The City of Renton received your application dated August 20, 2007, to operate a hobby
kennel at 2616 NE 61h Pl. On August 30, 2007, a letter was sent to you, Delivery
Confirmation# 0300 6000 0003 6520 3336, requesting additional information, i.e., a
detailed site plan, to be received by the City of Renton no later than September 14, 2007.
The required information has not been received at the City of Renton as of this date.
Therefore, your application for a hobby kennel license has been denied and will be
discarded.
On August 20, 2007, your were send an Order to Correct, violation index number C07-
0684, informing you that your property was in violation of Renton Municipal Code 4.9. ·
0900 and 4-4-1100. A copy of the order to correct is enclosed. This correction notice
required that you discontinue boarding animals and to reduce the total number of all pets
to three. Compliance date was September 20, 2007.
Animal Control Officer, Mark Hume, will be contacting you for an on-site inspection to
verify that compliance has been achieved.

On 08/03/07, about 1541 hrs, I responded to a report of a dogfight at 257 Thomas Ave SW. Two separate neighbors
around this residence called 911 reporting the incident.
I met Animal Control Officer Hume at the residence. Upon arrival, I did not hear dogs fighting. However, I heard several
dogs barking and whining in the back yard.
Resident Jonathan J. Cruz arrived on scene. He is the owner and caretaker of the dogs and allowed us access into the
backyard to investigate. In the backyard, I saw a freshly poured concrete pad that stretched about 50 feet down the
backyard from the house, and covered most of the width of the lot. On top of the pad were chainlink dog kennels running
down both sides of the pad. The south side of the pad had three kennels, and the north side had four. All of the dogs in
the kennels were pitbulls, and there were at least 23 of them on the property. Leaning against a wooden fence on the
south side of the property were unconnected sections of chain link fence, ready to be fastened together into more kennels.
I noted the yard was fenced with standard half-inch cedar fence boards.
Of the three south side kennels, from left to right, was a kennel with a single male gray adult pitbull, a kennel containing
15 pitbull puppies, and a kennel consisting of a brown and white adult.
On the north side, there were four adult pitbulls occupying four separate kennels,
I also saw two adult pitbulls being led on leashes in and out of the backdoor of the house.
The north side kennels were covered with a blue tarp and the south side kennels were uncovered. I noted there was quite
a bit of fecal matter scattered throughout the cages.
I quickly understood why a dogfight had been called in by the neighbors. One of the 15 puppies had been horribly mauled
in his cage by the gray adult male living in the adjacent kennel. The mauled puppy had probably stuck his leg through the
holes in the chain link fence. The gray adult bit the puppy's exposed leg breaking it in two places, The leg was also
violently sliced open in several places exposing the tendons. One of the puppy's ears had been completely bitten off, and
the other had been shredded into ribbons. Officer Hume removed this puppy from the kennel and transported it to a
veterinarian where it had to be euthanized. He also transported the offending adult pitbull to the Bellevue Human Society
for euthanasia.
While we were on scene, several of the dogs barked and whined consistent with the noise I heard while I was standing in
front of the residence.
I ran Cruz and he returned as a convicted felon for Assault in the Third Degree. He has also been criminally cited in
Renton for Violation of the Leash Law, Allowing a Vicious Animal to Run at Large, and Causing an Animal Bite.
Cruz lives at the residence with his mother, father, and extended family, including several elementary school and middle
school aged children. I learned it is common for the family to keep several of the dogs inside the house. It was hard to
get a straight answer from any of the family regarding how many dogs were on the property and inside the house. I also
watched the children get into the cages with the dogs.
The purpose of these kennels, the concrete pad, and the sheer number of dogs can only point to commercial pitbull
breeding. Cruz admitted he sells the dogs for profit, primarily out of state. I find this location of commercial pitbull
breeding inappropriate primarily because it is occurring in an area that is clearly a residential area. 257 Thomas Ave SW
is squarely in the middle of a large residential area stretching from SW Sunset Blvd to the Renton Ave Ext. It is nine
blocks from the commercial district of Rainier Ave S. Earlington Park, a quiet residential park with a large lawn, basketball
court, and playground equipment, is directly across the street from 257 Thomas Ave SW.
The situation comes under the scrutiny of Renton ordinances:
Breach of Peace, R-6-18-11:
Allowing or causing to be allowed any excessive, annoying, and/or disturbing noise.
Animal Howling, Yelping, or Barking, 6-6-5 B-7:
To keep or harbor any dog, cat, or other animal or fowl whether licensed or not, which by habitual howling, yelping,
barking, or other noise disturbs or annoys any person in the neighborhood, or to keep any domestic bird or animal that
emits frequent or long, continued noise so as to disturb the peace. quietness and comfort of the neighboring inhabitants.
A violation of this Subsection shall constitute a misdemeanor in accordance with RCW 9A. 20.021 (3), as now or hereafter
amended.
Furthermore, the situation is a Public Nuisance as defined by RCW 9.66.010:
A public nwsance is a crime against the order and economy of the state. Every act unlawfully done and every omission to
perform a duty, which act or omission shall annoy, injure, or endanger the safety, health, comfort, or repose of any
considerable number of persons.
The noise problem and disturbing of the peace is obvious due to the sheer number of dogs kept outdoors while in a
residential neighborhood. This property generates numerous noise complaints with neighbors saying, "It happens all the
time."
The noise and safety concerns constitute a public nuisance because they disrupt the "order" of the community around 257
Thomas Ave SW. The noise and safety concerns annoy and endanger the safety, health, comfort, and general well being
of the neighbors and community around the residence.
Cruz stated he sells many of the pitbulls he raises, and sells them primarily to out-of-state buyers. This also brings Cruz
into violation of Renton Municipal Code 4-9-090.D covering Prohibited Home Occupations. This code bans certain
occupations from being performed within a person's residence. These occupations are banned because they change the
residential character of the structure, and include kennels and other boarding for pets.
In Renton, a resident can have up to three animals. Anything above three, and between four to eight, the resident must
obtain a "Hobby Kennel License." Anything above eight animals would be considered commercial. The intent of a Hobby
Kennel License is to allow non-commercial pet owners the ability to own up to eight animals.
Cruz had at least 23 pitbulls on his property on 08103/07. There were 15 puppies under four months and at least four
adults. Having more than three dogs over four months old places Cruz in the position of having to obtain a "Hobby Kennel
License" in order to be legal. Cruz has acquired the paperwork and is reportedly in the process of applying for a Hobby
Kennel License. Cruz does not fit the parameters for receiving such a license.
First of all, the intent of the Hobby Kennel License is to allow the non-commercial ownership of up to eight animals,
allowing a special allowance above the City's limit of three animals. It is not intended for commercial kenneling or the
commercial sale of animals.
Second of all, the code indicates that Cruz does not fit the parameters for a Hobby Kennel License.
Renton Municipal Code 4-9-100 covers Hobby Kennel Licenses. Elements of the Code are:
The Development Services Division Director approves or denies the proposed application.
Neighbors within a 300 foot radius must be notified of the proposed application.
The decision criteria for determining if the Hobby Kennel License proposal is compatible with the surrounding
neighborhood are:
• The location having an adverse effect on adjacent properties.
• Past history of animal control complaints.
• Facility specifications.
* Animal size, type, and characteristics of breed.
* Zoning classification of the premises.
• Compliance with Renton Municipal Code 4-4-010
Renton Municipal Code 4-4-010 covers Standards and Review Criteria for Keeping Animals. Elements of the Code
are:
Purpose: Animals need to be monitored to lessen the impacts of noise, odor, and potential nuisance to the site and
adjacent properties. The animals must coexist harmoniously with adjacent (properties).
Fences: All open-run areas shall be surrounded by a six foot fence located a minimum of 10 feet from all property
lines.
Shelter: Shelter shall be provided in the rear yard in clean structures located a minimum of 10 feet from side and rear
property lines with a Hobby Kennel License.
Confinement: All animals shall be maintained in a manner that confines their movement to the premises.
Health and Safety: All animals shall be kept in such a manner so as not to create any objectionable noise, odor, or
otheiwise cause to annoy or become a public nuisance to the health, safety, or general welfare of any person.
Animal Waste: Shall be property disposed of, and not stored within the shelter setback area. Steps must be taken to
minimize odor, insects, and disease.
Cruz is not in compliance with the purpose and spirit of the Hobby Kennel License. In consideration of the elements of the
license, Cruz's location in a dense residential neighborhood has an adverse effect on adjacent properties due to the
noise. Neighbors report consistent problems of Cruz's property generating excessive noise due to barking dogs. Cruz
also has a past history of animal control complaints consisting of citations for Violation of the Leash Law, Allowing a
Vicious Animal to Run at Large, and Causing an Animal Bite. The type of dog being raised and harbored by Cruz under
his Hobby Kennel License are pitbulls, who are often bred to fight and have jaw muscles extending to the top of their
heads causing a bite strength of 2800 pounds per square inch. In short, there is a high likelihood the number of dogs
would create an unsafe and disruptive environment for the occupants of the house and neighbors.
As stated above, a condition of the Harbor Kennel License includes compliance with Renton Code 4-4-010, which is the
Standards and Review Criteria for Keeping Animals. The Code states the purpose of this ordinance is to lessen the
impact of noise, odor, and potential nuisances to the site and adjacent properties. Cruz is clearly in violation of the noise
element. In addition, his fences and shelters are not 10 feet from the property lines.
Cruz's operation is also not congruent with Renton Ordinances regarding Breach of Peace and Animal Howling, Yelping,
and Barking due to the consistent level of noise that is a steady irritant to the surrounding neighbors.
To conclude, Cruz is not a viable candidate for a Hobby Kennel License. His operation is too big and commercial for a
license whose intent is to allow applicants the "hobby" of raising four to eight dogs. Cruz's facilities are also inadequate,
with fences and shelters to close to the property lines and an inability to control the noise of his dogs. Furthermore, his
operation can pose an adverse effect on neighboring properties due to noise and the threat of his pitbulls getting out into
the street, other yards, or into the adjacent park.
I believe Cruz's operation should be swiftly shutdown and his 23 dogs transported to a commercially graded kennel. It is
inappropriate, from a quality of life standpoint, for the neighbors around Cruz to have to bear the noise and safety
concerns of his commercial operation.
I took pictures of the scene and burned those pictures onto a CD attached to this report. I also printed out selected
photos as hard copies.
Please forward this case to Animal Control Officers McAskill and Hume, Code Enforcement Officers Paul Baker and
Marilyn Kamcheff, and Commanders Leibman and McClincy.

dogs to three.

A drive by inspection noted a large shed on the back of the property with a fence around the yard. There was a previous
complaint in 2005 about a pit bull.

l spoke with Jon Cruz this morning. He said he will submit his Hobby Kennel application 08-15-07.
He had some questions regarding property lines and area for kennel but is clear on it now.

Officer Mark Coleman brought a case report to me that he had written because of a call out at this address for a "dog
fight." The report is in MS Office.

10:10 Hrs. I left a message for Ms. Wong stating that the police department and code enforcement are working together
to have these animals removed from the property.

09:26 Hrs. Jon Cruz left message asking for callback.
14:37 Hrs. J returned the call. He stated he had applied for his hobby kennel license on Monday, 8/20, and been turned
away because the application was complete.
I suggested that his application had been 1) received after I had checked with front counter personnel, or 2) perhaps it
had been Tuesday or Wed.
He asked what he would need to obtain a license. I advised him that obtaining a license would be very difficult after the
puppy mauling incident where 2 of his dogs had to be euthanized.

My name is Jon Cruz and I reside in the Renton city limits. 1 am writing this letter today
to address the guidelines in reference to RMC 4-4-010.
Location of proposed hobby kennel on property address (include distance from property

Property totals .23 acre

Kennel is located 175 feet from the front of the property line (driveway)
111 feet from rear of property line (rear of the yard)
5 feet away from neighbor to west of and east of property lines
Facility where animals will be kept consist of:
7 5xl0 Magnum Kennels (stainless steel)
2 6xl2 Chain link Kennels (8 guage, commercial grade)
All of the kennels are covered with heavy duty poly blended tarps.
All of the kennels have barriers to prevent kennel accidents
Dogs have automatic feeders and fresh water at all times
Note: Have plans of constructing a shed type shelter for whelping pups.
Structure will not exceed 120 square feet
Structure will be insulated with 2" R-14 foam to help suppress the noise from pups
Well be well ventilated and have ac/heat attached
My surrounding kennel is enclosed with 6ft high cedar
My gates have locks and have been re-enforced to prevent unlawful entry.
Locks are to be on at all times.
1 would like to house 6 dogs, which will consist of breedable males or females
These dogs are registered as American Bullys
Dogs are of Champion bloodlines and we do not breed for anything but Quality and not
Quantity. Dogs are of medium size.
Kennels are washed on a frequent basis, then pressure washed with an electric pressure
washer, on a weekly basis. The waste is put in a garbage can with a lid that remains on
the waste can at all times until making a deposit. Once a week the waste is then
transported to the Renton transfer Station. When returning, the waste cans are bleached
and cleaned to prevent infestation or diseases of any kind.
