell out side, temp was 42 degrees and a strong wind. When the
dogs have been loose they have been loose for awhile neighbors have caught
some of them taken them back and have had a hard time getting an adult to
retrieve them.

Yes an inspection was done and you should have gotten the report. Also you will be getting a report on the
last incident where the dogs got out and were attacking the neighbor. Two patrol officers and Dennis

I am writing in response to your letter dated October 11th, 2007, in which
you have replied to a letter I sent you on October 09th, 2007.
First of all, thank you for clarifying the purpose of the hobby kennel
license. You stated that the purpose of the kennel license is to control
the amount of animals in a residential area. From my point of view, Ms.
Adkinson's current ownership of 7 dogs + a few cats; along with the
neigbhours' dogs (they have at least two big dogs) catty-corner to the back
of our house, plus the lankova family's dog to our left and the dog across
the street, my family already feels overwhelmed by the number of dogs
residing in our direct vicinity.
Ms, Adkinson might wish to secure the enjoyment of her animals, but my
family would appreciate being able to go outside without 7 dogs barking at
us every time we venture into our backyard, or when we open/close windows
and doors. It takes very little provocation to elicit their barking and
growling. We would appreciate being able to enjoy our property without the
incessant barking, growling, and copulation of these Boston Terriers and
Chihuahuas. When Ms. Adkinson's dogs are outdoors at the same time as the
neighbours' dogs, the situation escalates and becomes intolerable.
So, I am wondering whether Ms. Adkinson's wish to enjoy her animals
supersedes my family's right to peaceful enjoyment of our property? I am
wondering if the license will be granted despite my family's VERY STRONG
objections. It is immaterial to us whether or not these animals are already
licensed. They have caused a disruption for us for about three months now,
and it has not been appreciated. On several occasions, Ms. Adkinson has
heard us tell her dogs to be quiet. Additionally, she either has a son or
nephew who abuses the dogs. His name is Alexander and he has kicked, hit
the dogs repeatedly with a plastic golf club, and kicked dirt into their
faces.

Despite all of this, the fact remains that these dogs, in all honesty, are
a great disruption to us personally, and to the neighbourhood generally.
Additionally, despite your assertions to the contrary, we firmly believe
that these animals are being permitted to copulate at will for a very
specific purpose, and any puppies resulting from this "breeding" will just
add to Ms. Adkinson's animal population and increase the noise level.
Is there any other authoritative party to whom I may file my concerns and
complaints?

An Animal Control Officer will inspect the residence to make sure it is suited for the

Dear Ms. Locher,
I am responding to a Notice of Application Letter that my husband, Brian, and I received in the mail this
afternoon. It is in regards to the Adkison Hobby Kennel License/LUA07-091.
We STRONGLY object to this proposal, as the individual who is making this application already has 5
Boston Terriers, 2 Chihuahuas, and several cats in his/her home. These animals have been in residence at
this home for at least the past 3 months. The dogs are not kept under strict control, as they bark
incessantly and are already permitted abundant opportunities to copulate. We have witnessed this
behaviour repeatedly, and have wondered if the homeowner was already in the process of attempting to
breed his/her dogs in order to sell the resultant puppies. We are privy to this knowledge, as the neighbour
in question lives directly in hack of our house and the structural design and height of the fence does not
allow for much privacy.
We personally feel as though these dogs are already a nuisance, and permitting the homeowner to have a
license to operate a kennel cause greater disruptions to the enjoyment of our home, and cause a
disturbance to the neighbourhood, as our neighbours have already complained about these dogs.
We sincerely hope that you will take our objections into consideration, and NOT grant this license. We
feel it is not in our best interests or that of the neighbourhood.
